(j) Required Signatures
No plat of a subdivision shall be filed with the •,
Registrar of Deeds or accepted for filing unless signed �
by the Mayor and Manager or Clerk and unless approved
as to survey and engineering accuracy by the County
Platting authorities.
3. Zero Lot Lines.
A. �e City may approve subdivisions for the development of
zero lot line� corutpn wall residential structures within 1�2 and
�3 zones. �ese lots shall be divided equally as is reasonably
possible within the restrictions of the existing guidelines of
the Zoning Chapter.
B. All other zoning requiranents in the respective districts
except for the setbacks along the cam�ron wall, zero lot. line(s)
must be met.
C. Seg3rate meters must i;� provide�d to each dwelling unit for
water, electricity and natur� gas. In addition, the common
party wall(s) fire rating shall be one hour for existing
structure and two (2) one hour walls for new construction.
D. �he awner of the property to be subdivided shall execute and
record at their expense a "Declaration of Cavenants, Conditions
and Restrictions" as provic3ed by the City. The said document
shall be used to protect the rights of the individual owners
sharing the single structure to maintenance, repair and
construction in case of darnage to the original structure. The
declarations, covenants, conditions and restrictions shall i
pravide protection to the property owners and the City on the
following objects:
(1) Building and Use Restrictions.
(2) Party Walls.
(3) Relationships among owners of adjoining living units
and arbitration of disputes.
E. The City shall be a beneficiary to these declarations,
covenants, conc3itions and restrictions.

Should the Planning Conmission or Council f ind that any of the
regulations or requiranents herein are not applicable to a proposed
land subdivision or to a preliminary or f inal plat thereof, or would

In determining fair market value of public areas for land subdivision Por cash
payment as required by Ordinance #633, the following values xill be used:
Residential Subdivision �1�500.00 per lot
Residential Lot Split � 750.00 per lot
Commercial/Industrial Subdivision or Lot Split � 0.023 per sq, ft.
This fee is to be paid at the time of final plat or lot split appraval. The City
Couneil may defer collection to the time a building permit is requested for

The City retains the option to aceept an equivalent amount in cash from the

Mr. Betzold stated that if both dwelling units do not already h e
separate water and sewer services, is July 1 is a reaso ble
deadline?
Ms. McPherson stated that the date can be changed.
Mr. Gary Lenart stated he had no problems with the tipulations.
He stated both dwelling units do share the same wat and sewer at
this time. He stated Council will not be taking a action on this
request until after July 1. He does not want to ake the water and
sewer improvements if the plat is not approve
Ms. Dacy suggested a deadline of September , 1992.
MOTION by Mr. Kuechle, seconded by Ms. dig, to close the public
hearing.
IIPON A VOICE VOTE, ALL VOTING AYE, CBAIRPERSON BETZOLD DECLARED
THE MOTION CARRIED AND THE PUBLIC EARING CLOSED AT 8:25 P.M.
MOTION by Mr. Modig, seconded b Mr. Kuechle, to recommend to City
Council approval of Preliminar Plat, P.S. #92-04, by Gary Lenart,
to replat the North 250 fee of the East 830 feet of Government
Lot 1, Section 24, into t o parcels, generally located at 6070 �
Central Avenue N.E. , with he following stipulations:
l. An access ea ment shall be executed between Lots 1 and
2 for the e isting driveway, or relocate the driveway so
that it i located within the "flag" lot.
2. The pe tioner shall provide proof of separate water and
sewer ervices for each dwelling unit or provide separate

