The City Council at their June 1, 1992 meeting established the date
of the public hearing for your plat request, P.S. #92-04, for July
6, 1992 . Ward Councilman Schneider will be unable to attend the
June 29, 1992 meeting, which was the proposed public hearing date.
This will move the date of final approval for the plat to the July
20, 1992 meeting. Your surveyor should send the preliminary plat
to the Anoka County Surveyor for review and approval by Anoka
County prior to the July 20, 1992 City Council meeting. The Mayor
will need to sign the final plat at the July 20, 1992 meeting.

I represent Peter A. Berger and Julie A. Berger, his wife,
who are tenants occupying the above property. They were tenants
of said property prior to and when the condemnation proceedings
were commenced by the City of Fridly under the above captioned
file number.
The purpose of this letter is to request that you provide
Peter A. Berger and Julie A. Berger all relocation benefits to
which they are entitled under Minnesota Statutes Chapter 117.
As provided by law, please provide them with relocation assistance
advisory services . They are in immediate need of relocating in a
comparable replacement dwelling in the project area. They wish to
apply their cash benefit, to which they are presently entitled in
sum of $5, 250. 00 for payment of rent up to 42 months, to apply as
a down payment and for incidental costs for the purchase of a decent ,
safe and sanitary replac�m�nt dwelling.
Please acknowledge receipt of this letter and confirm your
undertaking to assist my clients in relocating in a comparable
replacement dwelling they could purchase in the project area .

As a followup to our recent phone conversation regarding the
relocation issues with Gary Lenart and Peter Berger, we needed to

As we discussed, we anticipate making claims with one, and
possibly both, of these parties by the 30th of September.
Therefore, in order to expedite claims and to reduce conflict, we
request funds be available to pay claim amounts . We request you
receive City Council authorization to make pa ments to the
subject claimants in an amount not to exceed �$11, 000 . 00 . Since
claims have not been made at this time we are not certain as to

As you know, I represent the City of Fridley on this
Condemnation. The City filed the Condemnation Petition on August
26, 1992. I have secured an extension of time for the
Commissioners to file their Award until November 15, 1993 . I
have attempted, through numerous phone calls and correspondence,
to find an acceptable date when Leland J. Frankman, the Attorney
for the landowners, can appear for the Commissioners Hearing. To
date, I have been unsuccessful in finding a date. I am advising

Dear Barbara:
Enclosed is a Check Request form for half of the relocation
assis�.ance and half of the moving expenses for the occupants at
6070 Central Avenue N.E . in Fridley.
Because Peter and Julie Berger have separated and decided to
relocate to different locations, an addendum has been added to
the rental assistance and moving expenses claims to specify the
in�tent of the claimants as to distribution of the subject claim
am�unts . Please see attached addendum.
To date Peter Berger has relocated, so our office is requesting
his share of the rental assistance and moving expenses payment in
the name of his attorney (and father) Richard E . Berger. Please
see attached letter dated November 29 , 1993 . Julie Berger,
however, has yet to relocate { she still resides at the subject
property) . Our office will not submit a Check Request for Julie
Berger ' s share of the rental assistance and moving expenses
payment until she has relocated.
I h�ve enclosed copies of the executed claim forms for your
review (they will remain partially incomplete until Julie Berger
relocates ) .

The undersigned Commissioners appointed by this Court in the
above entitled action by Order of the Court, dated September 30,
1992 , do hereby report as follows:
1. That we met at the time and place appointed by this
Court therefore, to-wit: at the Court Administrator's Office in
the Anoka County Court House, Anoka, Minnesota, on the 13th day
of October, 1992 and severally took the oath prescribed by law.
2 . That after we gave written notice to the Respondents
named therein, we then viewed the premises described in said
Petition. Upon written notice being given to the persons
interested, we held public hearings at the Fridley City Hall,

Dear Mr. Frankman:
This letter is to confirm our earlier telephone conversation.
Previously, you advised me that a small portion of the Nelson
driveway crosses the parcel that was condemned by the City of
Fridley. This letter is to advise that the City will grant Mr.
and Mrs. Daniel G. Nelson a license to continue to use the
driveway as long as either of them own and live on the property.
This license will not be transferable to a third party without
the written consent of the City. The license will also require
that maintenance of the driveway will be done by the Nelsons at
their expense.
Based on the issuance or the above-described license, it is my
understanding the Nelsons will not appeal the commissioners'
award. I have also advised you that the City will not be
appealing the award. I have requested that the City issue a
check in the total amount of the commissioners' award, payable to
Mr. and Mrs. Daniel G. Nelson and yourself. You have indicated
that you will secure a release of judgment from the attorney that
has the lien.

Claim Addendum
On November 8, 1993 , Peter A. Berger and Julie A. Berger
(hereafter referred to as "claimants" ) executed a "Claim for
Rental Assistance or pownpayment Assistance" and a "Claim for

This Memorandum is in response to your Memorandum directed to
William Burns, City Manager, regarding the above subject, dated
May 5, 1994 . Attached to your Memorandum is a copy of a portion
of the City Council's Minutes of August 3 , 1992 regarding the
above subject and a memo from Mayor Nee to Bill Burns and
yourself, dated May 6, 1994 .
I also acknowledge having talked to you regarding this subject
some weeks ago.
After receiving your Memorandum and the attachments and having
reviewed the Council Minutes of August 3 , 1992 and Mrs. Nelson's
appraiser's report, I have the following comments:
At the August 3 , 1992 Council Meeting, Mayor Nee stated that
he felt that the City should reimburse Mr. Lenart for the
cost of surveying and platting. My response at that time
was that the Condemnation Commissioners could take that cost
into consideration. I am of the opinion that the
Commissioners did take those costs into consideration and
that they were reflected in the Condemnation Award.
The property owners used Malcolm O. Watson of Watson
Appraisal and Consultant Service as a expert witness in the
Condemnation Hearing. The valuation approach used by
Mr. Watson in appraising this property was one of
developmental abstraction. Mr. Watson describes this

approach as follows: "This procedure takes the value of
building sites with all utilities and street access in and
paid for and from that he subtracts the cost of those local
improvements to determine the net value of that property
(See Item 3 of Watson's Appraisal) " . Mr. Watson goes on to
state: "I have a 'land value by abstraction' cost analysis
prepared for general estimating of local improvements in our
area. I have broken down the cost per square foot of
platted building sites for a platting of both sides of a new
street with a cul-du-sac. Cost would include: street and
lot surveys (including plat) , grading, base, asphalt

