The meeting was called to order by Chairman Jensen at 7:35 P.M.

ORDER OF AGENDA; ,
The Subcommittee decided to take Item ��6 first because the petitioner
was present. The rest of the items would be taken in the opposite order as
written, 5, 4, 3, 2 and 1.
1. LOT SPLIT REQUEST: L,S. ��68-�6, RUTH T GEDIG: Lots 14 through 18, 53
and 54, Block G, Riverview Heights.
Mrs. Gedig stated that she owns Lots 15 through 18 on Hugo and her house
is on Lots 15 and 16. She plans on selling Lots 53 and 54 but her house is
built practically on the lot line. She is requesting a five foot strip for
� additional rear yard.
Member Jensen said the house sets on the back of Lots 15 and 16, and
if she sold lots 53 and 54, except for the requested five feet, he wondered
if it would be possible for her to get the contractor, who would be building,
and have to have a certificate of survey in order to get a building permit,
to verify the location.
Mrs. Gedig was informed that when the contractor orders the survey for
Lots 53 and 54, that he show the location of her house, how far it is to the
house from the new lot line.
Mrs. Gedig stated the stakes are easily identified on the back of the
lots, but in the front of the lots, she wasn't sure. When she stated that a
neighbor wanted to buy part of Lot 18, she was informed the cost of a survey
goes down considerably on the second lot. By putting the whole thing together,
she might come out considerably better. However, the Subcommittee could pro-
- ceed to take action regardless of the plans for the other lot.
MOTION by Schmedeke, seconded by Albrecht, that the Plats & Subdivisions-
Streets & Utilities Subcommittee approve the lot split, L.S. ��68-06, Mrs.
Ruth T. Gedig, to split five feet in depth, 50 feet in width off the South
end of Lots 53 and 54, this to be added to the North end of Lots 15 and 16,
Block G, Riverview Heights, waiving certificate of survey for Lots 15 and 16,
provided that the location of those lots are indicated on the survey for
Lots 53 and 54. Upon a voice vote, all voting aye, the motion carried
unanimously.
Mrs. Gedig was told that when the builder gets his lot, he should request
the surveyor to locate her house in relation to the new lot line and that

. should be provided for the next Planning Commission meeting on February
� 29th. The actual measurements to the edge of her house should be shown on the .
survey.
2. LOT SPLIT REQUEST; L.S. ��68-05, WALTER R. MACIASZEK: Lots 18-20, 26-28, Block 2,
Oak Grove Addition.
The area was checked on the aerial map. The question was asked if it were
necessary to ask the petitioner to provide a survey and descriptions. It was
' decided that at this level a drawing is sufficient because if changes have to
be made, it will be of less cost to the owner than having a survey changed in
the beginning.
MOTION by Albrecht, seconded by Schmedeke, that the Plats and Subdivisions-
Streets & Utilities Subco�nittee recommend approval of L.S. ��68-05 by Walte'r R.
Maciaszek of Lots 18 thru 20, 26 thru 28, Block 2, Oak Grove Addition subject
to certificate of survey for consideration of the Planning Commission, splitting
Lot 27 in half with half going to each of Lots 26 and 28 making two 60 foot
building sites and them the same on Lots 18 and 19, splitting into building
sites of 60 feet each. Upon a voice vote, all voting aye, the motion carried
unanimously.
3. LOT SPLIT REgUEST: L.S. ��68-04Z LARRY DEAN FERGUSON: Lot 21, Block 2, Spring
Lake Park Lakeside. �
The Engineering Assistant produced a street pattern which had been adopted
several years ago. It showed that Lots 20 and 21 will have access on the rear
of the lots. The back half should be red tagged as far as building is concerned
until water and sewer are put in. However, the Subcoirmlittee felt they needed
more information. The garage should also be tied in.
MOTION by Albrecht, seconded by Schmedeke, that the Lot Split request,
L.S. ��68-04, Larry Dean Ferguson, Lot 21, Block 2, Spring Lake Park Lakeside,
be continued until March 6, 1968. Upon a voice vote, all voting aye, the motion
carried unanimously.
4. LOT SPLIT RE UEST: L.S. ��68-02i ARTHUR CHRISTENSON: All of Lots 2 and 3, and
part of Lots 20 and 21, Block Z, Rees Addition to Fridley Park.
The Engineering Assistant said the location of the land is North of the
telephone building. The rear (Westerly line) is one foot from the old City
Hall garage which was moved to that property. He said Lots 1 and 2, Block 2,
are zoned C-1 and Lots 3, 4, 19, 20, 21 and 22 are zoned light industrial.
The Professional Buildi.ng is commercial as well as 1, 2, 3, Block 1, and the
telephone building is light industrial. Lots 2 and 3, the way they are zoned,
are basically impossible to build on, as they would have to maintain a 35 foot
clearance. They are still under one ownership, but Mr. Christenson wants to
have the split for special assessments £or now.
Being the request for the split was in two different types of zoning, the
Subcommittee believed this was more of a zoning problem than lot split. If
both lots were zoned the same, there would be no problem of setbacks, and if
- they approve this lot split, an illegal sideyard would be created,

