Stacy Stromberg, City Planner, stated the petitioners, Gordon and Angela Sangster, are seeking to replat the property located at 7169 Riverview Terrace in order to create two single-family lots. The subject property is zoned R-1, Single Family as are all surrounding properties. It is located on the corner of Riverview Terrace and 71 1/2 Way. The existing home and attached garage was constructed in 1966 and a porch addition was constructed in 1980. The existing lot is approximately 95 ft. by 226 ft. The petitioners plan to sub-divide the lot into 2 single family lots, one of which will accommodate the existing home and the other will allow for the construction of a new single-family home. Ms. Stromberg stated that Fridley requires that lots in the R-1 Single Family district be a minimum of 75' in width with a minimum total lot area of 9,000 square feet. The proposed Lot#1 will be 103 feet in width and 11,200 square feet in size after the replat. Proposed Lot#2 will be 110 feet in width and 10,000 square feet in size after the replat. Both lots will meet the minimum lot and set back requirements. Ms. Stromberg stated that city staff has heard from three neighboring property owners who are in opposition of the proposed preliminary plat request. From our discussion with them, they are simply in opposition of the request because they don't want to see another single family house on the subject property. Two letters in opposition have also been received. City Staff recommends approval of this preliminary plat request, with stipulations. The lots exceed minimum size requirements and this will provide additional homeownership opportunities for Fridley residents. Ms. Stromberg stated that City Staff recommends that the following stipulations be placed upon approval of this request. �1 / 1. Property owner of record shall obtain all necessary permits prior to construction. 2. Property owner of record at time of building permit application to pay a required $1,500 park fee prior to issuance of building permits. 3. Gordon Sangster, 7169 Riverview Terrace, has lived on this lot for 40 years. At the time the home was built we realized it was a large lot. It was great for raising the children but now we would like to split the lot to allow another single family lot. City Staff has been very helpful in this process and Mr. Sangster feels this is a proper use of the property. Commissioner Savage asked if Mr. Sangster has had any discussions with the neighbors who oppose this lot split. Mr. Sangster replied no. Commissioner Kondrick asked if Mr. Sangster had any problems with the stipulations. Mr. Sangster replied no. Commissioner Kuechle asked if Mr. Sangster had any plans as to what will be built on the lot or if he just plans to sell the lot. Mr. Sangster answered that he just plans to sell the lot. Maynard Nielson, 7144 Riverview Terrace, stated that he is speaking on behalf of his daughter Michelle Wold who lives at 133 Alden Circle. This new house would back up to his daughter's lot and they oppose this request. The petitioner is moving and will not live with the condition he is creating. Monte Gonia, 187 Alden Circle, strongly disagreed with this request. He moved to Fridley because of the privacy and large lots. He does not want to see this lot split. He questioned how the petitioner would feel if a neighbor did this to him when he was raising his family. The petitioner is moving so he won't have to worry about what it will look like. MOTION by Commissioner Kondrick to close the public hearing. Seconded by Commissioner Saba. UPON A VOICE VOTE,ALL VOTING AYE, CHAIRPERSON SAVAGE DECLARED THE MOTION CARRIED UNANIMOUSLY AND THE PUBLIC HEARING CLOSED AT 7:40 P.M. Commissioner Kondrick said he drove by the property and tried to envision the lot split. He stated that a property owner has the right to do with their property what they wish. This is a big lot and even splitting the lot, both lots will still be good size. He can understand the opposition but can't say this cannot be done. The lots will be large enough; it is a beautiful neighborhood and cannot vote against this request. A nice home will be built there. Chairperson Savage agreed that there was no alternative but to approve the request as the law permits and the lot is within city code requirements. She sees no basis to deny this request. Commissioner Kuechle agreed that this request meets the requirements and did not see another option but to approve the request. Commissioner Saba stated that he also drove by the property and understands how change will impact � � the area. The City has standards and this will exceed their standards. Commissioner Oquist concurred with the others and added that this will be a buildable lot that exceeds minimum requirements. Irr 2006 the Planning Commission reviewed one Master Plan Amendment, one Plat request, Special Use Permits, 3 Street and Alley requests and 3 Text Amendments. How does this compare other years? 