The Special Use Permit process begins by filling out a SPECIAL USE PERMiT APPLICATION. This,
with a site plcm, cmd other appropriate drawings, must be submitted to the Plcmning stcdf. A fee is
associated with the application; $100 for second accessory building applications, $400 for all other
applications. Fees cu�e non-refundable.
Once the application is received, the application is reviewed by stc�f from the Plcmning,
Engineering,Assessing, Fire, cmd Police Depcfftments. The impcicts to adjacent properties cse
discussed, cmd stipulations cu�e developed. Simultaneously, a madling list of all properties within a
350 foot radius of the property is generated. Plotices �f the request cu�e sent to these property
owners. There is approximately four weeks between the application due date and the Planning
Commission meeting.
Prior to the meeting of the Plcmning Commission, a stc�f report is written, cmd the petitioner called
regaa�dinq the stc�f recommendation.
The Plcmning Commission is made up of seven residents of the community. The meetings cse held
the first cmd third Wednesdays of the month czt 7:30 pm in the Council Chcnnbers in th�Municipal
Center. The Plcmning Commission is cm advisory commission to the City Council. It is the
responsibility of the Plcmning Commission to conduct a public hecu�ing, gather testimony�d rn�ke
a recommendation to the City Council regc�ding all special use permit requests.

Vacation of Dover Street to the Certificate of Title, of the property generally located at
591 Dover Street.
Enclosed is the current legal description of 591 Dover Street, accessed from the Anoka
County Tax System, which reflects the correct change of the Vacation of Dover Street in
the legal description.
Enclosed is the documentation needed to support the requested change of the
Certificate of Title.
The same letter and attachments were sent to Anoka County Torrens Property Taxation
and Records. The Torrens Department currently has a copy of the certified resolution. I

REQUEST
The petitioner, Timothy Miller is seeking a special use permit to allow the construction of an
840 square foot second accessory building at his residence at 591 Dover Street. The
proposed building will be used for vehicle parking.
ANALYSIS
The property is addressed off of Dover Street, however, it is accessed from Broad Avenue.
The dimensions of the lot are 110 ft. by 135 ft. and it's a rectangular shape. The existing
home was built prior to 1949, the existing garage was built in 1963, and there was a
building permit issued in 1998 to construct a basement and to add a foyer to the home.

Existing home and the existing garage is located on the east side of the home
Accessory structures over 240 square feet are a permitted special use in the R-1 zoning
district. The existing garage is 534 square feet and the proposed accessory structure is
840 square feet. The existing garage, plus the proposed accessory structure are a total of
1,374 square feet, which is 26 square feet less than the total allowed by Code.
The proposed garage will be setback approximately 58 feet from the front yard property
line. The proposed garage meets all other setback and lot coverage requirements. City
staff hasn't received any comments from neighboring property owners.

Ms. Stromberg stated that the petitioner is requesting a special use permit to allow the
construction of an 840 square foot garage. Section 205 requires a special use permit to allow
accessory buildings other than the first accessory building over 240 square feet and requires the
total square footage of accessory structures not to exceed 1,400 square feet. The total square
footage of the existing garage and the proposed accessory structure is 1,374 square feet. The
proposed structure would be located 58 feet back from the property line. Staff recommends
approval with the following stipulations as this is a permitted special use in the zoning district:
1. The petitioner shall obtain all necessary building permits prior to construction.
2. The structure shall not be used for a home occupation or living area.
3. All vehicles shall be stored on a hard surface as approved by the City.
4. Total square footage of all accessory structures must not exceed 1,400 square feet.

built by her husband and is not attached to the garage. It does ot bother her to take it down.
They will remove everything out from the storage area into th new garage and have the
storage structure dismantled then. Siteworks Design will be uilding the foundation. It should
take about three weeks to build the accessory structure.
Ms. Marlene Knight, 513 Rice Creek Terrace, stated th she has safety concerns and did return
the phone call about the covenant to Ms. Stromberg ce. She then talked to Mr. Bolin. This is
a very short street at about 1/2 block. People race a und these corners all the time. The
neighbors are looking at a 3+ car garage here and e potential for abuse by future owners is a
concern with extended family having more cars pr ducing more traffic. The neighborhood has
all attached garages and this would not fit in.
Ms. Savage stated that the special use permit equest meets the requirements that accessory
buildings cannot exceed 1,400 square feet.
Ms. Knight stated that she understands th t and is only bringing up various safety issues and
other things that come along with having uch a fairly short street.
Ms. Savage stated she is very familiar ith this street as she drives there twice a day. She has
never experienced cars zipping arou fast. She has lived near there for 15 years.
Ms. Knight stated cars go too fast I the time, go up on people's yards, and everything else.
She has lived there for over 30 ye rs.
Mr. Lloyd Nietling, 506 Rice Cre k Terrace, stated that he jogs the area. Many people's
garages are filled with treasur . He is a pat rack and has lots of treasures. They have no plan
to use this as a garage. The rst thing that will go into this structure will probably be the ping
pong table, saw, and other tr asures. He does not think that three car garages attached to the
house look very good. The e are many houses with two car garages with two vehicles sitting
out in the driveway, and h does not think that looks very good. They want to increase the
value of the property and eep the location looking nice.

does not have ny problem with this at all.
Ms. Johns st ed that there does not seem to be any problem with this request. If the home
was ever sol , there might be a problem with many cars in the driveway and garage.
Ms. Savag stated she does not have any problem with this request.

drainage concerns.
Mr. Timothy Miller, petitioner, stated that he does not have any objections to the stipulations.

Mr. Saba asked if there were any problems with drainage or flooding.
Mr. Miller stated he is on the end of a dead end street, and it is all downhill from there. The
water flows away from the property.
Ms. Sue Paenter, 541 Dover Street, stated she is Mr. Miller's neighbor. She wanted to show
support for Mr. Miller's project. She believed it is a good idea.

STORM WATER PUMP PROJECT:
Mr. Burns, City Manager, stated that on Febru 20, 2002, the City received one
proposal for installation of a thirty inch storm ter pump on 79�' Way. The bid was
submitted by Ray Anderson of General Repair ' the amount of$86,220. The bid is for
the installation of pump controls which will in ease pump capacity by about 250 percent
and greatly reduce the manpower needed to onitor pumping. It will also eliminate the
need to close Riverview Terrace and 79`h ay. Funding includes $30,400 from a DNR
grant and $44,750 from FEMA's Project pact program. This leaves $11,070 from the
City's Storm Water Fund. Staff recomm nded Council's approval.

The City will be resp nsible for the cost associated with sidewalk repair and adding
additional warning ar es. Staff recommended Council's approval.

Mr. Burn , City Manager, stated that this was a motion to�authorize the bidding. The
complet plans for the extension of 57`f' Avenue sewer main include construction of the
sewer ain from 7`h Street and University Avenue. Application was submitted to MSAS
and ot and staff was in the process of scheduling a neighborhood meeting in mid-
May Project cost had been budgeted as an HRA expense at $250,000. Staff
rec . mended Council's approval.

On July 1, 1991, the Fridley City Council officially approved your
request for a vacation, SAV #91-02, to vacate all that part of Van
Buren Street, now known as Dover Street in the plat of Riverview
Heights according to the plat thereof on file and of record in the
• office of the County Recorder in and for Anoka County, Minnesota,
lying Easterly of a line drawn from the Northwesterly corner of Lot
19, Block L to the Southwesterly corner of Lot 21, Block K and
lying Westerly of a line drawn from the Northeast corner of Lot 22,
Block L to the Southeast corner of Lot 18, Block K, all in the plat
of Riverview Heights.
Subject to an easement, for walkway purposes over the northerly ten
(10) feet of the snutherly twenty (20) feet of the portion o� Dover
Street to be vacated. 1
Subject to an easement for utility purposes over the Southerly
twenty (20) feet of the portion of Dover Street to be vacated.
Also reserving an easement to Minnegasco over the Westerly sixty

This request was approved with one stipulation:
1. The petitioners, Timothy and Donnett Miller, shall provide a
hardsurface driveway by August 1, 1992 .

On Monday, April 22, 2002, the Fridley City Council officially approved your request for a Special
Use Permit, SP #02-05, to allow the construction of an 840 square foot accessory building, legally
described as Lot 18-21, Block K, generally located at 591 Dover Street NE.
Approval of this special use permit is contingent upon the following stipulations:
1. Petitioner shall obtain all necessary permits prior to construction.
2. The structure shall not be used for a home occupation or living area.
3. All vehicles shall be stored on a hard surface as approved by the City.
4. Total square footage of all accessory structures must not exceed 1,400 square feet.
5. Garage shall be architecturally compatible with existing home and finished with a
complementary siding and color scheme.
You have one year from the date of City Council action to initiate construction. If you cannot
begin construction in time, you must submit a letter requesting an extension at least three
weeks prior to the expiration date.