Mr. Watson then went on to indicate that three lots could be
obtained on the subject property and calculated the market value
of the lots. To this figure he added the value of the existing
structures and concluded that the total value of the subject
property was $95, 900 . 00.
In making his assumptions Mr. Watson anticipated that the
property owners would have to incur surveying and platting
expenses. He valued the Nelson property as three platted lots,
which would have by necessity required surveying and platting
expenses. It is my opinion that the Nelsons were fully
compensated for their surveying and platting expenses by virtue
of the fact that they were given credit for three platted lots.
Had the Nelsons asked for additional compensation for surveying
and platting expenses at the Commissioners Hearing, I would have
objected and claimed that this would be a duplication considering
the valuation method used by their appraiser.

Dear Ms. Nelson:
During the process to investigate your request for reimbursement
for platting expenses, the City Attorney has determined that the
amount of the Commissioner's Award, $95, 900, already included
costs for processing the plat application and hiring a surveyor
to complete the plat.
The City Attorney's opinion is based on Malcolm O. Watson's
Appraisal which was submitted to the commissioners during the
commissioner's hearing. Watson stated in the appraisal that:
"This procedure takes a value of building sites with all

you requested at the August 3 , 1992 City Council meeting.

I also reviewed the plat file regarding the driveway issue. You
had submitted a request for reimbursements for costs to remove
trees in the driveway. You had indicated that the City required
you to construct this driveway.
Attached is a copy of the staff report and plat. The recommended
stipulation stated:
1. An access easement shall be executed between Lots 1 and 2
for the existing driveway, or relocate the driveway so that
it is located within the "flag" lot.
This stipulation did not require construction of a new driveway;
it merely stipulated that if the existing dirt driveway was to be
used that an easement be placed over it OR the driveway be
relocated so that it was within the flag lot. As you know, the
plat was denied, therefore, there was no requirement from the
City for a new driveway to be constructed.
The City therefore cannot reimburse you for checks #3208 and
#3329 in the amount of $399 . 81 and $104 . 00 respectively. The
record is clear that it was the City's intent to allow you to use
the existing driveway OR to relocate it.
You also submitted checks #1940 and #3270 to Gary Lenart in the
amount of $425. 00 and $525 . 00. You were going to verify the
nature of these expenses and contact me with that information.
It appears, however, that the City has properly reimbursed you
for platting expenses as provided in the Commissioner's Award.

SUBJECT: Status of Relocation Payments to Tenants of
Nelson Property
Kirk Schnitker brought me up-to-date on November 24, 1993
regarding the relocation payment status to the Berger's and Gary
Lenart. We recently processed a $400. 00 moving expense check
payable to Gary Lenart. This is the only expense that the City
will incur for his relocation. Kirk was able to find adequate
comparables, and it was determined that Lenart's income was high
enough such that a replacement payment was not required.
The Berger's are in divorce proceedings, so we may have to
process two checks instead of one, but this would not increase
the amount of money payable to them. We may have to write two
checks regarding moving expenses, but Kirk was to hopefully
resolve this issue in the near term.
As you know, the Commissioners conducted the hearing on December
8, 1993, and we are awaiting their response sometime in February.
Virgil Herrick seems to feel that they may make an award in the
range of $80, 000 - $90, 000.

Gary Lenart and the Berger's have vacated the residences on the
Nelson property. The tenants have also been fully reimbursed for
relocation expenses as required by law. Gary Lenart received
$400 in moving expenses, and each of the Berger's received
$2 ,908 . After completion of the title work pertaining to the
property, I recommend that we allow the Fire Department to use
the buildings for training purposes and ultimate demolition.

Mrs. Nelson has sent me copies of checks regarding the surveying
and platting expenses for the Gary Lenart addition. The
condemnation commissioners did not specifically address
reimbursement of the surveying and platting costs; however, in
the August 3 , 1992 minutes, Mayor Nee suggested that the City
consider reimbursing Mrs. Nelson for the surveying and platting.
I have contacted Bolton and Menk, Inc. to match their invoices
against the check copies submitted by Mrs. Nelson. Further, I
have verified that $500. 00 in application fees for the lot split
and plat applications were made by Mrs. Nelson. The total of the
surveying and plat application fees is $4, 377 . 41. Mrs. Nelson
has also requested reimbursement for other expenses in the amount
of $1, 453 . 81. I am still working on documenting what these
expenses are, and I am not sure at this point if they were part
of the platting and surveying costs.
After discussing this with the City Attorney, he suggested that
we verify with the City Council that the intent discussed in the
August 3 , 1992 meeting was to reimburse the surveying and
platting costs. Unless otherwise directed, I will direct the
Finance Department to prepare a check in the amount of $4 , 377 . 41
to Mrs. Nelson. I may follow-up with another reimbursement if I
verify that the remaining $1, 453 . 81 is indeed for surveying and
platting expenses.

I understand that the City Council has a question regarding
Virgil Herrick's memorandum regarding Mrs. Nelson's request for
reimbursement of platting and application fee expenses. I spoke
to Virgil again to confirm his recommendation. He believes that
the commissioner's award did account for platting expenses. It
is Virgil's opinion that we do not need to send her any
additional money.

Ms. McPherson stated the petitioner is requesting that a
preliminary plat approved in order to create two single family lots
for existing residences located on property addressed as 6070 .
Central Avenue N.E. The property is located west of Central
Avenue, east of Moore Lake, and north of Moore Lake Beach Park.
The property is zoned R-1, Single Family Dwelling, as are adjacent
parcels.
Ms. McPherson stated the petitioner is interested in purchasing
the westerly dwelling unit, and the petitioner is proposing to add
a 30 ft. by 30 ft. addition to the existing dwelling unit. The
petitioner is aware of the setback requirements and have determined
they will not require any variances.
Ms. McPherson stated the plat creates two lots which do meet the
minimum lot requirements of the R-1, Single Family Dwelling, zoning
district regulations. The plat creates what is known as a "flag
lot" in which the westerly parcel will have an access flag of 30
feet along Central Avenue. This meets the requirement to have a
minimum of 25 feet of access along a public street for every single
family parcel in the City.

Ms. McPherson stated the north/south lot line between the two
parcels is currently located 31 1/2 feet from the easterly dwelling
unit. The setback requirement for the front parcel is 40 feet, and
the surveyor has relocated the proposed lot line to meet the
ordinance requirements.
Ms. McPherson stated the access for the rear lot is currently on
the front parcel, and some type of access easement should be
executed between the two parcels to ensure that access to the
westerly parcel can be maintained, should the properties change
ownership, or the petitioner should relocate the driveway onto the
flag portion of the westerly parcel.
Ms. McPherson stated the City Engineering Department is not sure
if the dwellings have separate water and sewer services, and the
petitioner must provide information to the Engineering Department
that there are separate utilities for each dwelling or that
provisions will be made to provide separate utilities for each
dwelling.
Ms. McPherson stated the City has had a long-term goal to expand
Moore Lake Beach Park. The City Council has directed staff to
purchase properties along the west side of Central Aver►ue as they
are placed on the market. In 1988, the City purchased the property
north of 6080 Central Avenue and is holding it for future park
expansion. It has been the City's policy not to condemn properties
in order to achieve the goal of park expansion; the City prefers
to purchase the properties as they are placed on the market. In
1988, the City contacted Mrs. Nelson, the property owner, to
request that the City be granted the right of first refusal should
her property be placed on the market. Mrs. Nelson declined the
City's offer at that time.
Ms. McPherson stated that as the proposed plat meets the minimum
code requirements set forth in the R-1, Single Family District
regulations, staff recommends that the Planning Commission
recommend approval of the plat to the City Council, with the
following stipulations:
1. An access easement shall be executed between Lots 1 and
2 for the existing driveway, or relocate the driveway so
that it is located within the "flag" lot.
2 . The petitioner shall provide proof of separate water and
sewer services for each dwelling unit or provide separate
services by July l, 1992.
3 . The petitioner shall provide a hard surface driveway by
May 1, 1993 .

Mr. Betzold stated that if both dwelling units do not already have
separate water and sewer services, is July 1 is a reasonable
deadline?
Ms. McPherson stated that the date can be changed.
Mr. Gary Lenart stated he had no problems with the stipulations.
He stated both dwelling units do share the same water and sewer at
this time. He stated Council will not be taking any action on this
request until after July 1. He does not want to make the water and
sewer improvements if the plat is not approved.
Ms. Dacy suggested a deadline of September 1, 1992 .

Ms. McPherson stated the property is located a� the intersection
of Riverwood Drive and 71 1/2 Way N.E. and adjacent to East River
Road. The property is zoned R-1, Single Fa�tily Dwelling as are
the surrounding properties.
Ms. McPherson stated that located on th� property is a single
family dwelling unit with an attached two car garage. In 1986,
the petitioner applied for a lot split,;'a vacation, and a variance
for this property. At that time, the,'proposal was to remove the
existing single family dwelling and %'subdivide the property into
three single family lots. ,�f
Ms. McPherson stated the varianceirequest was to reduce the front
yard setback from 35 feet to 25 �eet, and to reduce the rear yard
setback from 25 feet to 21 f�et. At that time, the Appeals
Commission recommended approva�� of the variance request; however,
with the exception of the vac;�tion request, the land use requests
were not reviewed by the Cit�i Council.

Ms. McPherson stated the resent request by the petitioner is to
again subdivide the pr erty into three single family lots;
however, in this case t single family dwelling unit on Lot 2 is
not intended to be remo ed. Lots 1 and 3 would be vacant and would
be sold for single fa ily dwellings. Due to the location of the
existing single fami home, Lot 1 at 7,901 square feet cannot meet
the minimum lot are requirement. Lots 2 and 3 meet or exceed the
minimum lot area r quirement.
Ms. McPherson tated that Section 211. 05 of the Subdivision
Ordinance allo�s the Planning Commission and the City Council to
grant a variar�rce to the minimum lot requirement should they find
that the Cod�.� imposes an undue hardship on the subdivider. If the
Commission ooses to grant the variance, the Commission should
state the reasons for granting the variance to the zoning
ordinance Staff recommends that the plat be approved to create
only two single family lots.
Ms. Mc erson stated that Lot 1 also does not have the adequate
depth eeded to construct a single family dwelling without granting
a va ance. After the front and rear yard setbacks are applied to
thi lot, the remaining buildable area is 23 feet wide for a single
fa ily dwelling on this lot. Average homes are a minimum of 24

