The Special Use Pernut process begins by filling out a SPECIAL USE PERMTT APPLIC�TION. This,
with a site plcm, cmd other appropriate drawings, must be submitted to the Plcmning stc�f. A fee is
associated with the application; $100 for second accessory building applications, $400 for all other
applications. Fees are non-refundable.
Once the application is received, the application is reviewed by staff from the Plcmnin�,
Engineering, Assessing, Fire, cmd Police Depcu�tments. The impacts to adjacent prop�rties cu�e
discussed, cmd stipulations cae developed. Simultcmeously, a mcriling list of all propeirties within a
350 foot radius of the properly is generated. Notices of the request cQe sent to these pproperty
owners. There is approximately four weeks between the application due date cmd the Plamning
Commission meeting.
Prior to the meeting of the Plcmning Commission, a stc�f report is written, cmd the petit�oner called
regcu�ding the stc�f recommendation. '
The Plcmning Commission is made up of seven residents of the community. The meetings cu�e held
the first cmd third Wednesdays of the month at 7:30 pm in the Council Chmnbers in the Municipal
Center. The Plcmning Commission is cm advisoiy commission to the City Council. It is the
responsibility of the Plcmning Commission to conduct a public hecffing, gather testimany amd make
a recommendation to the City Council regarding all special use permit requests.

REQUEST
The petitioners, Richard and Laura Wolfe are seeking a special use permit to allow the
construction of a 600 square foot second accessory building.
ANALYSIS
The property is located on Hathaway Lane, with the home being "squared up"to and
fronting on Hathaway Lane. The lot is rectangularly shaped which narrows to a point in the
southern corner. The existing home was built in 1958 and the detached garage was built in
1966.
Accessory structures over 240 square feet are a permitted special use in the R-1 zoning
district. The existing one-stall garage and the proposed accessory structure are a total of
1,040 square feet, which is 360 square feet less than the total allowed by Code.
The proposed garage location would not encroach any closer to the side yard lot line than
the existing garage. City staff has received no comments from neighboring property
owners.

square feet. The proposed location of the garage is in the rear yard of the residence. Staff

Mr. Rick Wolfe, petitioner, stated that the same color of the house is not stocked anymore, but
he has found a similar compatible color that is almost exact, but slightly darker.
Ms. Johns asked if the proposed garage wouid go right on top of the slab shown on the picture
or further back.
Mr. Wolfe stated that it would go right on top of it. His back yard is very long so it does not
infringe on any easements. There is plenty of room.

Mr. W.olfe stated this was an easy process. Is there ever a chance the Planning Commission
couid give the knowiedgeable City staff the power over these decisions that are pretty routine
and simple?
Ms. Savage stated that the whole structure provided by Statute or ordinance would have to be
changed.
Mr. Bolin stated that a second accessory building over 240 square feet by zoning code is
required to go through a special use permit process. The cases where the second garage
would not fit due to lot size or surrounding uses gives the City discretion to place additional
stipulations to make the garage more compatible. A majority of the structures do make s�nse,
but there are a few cases with problems like putting in a second driveway. This way the
stipulations can be put on there. It is possible to change the zoning code to take the second
accessory structures out of the uses allowed with a special use permit and make them a
permitted use with conditions that need to be met. The City Council would have to take the
initiative to instruct staff to change that portion of the zoning code.
Ms. Johns stated that it is also good for the neighbors to be able to come in and give their
opinion on these requests.

Ms. Bulthuis stated that he petitioner is seeking to vacate a portion of 3�d Street which is
adjacent to 5`h Street an north of the apartments at 5451 5�h Street. This portion of street is an
unimpraved right-of-way nd is not used by the general public. A vacation request to vacate the
same portion of street was submitted in 1972. At that time, City Public Works staff did not
recommend vacating it in c se it was ever utilized again. Since that time, all connections to that
street have been vacated a there is no longer a reason to keep the entire right-of-way. The
proposed vacation is south o I-694 and, if granted, the petitioner would gain the 29 ft. x 302 ft.
piece of land, correcting a no onformity for the 5-foot setback needed for the existing garages.
There are no underground utili 'es, and the northerly five feet of this property shall be dedicated
to the City as an easement. Th re is a water main north of the property, and this easement is
needed for access purposes. St ff recommends approval.
Ms. Savage asked if any calls ha been received.
Ms. Bulthuis stated she has not re ived any.
Ms. Skarie, petitioner, stated she is i a family partnership in ownership of this property. She
has concern about the second stipul tion referring to the cell tower. They had negotiated to
place the cell tower back from the gar ge, because they would lose parking spaces. The cars
park along the whole strip by the gras right now; and if the cell tower came in, it would take that
grassy area. The area by 3`d Street te s to be a place where kids come back and play with dirt
bikes and some people actually throw shers and dryers back there. They are thinking of
putting in chain link fencing to discourag the dumping and graffiti on the garages. In
constructing the cell tower, the equipmen used may destroy part of the parking space.
Mr. Bolin stated this stipulation came from the Planning and Public Works staff. The petitioners
are required to have a paved driveway to t e cell tower for maintenance purposes. The City
does not like to see any more hard surface rea than necessary in Fridley. There is a paved
drive there already. There would be less im rvious surface utilizing what is already there.
There are concerns with plowing snow aroun the corner and the plows would be constantly
blocking the access drive into the cell tower si .
Mr. Kuechle asked if the property owners woul lease the site for the cell tower?
Mr. Bolin stated this site is an approved cell tow site identified by the City in 1997.
Mr. Kuechle asked Ms. Skarie if she had the prero ative of not letting the cell tower there.
Ms. Skarie stated, yes. �\

Mr. Bolin stated that during the construction, the City E�gineers probably would not have a
problem with equipment going across the grassy portion,of 3�d Street. They could come out

once a w�ek or so to work on the cell tower, and staff would rather have them utilize the area
you have.

Ms. Skarie �ated they even thought about asking the City for permission for more parking spots
because they�,are short of spots right now. They are not allowed to park on the street, and it
makes it hard°� the winter. If they are not going to put a driveway in the back, they may need to
take out the gr�ssy area to be used for more parking space.

Mr. Bolin stated t�tat Ms. Skarie would need to work with the Engineering staff regarding that.
Mr. Kuechle asked v�here the cell tower driveway is proposed to go through.
Mr. Skarie stated that the celt tower would be by the east parking entrance on the north side.
Ms. Skarie stated that if this is vacated, half of the property would go to MnDOT and they would
get 15 feet of it.
Mr. Skarie stated that five f t of it would have to go to the City.
Mr. Bolin stated they would ne d a five-foot easement. If MnDOT holds on to the property, that
would probably not be a proble

Mr. Oquist stated that 15 feet were indicated, but it st es it is 29.69 feet on the survey map.
Mr. Boiin stated they are only getting 15 feet of the 29.69 et. MnDOT would obtain the other
half.
Ms. Johns asked if staff indicated that driving on that grassy ar would be approved for
construction of the cell tower. � I
Mr. Bolin stated that is correct.
Mr. Oquist stated there is the problem of cars being parked back there o ,,parking spots for the

foot accessory building at 960 Hathaway Lane. The total square foota�e of all existing proposed
accessory structures on this site is 1,040 square feet, which is 360 square feet less than the total
allowed by Code. The proposed garage will be directly behind the existing garage. The
Planning Commission approved this at their June 6 meeting. Staff recommends approval with
six stipulations.
Councilmember Billings asked how many special use permit applications for secondary
structures in Fridley are received on an annual basis.
Mr. Bolin stated that there probably are 1� to 20.
Councilmember Billings asked how many have been approved and how many have not been
approved.
Mr. Hickok stated that he could recall one that was not approved since 1994.
Councilmember Billings stated that from a practical standpoint, this is merely complying with
the requirements of the code that in a single family zoning, a second garage needs City
permission, but is not unusual.
Mr. Hickok stated that the one that was denied was because of size.
Councilmember Billings stated that there is nothing special about the special use permit. We are
not going out of our way to do something for Councilmember Wolfe that we do not normally do.
It was unanimously approved by the Planning Commission.

