In the past, the Planning Conmission and City Council have used the special use permit p�ocess in order to allaw continuation of the limited o�mnercial operations in the area while �otecting the nei�iborhood character and interest. Ziiis garticular property was the subject of a special use permit for Midwest Qassified pririting in October of 1985. 7S�is special use permit was granted with stipulations, havever, the petitioner r�ver took occugancy of building. Mr. Glynn's operation is of a lower intensity use than the previously apprwed special use permit. 7he �evious petitior�er required eic�it garking stalls whereas Mr. Glynn irvdicated that he wi11 need f our or f ewer stall s. Due to the lesser need for parking, concrete curbing is not required. However, due to the fact that the awners of the ' property have been attempting to cooperate with the unique status of the , property (by trying to secure only oom�nnercial tenants which present a very low profile in terms of irxtensity of use, and which would be oompatible with ti�e residential area) it has made it extrenely difficult for then to l�se o� sell the building. I personally have had numerous reguests from various c�onmercial operations whirh would be allawed under ti�e oom�nercial sections of . the Code but would not be desirable in this particular area. 'Ihese requests have been discouraged and therefo�e t�e building has stood c�r►pty. Due to the awn�er's wntinuing efforts to secure an acoeptable tenant as defined by the City, we feel it would be inappropriate to designate the building as non-conforming for riei�iborhood coirmercial use at this time. We have spoken to the City attorney regarding this matter and he is in ap�rent c�oncurrence witiz this determi.nation. ' Enclosed is the l�se agreenent from the previous petition which provides ' 1,600 sq. ft. of City property for possible �rking lot expansion. It would , be advisab].e to l�se t�is �operty to Mr. Glynn r�ow so that he can glaoe his landscaping in a fashion which leaves room for the parking expansion if � ryeeded. Robi�nson stated the special use permit was to allow a copy sales and service business in the S-1 (Special Zoning District for Hyde Park) . The I�yde Park zoning overlay was created to change a legal non-conforming status that some of the residential dwellings had in the neighborhood prior to its enactment. One of the unique things about the ordinance was tha� it does • not have a provision for commercial development, although there are at least three commercial developments in the area, other than residential apartments. In the past, the Planning Commission and City �ouncil have used the special use permit process whenever there is a proposed change in cor�mercial use in the district. The special use perr�it process is utilized to ensure that the new development is compatible with the neiqhborhood and also to set stipulations for the quality of the development. t1r. Robinson stated this particular property at 5973 3rd St, was the suhject of a special use perr�it in October 1985, which was granted by the City Council ; ho�iever, the petitioner never too{: occupancy of the building and the operation was never finalized. Mr, Robinson stated P1r. Glynn's operati�n was a lower intensity use than what was proposed in 19�5 in that there will be four or fewer parking spaces required at any one tir�e. He believed there were approxir�ately three employees, not all full-time, so there a�ould not be the need for a parking lot expansion as was envisioned with the last proposal . t1r. Robinson stated the site plan, which was approved in 1��5, was for an expanded lot area. The proposal was to lease from the G�ty sliahtly over 16d0 sq. ft. of Lot 2�3. 8oth Lot 29 and Lot 3C are held by the City of Fridley and were acquired for the slip-off from University Aven, �'lt that time, a lease 4�as proposed and approved by the City.