Request
The petitioner requests that a plat be approved to create two
single family lots for existing residences on property generally
located at 6070 Central Avenue N.E. The proposed plat will bring
the property into conformance with the zoning code.
Site
Located on the property are two single family dwelling units which
are owned by Lorraine Nelson of 6080 Central Avenue N.E. ; the
parcel north of the subject parcel. The petitioners are proposing
to purchase the westerly dwelling and add on to it. The proposed
addition will be onto the south side of the dwelling and will
measure 30 ' x 30 ' . The petitioners are aware that a 25 foot rear
yard and a ten foot side yard setback needs to be maintained. The
subject parcel is zoned R-1, Single Family Dwelling as are all
adjacent parcels.
Analysis
As proposed, the plat creates two lots which meet the minimum
requirements of the R-1 zoning district regulations. The plat
creates a "flag" lot for the westerly parcel, providing 30 feet of
access along the public street. The north/south lot line between
the two proposed parcels will need to be relocated approximately
nine feet to the west of the proposed location to provide adequate
rear yard setback for the easterly dwelling unit. As proposed, the
existing driveway is on Lot 2 and an access easement between the
two parcels should be executed to insure that access is maintained
for the westerly parcel. The Engineering Department has not been
able to determine if the dwellings have separate water and sewer
services. The petitioner should provide proof that there are
separate utilities or should provide separate utilities for each
dwelling unit.
It has been a long-term goal of the City to expand Moore Lake Beach
Park. The City Council has directed staff to purchase properties
along the west side of Central Avenue as they come up for sale.
In 1988, the City purchased the property north of 6080 Central
Avenue, and is holding it for future park expansion. The City
Council will not condemn properties in order to achieve the goal
of park expansion; they prefer to purchase the properties as they
are placed on the market. Also in 1988, the City contacted Mrs.
Nelson to request that the City be granted the right of first
refusal should her property be placed on the market. Mrs. Nelson
declined the City's offer.

Recommendation and Stipulations
As the proposed plat meets the minimum code requirements set forth
in the R-1, Single Family District regulations, staff recommends
that the Planning Commission recommend approval of the plat to the
City Council, with the following stipulations:
l. An access easement shall be executed between Lots 1 and 2 for
the existing driveway, or relocate the driveway so that it is
located within the "flag" lot.
2 . The petitioner shall provide proof of separate water and sewer
services for each dwelling unit or provide separate services
by July 1, 1992 .
3 . The petitioner shall provide a hardsurface driveway by May 1,
1993 .
Planning Commission Action
The Planning Commission voted unanimously to recommend approval of
the request with an amended stipulation:

City Council Recommendation
Staff recommends that the City Council concur with the Planning

SUBJECT: Approval of Relocation Consultant Contract with
Professional Rede�elopment Resources
On August 3 , 1992 , the City Council authorized condemnation of the
Nelson property at 6070 and 6074 Central Avenue. As part of the
condemnation proceedings, a relocation consultant must be hired by
the City to determine appropriate relocation benefits for the
tenants of the two single family homes on the property.
Kirk Schnitker, of Professional Redevelopment Resources, assisted
the City with the last single family home acquisition and
relocation for the Riverview Heights project. We found his work
to be outstanding and recommend him again on this project.
The total contract cost is $1, 690, or $845 for each home.
Recommendation
Staff recommends that the City Council approve the contract as
presented.

SUBJECT: Request for Relocation Claims for Gary Lenart
and Peter Berger
Our relocation consultant, Kirk Schnitker, has requested
authorization to make payments to Gary Lenart and Peter Berger who
reside at 6070 and 6074 Central Avenue N.E. Both tenants are not
being required to move. They have indicated a willingness to
relocate. Gary Lenart, for example, has recently signed a purchase
agreement for another property. Peter Berger is pursuing another
residence.
Schnitker is requesting authorization to expend up to a maximum of
$11, 000. He indicates that the City may need to make a request for
an additional amount exceeding $11, 000, but he does not anticipate
that this will be necessary.
The purpose of receiving authorization is to be able to expedite
the claims and to return the money to the tenants as quickly as
possible.
Recommendation
Staff recommends that the City Council authorize the City Manager
to approve relocation payments to Gary Lenart and Peter Berger in
a total amount not to exceed $11, 000.

Ms. Dacy, Community Development Director, s ted that this request
is for a variance to reduce the front yard etback from 35 feet to
29. 5 feet to construct an addition to the front of this home. She
stated that the petitioner is also prop sing to create a covered
walkway to the new entrance of the dwel ing unit. She stated that
the petitioner received a special us permit for a second garage
in 1986.
Ms. Dacy stated that this area wa platted in 1954 , and there are
homes built closer than the typi 1 35 foot setback.
Ms. Dacy stated that the Appea s Commission recommended denial on
a 3 to 1 vote, and staff conc rs with this recommendation.
Mr. Awaijane stated that b th his neighbors were at the Appeals
Commission Meeting and ha e no objection to his addition. He
presented photos of thos homes in the area that have less than
35 foot setbacks.
Councilwoman Jorgenson stated that she did not feel the issue was
the setback but the a ount of lot coverage.
Mr. Awaijane stated hat with the addition the lot coverage would
still only be 24 p cent.
Councilman Billin s asked if there was a policy regarding averaging
front yard setb ks.
Ms. Dacy stat that there is a section in the Zoning Ordinance
regarding thi issue, which she explained.
Councilman illings stated there is a certain amount of logic that
if there i a situation on a street where there are a number of
homes tha do not meet the minimum setback, the variance is not
going to reate a hardship on other properties. He felt that this
theory plies in this particular case. He stated that if the
petiti er's figures are correct, the average front yard setback
is 29 eet.

done, and she stated, hopefully, this would continue with the Rice
Creek Watershed District.
MOTION by Councilman Fitzpatrick to receive Petition No. 10-1992
in support of the Locke Lake dam reconstruction. S onded by
Councilman Schneider. Upon a voice vote, all voting ay , Mayor Nee
declared the motion carried unanimously.
Councilman Billings stated that the Council has re eived a letter
from Mr. Joe Rusch, 561 63rd Avenue, indicating that he did not
want to pay more property taxes to restore the am that does not
benefit his property.