Chairman Hughes said he agreed entirely with that analysis, as it would be
the logical result if the rezoning application were approved.

Member Jensen saw an error in the motion of the Plats & Subdivisions-Streets
' & Utilities Subcommittee minutes of February 15, 1968. He asked the following
correction be made: "waiving certificate of survey for Lots 15 and 16 provided
that the location of the house on those lots are indicated on the survey for Lots
53 and 54." He called attention to the sketch submiLted by Mrs. Gedig showing
the house exists on Lots 15 and 16 and is extremely close to the lot line, and
as they did not �vish to put the petitioner to the additional expense of having a
survey, suggested the above procedure.
Mrs. Gedig presented certificates of survey which she had drawn up and, as
they contained the info nnation the Subcommittee asked for, Member Erickson said
that on the basis of that, he would make the motion.

No one was present representing the petitioner.
The area was described by the Engineering Assistant as follows: All single
family awellings, lots on Fridley Street are 80 foot lots, at the South end of
� the blocics they are vacant, Lots 18 to 20 are vacant, one owner from Lots 21 to
23 has house and garage, Lot 21 has the garage, Lots 24 and 25 one ownership
and built, Lots 26 through 28 vacant, and a house on Lots 29 and 30. The homes
built on Fridley Street are on double lots."
Mr. Jensen stated the Plats & Subdiv�isions-Stree�s & Utilities Subcomznittee
asked that Mr, Maciaszek get a certificate of survey showing the position of the
adjacent buildings for the Planning Commission.

made a motion subject to receiving of certificate of survey, that the Lot Split
request, L.S. ��68-05, Walter R. Maciaszek, Lots 18-20, Lots 26-28, Block 2, Oak
Grove Addition, be tabled until a certificate of survey, showing the location
of adjacent constxuetion, is submitted to the Planning Commission. Upon a voice

Chairman Hughes reviewed the preliminary plat request saying that the peti-
tioner had asked that the petition be continued, that it was heard by Council