Ms. McPherson stated the property is located at the intersection
of Riverwood Drive and 71 1/2 Way N.E. and adjacent to East River
Road. The property is zoned R-1, Single Family Dwelling as are
the surrounding properties.
Ms. McPherson stated that located on the property is a single
family dwelling unit with an attached two car garage. In 1986,
the petitioner applied for a lot split, a vacation, and a variance
for this property. At that time, the proposal was to remove the
existing single family dwelling and subdivide the property into
three single family lots.
Ms. McPherson stated the variance request was to reduce the front
yard setback from 35 feet to 25 feet, and to reduce the rear yard
setback from 25 feet to 21 feet. At that time, the Appeals
Commission recommended approval of the variance request; however,
with the exception of the vacation request, the land use requests
were not reviewed by the City Council.
Ms. McPherson stated the present request by the petitioner is to
again subdivide the property into three single family lots;
however, in this case the single family dwelling unit on Lot 2 is
not intended to be removed. Lots 1 and 3 would be vacant and would
be sold for single family dwellings. Due to the location of the
existing single family home, Lot 1 at 7,901 square feet cannot meet
the minimum lot area requirement. Lots 2 and 3 meet or exceed the
minimum lot area requirement.
Ms. McPherson stated that Section 211.05 of the Subdivision
Ordinance allows the Planning Commission and the City Council to
grant a variance to the minimum lot requirement should they find
that the Code imposes an undue hardship on the subdivider. If the
Commission chooses to grant the variance, the Commission should
state the reasons for granting the variance to the zoning
ordinance. Staff recommends that the plat be approved to create
only two single family lots.
Ms. McPherson stated that Lot 1 also does not have the adequate
depth needed to construct a single family dwelling without granting
a variance. After the front and rear yard setbacks are applied to
this lot, the remaining buildable area is 23 feet wide for a single
family dwelling on this lot. Average homes are a minimum of 24

feet wide; therefore, a variance of some type would need to be
granted in order to construct a dwelling on Lot 1.
Ms. McPherson stated Lot 3 is unique in that it is a double-fronted
lot and is parallel to the street right-of-way instead of
perpendicular as are Lots 1 and 2. The setbacks should be pre-
determined by the Coinmission to insure that there is no confusion
as to where the setbacks are to be measured from once the lot is
sold and a house is constructed.
Ms. McPherson stated staff recommends that the Planning Commission
recommend approval of the proposed plat, to split Lot 32, Revised
Auditor's Subdivision No. 77 into two lots, instead of the proposed
three lots, with the following stipulations:
1. Execute a 17 foot bikeway/walkway easement along East
River Road on Lot 3 by August l, 1992.
2. Pay the current outstanding assessments of $210.54 by .
July 6, 1992.
3 . The setbacks for a dwelling on Lot 3 shall be as follows:
A. 35 feet from the property line adjacent to 71 1/2
Way;
B. 35 feet from East River Road;
C. The north and south lot lines which run directly
east and west shall be the "side lot" lines
Setbacks are ten feet for living area and five feet
for the garage.
4. Pay a park dedication fee of $1,500 per lot at time of
building permit issuance.
Mr. Gary Obrycki stated that it was his intention 5 1/2 years ago
to remove the existing older home. However, at this time, for
financial reasons, they are proposing to keep the existing house
and plat the property into three lots and sell off two lots for
single family dwellings. Some of the extra money he will make from
selling the two lots will be used to improve the existing older
home. -
Ms. Barb Severni, 7145 Riverwood Drive, stated she has heard that
Anoka County will be widening East River Road. How will that
impact the size of Lot 3, and will it still remain a buildable lot?
Ms. McPherson stated Lot 3 is slightly over 13 , 000 sq. ft. Even
if the County takes some property, there should still be adequate
lot area to exceed the 9, 000 sq. ft.