Upon a voice vote, all voting aye, Mayor Nee declared the motion

Councilman Schneider felt that this oposal is a compromise and
the benefit to the community, as far as the aesthetics and
wildlife, is worth the cost to all esidents and those who receive
the most benefit will be paying more. He stated that all the
agencies involved have worked har , and John Flora deserves credit.
He stated that even if the Counc 1 approves the dam reconstruction,
he felt it is a long way to go with all the regulatory procedures.
Councilwoman Jorgenson stat that several persons have stated that
those upstream should be contributing to this portion of the
project. She stated that here is another item on the agenda this
evening which deals wit the Rice Creek erosion control problem.
She felt that there ar large segments of the creek that will be
restored, and there w' ll be costs to the property owners. She
stated that there are some checks and balances that will be taking
place to assure th everyone pays their fair share for these
projects. She fel that this assessment is fair and equitable.
Mayor Nee stated hat Ann Bolkcom has made a major contribution to
this progress. He stated that there has to be a compromise in
order to make i work, and the proposal is more giving than taking.
He stated tha it is hoped when it comes down to the vote, it will
be approved.

MOTION by Councilman Schneider to waive the reading of the public
hearing notice and open the public hearing. Seconded by
Councilwoman Jorgenson. Upon a voice vote, all voting aye, Mayor
Nee declared the motion carried unanimously and the public hearing
opened at 9: 19 p.m.
Ms. Dacy, Community Development Director, stated that this property
is located on the west side of Central Avenue, north of Moore Lake
beach. She stated that the property has two single family homes
on the parcel and is described as one lot. She stated that
Mrs. Lorraine Nelson owns the property.
Ms. Dacy stated that the proposed request is to replat the parcel
into two lots around each of the existing structures on the
property. She stated that an existing dirt driveway now services
the two existing dwellings.
Ms. Dacy stated that the area has been identified by the City for
long term expansion of Moore Lake beach. She stated that in 1989
and 1990, the City sent a letter to the property owners in this
area trying to determine if they were interested in selling the
property and whether they would be willing to enter into an option
agreement where the City would have the right to buy the property
on a first come basis.
Ms. Dacy stated that the Planning Commission recommended approval
of this proposed plat subject to three stipulations which she
outlined. She stated that the petitioner has submitted a drawing
of the proposed addition which was viewed by the Council. She
stated that all setback requirements would be met.
Councilman Schneider stated that he noted the petitioner has a
different address, and he asked if the petitioner intended to
purchase this home and then expand it.
Mr. Lenart, the petitioner, stated that he has been living in the
home since December and would be purchasing the property, if this
plat is approved. He stated that he agrees with all the
stipulations.
Councilman Schneider asked the value of the home.

Ms. Dacy stated that the total property is valued at $69, 000, but
she did not know what portion of this value is for the dwellings
and what portion is for the lots.
Councilman Schneider asked the approximate cost of the addition.
Mr. Lenart stated that he is proposing a 30 by 30 foot addition at
a cost of about $10, 000. He stated that he would be doing the work
himself.
Ms. Dacy stated that with the addition, the home would be in excess
of the code requirement.
Councilman Schneider stated that close to fifty percent of the
value would be added with the expansion. He asked if the entire
home had to be brought up to code.
Mr. Herrick, City Attorney, stated that he would need additional
information from the owners and staff to answer the question.
Councilman Billings asked if it was the Planning Commission's
intent, when they requested a hard surface driveway be provided,
that the driveway to the east lot also be brought up to code. He
stated that, in any case, this has been the City's past practice.
Mr. Lenart stated that he is the sole benefactor of all this
property and the homes. He stated that he does not intend to
remain in Fridley all his life.
Councilman Schneider questioned if the City may be better off
discussing any potential acquisition at this time.
Councilman Schneider felt that there are a number of items
regarding the building code issue, hard surface driveways, and
potential acquisition which should be discussed further.
No other persons in the audience spoke regarding this proposed
plat.
MOTION by Councilman Schneider to close the public hearing.
Seconded by Councilwoman Jorgenson. Upon a voice vote, all voting
aye, Mayor Nee declared the motion carried unanimously.

Ms. Dacy, Community Dev lopment Director, stated that this item is
before the Council as tipulation No. 14 of this Special Use Permit
which required Counci review at the first Council meeting in July.
She stated that this permit was issued to allow a repair garage at

Agreement between e City and Samir Awaijane and Mike Thompson at
the same time. e stated that there are four partners in this
corporation, and three of the four are here this evening.
Ms. Dacy stated that a deadline of June 1, 1992 was established for
the building nd electrical code improvements, screening of the
outdoor stora e area including an eight foot wood fence, paving the
parking lot, as well as striping, concrete curb, and landscaping.
She stated that only three items have been completed in the
easterly b lding on the property. She stated that the other items
need to be addressed.
Ms. Dacy stated that Mr. Awaijane stated the fence would be
complet as soon as possible in conjunction with the paving. She
stated hat the parking lot is under construction and must be
stripe and landscaped. She stated that the Police Department has
condu ed two inspections, and there were several vehicles and
parts that did not have a corresponding invoice and Mr. Awaijane
subm' tted the invoices within a week. She stated that the Police

Ms. Dacy stated that staff is recommending approval of the rezoning
regardless of the outcome of the Wal-Mart development oposal.
She stated it is believed that C-2 zoning is more comp ible with
the adjacent Springbrook Nature Center. She stat d that the
Planning Commission has also recommended approval of is rezoning.
No persons in the audience spoke regarding this roposed rezoning
request.