2005 was a big year as we had 10 Text Amendments that year. 2006 was a normal work ad receiving a total of 20 applications. Photos were shared of Hilltop Trailer Sales and K& N Labs whit�h were two of the projects from 2006. . ; i Ms. Stromberg thanked the Pla ing Commission for their hard work in 2006 and wished them a Happy New Year. 1 f Scott Hickok, Community De�6elopment Director, shared a few updates from City Council. The Planning Commission will recall that the John DeMello project, located at Old Century and Mississippi,was approved two years ago for the master plan and the plat for 70 condominiums and 10,000 square feet of commercial/retail mixed use space. Mr. DeMello is requesting an extension on the plat. Once the plat is approved they have six months to file. They have asked for several extensions. The market space of the area has raised some concerns and the retail space needs to be sold before the condominium units. There is a lot of interest on the condominium units but not so much interest in the retail mix property. Currently there are three investors interested in the retail area and hopefully they will close in February. Their extension reques4 would take them through mid June. Mr. Hickok stated that the development across the street, the Town Center Development, has recently requested to put up 2 sales trailer on the site for condominium sales. Everyone is asking what is happening to Sande's Restaurant. The developer has indicated interest in a restaurant and will probably redevelop Sande's:. The developer is dealing with market forces and when they first started the bank would finance up to 30% of the sold units. With the market slowing down, the bank has changed to finance 70% of the sold units. It is difficult for the developer to sell the units sight unseen. Their interest to place a trailer on the lot to help sell the units and envision what the units will look like on site should help the sales. Commissioner Kuechle questioned how many units are to be built on this site. Mr. Hickok, replied that this is a 54 unit building. It was originally set up in an "L" shape but neighbors had concerns about the height of the building. In response to the neighborhood concerns, the height was reduced and the configuration changed to a "C" shape. This will be a 54 unit building with underground parking. The sale of the units is causing delay in construction. Mr. Hickok wished Commissioner Kondrick Happy Birthday on behalf of the City Staff. He also thanked Jack Velin for joining the Planning Commission. Jack is a long time Commissioner member and volunteer for the EQEC. Recently Jack was nominated chair of the EQEC and will now sit in on the Planning Commission in place of Barbara Johns. Michelle Wold's house would back up to the new lot. The letter was signed by Maynard Nielsen on behalf of Michelle Wold. The City also received a letter from Michelle Wold on January 11. The letters were entered into the record at the Planning Commission. Mr. Hickok stated the Planning Commission held its public hearing on January 17. The Commission heard from two neighboring property owners who were in opposition to the request. After a brief discussion, the Planning Commission agreed with the preliminary plat request in that it meets the minimum standards and, therefore, recommended approval of PS #07-01 with eight stipulations. That motion carried unanimously. Staff recommends concurrence with that Planning Commission's recommendation. Councilmember Bolkcom stated both the lots will exceed the minimum size, and there really is no reason she can see why they could not do this. Mr. Hickok said it is a large lot on a corner that not only has the land area to devote to a second lot, but has street access. As long as it meets the minimum standards in the subdivision ordinance, it can be done. Councilmember Bolkcom stated the petitioners would actually sell the lot to someone after the lot split. Mr. Hickok replied that is his understanding. Councilmember Barnette said if the Sangsters split the lot, he is assuming the home that would be built on the lot would be facing south. Mr. Hickok replied that is correct. Maynard Nielsen, 7144 Riverview Terrace, stated he wrote one of the letters. It is for his daughter's house. They were unhappy with a house being north and south between two that are east and west. Gordon Sangster, 7169 Riverview, stated they have lived in the house for the last 40 years. Councilmember Saefke sta d he did have a question because the bidding procedure seems to be a little different. He asked r. Haukaas to explain the process. Jon Haukaas, Public Works 'rector, stated these are open-ended but there is a certain amount of repairs they need to do on th se wells each year, but they do not know the full extent of that until