RDGARDING: 6430 East River Road Plat Proposal
PROPQSAL �
To subdivide the single family lot at 6430 East River Road into three single
family lots. Lot 1 (with the existing house) has 128.01 feet of lot width
and 17,177 square feet; Lot 2, would have 65.0 feet of lot width and 8,952
square feet.; Lot 3 (the aorner lot) �uld have 73.39 feet of lot width and
11,064 square feet. City Code requires 80 foot of width for a corner lot,
and 75 feet of width for others. Minimum lot area is 9,000 square feet.
In conjunction with the Plat a request to vacate a 6 foot drainage and
utility easegnent which runs east to west across the property.
BAC�{GRO[7I�ID
The same petitioner processed a 1982 lot split appeal which included a 70
foot lot on East River Road, a 66 foot lot and the balance with the house of
132.01 feet. At that time staff recom¢nended:
1. Platting of the property.
2. Corner lot of 80 feet.
3. Intermediate lot of 75 feet.
4. Streeet dedication along the westerly 30 feet to provide access to the
properties to the south.
5. Assessments for properties abutting new road.
6. Park fees.
Oh May 3, 1982 the Council approved a split with a 76 foot corner lot, a 60
foot intermediate lof and 84 feet with the house. The approval also called
for the 3H foot street easement with a ZS foot triangle at it's intersection
with 64 1/2 Way. The petitioner was not to be assessed for the access road
unless it was used. The petitioner later rejected this compromise by
withdrawing her petition.

REC�NA9IIQDATION
Presently four residences exist to the south of the subject property which
share two unimproved driveways off East River Road. City and County
objectives would be to eliminate these curb cuts. The subject property
should pravide a mini�m of 25 feet of street easement on the west of the
Plat with a 25 foot triangle at it's intersection with 64 1/2 Way. The
balance of the right-of-way if needed could crnne froqn the adjacent park.
Lot widths should be as close to Code as reasonably possible. Staff
recommends a corner lot of 75 feet and an intermediate lot of 70 feet (each
five feet short of Code) leaving a balance of 121.3 for the petitioners home
site, with 16,727 square feet of lot area.
The petitioner was made aware of this request prior to having the Plat drawn.
Based upon Council's past action on this property and current desire for Code
' canforming lots, we feel the Preliminary Plat should be amended prior to
Council approval,
On D'Ia.y 6, 1987 the Planning Commission held a public hearing to review the Plat.
A majoxity of the meanbers felt that only two lots should be provided. However,
based on the 1982 Council action they cancurred with staff's reco�ranendation.
The complete list of stipulations approved by the Commission is attached.

Viet's 2nd Addition, and Lot 26, Revised Auditor's Subdivision No. 23,
according to the plats thereof on file and of record in the office of the
County Recorder in and for Anoka County, Minnesota, the same being

of the public hearing notice and to open the public hearing.
Upon a voice vote, all voting aye, Chairperson Billings declared the motion
carried unanimously and the public hearing open at 8:26 p.m,
P1r. Robinson stated this petit�on involved a single parcei of residential
' property on the southwest corner of East River Road and 64z Way. The
property was zoned single family. The proposal was to split the parcel ,
which included a single family existing home, into three single famii�� lots ,
creating t�•10 additional buildable iots.
Mr. Robinson stated a lat split request was reviewed by the City Council in
1982, and a copy of those minutes dated May 3, 1982, were included in the
agenda. At that time there was some controversy as to the size of the lots
and also a proposed street easment which the City was requesting to run along
the west side of the property.
Mr. �obinson stated that in 1982, a iot split approved by the City Council
was rejected by the petitioner, and the petitioner was back at this time ask-
' ing for a different subdivision.
Mr. Robinson stated the proposal was for a corner 1ot (Lot 3) to be 73,39 ft,
in width, the middle lot (Lot 2) to be 65 ft. in width, and the resident's
lot (Lot 1 } would have the balance of 128 ft. in width.
Mr, kobinson stated that as far as iot area, Lot 1 was 17,177 sq. ft. , Lot 2
would i�ave 8,952 sq. ft. , and Lot 3 would have 11 ,064 sq. ft. The code
required that corner lots be 80 ft. in width and that all lots be a minir�um
of 75 ft. in width. All lots must have an area of 9,000 sq. ft. so the plat
as proposed had 3 variances for lot width (Lot 2 and 3) and one for lot
area for the r�iddle lot Lot 2 ,

a seconcl accessory building, a garage, to be located to the ear of the
house. He stated there was quite a steep slape along the ide of the
petitioner's house a�here the driveway would be. He was t sure of the
petitioner's plans but Staff was recommending the drive ay slope be reduced
as much as possible.
, t1r. Robinson stated Staff was recommending the foll ing stipulations :
1 . Garage facade to match house.
2. Driveway to be at least three feet from ad oining lot.
3. Driveti�ay slope to be reduced as much as ossible.
4. Owner to secure NSP authorization of arage place�nent prior to
construction.
Mr. Gustafson stated that regarding s pulation #1 to have the garage facade
match the house, he liad thought of u ng a different type of facade for the
garage, lie stated his house has wh' e steel siding, and he thought that the
garage in its proposed location wi the trees might look better with a
redwood facade. Hov�ever, he woul do whatever the City wanted.
r1r. Bondow stated he agreed wit P1r. Gustafson. He stated he thought the
redwood would have less of a v sual impact than the white when viewing the

Mr. Robinson stated the in nt of that stipulation was to ensure that the
i second accessory building as compatible with its surroundings.

�4r. Robinson stated a -variance would still be needed on the corner lot and
middle lot for a lot width of 5 ft.
Mr. Robinson stated that in 1982, the City Council approved a 7b ft. width
for the corner 7ot (Lot 3) , b0 ft. width for the middle lot (Lot 2) , and
84 ft. width for the petitioner's lot (Lot 1 ). Ne believed the 84 ft. width
must have been a mistake in the ninutes because it did not add up to the
total ari�fth of �the three lots.
Mr. Robinson stated Staff was recor�mending the following stipulations for
both the preliriinary plat and the vacation (Item 5 on the agenda) :
1 . Provide for the following lot widths: A) corner 75 feet; Q) middle
70 feet; C) westerly approximately 121 feet.
2. Provide a 25 ft. street easement along west of property with 25 ft.

' (f1r, Robinson stated that in 1983 a garage permit was issued for a new garage
which now faces 64z Way. Originally when the garage was built, it was
oriented towards East River Road. Along with that 1983 building permit,
there vras a stipulation that the existing garage be converted to livinn space
and that completion should be aceomplished within 90 days after the garage
was completed. So, it I�as now been several years since the garage was built,
and that should be taken care of. )

Mr. Robinson stated the road easement that was being proposed alor�e� the
wester7y side of the property was for a future road, Tt��e�'� were three k�ouses
on that s�de that were serviced by a dirt drive to East River �oad, a��1 there
was a master plan (inciuded in the agenda) that would include a 50 ft. right-
of-way (25 ft, from the park and 25 ft. from the petitioner's property)
culminating in a cul-de-sac which wou7d open up access to potentially five
properties.

Mr. Billings asked what the sizes of the lots were across the street on
64'2 Way.
Mr. Robinson stated those lots were 100 ft. in width.
Ms. Donna Olson stated that because of the fact that she was changing the
position of her home from facing East River Road to facing 642 Way and the
way the house was situated on the lot, cutting her sideyards down and provid-
ing an easenent across the back of the lot would leave her with no sideyards
or backyard. She stated she has a large four-bedroom house that wi11 accorr�no-
date a large fami�y but no yard. If the house was built to face 6 42 Way,
it would probably have been built closer to 641� !Jay, but it was sitting back
farther than the required 35 ft. setback.
t1s. Olson stated she did v�ant to finish the construction they have started.
The smaller her lot becomes , the less money she will get fror� Twin City
Federal to help finance the finishing of the construction. She stated the
City Council approved a 60 ft. width lot for .the middle 1'ot in 1982. All
she was asking for now was a 65 ft. width. She did not mind c7iving the ease-
mer�t in the back as long as she had a decent yard around the house.
Mr. Betzold stated they are stuck with the parameters that are existin�.
With a fairly large house on Lot 1 , by squeezing down the other two lots ,
� it made a fairly small lot for Lot 2. Why not split into just two lots?

in favor of the stipulations for the revised lot widths as recommended by

, it would be more appropriate to end up with two lots, each being approximately
130 ft. in width which would be consistent with the 100 ft. wide iots across
the street. The petitioner had indicated that this would not be econor�ically
� feasibie, The Planning Commission was not obligated to do things which were
' motivated by financial criteria; hotrever, at the same time, some concessions
' were made by the City Council in 1982, and he thought the compromise made by
� Staff on the lot widths was a fair compromise. It was not what they would
like to see, but it was sor�ething they could probably live with. He could go
along with the stipulations as recommended by Staff.
, P�r. Billings stated he would like to see the Planning Commission recommend
to the City Council that the park fees be $750/lot for two lots , rather than
$1 ,500, because of the additional expense the petitioner has gone to for the
replat and the petitioner's willingness to work out a compromise.

' Mr. Flora, Public Works Director, stated Mrs. Miller has requested a lot
split to provide a 70 foot iot abutting East River Road, a 66 foot lot,
and the remaining lot would be on the parcel where Mrs. Miller currently
resides.
Mr. Flora stated the City staff reviewed this property and has a number
of concerns as normally a replatting would be required so that the necessary
easements are dedicated.
Mr. Flora stated staff has suggested an 80 foot frontage corner lot parallel-
ing East River Road and a 75 foot lot adjacent to it. If the property is
split this way, it leaves an 84 foot lot, with the existing building on it,
and provides for. a 30 foot street and utility easement for future access �
to the large properties to the south.
, Mr. Flora felt access to Mrs. Miller's existing garage could be provided by
establishing a joint drivewa�y easement along the split property line, or by
converting the existing garage to home use and constructing a new garage
behind the existing house serviced off 64� Way.
Mr. Flora stated he has met with Mrs. Miller and explained the platting
process and necessary requirements, however, she is interested in dividing
the property through the lot split process. ,
Mrs. Dliller stated she visited all the persons in her block that would be
concerned about a road easement and, at this point in time, not one person
would be interested in acce:s. She stated she would like the Council to
consider her request for a 70 foot corner lot, a 66 foot lot adjacent to
it, and the rem�inder of the parcel to be her lot.
, Dti,. Qureshi, City manager, stated if the property is going to be split,
it should b.e platted so that proper easements be provided for future
access. He stated the easement only provides the right of access and
would not necessarily take the property, if there isn't a need for it
in the future. He pointed out that properties do change and the people
who live there now may not want access provided, however, this may not
_ be the case if the property is sold. _ _

Mrs. Miller stated if an easement is provided, it would be subject to road �
assessments and would reduce the value of the property.
Councilman Fitzpatrick felt one concern was if the road was ever developed,
Mrs. Miller would be assessed. He felt if there was no benefit to her
property, pos5ibly there would not be an assessment on it. He thought
Mrs. Miller might be reluctant to give the easement because there may bc`
a road assessment.

