The Special Use Pernut process begins by filling out a SPECIAL USE PERMIT APP CATION. This,
with a site plcm, cmd other appropriate drawings, must be submitted to the Plcmnin stc�f. A fee is
associated with the application; $100 for second accessory building applications, 400 for all other
applicc�tions. Fees cu�e non-refundable.
Once the appliccrtion is received, the application is reviewed by stc�f from the Pl ' g,
Engineering, Assessing, Fire, cmd Police Depcu�tments. The impacts to adjacent pr perties cse
discussed, cmd stipulations c�re developed. Simultcmeously, a mcriling list of all pr rties within a
350 foot radius of the property is generated. Notices of the request cQe sent to thes properly
owners. There is approximately four weeks between the application due date cmd e Pl�ning
Commission meeting.
Prior to the meeting of the Pla�uung Commission, cc stc�f report is written, cmd the titioner called
regcu�ding the stc�f recommendation.
The Plcmrung Commission is made up of seven residents of the community. The m tings cnre held
the first amd third Wednesdays of the month at 7:30 pm in the Council Chcunbers in e Municipal
Center. The Plcmning Commission is cm advisory commission to the City Council. is the
responsibility of the Plcmning Commission to conduct a public hecuing, gather tes ' ony amd make
a recommendation to the City Council regcu�ding all special use permit requests.

The petitioner,Nedegaard Construction, is seeking a special use pernut to allow the construction of a
561 square foot accessory structure attached to the home proposed for 1305 53`d Avenue.
ANALYSIS
The property is zoned R-1, single family and is located at the intersection of 53`d Avenue and Filimore
Street. The property was platted in 2001 and new homes have been constructed on two neighboring
properties. The proposed home will front onto 53`d. The proposed accessory structure (RV garage)
will open and front onto Fillmore.
City Zoning Code requires a special use permit to allow second accessory buildings, other than the first
accessory building, over 240 square feet. Typically,these requests involve a property owner who
wishes to construct an additional detached garage in the rear yard. In this particular instance,both of
the garages are attached to the home. The main garage is proposed to be a 600 square foot garage
facing on 53`d Avenue. The proposed second accessory structure is a 561 square foot RV storage
garage facing on Fillmore Street.

RECOMMENDATIONS
City Staff recommends approval of this special use permit, with stipulations.
Second accessory buildings over 240 square feet are a permitted special use in the R-1 zoning district,
provided the total square footage of all accessory buildings doesn't exceed 1,400 square feet. The
main garage is proposed to be 600 square feet and the proposed accessory structure is 561 square
feet. The total of all accessory buildings is proposed to be 1,161 square feet.
STIPULATIONS
1. Grading and drainage plan to be approved by City's engineering staff prior to the
issuance of any building permits, in order to minimize impacts to the surrounding
properties.
2. During construction, silt fencing shall be used where applicable and streets cleaned
as needed.
3. Petitioner to pay$1, 500 park fee dedication prior to issuance of building permits.
4. At British Petroleum's request, petitioner shall agree to not build closer than 25 ft
from the centerline of the BP Pipeline on this lot.
5. No soil can be removed from over the BP Pipeline that results in a depth of less than
3 feet. � �
6. Utilities crossing the BP Pipeline must be located below it and have a minimum
clearance of 12 inches between structures.
7. As the Zoning Code requires, the garage may not extend more than 5'in front of a
home, petitioner shall bring the home design into compliance prior to the issuance of
any building permits.
8. As second accessory structures with doors opening onto a side street are required by
Zoning Code to be setback 25'from the property line, the home must be re-located

backyard, but no one is opposed.
Mr. Kuechle stated he sees no probiem w� h the request, and he is especially happy that the

Ms. Stromberg stated the petitioner is requesting a special use permit to allow the construction
of a 561 square foot accessory structure attached to the home at 1305 - 53`d Avenue. The
structure will be used for RV storage. The property is zoned R-1, Single Family, and is located
at the intersection of 53�d Avenue and Fillmore Street. The property was platted in 2001, and
new homes have been constructed on two of the neighboring properties. The proposed home
will front on 53`d Avenue. The proposed accessory structure will open in front on Fillmore Street.
Ms. Stromberg stated Section 205 requires a special use permit to allow second accessory
buildings over 240 square feet. Typically these requests involve a property owner who wishes
to construct an additional detached garage in the rear yard. In this particular instance, both of
the garages are attached to the home. The main garage is proposed to be 600 square feet and
face 53`d Avenue. The proposed second accessory structure is a 561-square foot RV storage
garage which face Fillmore Street.
Ms. Stromberg stated the City Code also requires that the total square footage of accessory
structures cannot exceed 1,400 square feet. The total square footage of both the proposed
main garage and the proposed second accessory structure is 1,161 square feet.