it is pulled apart. They did ange how they are doing this a little bit to more reflect the bid based on things they knew were bsolutely going to happen which is the best case scenario. They would hope it would be that ay, they know it will not be. They will probably have more costs, but they will not know what ey will be until they are pulled apart. It is just a different way of looking at the bidding process. He felt it was a safer way for the City. Councilmember Saefke asked if they 1 oked at the alternate bids, when they looked at the base bid. Mr. Haukaas said they did look at those. As a general rule, everyone was in step with each other. Councilmember Saefke asked about Well No. 0 and the cleaning of the screen. He did not see in the base bid where televising would be approp 'ate. He is just wondering how they are going to be able to tell if it needs to cleaned if they canno see it first. Mr. Haukaas said it would be part of their inspection d their evaluation as it is pulled apart. Councilmember Saefke asked why videoing was not p of the base. i Mr. Haukaas said one of the things they talked about is�'�the amount of history they have on these wells. They have not seen a lot of change and there ` ay be an instance especially in the City's current financial situation where they might be lookin for minor parts they could drop off. If they have not had changes in 30 years on something, m��be they could skip it every now and then. It was a judgment call and they put it as an alternate thi�s time around. Councilmember Bolkcom asked what would happen if they see all these other problems that are there. She asked where the funds would come from in a worst case scenario. Mr. Haukaas replied that is why they budgeted $60,000 for this. They could basically completely rebuild this well, as a catastrophic condition, with the $60,000. In the years they have been doing this, they have never had to do that. The C' y is pretty much dependent on property taxes. Probably left to our devices, we would no get into the liquor business, but it is an available revenue source and is something that has een very beneficial to Fridley. At the request of the City Prosecutor, Carl New ist, staff is recommending the addition of language to Chapter 31 of the Fridley City Code th will clearly make it a crime to attempt to pawn an item that is not the property of the pers n initiating the transaction. Detective Pankonin has reviewed this change with the pawnshops and they are fine with it. Staff recommends Council's approval. Resolution Approving a Plat, P.S. #07-01, Sangster Addition, by Gordon and Angela Sangster, for the Purpose of Creating Two Single Family Lots, Generally Located at 7169 Riverview Terrace N.E. Dr. Burns stated Council approved the preliminary plat for the lot split of 7169 Riverview Terrace at their February 12 meeting. Dr. Burns, City Manager, state innesota legislation passed in 1992 provides for the creation and funding of regional hazardou materials and emergency response teams, as well as a hazardous materials chemical assessm t team. Fridley has been a member of the North Metro FRIDLEY CITY COUNCIL MEETING OF MARCH 12 2007 PAGE 4 Chemical Assessme t Team since 1995. Other members of the team include the Coon Rapids Fire Department an the Spring Lake Park/Blaine/Mounds View Fire Depaxtment. Since the State is soliciting pr osals for new contracts for services beginning July l, staff is seeking authorization to sub 't a contract proposal as a member of the North Metro Chemical Assessment Team. St recommends Council's approval. ADOPTED RESOLUT N NO. 2006-17. 4. Approve 2007 SC Grant/Anoka County Residential Recycling Agreement. Dr. Burns, City Manager, st ed this is an agreement that is renewed annually. It provides the conditions for Fridley's receip of SCORE money from Anoka County. The 2007 agreement provides $59,173.76. It is base on a base amount of$10,000 plus $4.37 a household. In 2006 Fridley received $63,241.60. oka County is becoming more organized and the decrease reflects changes in population gro in the County. Staff recommends Council's approval. Mr. Kirk replied, yes,just to Springbrook. Councilmember Bolkcom stated so it is almost two sep te issues. Nos. 1-3 relate more to Community Park and Commons Park and No. 4 relates to pringbrook. Before this comes back to them, she thinks there should be some definitions rel ed to club and some of those things or the wording should be changed. Mayor Lund stated his suggestion is that they leave o.4 and include "as defined by Minn. Stat. Ch. 340A." The existing home and attached garage was constructed in 1966, and a porch was added � . , . . � FRIDLEY CITY COUNCIL MEETING OF FEBRUARY 12,2007 PAGE 16 - to the home in 1980. The existing lot is approximately 95 x 226 feet, and petitioner plans to subdivide the lot into two single-family lots, one which will