RESOLUTION ��32-1968 - IMPOSING LOAD LIMITS ON PUBLIC STREETS AND HIGHWAYS IN
THE CIT'Y OF FRIDLEY:
CounciJ.man Harris asked if this was the same resolution listing the same streets
that has been passed in the past. The City Engineer said that as the streets
are built to higher standards, they are eliminated from the list. He said that
in the past there were many streets that were not up to standard, but once they
conformed to state and county road limits they were taken from the list. The
City Engineer said that in the past the City has been issuing many permits
for such things as cement trucks to travel over the roads, but this year they
plan to only issue permits to people in dire need, such as moving in or out
of a house. The Council agreed that this was necessary to protect the streets,
and it would be an administr.ative decision as to wtiich p::rmits were justified.
Chief McCarthy said that the City had no way to enf.orce the load limits
effectively as we do not own s�ales. He said that there is a minimum distance
; a truck is required to travel to be weighed, but he thought the scales at
' Minnesota Linseed Company would come within that distance. Mr. Gibbs pointed
out that the City would have to pay any charge, unless a truck was overweight
and there was a fine. Mr. Gibbs said he would check the regulations on mileage
and give this information to the Chief of Police. There was a discussion about
the possibility of using the scales of the Wyatt Company in the north end of
Fridley also. The Council suggested the Administration work out a reasonable
program, so there is adequate enforcement for the load restirctions.
MOTION by Councilman Liebl to adopt Resolution ��32-1968. Seconded by Council-
man Harris. Upon a voice vote, there being no nays, Mayor Kirkham declared the
motion carried unanimously.
PLANNING COMMISSION MEETING MINUTES FEBRUARY 29 1968•
1. CONTINUED REZONING REOUEST: ZOA ��68-01 ELDON SCI-T�i1EDEKE:
Councilman Harris said that a Public Hearing is scheduled on this request for
March 11, 1968, so the only action necessary would be in receiving the minutes.
2. LOT SPLIT REQUEST: L.S. ��68-06, RUTH GEDIG: LOTS 15, 16, 53 AND 54L

_ The City Engineer showed the Council a map and explained that Mrs. Gedig had
owned all the property shown, but she has sold two lots, and would like to

i RICE CREEK ROAD/CENTRAL AVENUE PLAN:

The City Engineer said that the Planning Commission has been working on this
plan for over 9 months, and has resolved a street plan that they recommend be
adopted as a guide to be used when individuals in the area start planning
their property, at which time suggestions and deviations could be made if
necessary. Councilman Sheridan said he had received a call from one of the
affected property owners, who objects to the plan, and he had told him he did
not think the Council would be taking action on it at this meeting, as it is
the first time the Council has seen it, so Councilman Sheridan said he would
request that the Council table this item until the next meeting when this
property owner could appear.
MOTION by Councilman She-ridan to table consideration of the Rice Creek/
Central Avenue Plan until the regular Council Meeting of March 18, 1968. He
said that he would contact the interested property owner. Seconded by Council-
man Samuelson. Upon a voice vote, there being no nays, Mayor Kirkham declared
the motion carried unanimously.

Councilman Harris said that in regard to the Schmedeke rezoning, for which
there is to be a public hearing next week, he would suggest that the Council
keep in mind that it might be in order for them to have a meeting with the
Planning Commission on the whole general area, before individual requests
are considered. He said that the policy is usually to close the public
hearing and not make a determination the same evening, and he would suggest �
they follow this policy and then hold a meeting on the general area. Mayor
Kirkham said he thought the Planning Commission would appreciate some communi-
cation from the Council. Mr. Schmedeke said that at this time he is interested
in his own lot, but he would be happy to work with a planner or the Planning
Conunission on the whole area.
RESOLUTION ��33-1968 - ORDERING PRELIMINARY PLANS AND SPECIFICATIONS FOR STREET
IMPROVEMENT PROJECT N0. ST. 1968-3;
The City Engineer said that this resolution is basically setting the program
the County will be putting in, and in which the City will share the cost of
sidewalks and curbs. Councilman Liebl said he would like to see exactly what
is planned for the west service drive on T.H. �k47 and riississippi Street, and
' would like to know how much right-of-way must be acquired. The City Engineer
said that he would give him a copy of the plan. Counci].man Harris asked if
this project will cover the loop on Star Lane. The City Engineer said it ,
would not. He said this was 6 projects under one contract that the County is F �

letting and supervising, and the County and City wi71 share the cost. He .
Said that on the West University Service Drive, the cost will be shared by �
the State and City. He said that hopefully this will all be done this year.
