The City of Fridley Planning Commission will be holding an informal
hearing on a request for a lot split, L.S. #89-02 , by Susan and
Todd Novitsky, and Woodrow and DeeLores Lubanski, to alter the
existing side lot line between Lot 5, Block 3, Shorewood Addition
and Lot 6, Block 3, Shorewood Addition, in order for Lot 5 to
obtain 20 feet of rear property and for Lot 6 to obtain 20 feet of
front property, the same being 6211 and 6201 Carol Drive N.E.
Anyone who wishes to be heard shall be given an opportunity at the
Planning Commission meeting on Wednesday, April 5, 1989 at the

Ms. Dacy stated it had. In fact, the lot is almost twice the size
as the lots to the northeast of the property.
Mr. Betzold asked Mr. Nyberg if he had any pro ems with the
stipulations as presented by staff.
Mr. Nyberg stated he did not have any oblems with the
stipulations. He stated he realizes he wil need some fill in
order to hook up with city sewer.
Mr. Betzold asked if Mr. Nyberg would be le to save some of the
trees on the lot.
Mr. Nyberg stated he plans to put the dr veway where the tall stand
of trees is on the east side. Ther are about 30 trees along
there. He does not need a double wi h driveway so he might take
down two trees. He wants to save a many trees as possible.
Ms. Sherek stated she thought the ity's concern is traffic safety
and so more trees might have to e removed for proper visibility.

To alter the existing side lot line between Lot 5, Block 3 ,
Shorewood Addition, and Lot 6, Block 3, Shorewood Addition,
in order for Lot 5 to obtain 20 feet of rear property and for
Lot 6 to obtain 20 feet of front property, the same being 6211
and 6201 Carol Drive N.E.
Ms. Dacy stated these properties are zoned R-1, single family. The
petitioners are proposing what can be called a "land swap" of about
a 20 foot wide triangle at the base of the triangle.
Ms. Dacy stated staff has no problems with this lot split request
and recommends approval with one stipulation: The owners of Lot
5 and Lot 6 shall combine the proposed parcels with the current
legal descriptions.
Mr. Betzold asked if there were any tax consequences for either
property owner.
Ms. Dacy stated she did not know. She could check on this with the
City Assessors' office. She would think that they would look at
the property in terms of an improvement to the property and the
condition of the house, and the fact that it is such a small land
area being added.
Mr. Betzold asked why the petitioners were requesting this "land
swap" .
Mr. Todd Novitsky stated he had purchased 6211 Carol Drive from the
one time owner of that property. The owner, Ms. Lubanski, is the
fourth owner of 6201 Carol Drive. Through a verbal agreement with
previous owners of the properties, a fence was put up between the
two properties in the location where they are proposing the "land
swap" . He stated he is selling his property and wants to clear up
the matter of the lot lines. The new buyers also want the matter
settled before they move in.

3 . REVIEW EXECUTIVE SUMMARY OF SENIOR HOUSING STUDY:
Ms. Dacy stated the Commission members had received the "Senior
Housing Study for City of Fridley Executive Summary" and a cover
memo from herself dated March 30, 1989.
Ms. Dacy stated she met with the consultant this af ernoon to
discuss the survey results in more detail. She st ed at this
meeting she wanted to summarize a couple of points a review what
she thinks the Planning Commission should be looki g at in terms
of the study.
Ms. Dacy stated one of the major purposes of th study was to find
out how many low and moderate income seniors t ey have in Fridley.
The consultant sent out 1, 136 surveys. She tated the consultant
is confident that nearly all of the senior households age 65 and
older were surveyed. There was a 55� r sponse rate which is a
tremendous response rate and indicates high level of interest.
Ms. Dacy stated that as far as the br kdown of that total number,
it appears that the number of low i ome seniors, moderate income
seniors, and upper income seniors break out to about one-third
each. For example, 198 responde ts indicated an income of less
than $15, 000 (HUD cut-off fo low income) ; 177 respondents
indicated an income of $15 00-25, 000; and 186 respondents
indicated an income of $25,00 and greater.
Ms. Dacy stated the other p rpose of the study was to find out the
housing preference. The ajority of the respondents preferred a
one-story townhouse wi individual entrance (similar to "the
Cottages" approach tha was presented earlier this year) . When
sorted by income ver us housing preference, there was no clear
pattern for a housi preference.
Ms. Dacy stated s e had talked to Mr. Dahlberg, and he had asked
her to state hi opinions. She had not met with the consultant
when she talke to Mr. Dahlberg, so he was not aware of the more
recent inform tion. Mr. Dahlberg wanted to test the assumption

townhomes, �aybe the City should consider not assisting those types
of project�s that are going to attract the wealthier seniors. She
stated tt�e consultant told her that assumption is not the case .