$"s,000 for the purchase of scoreboards i the new community park complex.
Mr. Schrupp stated the philosophy of the �ycees is to provide growth to the
members through corrcnunity development and, in keeping with this philosophy,
theirrpledge was for $6,000. He stated $3 000 was given last year and the
$3,000 presented this evening is their fin 1 payment.
All i;iLmbers of the Council extended their t nks and appreciation to �he
Ja�ycees for their contribution.
Dr. Boudreau stated there are several groups 'n the City assisting in Lhis
community park endeavor and he appreciates th ir support. He stated if

Councilman Fitzpatrick felt the lot split would be�;of s ane benefit to the

Mrs. Miller stated one of her concerns is the possibility of a road assess-
ment, however, she didn't want to sell.the lots and then have someone have
to pay for a road, after they tsought the property. She stated her original
proposal was for zero lot lines which she felt would be nice for the neighbor-
hood, but no matter what she does, it involves an easement.
` Mr,_Qureshi, City Manager, felt it was the City's responsibility to provide
( access. He stated if the Council wishes to acquire an easement and have
no assessment imposed, unless the access is used, this can be put into the
► record. Councilman Fitzpatrick stated he would be prepared to move that
they approve the sub-standard frontage width on the two lots and, in return,
that an access of 30 feet be provided along the west edge of the property
and also to give assurances that the property in question would not be
assessed for a road improvement, unless they have access from it and use it.
Councilman Schneider asked if they would be setting a precedent in app mving
the sub-standard lots.
Mr. Herrick, City Attorney, stated the Council has, in the past, given
waivers on dimensions of lots. He felt the situation here was somewhat
unique and didn't feel a waiver would correnit the Council to granting .
waivers in other situations.
Mr. Qureshi felt the matter of drainage should be taken into consideration
as some of the area was low and it could be handled when the buiTding permits
are issued.
Mr. Qureshi suggested, if the lot split is approved, the corner lot be 76
feet, the middle lot be 60 feet, and access be provided from 642 on the
west edge of the corner lot and there be no access off East River Road,
� MOTION by Councilman Fitzpatrick to approve Lot Split #82-03 to combine
� into three 1ots, 110 and 120 and 140 64'� Way, with a 76 foot lot (110 64� Way)
closest to East River Road, a middle lot of 60 feet (120 642 Way) and the
existing parcel (140 64; Way) where Mrs. Pliller's home is located, to be
84 feet. Further, the westerly 30 feet is to be dedicated as a road and
utility easement, with a 25 foot triangle at the intersection with 64Z Way.
All driveways and access for.these lots should be off 64'� Way and the
driveway on the 76 foot lot is to be on the west edge of the lot line,
with a paved driveway to the present garage located on the 84 foot lot.
The drainage on the two new lots will have to be considered at the time
building per�its are issued and a variance for the square footage on
the 60 foot lot is approved in conjunction with this ]ot split. Also,
there will be no future assessment on Mrs. Miller's lot, unless she uses
the street, if road improvement is needed to provide access to the south.
Seconded by Councilman Schneider. Upon a voice vote, all voting atye,
Mayor Nee declared the motion carried unanimously.
The Council noted, from Mr. Flora's memo, that Mrs. Pliller must come in
to apply for a vacation of the existing easement on her property.

Mr. Flora, Public Works Director, stated First Bank Systems is requesting
, a special use permit for a steel frame building to house an automatic
teller machine in Plenard's par-king lot.
He stated the Planning Cortmission has recommended approval of this request
for a special use permit.
Mr. Vern Wilcox, Assistant Vice President for First Bank System, Construction
Division, presented a model of the proposed building to be located on Menard's
site. Mr. Wilcox stated they are building these units, in conjunction with
other banks, so this necessarily wouldn't be just a First Bank unit. �
Councilman Schneider felt there may be a problem of control and asked what
mechanisms they were using.. Mr. Wilcox stated there are 19 points they are
continually monitoring, including the security, and stated that vandalism
hasn't been a problem. He pointed out there is no access to any cash in
this building and there are phones in the building in the event it is
necessary for a customer to communncate with someone regarding his banking �
transaction. �

Councilman Fitzpatrick felt there is a problem regarding the stop signs, as
you exit Plenard's parking lot, as people do not observe them.
Mr. Flora stated it is proposed that the banking unit would be primarily
used during the hours when Menard's and the shopping center across the
street are closed.
Mr. Wilcox stated their high traffic volume is during non-banking and
non-store hours.
Mr. Qureshi, City �lanager, questioned whether enough light would be
. provided, as it was pointed out �lenard's doesn't have any parking lot
lights.
Mr. Wilcox stated the building would be illuminated, however, the matter
of lighting the lot is probably sanething they would have to check.
Mr. Flora stated landscaping and curbing would be provided for this area.
Mr. Wilcox stated they are presently negotiating for the landscaping and
maintenance of the building. He pointed out they are concerned abuut
appearances and keeping a well-maintained building. -

Couneilman Goodspeed stated at the P�,-`anning Commisaion meeting there was

done to see what type of us�s the Council wishes in a manufacturing zone.
Mr. Herrick, City Attor �, stated the discussion at the Planning Commission
was pertinent and felt� may be a good idea to review the Zoning Code . He
stated industrial use� are changing somewhat to a more high teeh use . He
stated, originally, ;�he City did allow commercial in an industrial zone,
however, this was ;�hanged several years ago. He stated he hasn' t been
terribly eoncerne ��ith these developments because he felt they are good
quality. He st d persons having heavy industrial plants would be harmed
by this type f commercial use in a manufacturing zone . He felt the
distinction s becoming less clear and probably should be reviewed and
expand the definition or revert back to the type of zoning that was
previously in effeet.
Mr. Bur au, the petitioner, stated development in the �rin Cities is towards
light ulti-use high tech and away from heavy industrial. He stated he felt
this ould be a nice development for the conmunity. He stated the buildings .

Mr. Robertson, Community Development Director, stated a publ ic hearing was
held on this plat at the Council meeting of June 1 . He stated the plat
shows a 10 foot easement on the north and a 25 foot easement on the �rest.
He stated stipulation No. 3 had to be redrafted because the street easement
is not a part of the plat� but a separate document.
MOTION by Councilman Fitzpatrick to adopt Resolution No. 47-1987 With the
following stipulations attached as Exhibit A: (1) provide for the following
lot �:idths: a) corner 75 feet; b) middle 70 feet; c) westerly approximately
121 feet (incorporated on revised plat received June 10, 1987) ; (2) provide
a 25 fnot street easement along West of property with 25 foot triangle at
intersection with 64 1/2 Way. Petitioner not to be assessed for neW street

I Mr. Robertson, Community Development Director, stated this i a request for
a special use peroit to allo� offices not associated with principal use
in an industrial zone. He stated plans are to constr ct two buildings
totaling 113,000 square feet With 29$ lot coverage. He tated the parking
' ratio associated With a building of this type was one stall for every 500.

Councilman Goodspeed stated at the Planni g Commission meeting there Was �
� discussion regzrding the Zoning Code nd if it should be changed to
accommodate these types of buildin and there Was concern about the
additional traffic.
� I�r. Aobertson felt this Was a va1 eoncern and a reviex should probably be
done to see �rhaL type of uses Council Wishes in a manufacturing zone.
Mr. Herrick, City Attorney, ated the diseussion at the Planning Co�amission
was pertinent and felt it y be a good idea to review the Zoning Code . He
stated industrial uses ar changing somewhat to a more high tech use. He

stated, originally, the ity did allow commer i 1 ,
hoWever, this Kas ch ged several years ago. He stated he hasn' t been
terribly concerned � th these developments because he felt they are good
I quality. He state persons having heavy industri2l plants would be harmed
by this type of commercial use in a manufacturing 2one . He felt the
distinetion is coming less clear and probably should be revieWed and
expand the finition or revert back to the type of zoning that was
� previously effeet.
Mr. Bure u, the petitioner, stated development in the T�rin Cities is toNards
li�t ti-use high tech and aKay from heavy industrial. He stated he felt
I this ould be a nice develapment for the conmunity. He stated the buildings

c opy. He stated they are seeking tenants Who are ligt�t industrial users,
