The meeting was called to order at 7:55 P.M, by Chairman Jensen.

ADOPTION OF AGFNDA:
It was the decision of the Subcommittee to consider Item 2 as the first
one on the Agenda.
�j l. LOT SPLIT REQUEST: L.S. #67-02, J.Ro Du,�'iOUCHEL: Part of Lot 29, Block 1,
'� Marian Hills Addition.
Mr. DuMouchel was present, and explained that he owned Lot 30, Block l,
and North of his lot is Lot 29 which has been left vacant since most of the
lot was taken for 52nd Avenue leaving this triangle. The land lay idle for
quite a long time. He and his neighbor, Mr. Propokovich, purchased the
triangle and agreed how �t woul_d be divided. He picked up the piece along
his lot, had it surve.yed, paid back taxes, and with legal counsel had papers
drawn. We are asking your consideration that the lot lines will be approved.
This land will not be sold or built upon, just adding it to our lots and
making the area look better. �
Chairman Jensen asked Mr. DuMouchel if he had the actual description,
and was told that the deed was home, but Mr. DuMouchel would be glad to get ' . �
it. Chairman Jensen said the reason for concern is the �tandard for des-
criptions that has been more or less fo7.lowed in lot splits is that in order
to make the division of property there must be a simple description.
Irregular property becomes difficult and if we were to allow indiscriminate
situations of this scrt, it becomes too long and makes the job of administering
the City's business extremely difficult. It would be well to have the deed
as drawn by the attorne� to consider the description because this is a -
worthy purpose that �ou have in mind.
Mr. 0'Bannon said that he built Mr. Propokovich's home, so that he is
familiar with the area and that triangle was a collector of all the garbage,
and if the City of Fridley would have more people who would take a piece of
- property like this and improve it, it would be a fine thing.
Chairman Jensen told NIr. DuMouchel that if he would be willing to get t1�e
deed and return tonight, tihe Subcommittee will consider it at that time. Mr.
DuMouchel agreed.
2. DISCUSSION OF TF�E PROPOSr� ROAD PLAN FOR TI� COC���1N, CARLSON, CHIES, 0'FATTNON
AND SCHII'�ER PROPERTIES:

The description as written on the new certificate of survey was read by �
Chairman Jensen. The Subcommi�ttee agreed it was a simple and to the point
description.
MOTIOTZ by Albrecht, seconded by Schmedeke, that the Plats & Subdivisions-
Streets & Utilities Subcommittee recommend approval of the Lot Split #67-02,
J.R. DuMouchel, of part of Lot 29, Block l, Marian Hills Addition, pointing
out that the description is more complex than usual, but due to the fact that
it is not a building site, it would not be economical to plat. Upon a voice
vote, all voting aye, the motion carried unanimousl�r.
3. ALIGNMEN'I' OF 83RD AVEN[TE: Favre Gasoline Station:
A short resume was given oi this problem. i�'Lr. Favre had come in with an
application for a bui]_ding permit and Council did say to go ahead and acquire
the right of way, but Superior Oil is usging him to rebuild his station. Coon
Rapids was contacted and asked if they would be interested in cooperating, but
they were not. The Cit� Attorney was consulted regarding a.nnexing land for
the road from Coon Rapids, but he said it would be too involved.
It was noted that the Pl�.nning Commission at their meeting of June 23,
1g66 moved to concus with the Streets and Utilities Subcommittee recommendation
that 83rd Avenue N.E. be considered as part of the logical street pattern and
that the Cit� of Fridley take the necessary steps to carry out that pattern
as �he need arises and tha,t right of wa,y which is needed, be acquired before an�r
additions to the Favre Gasoline Station are made. �
The motion by the Council at their regular meeting of Jul.y 5, 1966 stated
they would "concur with the recommendation of the Plan.nirg Commission and ' • �
instruct the administrati.on to proceed with the necessar�r steps to obtain an
easement for 83rd Avenue in the Cit� of Coon Rapids" .
It was the unanimous opinion of the Subcommittee that the� should go
right along with the motion of the Council at their regular meeting of July
5, 1966 as stated above, and ask the Engineering Assistant to draw a map showing
a 60 foot road in Coon Rapids approximately 200 feet long. If it is possible
to buy a piece 6�J feet wide and about 200 feet long fron the land North of
Favre' s Station, then there is a �vay for the road to be build. It was also �
an unanimcna.s agreement that the previous actions taken were proper.

ADOPTION OF AGENDA:

Mr. DuMouchel was present and informed the Commission he was the owner
of Lot 30, Block 1, Marian Hills Addition and has been for eight years.
Lot 29, at the present time, is what was left over after 52nd Street was
put in and is to the north of his lot. It is a pie shaped piece of land.
For years it was just a hole, and a collector of garbage and junk. Last
fall he and his neighbor agreed to purchase this piece of property. He
had it surveyed, paid back taxes, had a deed prepared and recorded, leaving
40 feet in the northwest corner for his neighbor, Mr. Stanley Prokopovich.
The property is too small to build on, is still bare ground, but he has
started to plant evergreens. It is just a matter of having the area look
. better. .

In answer to the question of whether or not Mr. DuMouchel had a legal
description of the division, Mr. DeNiouchel said he had two deeds, one for
Lot 30 and the other the balance of Lot 29. The reason for the lot split
request was that the assessments could not be split without it. It could _
not be determined now if the assessments will be on two separate statements
or one.
The question was brought up whether or not Mr. Propokovich had filed
a deed for his 40 feet and the Engineering Department was asked to check
on this in order to prevent a small piece of land, too small to be utilized,
being returned to the City for lack of payment of taxes.
MOTION by Jensen, seconded by Ylinen, that the Planning Commission
accept the recommendation of the Plats & Subdivisions-Streets & Utilities
Subcommittee and recommend approval of Lot Split ��67-02, part of Lot 29,
' Block 1, Marian Hills Addition, J. R. ITuMouchel, upon verification of the
remaining triangle of property of Lot 29 actually being a recorded deed
to the abutting Lot 1, Block 2, Marian Hills 2nd Addition. Upon a voice
vote, all voting aye, the motion carried unanimously.
Member Erickson said that he thought the Commission would be doing
the right thing if they asked the other party to also enter into this,
principally because if we allotv the lot split and accept the deed to the
other property and acceptance with the deed, he is still under no obliga-
tion to pay the taxes as he has not petitioned for it. He could let it
go and the City would wind up with a piece of ground that is no good to ,
the City. The neighbor could accept the title and never pay taxes or
assessments on it.
Mr. DuMouchel said he hasn't had the property long enough to get a
tax statement and therefore does not know whether it will be one or two
statements.
Mr. UuMouchel was informed that the lot split request will go to the
Council on Monday for their consideration, and it would be advisable
; for him to have his deed available and also the deed for the smaller
�__ triangle if Mr. Propokovich has one.
2. DISCUSSION: FINAL PLAT (P.S. ��66-03) SHADY OAK ADDITION, ANDREW GAWEL:
Lot 2, Auditor's Subdivision ��92. . . .
Member Jensen explained that this was reopened as a function of a �
study to the north. An overall study is being made of the Southeast
Quarter of Section 13, concerning in part the parcels of 0'Bannon, Chies,
Carlson, etc. As a result of that study and the point it is in right now,
it appears that Benjamin Street will be a street of considerably more
importance than we recognized previously. We feel now the need for addi-
tional right of way. In the Council minutes of August 15, 1966, some
consideration was given to the needs of Benjamin Street. The second area
of discussion was the likelihood of 61st Avenue being terminated in a cul
de sac at the northwest corner of this subdivision. It was felt if this
were to take place, a turn around easement should be requested on the north
, end of Lot 1 of this proposed plat. This could be done in simple deed
form and held as an easement by the City without filing until such time
as a specific decision was made. Benjamin Street will almost certainly
be a major collector street for the entire neighborhood both to the

The City Manager said that they may have been given the permit on the Board
of �ppeals action.
The City Attorney s��.'.d that on behalf of St. Philip' s Church, this matter _
has been discussed, and the Church would be perfectly satisfied with the
location ancl parkin.g arran.gement. He said the rlortuary will have access
to 200 parking spaces across the street at the Church and i£ ttie Council
consi.ders this adequate the Church will enter into a reciprocal agreement.
Councilman Sheridan said that people will not know there is parking across
the 1treet and ��ahen the 18 spaces are full, they will parlc on the street,

var;..ances, given any additiocial information that they may not have had
previously, and direct the Administration not to issue the permit. Seconded
by Councilcnan Samuelson. Upon a voi.ce vote, there being no nays, Mayor
Kirkham declared the motion carried.
The Cit.y Engineer suggested that when the permit is issued ttie City ask
for three more feet of additional right-of-way from the Church and the
Mortuary on 61st Avenue for a sidewalk on their property so that they will
have the same houlevard as the City is asking from the school. The Council
