Petitioner is seeking a special use permit to allow the construction of a 900 square foot
second accessory building.
ANALYSIS
The property is located on the corner of 7t" Street and 59`h Avenue. The lot is
rectangularly shaped, with the home being "squared up" to and fronting on 7`" Street.
The existing home and attached garage were built in 1958.
Accessory structures over 240 square feet are a permitted special use in the R-1 zoning
district. The existing one-stall garage and the proposed accessory structure are a total
of 1,197 square feet, which is 203 square feet less than the total allowed by Code.
There is also a small shed located in the rear yard of the property that will be removed if
this special use permit is granted.
The petitioner is also seeking a variance to reduce the required sideyard setback, for
the accessory building that would open to the side street, from 25' to 17.9' to construct
a detached garage. The proposed garage location would not encroach closer to the lot
lines than the existing home already does and would allow the petitioner to save one
rather large tree, that would be removed if garage were setback to meet code
requirements. This request went to the Appeals Commission on March 28, 2001 and
was unanimously approved. City staff has received no comments from neighboring
property owners.

foot detached garage at 5900 7th Street N.E. On March 28, 2001, the Appeals Commission
granted a variance to reduce the setback of the garage from 25 feet to 17.8 feet. City Code
requires a special use permit to allow a second accessory structure of over 240 square feet.
Code requires the total square footage of accessory structures not exceed 1,400 square feet.
The total square footage of all existing and proposed structure on this site is 1,190 square feet.
The new garage would have the same setback as the home and be located in the rear yard of
the lot. The tree closest to the street would be removed for the proposed garage, but the tree
behind that would be saved due to the variance granted. Staff recommends approval with
stipulations.
Ms. Savage asked if staff had received any calls regarding this request.
Ms. Bulthuis stated they did not.

Mr. Robert Hughes, Timothy Hughes' (petitioner) father, stated that he was present on behalf of
Timothy due to an out of town trip.
Ms. Savage asked if he had anything to add.
Mr. Hughes stated that there is plenty of room on the lot for this plan.
Ms. Savage asked if there was any opposition to the stipulations.
Mr. Hughes stated that his son, Timothy, asked all the neighbors if they had any problems with
this, and nobody did. He doubted that Timothy had any problems with the stipulations.
Mr. Kondrick asked if he was aware of the stipulations.
Mr. Hughes stated he believed he was.

reviewing land use planning applications. Until now, she has been the Planner/Code
Enforcement Officer.

INTRODUCTION
Timothy & Angela Hughes, property owners at 5900 7`h Street NE, are seeking a
special use permit to allow the construction of a s�cond accessory structure over
240 square feet in size.
Accessory buildings over 240 square feet are a perrnitted special u�e. The existing
attached garage and the proposed detached garage are a total of 1,197 square
feet, which is 203 square feet less than the total allowed by Code. The location of
this detached garage is well suited for this site and a variance has been obtained to
allow the garage to be setback 17.6 feet from the side yard property line.
PLANNING COMMISSION ACTION
At the April 4, 2001, Planning Commission meeting, a public hearing was held for
SP #01-02. After a brief discussion, the Planning Commission endorsed staff's
recommendation for approval.
A motion was made to recommend approval of special use permit, SP #01-02, with
stipulations as presented in the staff report.

Association in 1995. This is an organization of 21 cities dedicated to supporting the
common intere s of the northern suburbs and the City of Minneapolis. It focuses largely
on transportatio issues. The cost to belong to the organization in 2001 will be $8,713.

Mr. Hervin stated that the ihird case was for James and Nancy Jorgenson for a sing family
home on Polk Street. The complaint was that the home was near a TIF District also near
some freeways, which caused constant noise. In the process of researching thi matter, sales
were found that were influenced by a busy street with noise by TIF Districts. o reduction in
value was found. He stated that the Jorgenson house was valued at $157,000 or a selling price.
The City has valued it at $140,000. Staff is recommending no change to e assessment. The
City was approximately 15 percent low on all the properties according o what the properties
actually sold for. He said the City has very conservative values.
Councilmember Billings asked if they had heard from Ms. Jorgen n.
Mr. Hervin stated that he let her know that he was going to re ommend no change.
Councilmember Billings stated that Mr. and Mrs. Jorge on looked at similar property to theirs,
and it was priced quite a bit higher than what her ome was appraised for. Her home was
relatively close to busy streets. An analysis was one with homes on busy streets and Mr.
Hervin's estimated market value was only 85% o the selling price. He said there is no choice
other than to affirm the assessor's value or rai the value. He asked what the procedures for
increasing the value would be?
Mr. Hervin stated that the value can be ra' ed if they chose to do so.
Councilmember Billings asked if ther were notification requirements to raise the value.
Mr. Hervin stated that it was not n cessary.
Councilmember Billings state that they have to inform the property owner that the City is
looking at raising the value o the property.
Mr. Hervin stated that it is ossible but he is not aware of that.
Councilmember Billin asked if the County could carefully review the information if the value
is raised and take wh ever action is appropriate.
The County Asses r stated that the County will notify the taxpayer of any change.

Mr. Burns, City Manager, stated the petitioners wish to build a second accessory structure
that is over 240 square feet. It will be used as a detached garage and the location is well
suited for this site. The proposed size is in the requirements for cade �nd staff
recommends Council's approval.

3. APPROVE A JOINT� POWERS AGREEMENT BETWEEN THE CITY OF
FRIDLEY AND THE N TH METRO MAYORS ASSOCIATION:
Mr. Burns, City Manager, st ed that Fridley last belonged to the North Metro Mayors
Association in 1995. This is organization of 21 cities dedicated to supporting the
common interests of the northern burbs and the City of Minneapolis. It focuses largely
on transportation issues. The cost belong to the organization in 2001 will be $8,713.
Staff recommends Council's approval.