LAKE BEACH PARK•
Mr. Burns, City Manager, stated that the City has for some time
been considering expansion of Moore Lake Beach Park. He stated
that the City acquired the Pierce property and sent letters to
other property owners requesting right of first refusal. He stated
that it is requested the Council consider adoption of this
resolution expressing their intent to expand Moore Lake Beach Park.
Councilwoman Jorgenson asked if the Pierce property was purchased
by the Housing and Redevelopment Authority or by the City.
Mr. Burns stated that it was purchased by the City.
Councilwoman Jorgenson stated that there is an area there that has
to be cleaned. She also asked if residents were notified of this
resolution and if the City is required to do so.

required to notify the residents.
Councilman Billings stated that this resolution identifies the

Mr. Burns, City Manager, stated that it is recommended th Council
acquire the .property at 6070 Central Avenue N.E. rough the
eminent domain process.
MOTION by Mayor Nee to adopt Resolution No. 56- 2. Seconded by
Councilman Billings.
Councilman Fitzpatrick stated that, in s mind, an immediate
public need cannot be demonstrated for is property. He stated
that he finds it difficult to take wner-occupied residential
property by eminent domain when the ity can collect taxes on the
parcel.
Councilwoman Jorgenson state that she is in agreement with
Councilman Fitzpatrick's com nts. She stated that there are three
properties to the south a two properties to the north of this
parcel, so you would ha e an island of land with no plans for
extension of the park. She stated that she could see no public
purpose for obtaining he property at this time.
Mayor Pro Tem Sch ider asked if the property was non-homesteaded.
Mr. Burns state that the property was not homesteaded.
Councilman B' lings stated that the property is kind of quasi-owner
occupied a an expanded family unit. He stated that he requested
informat' n from staff relative to the taxes on this parcel. He
stated at he did not consider the fact that it currently is non-
home eaded and, with that in mind, the current taxes are about

in order to minimize the amount of expense to the 'tizens of
Fridley. He stated that when this property owner plied for a
replatting and staff made the presentation at the blic hearing,
the petitioner indicated that he was going to bu he property and

inherit the property and was not going to li there for the rest
of his life. He stated that the conv sations he had with
Mrs. Nelson on the telephone and implicat'on was that were made is
that the City is trying to throw peop out of their homes that
they have been living in for all the' lives and want to live in
for the rest of their lives. He s ted that is not the case.
MOTION by Councilwoman Jorgenso to call the question and end the

Mayor Nee stated that he felt Mr. Lenart should be reimbursed the �
costs of surveying and platting.
Mr. Herrick, City Attorney, stated that the condemnation
commissioners can take that into consideration.
Councilman Billings verified the Code requirements for lot frontage
in order for a lot to be conforming. He stated that lots with this
same type of configuration have not been approved by the Council
in the past and by and large is not eneouraged by the City. ,
Councilman Billings stated that there have been situations where
there are two homes on a lot and, historically, it has been the
intent to remove those kinds of situations. He stated that from
his perspective, a lot split of this nature is not necessarily in

the best interests of the City or the homes in the immediate
neighborhood. He stated that he personally is not able to support
this replatting.
Mrs. Nelson, 6080 Central Avenue N.E. , stated that this situation
is not much different than the homes in Heather Hills.
Councilman Schneider stated that all those homes front directly on
the street.
Mr. Herrick stated that the Council can either vote on the
replatting or table this item on the basis that they have directed
the acquisition of this property. He stated that when it comes to
the point of determining the value, the commissioners will look on
this as two buildings on one lot with the possibility there might
have been a lot split.
MOTION by Mayor Nee to table this item, based on the adoption of
Resolution No. 56-1992 to acquire this property through eminent
domain. Seconded by Councilman Fitzpatrick. Upon a voice vote,
Mayor Nee and Mayor Pro Tem Schneider voted in favor of the motion.

Ms. Dacy, Community Development Director, stated that this is a
variance to reduce the front yard setback from 35 feet to 8. 2 feet
and to reduce the side yard setback from 10 feet to 9. 8 feet in
order to allow the reconstruction of a non-conforming structure
damaged more than fifty percent of its value due to a fire. She
stated that this structure was damaged by a fire in August, and the
Chief Building Official has verified that over fifty percent of the
value of the structure was destroyed in the fire.
Ms. Dacy stated that staff and the Appeals Commission recommend
denial of the variance request, but it should be noted that there
is a creek that meanders through the rear portion of the property
and moving the house back may impact the edge of that creek. She
stated that some type of front yard variance would be necessary,
but since over fifty percent of the value was destroyed, this may
be the opportune time to reconstruct the home within the existing
code.
Ms. Dacy reviewed some of the setbacks of other homes in the area,
and some homes have only five feet to�ten feet front yard setbacks.
Mr. Blegen, the p�titioner, stated that all he wanted to do was to
build on the same footings. He stated that if he has to remove the
existing foundation, it would cost $15, 000 . He stated that he is
living in an apartment at the present time and would like to get
started on rebuilding.
Councilman Schneider stated that he has contacted the Ward Council-
member, Ed Fitzpatrick. He has indicated he supports this front
yard vari-ance.
Ms. Sporre, 295 Ironton Street, stated that she lives next door to
this property, and the neighborhood is in favor of the variance.
She s�ated that if Mr. Blegen were to move the home back, it would
impact on the beautiful oak trees on the property. She stated that
there are other homes with these setbacks, and they would like to
keep the integrity of the neighborhood.