Ms. Severni stated the older home on Lot 2 is in very poor shape.
It is an eyesore to the neighborhood. It is hard to believe that
people will want to build new homes next to a home that is in such
poor shape. She stated she is not in favor of subdividing the
p'roperty into three lots when one of the lots would be substandard.
She would like to see only two lots and the removal of the existing
home.
, Ms. Diane Naumovich, 100 - 71 1/2 Way, stated she lives right by
Lot 3. She stated they were notified by Anoka County on January
23, 1991, that the County wanted to leave her with 40 feet in her
back yard. Her lot is 137 ft. by 70 ft. She did not understand
how a home will be able to be built on Lot 3 with the County taking
so much property. Her main concern is that three lots are just not
going to work.
Ms. Jean Latour, 80 Alden Circle, stated her property backs up to
Lot 1. That lot is very small. She stated the existing house is
in horrible shape. In the past, the house has been condemned
several times and it is in worse shape now. She would like to see
the existing home torn down and the property subdivided into two
lots instead of three. Lot 1 is not big enough for a house.
Ms. Modig asked if there is any documentation of condemnation on
the existing home.
Ms. McPherson stated there are notes in the file that indicate that
the City has inspected the property several times; however, there
are no condemnation notices in the file.
Mr. Albert Aspenson, 112 - 71 1/2 Way, stated he is concerned about
three lots and putting two more houses on this property. These are
very narrow lots, and he is concerned about how two houses would
fit into the neighborhood. He would not be in favor of three lots.
Mr. Jerry Tollefson, 106 - 71 1/2 Way, stated if two more homes
are added on this property, that would put seven driveways onto
this little cul-de-sac. There is enough traffic in front of their
homes. He is also in agreement that this property should not be
subdivided into three lots. Two lots are the maximum.

� Ms. Modig stated she is not comfortable with taking any action on
this request until they have more information about how much
property the County will be taking for the expansion of East River
Road. Depending upon how much property the County takes, it could
adversely affect this. property.
Ms. Dacy stated staff is willing to contact Anoka County and
confirm the exact square footage that will be taken. However, with
a two lot subdivision, there would be adequate buildable area to
build on Lot 3 without any variances.
Mr. Betzold stated he cannot agree to the subdivision to three lots
creating a substandard lot for the sake of maintaining the existing
home.
Mr. Kuechle stated he also could not agree with the proposed plan
which creates a substandard lot that would need variances in order
to build a single family dwelling.

Council denial of the proposed Preliminary Plat, P. S. #92-03, by

REQUEST
The petitioner requests that a plat be approved to create three
single family lots on Lot 32, Revised Auditor's Subdivision No. 77.
The request is generally located at 105 - 71 1/2 Way N.E.
SITE
Located on the subject parcel is a single family dwelling unit
constructed in 1954, which has an attached two car garage. The
property is zoned R-1, Single Family Dwelling, as are all adjacent
properties.
ANALYSIS
Historv
The petitioner applied for a lot split, vacation, and variance in
1986. The proposed lot split was to subdivide the subject parcel
into three single family lots. The vacation request was to vacate
a portion of right-of-way adjacent to 71 1/2 Way. The variance
request was to reduce the front yard setback from 35 feet to 25
feet, and to reduce the rear yard setback from 25 feet to 21 feet.
The Appeals Commission recommended approval of the variance
request; however, with the exception of the vacation request, the
land use requests were not reviewed by the City Council. The
petitioner at that time was intending to remove the existing house
and construct three new single family dwellings.
Present Reciuest
The present request is to subdivide the subject parcel into three
single family lots; Lot 2 for the existing house and Lots 1 and 3
to be sold for single family dwellings. Due to the location of the
existing single family home, Lot 1 at 7,901 square feet cannot meet
the minimum lot area requirement. Lots 2 and 3 meet or exceed the
minimum lot area requirement. Section 211. 05 allows the Planning
Commission and the City Council to grant a variance to the minimum
lot requirement should they find that the code imposes an undue
hardship on the subdivider. The Commission should state the
reasons for granting a variance to the requirements of the zoning
ordinance. Staff recommends that the plat be approved to create

The City Council continued the public hearing for the plat request
for 105 - 71 1/2 Way N.E. at their June 29, 1992 meeting. The
petitioner has since worked with the property owner to the west of
the subject parcel and has reached an agreement for the property
owner to purchase one half of the original proposed Lot 1, which
' will become Outlot A. The remainder of proposed Lot 1 will be
combined with Lot 2 to create a new Lot 1 and the proposed Lot 3
will become Lot 2. Lot area for Lot 1 is 12,750 square feet and
the lot area for Lot 2 is approximately 13 ,430 square feet.
Recommendation
Staff recommends that the City Council direct the petitioner to
prepare the final plat as proposed. Staff, at final plat approval,
will also recommend a fifth stipulation:
1. Outlot A shall be combined with the property to the west in
conjunction with filing the plat at Anoka County.