- 64 is stil`1 fairly large so that ten years from now, they are
still going to see the demand for senior housing. Staff has asked
the consultant to come back with an estimate of the demand in ten
years.
Ms. Dacy stated the implications for the Plannin Commission would
be in looking at the special use permit re ests for elderly
housing. There was a question about where s iors would like to
be located. Does a particular site meet wha was indicated in the
survey? Is the location of senior housing m eting what the seniors
wanted? Should they be actively looking t designating sites at
this time and providing a list of poten ial sites to interested
developers? She stated it is staff's f eling that they are going
to get more interest from senior housi g developers.
Mr. Barna stated he thought the Plann'ng Commission and City should
be looking at this in a little bit onger term. People in their
early 50 's now will be turning 62 65 just after the turn of the
century. This is a large number o people whose children no longer
go to Fridley schools, one or tw or nane might be living at home,
and they are probably have anot r 10-15 years in their home before
looking for a place to retire. They can use this study as a basis
for what to do now, but the probably should be looking at the
amount of available vacant p operty in a general overall plan and
see where they are going to be in 10-15 years.
Ms. Dacy stated originall when they started out, they were going
to survey the age group f 55-65. The consultant's recommendation
was not to do that, bec use it was their experience that they get
a very poor response r te from that age group because it is these
people's perception t at they are not going to be a senior for 10-
15 years and do not want to deal with it. So, staff and the
consultant, made th decision to focus on age 65 and older. She
stated Mr. Barna as certainly correct in his statements, and,
hopefully, with e ten year projection, they will be able to
answer this ques on.
Mr. Saba state he thought the reasons a lot of the wealthier
seniors prefer the one-story townhomes is because they do not live
in Minnesota uring the wintertime. A lot of seniors spend their
winters in w er climates. They want a home but not one that has
any upkeep.
Ms. Shere agreed. She stated that in the situation of her
parents, hey are specifically looking for a place that is not
apartmen like. They still want their own "home" but do not want
all the maintenance that goes along with a home.
Mr. Betzold asked what Ms. Dacy meant about lists of potential
sites for senior housing developers.

REQUEST
The property owners of 6201 and 6211 Carol Drive N.E. are
requesting a lot split approval to exchange 20 feet of property
along the common lot line. This land exchange was discussed by
previous land owners of these properties in 1960; however, a formal
lot split application was not submitted for City approval.
The owner of Lot 5, Todd and Susan Novitsky (6211 Carol Drive
N.E. ) , are selling the property and need to consummate the lot
split approval prior to closing.
ANALYSIS
The Shorewood Addition plat was recorded in 1955. Each lot
currently meets the zoning ordinance requirement for lot area and
lot width.
The current lot line is such that it runs in a diagonal fashion
from the northeast to southwest. The proposed lot line adjustment
would straighten the line, such that it would be in a more
north/south alignment.
The proposed lot line adjustment would swap 20 feet of property
between the two lots. The lot line adjustment would increase the
side yard setbacks between the two residences and the new lot line.
Because there is an approximately equal exchange of land area,
there is no adverse affect to the lot area of either property. Lot
5 will increase in lot width to 95 feet and the rear lot line
dimension for Lot 6 will increase to 156 feet.
The Assessor's office has recommended that each owner combine the
proposed parcels with the current lot descriptions.
RECOMMENDATION
Planning staff recommends the Planning Commission recommend
approval of L.S. #89-02 based on the survey dated received March
3 , 1989 and subject to the following stipulation:
1. The owners of Lot 5 and Lot 6 shall combine the proposed
parcels with the current legal descriptions.