neighborhood and are concern about the property due to the experience before. Six calls were
received by other neighbors wi the same concems. A sober house is an honorable idea, but the
Taylors do not even homestead he property and this is where they live.
Councilmember Bolkcom ask if five unrelated people could live in this home until the
necessary corrections are finish .
Mr. Bolin stated that was correct
Mayor Lund asked about the othe neighbors' concerns.
NIr. Bolin stated that he received s x calls before the Planning Commission meeting and all were
in agreement with the St. Arnolds.

Councilmember Bolkc ro stated that only one family showed up for the meeting on the
Springbrook Creek. Th decision will not be made until more information is obtained about
drainage. The St. Arnol have worked out a plan with Jon Haukaas. She would ask the City
Manager to send Mr. Hauk a letter that states that due to lack of participation, a "do nothing"
policy is proposed. She said hat five people showed up for a street reconstruction meeting. They
are waiting for more petitions om the neighborhood.
Councilmember Wolfe stated th he was impressed by all the families that showed up for `49er
Days.
Councilmember Barnette stated tha Safety Camp is neYt Tuesday and Wednesday, June 26
and 27. Please call the City if you sire more information. Everyone is invited to see this
wonderful program.

Councilmember Bolkco stated that there is a farewell gathering for the Superintendent of

Mr. and Mrs. Marie and S ott St. Arnold, 350 Ironton, stated that they like the quiet
neighborhood and are concern about the property due to the experience before. Six calls were
received by other neighbors wi the same concerns. A sober house is an honorable idea, but the
Taylors do not even homestead the property and this is where they live.
Councilmember Bolkcom ask if five unrelated people could live in this home until the
necessary corrections are finish .
Mr. Bolin stated that was correct
Mayor Lund asked about the othe neighbors' concerns.
Nir. Bolin stated that he received s';c calls before the Planning Commission meeting and all were
in agreement with the St. Arnolds.
MOTION by Councilmember Bolk om to continue this item. Seconded by Councilmember
Wol€e.
MOTION by Councilmember Bolkco to amend the motion to continue this item until July 23.

Ms. Marty stated that they have no ob�ection to eYtending this to the second 60-day period
provided by the Statute.
Mayor Lund asked when the second 60-day period would stairt.
Mr. Bolin stated that would be on July 3.
Councilmember Billings stated that they are all in agreement with this. They are not trying to
make it difficult for people to remodel and this extension is at the request of the petitioner and
not a request by the City Council.

LOCATED AT 960 HATHAWAY LANE N.E. (WARD 2):
Mr. Bolin stated that the petitioners are seeking a special use permit to construct a 600 square
foot accessory building at 960 Hathaway Lane. The total square footage of all existing proposed
accessory structures on this site is 1,040 square feet, which is 360 square feet less than the total
allowed by Code. The proposed garage �vill be directly behind the existin� garage. The
Planning Commission approved this at their June 6 meeting. Staff recommends approv�l with
six stipulations.
Councilmember Billings asked how many special use permit applications for secondary
structures in Fridley are received on an annual basis.
Mr. Bolin stated that there probably are 1� to 20.
Councilmember Billings asked how many have been approved and how many have nat been
approved. i
Mr. Hickok stated that he could recall one that was not approved since 1994. II
Councilmember Billings stated that from a practical standpoint, this is merely complyin with
the requirements of the code that in a single family zoning, a second garage need� City
permission, but is not unusual. '
Mr. Hickok stated that the one that was denied was because of size. I
Councilmember Billings stated that there is nothing special about the special use permit. '�JVe are
not going out of our way to do something for Councilmember Wolfe that we do not normally do.
It was unanimously approved by the Planning Commission.