Ms. Dacy, Community Development Director, stat� that this request
is for a variance to reduce the front yard s back from 35 feet to

stated that the petitioner is also propo ng to create a covered
walkway to the new entrance of the dwell ' g unit. She stated that
the petitioner received a special use ermit for a second garage
in 1986.
Ms. Dacy stated that this area was p atted in 1954 , and there are
homes built closer than the typica 35 foot setback.
Ms. Dacy stated that the Appeals ommission recommended denial on
a 3 to 1 vote, and staff concur with this recommendation.
Mr. Awaijane stated that bot Yiis neighbors were at the Appeals
Commission Meeting and hav no objection to his addition. He
presented photos of those omes in the area that have less than
35 foot setbacks.
Councilwoman Jorgenson ated that she did not feel the issue was
the setback but the am nt of lot coverage.

Councilman Billin s asked if there was a policy regarding averaging

Ms. Dacy stat d that there is a section in the Zoning Ordinance
regarding th' issue, which she explained.
Councilman illings stated there is a certain amount of logic that
if there s a situation on a street where there are a number of
homes th t do not meet the minimum setback, the variance is not
going t create a hardship on other properties. He felt that this
theory applies in this particular case. He stated that if the
petit oner's figures are correct, the average front yard setback
is 2 feet.

Mr. Richard Smallwood, 7150 East River Road, stated that he lives
north of the proposed lots. He stated that his driveway is along i
the lot line on the north side along Lot 2 . At this time, every
time the City flushes the hydrants, the water comes into his yard.
He stated that he has called the City about this problem in the
past. He has been told there is supposed to be a storm water
drain, but he has lived there for 25 years and has nOt seen olle
yet. If Mr. obrycki raises the land level up to the level of the
other' new homes lri the area and builds a house on Lot 2, he W111
end up with all ]cinds of water. That leaves his driveway at least
one foot below the rest of the land.
Mr. Flora stated that the City will have to wait until they get a
building permit for the new home, but he did not see the petitioner
raising the land one foot adjacent to Mr. Smallwood's property.
Normally, the City would not allow that. There are also plans to
do some work on East River Road in the near future, and maybe some
of these concerns can be addressed with the East River Road
improvement.
Ms. Diane Naumovich, 100 - 71 1/2 Way N.E. , stated that this is her
third time before the Council on this issue. Her concern is with
the clean-up and maintenance of this property. The petitioner
promised her in August 1991 that he would clear out Lot 2 , but the
mega-storm came, and it was never done. Is he going to clean up
Lot 2 first? She would appreciate it if he would keep his promise.
There are two trees on the lot that could fall in bad weather.
When the current tenants at 105 - 71 1/2 Way N.E. move, is it going
to stay rental property? Is the petitioner going to keep the
property up until he finds the right tenant? Will he check on the
property on a regular basis and provide security for Lot 1? Will
the grass be cut? She did not know if the petitioner is going to
improve the house, both inside and outside, but he is going to have
to look at grooming the property so it looks good if he is going
to re-rent the house.
Ms. Naumovich stated that there have been a lot of hurt feelings
on the part of the people in this circle. If the Council is going
to give Mr. Obrycki what he wants, the Council has to give to the t
people who live there what they want, too, that Mr. Obrycki provide `t
security for his property, that he cut the grass, and that he clear .m
Lot 2. she is concerned about the safety of the people in the �a
circle.
Mayor Nee asked Mr. Obrycki to respond to Ms. Naumovich's concerns.
Mr. Obrycki stated that he has renters living in the existing home,
and rental people are not going to take care of the house like they
would their own. That is why, when he decided to split the lots,
he decided to sell the house. In order to sell the house, he is
going to have to fix up the house and maintain the lot. Lot 2 will
definitely be cleaned up. They will cut down all the bad trees,