Ms. Stromberg stated City staff recommends approval of the special use permit with t e

1. The grading and drainage plan shall be approved by City engineering staff pri r to
issuance of any building permits, in order to minimize impacts to the surroundi g

2. During construction, silt fencing shall be used where applicable and streets cl aned as
needed.
3. The petitioner should pay a $1,500 park dedication fee prior to issuance of bui ding
permits.
4. At British Petroleum's request, the petitioner shall agree to not build closer tha 25 feet
from the center line of the BP Pipeline on this lot.
5. No soil can be removed from over the BP Pipeline that results in a depth of le s than 3
feet.
6. Utilities crossing the BP Pipeline must be located below it and have a minimu
clearance of 12 inches between structures.
7. As the Zoning Code requires, the garage may not extend more than 5 feet in ont oT the
home. The petitioner shall bring the home design into compliance prior to the issuance

Ms. Stromberg stated the petitioner has already complied with stipulations 7 and 8.

Mr. Bruce Nedegaard, President of Nedegaard Construction, stated they have no pr blems with
the stipulations.
Mr. Kuechle asked where the pipeline runs?
Mr. Nedegaard stated it runs parallel to 53`d Avenue.
Mr. Kuechle asked if the driveway would be over the pipeline? �
Mr. Nedegaard replied that, no, not all of the petitioner's driveway. It will run with 53` . It will be
the same as the house next door, and there was no problem with that home.
Mr. Kuechle asked whether the utilities ran under the pipeline?
Mr. Nedegaard replied, yes, they did the same thing for the house next door.
Mr. Kondrick asked whether there was any problem with water runoff considering th fact they
have to watch how far above the pipeline that they get with the grading and so forth o the water
can exit the property without any problem.
Mr. Nedegaard stated with the front yard, it will all exit towards 53�d Avenue and out nto the
street. Again, basically the same as the house on the right.

INTRODUCTION
Nedegaard Construction Company is seeking a special use permit to allow the
construction of a 561 square foot accessory structure attached to the home proposed for
1305 53`� Avenue.
City Code requires a special use permit to allow second accessory buildings, other than
the first accessory building, over 240 square feet. Typically, these requests involve a
property owner who wishes to construct an additional detached garage in the rear yard. In
this particular instance, both of the garages are attached to the home. The main garage is
proposed to be a 600 square foot garage facing on 53`� Avenue. The proposed second
accessory structure is a 561 square foot RV storage garage facing on Fillmore Street.
PLANNING COMMISSION RECOMMENDATION
At the January 15, 2003, Planning Commission meeting, a public hearing was held for SP
#03-02. After a brief discussion, the Planning Commission recommended approval of
special use permit, SP #03-02, with the stipulations as presented.

building a 896 square foot accessory structure in the rear yard. Th Planning
Commissi n reviewed the proposal at its January 15 meeting and voted una imously to

Dear Mr. Nedegaard:
On Monday, January 27, 2003, the Fridley City Council officially approved your request for a Special
Use Permit, SP #03-02, to construct a second accessory structure (garage), on a vacant piece of
property, when a new home is constructed, legally described as Lot 4, Block 1, Skywood Ad�en,
generally located at 1305-53ro Avenue NE. �
Approval of this special use permit is contingent upon the following stipulations:
1. Grading and drainage plan to be approved by City's engineering staff prior to the
issuance of any building permits, in order to minimize impacts to the surrounding
properties.
2. During construction, silt fencing shall be used where applicable and streets cleaned
as needed.
3. Petitioner to pay $1,500 park dedication fee prior to issuance of building permits.
4. At British Petroleum's (BP) request, petitioner shall agree to not build closer tnan 2�
feet from the centerline of the BP Pipeline on this lot.
5. No soil can be removed from over the BP Pipeline that results in a depth of less and
3 feet.
6. Utilities crossing the BP Pipeline must be located below it and have a minimum
clearance of 12 inches between structures.
7. As the Zoning Code requires, the garage may not extend more than 5 feet in front of
a home, petitioner shall bring the home design into compliance prior to issuance of
any building permits.
8. As second accessory structures with doors opening onto a side street are required
by Zoning Code to be setback 25 feet from the property line, the home must be
relocated on the lot or otherwise brought into compliance prior to the issuance of any
building permits.
