The Special Use Permit process begins by filling out a SPECIAL USE PERMIT APPLIC TION. This,
vrrith a site plcm, cmd other appropricrte drawings, must be submitted to the Plcmning c�f. A fee is
associated with the application; $100 for second accessoiy building applications, $4 for all other
applications. Fees are non-refundable.
Once the application is received, the appliccrtion is reviewed by stc�f from the Pl ' g,
Engineering, Assessing, Fire, cmd Police Depc�tments. The impacts to adjacent pro rties cu�e
discussed, cmd stipulations cu�e developed. Simultcmeously, a mcaling list of crll pro rties within a
350 foot radius of the property is generated. Notices of the request cnce sent to these roperty
owners. There is approximately four weeks between the application due date cmd th Plamning
Commission meeting.
Prior to the meeting of the Plcmn;ng Commission, a stcdf report is written, cmd the peti 'oner ralled
regcu�ding the stcdf recommendcrtion.
The Plmining Commission is made up of seven residents of the community. The mee ' gs cu�e held
the first cmd third Wednesdays of the month at 7:30 pm in the Council Chcunbers in th Municipal
Center. The Plcmning Commission is cm advisory commission to the City Council. It i the
responsibility of the Plcmning Commission to conduct a public hecu�ing, gather testim ny cmd make
a recommendation to the City Council regcffding crll special use pernut requests.

RECOMMENDATIONS

MOTION by Mr. �drick, seconded by Ms. Johns, to approve the September 4, 2002, Planning
Commission me ing minutes as amended.
UPON A VOI VOTE, ALL VOTING AYE, CHAIRPERSON SAVAGE DECLARED THE
MOTION C RIED UNANIMOUSLY.
1. PUBLIC HEARING:
Consideration of Special Use Permit, SP #02-09, by Kevin Swanson for a second
accessory structure, for storage purposes, generaily located at 7053 Hickory Drive NE.
MOTION by Mr. Kondrick, seconded by Mr. Kuechle, to waive the reading and open the public
hearing.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON SAVAGE DECLARED THE
MOTION CARRIED AND THE PUBLIC HEARING OPENED AT 7:32 P.M.
Ms. Hanson stated the petitioner is requesting a special use permit to construct a 960 square
foot accessory building located at 7053 Hickory Drive. Code requires a special use permit to
allow accessory buildings other than the first building over 240 square feet. Total square
footage of accessory structures is not to exceed 1,400 square feet. The total square footage of
all the existing and supposed structures on this site will be 1,400 square feet.
Ms. Hanson stated that the arborvitae and the birch tree will be transplanted to a different area
in the yard. There is also a site plan which shows that the structure will be located 12.5 feet
from the property line. Staff recommends approval as second accessory buildings over 240
square feet are permitted in the R-1 zoning district. Staff recommends the following stipulations:
1. Staff shall conduct regular inspections of this site if at any time a trail simulating a
driveway is present, a hard surface driveway as approved by the City will need to be
expelled within 90 days.
2. The petitioner shall obtain all necessary building permits prior to construction.
3. The structure shall not be used for a home occupation or living area.

Ms. Savage stated that a second accessory structures cannot be used as a home occu ation or
living area, but can it be used as a study?
Ms. Hanson stated that she is unsure of how to answer that. Living space is not permis ible.
To the best of her knowledge, only storage is allowed.
Mr. Saba stated that he would like clarification on that.
Ms. Hanson stated she would have to consult with other staff before she could answer t at
question.
Mr. Kuechle stated the definition of "living in the place"would be spending the night the e.
Ms. Savage stated this can be clarified by staff at the next meeting.
Ms. Hanson stated staff would bring the answer to the next meeting.
Mr. Kuechle asked if she knew what the rule was regarding plumbing in an accessory b ilding.
Ms. Hanson stated she did not.
Mr. Kuechle asked if any construction was going on at this site right now.
Ms. Hanson stated that the petitioner did come in and get building permits.
Ms. Savage asked if she was aware of any opposition from the neighbors.
Ms. Hanson stated staff has not heard of any opposition.
The petitioner, Mr. Kevin Swanson, stated that he will use this building for vehicle stora e. He
would store a truck, boat, and trailer in the building. He would prefer to put everything i side a
building. He has no use for a driveway and has no problem with the stipulations.
Mr. Kuechle asked if Mr. Swanson understood that he would not need a paved surface riveway
to his garage for occasional use of the garage.
Mr. Swanson stated that he understood.
Ms. Johns asked if he would meet all the setback requirements if there is a need to put n the
d riveway.
Mr. Swanson stated he would. The property is a half acre, and the house is so close to the
street that there is a big backyard. There are no neighbors to the east, only to the nort and the
south, and these neighbors have no problems with this request.
Ms. Johns asked if the tree was transplantable.
Mr. Swanson stated that the birch tree was close. He is spending the extra money to t to
transplant that rather than spending money on more trees.
