Mr. John Glynn has made application fo� a special use permit to allaw sales
and service � �iiato oog� equipnent in an S-1, Hyde Park zoning district, at
5973 - 3rd Street N.E. �e property in question is the vacated Energy Shed
builcling. �ere would be very little customer visits to the site and
typically Mr. Glynn would have need of four or fewer parking stalls at one �
time.

Zhe Hyde Park zoning is an overlay zoning which was created to c�ange the
legal non-conforming staus that some residential dwellings had in the
neic�borhood prior to the enactment of the ordinance. �is case is unique
because tfie Hyde Park ordinance does not have a provision for oommercial
. develognent, even though there are at least three commercial operations in
the ryeic�borhood. In the past, the Planning Conmission and City Council have
used the special use permit p�ocess in order to allaw continuation of the
limited o�mnercial operations in the area while �otecting the nei�iborhood
character and interest. Ziiis garticular property was the subject of a
special use permit for Midwest Qassified pririting in October of 1985. 7S�is
special use permit was granted with stipulations, havever, the petitioner
r�ver took occugancy of building.
Mr. Glynn's operation is of a lower intensity use than the previously
apprwed special use permit. 7he �evious petitior�er required eic�it garking
stalls whereas Mr. Glynn irvdicated that he wi11 need f our or f ewer stall s.
Due to the lesser need for parking, concrete curbing is not required.
Im�avenents to the facade of the building and also landscaping will be �
required.

to single family use. However, due to the fact that the awners of the
' property have been attempting to cooperate with the unique status of the
, property (by trying to secure only oom�nnercial tenants which present a very
low profile in terms of irxtensity of use, and which would be oompatible with
ti�e residential area) it has made it extrenely difficult for then to l�se o�
sell the building. I personally have had numerous reguests from various
c�onmercial operations whirh would be allawed under ti�e oom�nercial sections of .
the Code but would not be desirable in this particular area. 'Ihese requests
have been discouraged and therefo�e t�e building has stood c�r►pty. Due to the
awn�er's wntinuing efforts to secure an acoeptable tenant as defined by the
City, we feel it would be inappropriate to designate the building as
non-conforming for riei�iborhood coirmercial use at this time. We have spoken
to the City attorney regarding this matter and he is in ap�rent c�oncurrence
witiz this determi.nation.

' Enclosed is the l�se agreenent from the previous petition which provides
' 1,600 sq. ft. of City property for possible �rking lot expansion. It would
, be advisab].e to l�se t�is �operty to Mr. Glynn r�ow so that he can glaoe his
landscaping in a fashion which leaves room for the parking expansion if
� ryeeded.

h1r. Robi�nson stated the special use permit was to allow a copy sales and
service business in the S-1 (Special Zoning District for Hyde Park) . The
I�yde Park zoning overlay was created to change a legal non-conforming status
that some of the residential dwellings had in the neighborhood prior to its
enactment. One of the unique things about the ordinance was tha� it does
• not have a provision for commercial development, although there are at least
three commercial developments in the area, other than residential apartments.
In the past, the Planning Commission and City �ouncil have used the special
use permit process whenever there is a proposed change in cor�mercial use in
the district. The special use perr�it process is utilized to ensure that the
new development is compatible with the neiqhborhood and also to set
stipulations for the quality of the development.
t1r. Robinson stated this particular property at 5973 3rd St, was the suhject
of a special use perr�it in October 1985, which was granted by the City Council ;
ho�iever, the petitioner never too{: occupancy of the building and the operation
was never finalized.
Mr, Robinson stated P1r. Glynn's operati�n was a lower intensity use than what
was proposed in 19�5 in that there will be four or fewer parking spaces
required at any one tir�e. He believed there were approxir�ately three employees,
not all full-time, so there a�ould not be the need for a parking lot expansion
as was envisioned with the last proposal .
t1r. Robinson stated the site plan, which was approved in 1��5, was for an
expanded lot area. The proposal was to lease from the G�ty sliahtly over
16d0 sq. ft. of Lot 2�3. 8oth Lot 29 and Lot 3C are held by the City of Fridley
and were acquired for the slip-off from University Aven, �'lt that time, a
lease 4�as proposed and approved by the City.
P1r. Robinson stated that at this time, they do not envision a par{:ing lot
lii:e that proposed in 1985, but rather would util�ze the existing blacktop
area. It ►•�ould be sufficient for four cars, so the parE:ing requirement which
was part of the previous proposal was not part of the current proposal .
�":r. P,obinson stated Staff has worl:ed with P�r. �lynn to cor�e up with ir�prove-
ments to the property. �hese would include facade improvements. ?hey have
not yet arrived at what they Feel is the most appropriate plan for the
building; however, they have looked at sor�e opportunities such as adding some
cedar trim.
Mr. Robinson stated Staff was recommending the following stipulations:
1 . Building facade improver�ents, suhject to staff approval , to he
completed by Oct. 31 , 1988.
2. Landscape improvements, as per City plan dated Oct. 21 , 1987, to
be installed by Oct. 31 , 1988. Location of plantings on north
subject to Council determination.