accommodate the existing home, and another which will allow for the construction of a new single-family home. City Code requires that lots in the R-1 Single Family District be a minimum of 75 feet in width and a minimum lot area of 9,000 square feet. Proposed Lot 1 would be 103 feet in width and 11,200 square feet in size after the replat. Lot 2 would be 110 feet in width and 10,000 square feet in size. Mr. Hickok stated City staff has heard from three neighboring property owners who are in opposition of the proposed preliminary plat request. From discussions with them, they are in opposition to the request because they do not want to see another single-family house on the subject property. The City received a letter on January 9 from Maynard Nielsen and Michelle Wold indicating they strongly oppose the division of the lot, stating the house would have to face a different direction than the two homes now; and they would not like to have a home put in their backyard. Michelle Wold's house would back up to the new lot. The letter was signed by Maynard Nielsen on behalf of Michelle Wold. The City also received a letter from Michelle Wold on January 11. The letters were entered into the record at the Planning Commission. Mr. Hickok stated the Planning Commission held its public hearing on January 17. The Commission heard from two neighboring property owners who were in opposition to the request. After a brief discussion, the Planning Commission agreed with the preliminary plat request in that it meets the minimum standards and, therefore, recommended approval of PS #07-01 with eight stipulations. That motion carried unanimously. Staff recommends concurrence with that Planning Commission's recommendation. Councilmember Bolkcom stated both the lots will exceed the minimum size, and there really is no reason she can see why they could not do this. Mr. Hickok said it is a large lot on a corner that not only has the land area to devote to a second lot, but has street access. As long as it meets the minimum standards in the subdivision ordinance, it can be done. Councilmember Bolkcom stated the petitioners would actually sell the lot to someone after the lot split. Mr. Hickok replied that is his understanding. Councilmember Barnette said if the Sangsters split the lot, he is assuming the home that would be built on the lot would be facing south. Mr. Hickok replied that is correct. Maynard Nielsen, 7144 Riverview Terrace, stated he wrote one of the letters. It is for his daughter's house. They were unhappy with a house being north and south between two that are east and west. Gordon Sangster, 7169 Riverview, stated they have lived in the house for the last 40 years. Councilmember Sae e stated he did have a question because the bidding procedure seems to be a little different. He sked Mr. Haukaas to explain the process. Jon Haukaas, Public W rks Director, stated these are open-ended but there is a certain amount of repairs they need to do on these wells each year, but they do not know the full extent of that until it is pulled apart. Th did change how they are doing this a little bit to more reflect tne bid based on things they kne were absolutely going to happen which is the best case scenario. They would hope it would b that way,they know it will not be. They will probably have more costs, but they will not kno what they will be until they are pulled apart. It is just a different way of looking at the bidding rocess. He felt it was a safer way for the City. Councilmember Saefke asked i they looked at the alternate bids, when they looked at the base bid. Mr. Haukaas said they did look those. As a general rule, everyone was in step with each other. Councilmember Saefke asked about ell No. 10 and the cleaning of the screen. He did not see in the base bid where televising would e appropriate. He is just wondering how they are going to be able to tell if it needs to cleaned if ey cannot see it first. Mr. Haukaas said it would be part of thei 'nspection and their evaluation as it is pulled apart. Councilmember Saefke asked why videoin was not part of the base. 1V�r. Haukaas said one of the things they tal ed about is the amount of history they have on these wells. They have not seen a lot of chang and there may be an instance especially in the City's current financial situation where they mi�it be looking for minor parts they could drop off. If they have not had changes in 30 years on s mething, maybe they could skip it every now and then. It was a judgment call and they put it as a alternate this time around. Councilmember Bolkcom asked what would happen they see all these other problems that are there. She asked where the funds would come from in a v,�vorst case scenario. Mr. Haukaas replied that is why they budgeted $60�00 for this. They could basically completely rebuild this well, as a catastrophic condition, ith the $60,000.