Ms. Dacy, Community Development Director, stated that this plat
request is to create three single family lots. She stated that
there is an existing home on Lot 2, and Lots 1 and 3 would be sold
for single family dwellings. She stated that Lot 1 does not meet
the minimum lot area requirement, and Lots 2 and 3 meet or exceed
the minimum lot area requirements.
Ms. Dacy stated that at the Planning Commission meeting, there was
a question from the neighbors regarding the amount of right-of-way
the County would take for road improvements. She stated that the
County has indicated they did not have the exact width, but the
amount needed for the improvements would be 15 to 25 feet to be
acquired from the proposed third lot.
Ms. Dacy stated that staff's recommendation to the Planning
Commission was for denial of this request because one lot is below
the minimum lot area requirement and, due to the existing depth of
the lot, a va�iance would be needed to the front and rear setbacks.
She stated that staff did recommend creating two lots, one for the
existing home and the other lot on the east portion of the
property. She stated that the Planning Commission also recommended
the Council consider a two lot plat.
Mr. Obrycki, the petitioner, stated that he would be in agreement
with splitting the property into two lots but would prefer to have
three lots. He stated that he intends to upgrade the existing
home. He stated that at this point, he is requesting the lot split
for two lots.
Councilman Billings stated that the homes in the immediate adjacent
area are mostly new homes and asked if this home is of lesser value
than most of the homes in the neighborhood.
Mr. Obrycki stated that a realtor has advised him he could sell the
home for about $65,000 to $70, 000, and the other homes in the area
are valued at about $90, 000 to $100, 000.
Councilman Billings asked Mr. Obrycki what his plans would be for
the property if the lot split is approved for the three lots.
Mr. Obrycki stated that he would sell the property and make some
improvements in the home in order to sell it.
Councilman Billings asked Mr. Obrycki what his plans were if the
property was split into two lots.
Mr. Obrycki stated that the home would be improved, but he would
have more money if the parcel was split into three lots, and he
could make more extensive improvements.
Councilman Billings stated that it seemed one alternative, when
this issue came up in 1986, was to sell a portion of the property
to the property owner immediately to the west.

Ms. Dacy stated that the total property is valued at $69, 000, ut
she did not know what portion of this value is for the dwe ings
and what portion is for the lots.
Councilman Schneider asked the approximate cost of the addition.
Mr. Lenart stated that he is proposing a 30 by 30 fo t addition at
a cost of about $10, 000. He stated that he would b doing the work
himself.
Ms. Dacy stated that with the addition, the ho e would be in excess
of the code requirement.
Councilman Schneider stated that close o fifty percent of the
value would be added with the expansio . He asked if the entire
home had to be brought up to code.
Mr. Herrick, City Attorney, stated that he would need additional
information from the owners and s aff to answer the question.
Councilman Billings asked if it was the Planning Commission' s
intent, when they requested hard surface driveway be provided,
that the driveway to the ea lot also be brought up to code. He
stated that, in any case, his has been the City's past practice.
Mr. Lenart stated tha he is the sole benefactor of all this
property and the hom . He stated that he does not intend to
remain in Fridley al his life.
Councilman Schnei er questioned if the City may be better off
discussing any p tential acquisition at this time.
Councilman S neider felt that there are a number of items
regarding t e building code issue, hard surface driveways, and
potential cquisition which should be discussed further.

Ms. Dacy, Community Development irector, stated that this item is
before the Council as Stipulat' n No. 14 of this Special Use Permit
which required Council review at the first Council meeting in July.
She stated that this permit as issued to allow a repair garage at
7570 Highway 65 N.E. , and the Council also approved a Settlement
Agreement between the Ci and Samir Awaijane and Mike Thompson at
the same time. She st ted that there are four partners in this
corporation, and thre of the four are here this evening.
Ms. Dacy stated tha a deadline of June 1, 1992 was established for
the building and lectrical code improvements, screening of the
outdoor storage ea including an eight foot wood fence, paving the
parking lot, as well as striping, concrete curb, and landscaping.
She stated t t only three items have been completed in the
easterly bui ing on the property. She stated that the other items
need to be ddressed.
Ms. Dacy stated that Mr. Awaijane stated the fence would be
complet d as soon as possible in conjunction with �he paving. She
state that the parking lot is under construction and must be
stri d and landscaped. She stated that the Police Department has
con cted two inspections, and there were several vehicles and
pa ts that did not have a corresponding invoice and Mr. Awaijane