some trees are encroaching on their neighboring property owner and
newspapers are dropped at his home after 9 p.m. on Sunday evenings.
Mr. Mayer stated the reason he is bringing this to the Co cil 's
attention is that these same things were occurring in the c unity
where he previously lived. He stated this tends to pr ress and
get worse and hoped somehow the City can be a little re visible
in its code enforcement.
Mr. Mayer stated he would like the City to provi some mailings
regarding code enforcement policies. He stated e has contacted
the Code Enforcement Officer only one time ince he moved to
Fridley, however, he could make many more cal now.
Mayor Nee stated this is an area the Counci has been discussing.
Councilwoman Jorgenson stated she spoke o a lady in Mr. Mayer's
area this morning regarding some of t e concerns Mr. Mayer is
addressing. She stated she has asked e City Manager to request
the Code Enforcement Officer to check he area and notify property
owners who are in violation of any des. Councilwoman Jorgenson
stated the Council has not had an o portunity to discuss the issue
this evening. She felt a system ic plan of code inspection may
have to be implemented.
Mr. Mayer stated he was glad t hear the Council is aware of these
issues and taking steps to co rect the situation. He stated this
means a lot to him as a Fri ey resident.

amendment of the o dinance regarding water conservation regulations
for the City. stated this amendment would make it easier for
the Council to espond more quickly to problems relating to water
conservation. Mr. Hunt stated this amendment would allow the
Council to es ablish, by resolution, water conservation regulations
which may b required, rather than by amendment of the ordinance
itself.

stipulations. She stated there was concern, pri to the meeting,
about the bikeway/walkway easement. Ms. Dacy ated, however, Mr.
Hansen of API has advised them that Glacie Park has signed the
plat and has no objection to the bikeway/ lkway easement.
Ms. Dacy stated the Planning Commissio recommended approval of the
plat with two stipulations attache to this resolution as Exhibit
A.
Councilman Fitzpatrick stat it should be mentioned there is a
problem in this area with e road sometimes under water and the
County came in too late ith a request for a wider easement than

Ms. Dacy, Planning Coordinator, stated this resolution author' es
the signing of this plat for Glacier Park Addition. She ated
this subdivision request for API Supply Company at 5110 Mai Street
was approved at the Council 's March 6, 1989, meeting ith two
stipulations. She stated there was concern, prior to e meeting,
about the bikeway/walkway easement. Ms. Dacy state however, Mr.
Hansen of API has advised them that Glacier Par has signed the
plat and has no objection to the bikeway/walkw easement.
Ms. Dacy stated the Planning Commission reco ended approval of the
plat with two stipulations attached to t ' s resolution as Exhibit
A.
Councilman Fitzpatrick stated it ould be mentioned there is a
problem in this area with the r d sometimes under water and the
County came in too late with request for a wider easement than
the ten feet provided in the lat.

property owners swapping a triangular piece of property. She
stated both lots meet the lot area and width requirements under the
new lot line arrangement.
Ms. Dacy stated the Planning Commission recommended approval of
this lot split subject to both property owners combining the legal
descriptions with the new triangular piece.

of the Planning Commission and grant this lot split by adoption of
Resolution No. 39-1989. Seconded by Councilman Billings. Upon a

5. CONSIDERATION OF CHANGE ORDER NO. 7 FOR THE FRIDLEY MUNICIPA
CENTER IMPROVEMENT PROJECT NO. 189:
Mr. Flora, Public Works Director, stated this change order co ists
of 20 Proposal Requests and Works Orders Nos. 1926 through 31 for
a total cost of $35,457. 16 involving plumbing changes, el ctrical,
extra stone and other miscellaneous items for the Munici al Center,
Fire Station and Parking Ramp. He stated this chan order also
includes a contract amendment to Brin Northwestern or $4 ,735. 00.
He stated these funds were included in the o iginal project
authorization as miscellaneous materials.
MOTION by Councilman Schneider to approve C nge Order No. 7 for
the Municipal Center Improvement Project N . 189 in the amount of
$35,457. 16, and a revised contract a ount of $3 , 614,515.59
Seconded by Councilwoman Jorgenson. Upo a voice vote, all voting
aye, Mayor Nee declared the motion ca ied unanimously.
6. CONSIDERATION OF RELEASING TH TAX FORFEIT PROPERTIES:
Mr. Flora, Public Works Director, stated there are three properties
in Fridley which recently wen tax forfeit. He stated one of the
properties is located on 63r Way and the other two parcels are on
the boundary between Coon apids and Fridley. He stated all of
these properties are u uildable. Mr. Flora stated staff is
recommending the Cou il authorize the sale of these three
properties to the ad ' ining property owners by the County.
MOTION by Council n Fitzpatrick to notify the County that the lots
are unbuildable nd the County should attempt to sell them to the
adjoining prop ty owners. Seconded by Councilman Schneider. Upon
a voice vote, all voting aye, Mayor Nee declared the motion carried
unanimousl .
