The Special Use Permit process begins by filling out a SPECIAL USE PERMIT APPLICATION. This, with a site plcm, cmd other appropriate drawings, must be submitted to the Plcmning stc�f. A fee is associated with the application; $100 for second accessory building applications, $400 for crll other applications. Fees cu�e non-refundable. Once the application is received, the application is reviewed by staff from the Plcmning, Engineering, Assessing, Fire, cmd Police Depcu�tments. The impcYcts to adjacent properties cu�e discussed, cmd stipulations cu�e developed. Simultcmeously, a mcriling list of all properties within a 350 foot rad.ius of the property is generated. Notices of the request cu�e sent to these property owners. There is approximately four weeks between the appliccrtion due date cmd the Planning Commission meeting. Prior to the meeting of the Plmuiing Commission, a staff report is written, cmd the petition�r called regarding the stc�f recommendation. The Plcmning Commission is made up of seven residents of the community. The meetings cse held the first cmd third Wednesdays of the month crt 7:30 pm in the Council Chcunbers in the Municipal Center. The Plcmning Commission is cm advisory comrrussion to the City Council. It is the responsibility of the Plcmning Commission to conduct a public hearing, gather testimony cmd make a recommendation to the City Council regcu�ding all special use permit reqizests. Your existing garage, shed, and proposed garage would be considered the accessory structures on your property. Your existing garage is 574.62 square feet and your shed is 96 square feet. The pitch he submitted in the plan has to do with going steeper than the house because he has to shovel off the roof in the winter. He also would like to build the garage as close to 826 square feet as possible to get as close to the 1400 square foot maximum allowed. What is the maximum height to the top of the garage allowed? Ms. Bulthuis stated that 14 feet is the maximum to the center line of the garage. Mr. Hatchett asked if there was a 3 foot setback required from the side property line to the overhang of the garage. Ms. Bulthuis stated that it does not apply to the overhang. Mr. Kondrick stated there are ways to make this garage able to handle any rype of snow load without maximizing the height of the garage. He thinks the pitch should look exactly the same as the house. Mr. Kuechle stated that there should be no reason why anyone needs to shovel snow off the roof. Mr. Kondrick stated that since there will not be heat inside the garage, there should not be a problem with the snow. Mr. Hatchett stated there would be heat in the garage. Mr. Kondrick stated there are ways to not have to add to the pitch very easily. Mr. Hatchett stated that for some reason, he always has to shovel off his garage. Mr. Kuechle stated that he could make the garage a little bit bigger because he is within 46 feet of the allowed square footage. Ms. Hanson stated that s�aff is requesting consideration of the text amendment to the Ciry building code tMat fraternal organi�tions be recognized as a special use in the R-3 district. They have one fraternal organization in th�R-3 district which is the Knights of Columbus (KC). For over thirty years, the KC has been givi g back to the City of Fridley by delivering Christmas baskets, sponsoring the "Clean-the-Hi hway" program, annual Tootsie Roll drive, and the KC picnic. In years past, the KC has allowed US est to use portions of a parking lot for temporary storage of a trailer that functions for distribution o hone books. This allows additional money raised to be donated to charitable contributions. Staff w s made aware of the improper parking of the trailer in 1999. The organization was asked to discon�inue this. As a result, the Council asked staff to analyze the code regarding such use. � \ Ms. Hanson stated after analysis, st'�ff has determined that a zoning text amendment would be necessary for fraternal organizations'�o have the ability to continue fund-raising in a manner consistent with what is allowed in othek locations. This addition to the code would be added to the definition of fraternal organization: "A gtoup of people formally organized for the common interest, usually cultural, religious, or entertainme�t with regular meetings and formal written memberships." Also added under the Uses Permitted wo Id be: "Trailers for use by a fraternal organization for fund-raisers provided the trailers are scre ed from the right-of-way and adjacent land uses do not adversely affect parking providing the orga ization use of the trailer would meet the following standards: ` �� 1. The number of trailer shall not at ai�y time exceed three. 2. Trailer size shall not exceed Minnespta Department of Transportation standards for enclosed trailers. � 3. Ms. Hanson stated that this will allow fraternal organizations to raise additional funds and ensure the continuation of charitable contributions to the commur�ity. Staff recommends the approval of the zoning text amendment. In the event the amendment�s approved, the Knights of Columbus may make the August 31 deadline for the special use permit application. This will go before the Planning Commission on October 3, 2001. The Council on October 22, 2001, will review the application. Mr. Kondrick asked about screening the trailer from public Jiew.
