The City of Fridley Planning Commission will be holding an informal
hearing on a lot split, L.S. #92-02, by Myron and Lillian Ostlund,
to split the below referenced property into two separate parcels:
The East 83 feet, front and rear, of Lots 6 and 14,
Revised Auditor's Subdivision No. 10, Anoka County,
Minnesota, also the East 83 feet of Outlot A, Dennis
Addition, Anoka County, Minnesota, according to the
recorded plats thereof on file and of record in the

Ms. Dacy stated the minutes of the Council meeting will be reco ed
against the property, so any new property owner would se the
minutes in the title search and that should flag the hard urface
driveway requirement. �
Ms. Sherek stated that she did not think the s ipulation is
necessary; however, if they choose to have it r ain, maybe it
should state that if the structure is ever in nded for garage
purposes, that a hard surface driveway should e constructed.
Mr. Kondrick stated he did not think the s pulation is necessary

To split the above referenced property into two separate
parcels: The East 83 feet, front and rear, of Lots 6 and 14,
Revised Auditor's Subdivision No. 10, Anoka County, Minnesota,
also the East 83 feet of Outlot A, Dennis Addition, Anoka
County, Minnesota, according to the recorded plats thereof on
file and of record in the Office of the Register of Deeds,
Anoka County, Minnesota, generally located at 1400 - 66th
Avenue N.E.
Ms. McPherson stated this property is located east of Central ,
Avenue and west of the Fridley/New Brighton border. The property
is a double-fronted lot. The rear of the lot fronts on Creek Park
Lane. The property is zoned R-1, Single Family Dwelling, as are
all the adjacent properties.

Ms. McPherson stated the petitioner is proposing to subdivide the
existing single family lot into two parcels. There is a single
family dwelling unit with an attached two-car garage located on the
property addressed as 1400 - 66th Avenue N.E. The petitioner is
proposing to create a new lot, 83 feet by 120 feet. The lot split
will create two lots which meet the minimum requirements of the R-
1 zoning district regulations for lot width, lot size, and setbacks
for the existing dwelling unit. A variance was granted for the
living area to the rear of the garage on the existing dwelling unit
several years ago.
Ms. McPherson stated utilities were stubbed to the lot line for the
vacant lot when Creek Park Lane was constructed in 1984. There are
outstanding special assessments which will need to be paid at the
time the lot is sold or prior to the issuance of a building permit.
A park dedication fee of $750 will also need to be paid at the time
of issuance of a building permit.
Ms. McPherson stated that as .the lot split creates two lots which
meet the minimum requirements of the R-1 zoning district
regulations, staff recommends the Planning Commission recommend
approval of this request with one stipulation:
1. A park dedication fee of $750. 00 shall be paid at the
time of issuance of a building permit for the vacant lot.
Mr. Ostlund stated his property is located right next to the old
Rice Creek School property. When that was developed, it was
suggested that he split his property into two lots. Since he was
grandfathered in, he was not required to split his property at the
time and would only be required to pay the assessments when he did
split the property.
MOTION by Mr. Saba, seconded by Mr. Kuechle, to recommend to City

Request
The petitioner requests that a lot split be approved to split 1400
- 66th Avenue N.E. into two residential lots.
Site
Located on the property is a single family dwelling unit with an
attached two car garage. The property is zoned R-1, Single Family
Dwelling, and there is similar zoning to the north, south, east,
and west.
Analysis
The petitioner is proposing to subdivide the south 120 feet of the
subject property in order to create a second lot fronting on Creek
Park Lane N.E. The proposed lot split would create two single
family lots; one of 10, 001.5 square feet, which will be the new
lot, and one of 10,707 square feet, which will be for the existing
dwelling unit. The proposed lots meet the minimum requirements for
lot width, lot area, and setbacks for the existing dwelling unit
as required by the R-1, Single Family Dwelling district
regulations.
Utilities were stubbed to the lot line when Creek Park Lane was
constructed in 1984. There are outstanding special assessments of
$13,737. 37 which will need to be paid at the time the lot is sold
or prior to issuance of a building permit. A park dedication fee
of $750. 00 will also be required to be paid at the time of issuance
of a building permit for the vacant lot.
Recommendation
As the proposed lot split creates two lots which meet the minimum
requirements of the R-1, Single Family Dwelling district
regulations, staff recommends that the Planning Commission
recommend approval of the lot split request, L.S. #92-02, to the
City Council, with the following stipulation:
1. A park dedication fee of $750. 00 shall be paid at the time of

Ms. Dacy, Community Development Director, stated that this property
is located between 66th Avenue and Creek Park Lane, and the
petitioner is requesting the property be subdivided in equal
halves. She stated that the Planning Commission recommended
approval of this lot split with the stipulation that the park
dedication fees be paid. She stated that staff recommends adoption
of this resolution.
Councilman Schneider stated that there are some outstanding
assessments.
Ms. Dacy stated that she believed these were deferred until such
time as the lot was split.