Ms. Sporre stated that there is a long history to the boulevards
on this street. She stated that both boulevards or easements are
on one side of the street which was a compromise reached when
residents stated that they would sue the City.
Mayor Nee stated that the south boulevard was moved to the north
side and the lot line moved north to include two boulevards.
Councilwoman Jorgenson stated that she cannot foresee the street
being widened, and she could not know what future councils might
do.
Ms. ,Sporre felt that if I�4r. Blegen had to maintain a 35 foot
setback and build to the rear of the property, there might also be
problems with flooding. She stated that water backs up now in the
creek with water coming from the housing project in Coon Rapids.
MOTION by Councilman Schneider to grant Variance Request,
VAR #93-22 , to reduce the front yard setback from 35 feet to
8 . 2 feet and to reduce the side yard setback from 10 feet to
9 . 8 feet at 275 Ironton Street because the adjacent homes on each
side are approximately at the same setback or less, as well as the
potential for flooding and past history of the drainage. Seconded

stated that as part of the condemnation proceedings, a relocation
consultant must be hired to determine appropriate relocation
benefits for the tenants.
Ms. Dacy stated it is recommended that Kirk Schnitker of
Professional Redevelopment Resources be hired to determine the
relocation benefits.
Mr. Herrick, City Attorney, stated that the City is not indicating
the tenants must move; however, he understands this particular
property owner wishes to move and purchase another home.

Mr. Lindstrom stated that he could not say the expansion would not
add additional traffic. He stated that he can understand the
residents ' concern; however, six years ago this bui�ding was an
eyesore for the neighborhood. He stated that if .they moved the
expansion closer to the road, a variance would no� be necessary.
Mr. Dan Super, 200 Liberty Street, questioned �the location of the
parking lot and asked if trucks would no longer be lined up on
Ashton Avenue.
Mr. Lindstrom stated that he could not s� if the trucks would be
on Ashton Avenue, but this expansion wou, d help the situation.
Mr. Super felt that an alternative crqssing to get the trucks in
and out of that area without going ttirough the residential area
should be considered. �

Mayor Nee stated that if the road t'o the east across the railroad
tracks is opened to Ashton Avenue, ;there may be more truck traffic.

Mr. Super stated that there are a�lot of commercial vehicles in the
area, and the children. catch the�school bus at 79th Way and Ashton
Avenue. Traffic has definitel increased.
Mr. Flora, Public, Works Dir ctor, stated. that the only way to
obtain support from the rail oad for a crossing is to construct a
bridge.
Councilwoman Jorgenson as ed if an additional right-of-way would
be needed if a bridge wa constructed.

Mr. Flora stated that there is not sufficient right-of-way on
81st Avenue west at Hi kory Street for a full width street.
Mr. Herrick, City At orney, stated that in the past, the City got
nowhere in trying tq obtain cr.ossings. He felt that it would� be
even harder now tq' try to obtain a crossing, and it would be
questionable if it%would be worth the effort.
Mr. Super asked if the City could monitor the traf f ic on Ashton
Avenue as to co mercial traffic in the area .

WHEREAS, the Planning Commission held a public hearing on the Plat,
P.S. #92-04, on May 13, 1992, and recommended approval; and
WHEREAS, the City Council also conducted a public hearing on the
proposed Plat at their July 6, 1992 City Council meeting and
approved the Plat at their meeting; and
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City
of Fridley hereby approves the Plat, P.S. #92-04, Gary Lenart
Addition, with the stipulations attached as Exhibit A, and

AGREEMENT
This agreement, entered into as the 13th day of September, 1993 by
the City of Fridley (hereinafter referred to as Contractor) , and
Professional Redevelopment Resources, Inc. (hereinafter referred
to as Consultant) .
WITNESSETH
WHEREAS, the Contractor desires the provision of certain technical
assistance and other services pursuant to the terms of Minnesota
Statutes, Section 117. 50 et. seq. , and/or the Uniform Relocation
and Real Properties Acquisition Policies Act of 1970, whichever is
applicable, in connection with the implementation of the Moore Lake
Beach project as heretofore adopted by the Contractor, and

assistance and services to provide for relocation assistance, in

WHEREAS, the Contractor proposes to acquire certain real property
and desires that the Consultant furnish the Contractor certain
services with respect to such property, and the consultant
represents that the consultant is fully qualified to perform such
services and will furnish such services personally.
NOW, THEREFORE, in consideration of the mutual covenants and
promises contained herein, the parties agree as follows:
Consultant agrees to provide services set forth below under Section
I entitled "Residential Relocation Service (Scope of Services) " and
the Contractor agrees to pay for such services in the amount and
manner set forth below under Section II entitled "Compensation",
and Section III entitled "Method of Payment of Fees" .
SECTION I: Residential Relocation Services (Scope of Services�
A. The Consultant will distribute an information booklet on the
residential relocation assistance and all appropriate forms
and data to each residential occupant expected to be
displaced. Tn� Consultant will:
l. Obtain a signed receipt for the informational statement
provided by the Contractor in accordance with the
applicable regulations.
2 . Explain the residential relocation program and the
displacee 's responsibility to receive benefits.
3 . Explain how to receive various kinds of assistance in
finding new locations.
4 . Explain the residential relocation needs and prepare
Family Record Card.
5. Provide Notices of Displacement within 30 days after
initiation of negotiations.

6. Analyze existing data to determine eligibility of the
displacee's relocation expenses for compensation.
7. Interview residential displacee to determine housing
needs.
8. Identify and determine the cost of comparable replacement
housing.
9. Provide referrals to replacement housing units.
10. Provide other social services, on an as-needed basis.
11. As�ist the di�placeP in �ietermir�ing the more ad�rant�geous
payment alternative to claim for moving expenses and
prcvide further instructions on how to proceed.
12 . Issue 90 day notice as necessitated after referral to
replacement housing is made.
13 . Determine if selected replacement location is decent,
safe, and sanitary.
14 . Assist eligible residential occupant in preparation of
claim for Replacement Housing Payment for 180 day
homeowners.
15. Assist eligible residential occupant in preparation of
claim for Rental Assistance Payment and/or pown Payment
Assistance for 90 day occupants.
16. Assemble the appropriate claim forms and documentation
for signature and submission for approval.
17. Transmit to the Contractor the final claim for its
action. The claim will include the amount of payment to
be made and any special considerations.
B. The Consu�tant does not assume ths respor.sibility fQr:
* Preparation of Status Reports
* Housing of Last Resort Services
* Accounting and Record Keeping (except as related to
specific claim)
* Payment for direct loss appraisals, property analyses,
and moving cost estimates and/or bids
SECTION II : COMPENSATION
The Consultant shall provide all necessary tenant relocation
services involving the two subject rental properties. The total
that shall be charged for subject services shall be $845. 00 for
each relocation for a total not to exceed $1, 690. 00.

SECTION III: METHOD OF PAYMENT OF FEES
Monthly requisitions may be made subject to receipt of a statement
from the Consultant specifying that it has performed the work in
conformance with the Contract and that it is entitled to receive
the amount requisitioned under the terms of the Contract. The
Contractor will make payment on such invoices upon receipt,
provided, however, that payment shall not be made for any
incomplete, inaccurate, or defective work until same is remedied
by Consultant without additional cost to the Contractor.
SECTION IV: LIABILITIES
A. The City agrPes to hold the consu�tant ha.rmless from any and
all claims or causes of action arising from the City's
pArformance of �his agre�ment.
B. The Consultant agrees to hold the City, its agents and
employees harmless from any and all claims or causes of action
arising from the performance of the services identified as the
Consultant's responsibility in this agreement including but
not limited to consultant error and services that consultant
completes for the City as a result of any changes made in the
contracted services as allowed by Section VII of this
agreement. This clause shall not be construed to limit any
legal remedies the City may pursue in the event that the
consultant fails to fulfill the Consultant's obligations
pursuant to this agreement.
SECTION V: PROPERTY COVERED UNDER THIS AGREEMENT
6070 Central Avenue N.E. and 6074 Central Avenue N.E. , both in
Fridley, Minnesota. These are tenant occupied properties.
SECTION VI: CONTRACT PERIOD
The Consultant shall commence performance of this contract upon
Notice to Proceed by the City Manager or upon execution of this
Contract and shall complete performance of this contract no later
than sixty (60) days after the last occupant of real property has
vacated the project area and all appropriate documentation has been
provided by the displacee to the Consultant.
SECTION VII: CHANGES IN CONTRACT
The Contractor or the Consultant may request changes in the scope
of the services to be provided. Such changes, including any
increase or decrease in compensation, which are mutually agreed
upon by and between the Contractor and the Consultant shall be
incorporated in written amendment to this Contract.
SECTION VIII: ADDITIONAL CONSIDERATION
A. Interest to Certain Federal Officials
No member of or delegate to the Congress of the United States,

and no other Federal Official, shall be admitted to any share
or part of this Contract or to any benefit from this Contract.
B. Covenant Against Contingent Fees
The Consultant warrants that it has not employed or retained
any company or persons other than bonafide employees or
technical subcontractors working solely for the Consultant,
to solicit or secure this Contract, and that it has not paid
or agreed to pay any company or person other than a bonafide
employee or technical subcontractor working solely for the
Consultant, any fee, commission, percentage, brokerage fee,
gift, or any other consideration, contingent upon or resulting
from the award or maki.ng of this Gontract, For breach or
violation of this warranty, the Contractor shall have the
right to annul this Contrac� without liability.
C. Termination of Contract
The Contractor or the Consultant may terminate this Contract
or renegotiate this Contract upon thirty (30) days written
notice. In the event of termination, all property and
finished or unfinished documents, data, studies, and reports
purchased or prepared by the consultant under this Contract
shall be disposed of according to the Contractor directives
and the Consultant shall be entitled to compensation for any
unreimbursed expenses reasonably and necessarily incurred in
satisfactory performance of this Contract.
D. Extent of Contract
This Contract represents the entire and integrated agreement
between the Consultant and Contractor and supersedes all prior
negotiations, representations, or agreements, either written
or oral. This contract may be amended only by written
instrument signed by both Consultant and Contractor.
E. Personnel
The Consultant represents that it has or will secure all
personnel required in performing the services under this
Contract as provided above. All of the services herein will
be performed by the Consultant or under its supervision, and
all personnel engaged in the work shall be fully qualified and
shall be authorized under State and local law to perform such
services.
F. Non-Discrimination
The Consultant will not discriminate against any employee, or
applicant for employment because of race, creed, color, sex,
national origin, religion, marital status, disability, status
in regard to public assistance, or age. The Consultant will
take affirmative action to ensure that applicants are
employed, and that employees are treated during their
employment, without regard to race, creed, color, sex,

national origin, religion, marital status, disability, status
in regard to public assistance, or age. Such action shall
include, but not be limited to, the following: employment,
upgrading, demotion, or transfer; recruitment advertising,
layoff, or termination; rates of pay or other forms of
compensation; and selection for training, including
apprenticeship. The Consultant agrees to post in conspicuous
places, available to employees and applicants for employment,
notices to be provided by the State setting forth the
provisions of this nondiscrimination clause. In addition, the
Consultant will in all solicitations and advertisements placed
by or on behalf of the Consultant, state that all qualified
applicants will receive consideration for employment without
regard to race, creed, color; sex, national origin, religion,
marital status, disability, status in regard to public
assistance, or age.
G. Assignment
The Consultant shall neither assign nor transfer any rights
or obligations under this Agreement without prior written
consent of the City.
H. Special Administrative Provisions
All records pertaining to this Agreement shall be maintained
by the Consultant for a period of at least three (3) years
after the creation of such records.