3. Parking situation to be �reviev�ed in two years (or sooner if
necessary) to determine adequacy of exist�ng parking lot. If

Mr. Flora, Public Works Director, stated this proposal is to allow a
printing plarit at 5973 - 3rd Avenue. He stated the busir�ss previously at
this location was The Enerc� Shed. Mr. Flora stated the property is in an
S-1 zaie in the Hyde F�rk area.
. Mr. Flora stated the petitioner agrees to make substantial site

Cbuncilman Gooclspeed stated the stipulatiaz that the City should sell land
to S-1 zoned property was in vialation of the spi rit of the S-1 zoning in
that these businesses shoulc�'t expand.
Councilman Fitzpatrick stated he agreed with Councilman Goodspeed on
ex�nsion of non-conforming uses which they would have if the petitioner
were to buy the City land. He stated if the petitioner were to purchase
this land, he believed it would affect a n�unber of the stipulations. He
stated the question he had was if the petitioner, Mr. 57nith, wishes to
purdiase this City property. Mr. S�nith stated he did not.
Mr. Qureshi, City Manager, asked Mr. 9nith haa many p�rking spaoes he neecied
i in orc3er to wnduct his business. Mr. Stnith stated six to eic�t cars would
be there on any given day. Mr. Qureshi asked Mr. 9nith ho�w he intended to -
pra�ide the parking. Mr. 9nith stated it wouldn't be possible to provide
the required parking if it had to be marked and striped, without the extra

land. Mr. Qureshi stated the question really is if thi s i s an impr av ement
to the building. He stated, if it is, he felt there should be curbing to
make it look presentable.
Q�incilman Schneider stated if City land is used, it precluc�s anything
being built on the slip-off. Mr. Flora stated there has been some
discussio�n before the Planning Commission about the City closing off the
sl ip-o�f.
Gbunci.lman Fitzpatrick stated there were statenents to the effect that the
purpose o� the 5-1 zoning was to return the area to residential.
Mr. 9nith stated he was in agreement with the stipulations made by the
Planning Caamission and would work with the (�ty regarding the parking and
landscaping. Mc. Flora stated staff can work with Mr. 9mith to bring the
property closer into oode oompliance, without him acquiring additional
property fran the City. ,
Cb�mcilman Goodspeed stated he did not want additional land given or sold to
the petitiorier, but he would not be opposed to his leasing it.
NDTION by Co�mcilman Goodspeed to grant special use permit 5P #85-12 to
allaw a different a�mnercial use in an S-1 District at 5973 - 3rd Street,
with the fnllowing �ipulat�i.an�s: (1) exterior imprwenents be made to the
building, as per plan, by May 1 , 19B6 ; (2) a portion of Lot 29 ,
approximately 1,604 square feet, be leased frrnn the City for $1.00 per year
with the City's ric�t to terminate the lease with a ane year notice, after
the third year; (3) parking area be provided, as per glot plan, with
ooncrete curbing and asphalt �ving by July 1, 1986 ; (4) landscaping be
pravid�d, as per plot plan, by August 1, 1986; (5) a sound insulated Gh�nber
be provided for the air compressor , prior to occupancy; f6) a site
impravenent performanoe bond be prwided in the anount of $5,000, prior to

Mr. Hill, Public Safety Direetor, stated the Legislature enacte :�'�Chapter 33�
which went into effect on August 1 , 1987 • He stated this 1 :gislation is
commonly referred to as the Police Practices Bill and unde i�this new law,
the City must now give explicit authorization for non-p ;�ce officers to
issue citations for building, fire housing code, anim ', noise control,
zoning and other land use violations. He stated this or, inance would bring
the City in compliance with the State statute. %

Mr. Hill noted that item 6, under Seetion 803.02 of,<�his ordinance, should
be changed from Building Inspections to Buildin ifnspectors and would be
corrected at the time of second reading of the o,r�dinance.

Mr. Robertson, Community Develop�t Director, stated when this special use
permit was approved, the Counci��%requested it be reviewed itt six months. He
stated in the review proce��, it was found only two out of the 1 �
stipulations remain to be co�leted. He stated this involves the repair and
striping of the parking lot,�: nd sodding the area between the parking lot and
planting beds. Mr. Rober� {on stated Mr. Waldoch has provided the City with
a bond which expires on , tober 1 , 1988 and it is, therefore, recommended