6. RESOLUTION NO. 82-1992 APPROVING A PLAT, P.S. #92-03 , GARY
OBRYCKI ADDITION (105 71-1/2 WAY N.E. ) :
Ms. Dacy, Community Development Director, stated that this plat has
been revised to create two, rather than three, buildable lots. She
stated that one lot is for the existing single fa�iily home, and the
other lot is vacant for building. She stated that Outlot A is to
be conveyed to the adjacent property to the west.
MOTION by Councilman Fitzpatrick to adopt Resolution No. 82-1992,
with the following stipulations attached as Exhibit A: (1) execute
a 17 foot bikeway/walkway easement along East River Road on Lot 2
prior to the City signing the plat; (2) pay the current outstanding
assessments of $210.54 prior to the City signing the plat; (3) the
setbacks for a dwelling on Lot 2 shall be as follows: (a) 35 feet
from the property line adjacent to 71-1/2 Way; (b) 35 feet from
East River Road; and (c) the nQrth and south lot lines which run
, directly east and west shall be the "side lot" lines. Setbacks are
ten feet for living area and five feet for the gara�e,; and (4) pay
� a park dedication fee of $1,500 per lot at the time of building
permit issuance. Seconded by Councilman Schneider.
Councilman Billings stated that when this item was f�r�t i�efore the
Council, concern was expressed about creating outlots. He stated
that it was his understanding the whole process of creating the
outlot was contingent on the sale of the outlot to the adjacent
property owner. He �felt that this should be part of the
stipulations.
Ms. Dacy stated that staff is in the process of arranging for
Mr. Obrycki to bring in the deed, and the plat would not be filed
until this is done.
MOTION by Councilman Billings to add the following stipulation: (5)
"That Outlot A must be so13 to the property owner immediately west
of this property and that the plat is contingent upon the City of
Fridley receiving a copy of the deed to that effect. Further, the
plat and the deed �shall be filed simultaneously. " Seconded by

Mr. Pribyl stated that they are trying to ccomplish this within

RESOLUTION NO. 82 - 1992
A RESOLUTION APPROVING PLAT, P.S. #92-03, GARY
OBRYCKI ADDITION
WHEREAS, the Planning Commission held a public hearing on the Plat,
P.S. #92-03, on May 13 , 1992, and recommended approval; and
WHEREAS, the City Council also conducted public hearings on the
proposed Plat at their June 29, 1992, July 6, 1992, and July 20,
1992 meetings, and approved the Plat at their October 19, 1992
meeting; and
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City
of Fridley hereby approves the Plat, P.S. #92-03, Gary Obrycki
Addition, with the stipulations attached as Exhibit A, and
authorizes the Mayor and City Manager to sign the Plat as prepared
by Bolton and Menk Inc.
BE IT FURTHER RESOLVED that the petitioner is requested to record
this Plat at Anoka County within six (6) months or said approval
with become null and void.
PASSED AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF FRIDLEY THIS

1. Execute a 17 foot bikeway/walkway easement along East River
Road on Lot 2 prior to the City signing the plat.
2. Pay the current outstanding assessments of $210.54 prior to
the City signing the plat.
3. The setbacks for a dwelling on Lot 2 shall be as follows:
A. 35 feet from the property line adjacent to 71 1/2 Way;
B. 35 feet from East River Road;
C. The north and south lot lines which run directly east and
west shall be the "side lot" lines. Setbacks are ten
feet for living area and five feet for the garage.

Dear Gary:
As you are aware, the Council approved your plat on October 19,
1992 . The City has yet to finalize the plat by having the Mayor
and City Clerk sign the mylars in preparation for recording at the
County.
The City ordinance requires that all plats are to be recorded at
the County with 180 days of City Council approval. Once 180 days
have passed, the plat becomes null and void, and the process must
be reinitiated. You have until April 17, 1993, to record your plat
at the County. Please recall that the City will not sign the
mylars until you have executed and presented the deed for the sale
of Outlot A to the adjacent property owner to the west.