AND RECIPIENTS OF 1992-1993 FEDERAL CO NITY DEVELOPMENT
BLOCK GRANT FUNDS FOR HUMAN SERVICES OR IZATIONS:
Mr. Barg, Planning Assistant, stated tha ixteen applications were
received for the Community Developme Block Grant funding. He
stated that this amounted to over 68, 000 in requests, and only
$31, 000 was available. He st ed that the Human Resources
Commission reviewed these applic ions and heard presentations from
these organizations.
Mr. Barg stated that the man Resources Commission, in reviewing
these applications, con idered the following criteria: (1) to try
and promote new and i ovative programs; (2) organizational need;
(3) community need: 4) program quality; and (5) budget. He stated
that the Planning ommission has concurred with the recommendation
of the Human Re ources Commission for this funding.
Mr. Barg st ed that the Human Resources Commission_ in making their
recommend ions were under the impression that if the mental health
agencies could not get funding from the City, the County would make
up tha funding on a dollar to dollar basis. He stated that Mr.
York, Director of Community Social Services and Mental Health for
the County, has advised the City that the County's mission is to

Mr. Kisch, the petitioner, he stated that if the re ning is
denied, he would have to look at some other use of the roperty.
Councilman Fitzpatrick stated that he also felt is is spot
rezoning in order to change a small portion of the arcel.
Councilman Schneider stated that he does not ne essarily have an
objection to the car wash, but rezoning opens t door to a lot of
other uses which the City would not want at thi location, and this
is the reason it is zoned C-1 and C-2 would a spot rezoning.
UPON A VOICE VOTE TAKEN ON THE ABOVE MOTI N, all voted aye, and
Mayor Nee declared the motion carried una imously.

Ms. Dacy, Communi Development Director, stated that this is a
request for a spe ial use permit to allow the construction of a 20
by 22 foot acce sory building for storage purposes. She stated
that the Planni g Commission re�ommended approval of this request
with two stipu ations which she outlined.
Mr. Bargy s ted that he would use this building to store items
such as a c noe and lawn equipment.
MOTION by Councilman Schneider to concur with the recommendation
of the P anning Commission and grant Special Use Peamit, SP #92-06,
with t e following stipulations: (1) the proposed accessory
struc re shall be architecturally compatible with the existing
dweli ng unit and shall not exceed 14 feet in height; and (2) the
acce sory structure shall not be used for a home occupation as
def ned in the Zoning Code. Seconded by Councilwoman Jorgenson.

WHEREAS, the City Council approved a lot split at the
July 6, 1992 , 1992 meeting; and the Planning Commission
stipulation attached as Exhibit A; and
WHEREAS, such approval was to split property into two separate
parcels, Parcel A and Parcel B, described as follows:
Parcel A: The east 83 .00 feet, front and rear, of Lot 14, Revised
Auditor's Subdivision No. 10, Anoka County, Minnesota, and the east
83 .00 feet of Outlot A, Dennis Addition, Anoka County, Minnesota,
and that part of the east 83 . 00 feet, front and rear, of Lot 6,
Revised Auditor's Subdivision No. 10, Anoka County, Minnesota,
lying north of the south 120.50 feet, as measured along the east
and west lines of Lot 6.
Parcel B: The south 120.50 feet, as measured along the east and

WHEREAS, the City has received the required Certificate of Survey

Ms. Dacy, Community Development Director, stated that this property
is located between 66th Avenue and Creek Park Lane, and the
petitioner is requesting the property be subdivided in equal
halves. She stated that the Planning Commission recommended
approval of this lot split with the stipulation that the park
dedication fees be paid. She stated that staff recommends adoption
of this resolution.
Councilman Schneider stated that there are some outstanding
assessments.
Ms. Dacy stated that she believed these were deferred until such
time as the lot was split.
MOTION by Councilman _Schneider to adopt Resolution No. 50-1992,
with the attached Exhibit A regarding payment of the park fee.
Seconded by Councilwoman Jorgenson. Upon a voice vote, all voting
aye, Mayor Nee declared the motion carried unanimously.

BLOCK GRANT FUNDS FOR HUMAN SERVICES ORGAN�ATIONS:

Mr. Barg, Planning Assistant, stated that�teen applications were
received for the Community Development� lock Grant funding. He
stated that this amounted to over $�B;OOO in requests, and only
$31,000 was available. He sta�d that the Human Resources
Commission reviewed these applica�ions and heard presentations from
these organizations. � _

Mr. Barg stated that the�Y(iman Resources Commission, in reviewing
these applications, co�idered the following criteria: (1) to try
and promote new and novative programs; (2) organizational need;
(3) community need�-� program quality; and (5) budget. He stated
that the Plannin ommission has concurred with the recommendation
of the Human R ources Commission for this funding.
Mr. Barg s ted that the Human Resources Commission_ in making their
recomme ations were under the impression that if the mental health
agenc' s could not get funding from the City, the County would make
up at funding on a dollar to dollar basis. He stated that Mr.
Y k, Director of Community Social Services and Mental Health for
he County, has advised the City that the County's mission is to �
