it will be required for this meeting. The City Council meets on the first
and third Mondays of the month.
6. �e City Gouncil ap�wal may be subject to oertain stipulations which must
be oampil ed with tr,� the appl icant.
7. If apprwed, the applicarit shall then have the land involved in the lot split
surv�ed. Upon receipt of the required Surv�or's Certificate, the Council
shall pass a resolution appraving the lot sglit.
8. After fir�l appraval, a �ertified oop� of the resolution appraving the
lot sglit and a "Certificate of Status" form shall be attached to the notioe
of appraval and forwarded to the appl icant. �e lot sgl it, together with a
certif ied aop� of the resolution and "Certif ication of Status" form, shall
thereafter be reoorded among the reoords of the County within one hundred
eighty (180) days after the date of the resolution, �].ess a longer period of
time is granted and prwided for reoording at the time of apprwal.
9. In all cases where City Council action has been sought and denied, no petition
for iderrtical action can be preserited until a period of six mortths has elapsed.

In determining fair market value of public areas for land subdivision for cash
payment as required by Ordinanee �633, the follawing values wi11 be used:
Residential Subdivision $1,500.00 per lot
Residential Lot Spl it $ 750.00 per lot
Commereial/Industrial Subdivision or Lot Split $ 0.023 per sq, ft.
This fee is to be paid at the time of final plat or lot split approval. The City
Council may defer collection to the time a building permit is requested for
individual lots created by sueh subdivision/lot split.
The City retains the option to aecept an equivalent amount in cash from the
applicant for part or all of the portion required to be dedicated.
PARK FEE AGREEMENT
The undersigned understands that aceording to the City Platting Ordinance, the
follawing public park land dedication is requi.red to plat residential, commercial
or industrial zoned property.
It is further understood that the publie park land dedication or cash payment
equivalent is at the discretion of the City.

UPON A VOICE VOTE, ALL VOTING AyE, CHAIRPERSON BILLINGS DECLARED THE
MOTION CARRIED UNANIMOUSLY AND THE PUBLIC HEARING OPENED AT $:40 p.m.
INr. Robinson stated 1�. Olchefske wishes to expand his ca�wash
facility by adding 1,252 square feet to the existing bu" ding.
He stated l�tr. Olehefske intends to use this extra spac for uses
associated with his car wash business such as polish' g and buffing.

A'h�. Robinson stated in conjunction with the rezoni�g petition by
Tfr. Olchefske and Mr. Freyinger, I�. Freyinger wia�l make available
ten parking stalls on the west end of his 1ot f r this operation.
He stated in order to facilitate the building rogram for Mr. Ole-
chefske a building permit would be issued un er C-1 and would be
valid under the C-2 zoning when it is compl��ted.
Mr. Robinson stated staff is recommendin �the following stipulations:
(1) owner agrees to manage the car was operation in such a way as
to not require greater than LO space of parking. In the event of
a shortage, parallel parking may be equired on the north side of
the building; (2) special use perm' , SP ��87-15, is contingent upon
compliance with all stipulations utlined in the rezoning petition
ZQA ��87-03; and (3) it is unders1.tood by the City and the petitioner
that speciai use permit, SP ��8��=15, is valid under the proposed C-2
zoning classification. �`

l�r. Robinson stated there �'s a water line on the east side of the
property .and, based on re��ent information, there is the possibility
this could be a public e�`sement. He stated if this is the case,
a vacation would be ne�"essary before the building is constructed.
He stated staff woul suggest the Commission recommend to the City
Council that constr tion be allowed to proceed if Mr. Olchefske
provides a new eas ent, pays all costs to relocate the water line,
and applies for a vacation of the easement. He stated if this is
a private easem t, it would involve only the two property owners
and Nh�. Olchefs_ e would have to provide a new easement and pay any
relocation co�Es.

Mr. Robins stated if this special use permit is recommended for
approval, he stipulation regarding the driveway on East Ri�rer Road
should b included.

Ms. Sherek stated as she understands, the driveway on East River Road
would. be designated and signed as an exit only and the driveway on
Mis��issippi would be signed as an entrance, but not necessarily

Mr. Robinson stated this proposal is to remove an existing home and
split the property into three lots each about 66-1/2 feet wide. He
stated the petitioner, in conjunction with this lot split, is requesting
a vacation of the alley easement. He stated if the alley is vacated,
these lots wi11 all meet the code requirements regarding square footage,
however, without the vacation, they will be slightly below.

Mr. Robinson stated staff is recommending the following stipulations:
(1) petitioner or subsecuent owners agree to construct homes of
equal or better qualit�;: ''��n those petitioner has used as illustrative
of intended development; (2) lot width variances for width and area
to 66.66 feet and 8,599 square feet respectively arc granted with
the final approval of this lot split; (3) three park fees of $750 each
to be paid prior to issuance of each permit; and (4) lot split to be
recorded at the County prior to October 15, 1987 .
Mr. Leffler stated the lots would be about 66 feet wide and the homes
45 to 46 feet wide. He stated the square footage of the homes would
range from 1,070 to 1,100 and the fronts of the homes would be
different. He stated these homes would be two bedrooms with the
possibility of expansion in the lower level and double car garages
no smaller than 22 x 22 feet. I�. Leffler stated he built the home
to the north of this ro erty which is on a 66 foot lot.

Mr. Betzold asked the price range for these homes. 1�. Leffler stated
' they would range fro m the upper 80's to the low 90's.
I�. Kondrick asked if the homes would have the same setbacks as the
others fronting on Jefferson Street. Mr. Robinson stated the minimum
setback is 35 feet so this would not be a problem.
Mr. Leffler presented photos of a similar home in Andover which he
constructed.

Mr. Fl.ora, Public Works Director, stated Well No. 1 had to be taken out of
operatian due to possible breakdown in the bowl assembly. He stated since
this well is one of two which support the hgh level reservoir system and it
is the aeason where water demands would normally increase� he would su�gest
Council consider an emergency repair of this well. He stated tire cost is
estimated around $15,000. Mr. Flora stated if the Council wished the repair
work to be done on a normal basis, he Would suggest advertising for bids.
He stated if an emergency ordinance is adopted, bids would be called for and
time could be saved in the advertisement process.
Mr. Qureshi, City Manager, stated this year has been extremely dry and in
June, the City pumped the highest amount of water in its history.

Ordinance No. 891 for contracting and expenditure of funds to repair Well

I�.r. riora, Public Works Director, stated Well No. 1 had to be taken o of
operstion due to possible breakdown in the bowl assembly. He state since
this well is one of two Which support the hgh level reservoir syste and it
i4 the sesson Where Water demands would normally increase, he xo suggest
Council consider an emergency repair of this well. He stated he cost is
estinated around $15,000. Nr. Flora stated if the Council wi ed the repair
work to be done on a normal basis, he Would suggest advert ing for bids.
He stated if an emergency ordinance is adopted, bids would called for and
time could be saved in the advertisement process.
N`r. Qureshi, City Manager, stated this year has been xtremely dry and in
June, the City pu�ped the highest amount of Water i its history.
MOTION by Councilman Goodspeed to Waive the r ding and adopt Emergency
Ordinance No. 891 for contracting and expendit re of funds to repair Well
and pump �1 . Seconded by Councilman Schne er. Upon a voice vote, all
voting aye, Mayor Nee declared the motion rried unanimously.

t�. Robertson, Community Deve opment Direetor, stated the HRA initiated this
� 1ot split in order to ac mmodate the proposed future re-2lignment of
Hacl�ann Drive to provide tter aecess to Old Central. He stated the lot
split involves 154 squar feet that is necessary to be added at a future
date to Parcel A. .
I�r. Robert�on stat the awner of Lot 6 has agreed to the split and purchase
price of �400. stated it is recommended this lot split be approved to
preserve futu options of the HRA to adequately provide the reverse
driveway to lot.
N�OTION by ouncilman Schneider to adopt Resolution No. 55-1987. Seconded by
Council oman Jorgenson. Upon a voice vote, all voting aye, N,ayor Nee
declar d the moLion carried unanimously.

approve a lot split on Lots 1 through 5, Block 4, Adams Street Addition in
order to Qake three residential building sites. He stated the Planning
Co�ission revie�ed this request and has recom�ended approval.

width and a publie hearing has been scheduled for August 3 for a vacation of
the alley. He stated if the vacation is approved, the lots xould be the
n:ini.muu� lot Width. t�. Robertson outlined the four stipulations recom.mended
for this lot split. -
M�r. Leffler, the petitioner, stated the existing house Would be removed as
well as the two garages. Ee stated the lot would be completely leveled for
the r�w construction. Mr. Leffler stated ad�acent lots are also 66 feet
�ia�.
Counciln:an Goodspeed asked uhat would happen if the lot split is approved
and there is ob�eetian to the vacation of the alley.

N'r. Qureshi, City N.anager, asked if these lots Would be separate tax
parcels. It �:as noted that the Surveyors Certificate delineates these as
separate parcels and probably should be included With the resolution as an

MOTION by Councilman Goodspeed to adopt Resolution No. 57-1987, With the
stipulations attached as Exhibit A and the Surveyors Certificate attaehed as
E�ibit B. Seconded by Councilman Schneider. Upon a voice vote, all voting
aye, Nayor Nee declared the motion carried unanimously.
17. RESOLUTION N0. 8-1 8 APPRCNING A LOT SPLIT L.S . �8 -Ou TO SPLIT
PARTS OF LOT AND 4 BLOCK 2 EAST RANCH ESTATES SECOND ADDITION GE ALLY
LOCATED AT 10 UNNERSITY AVENUE N.E. BY J. BEISSON AND G. BRADBtT .
Mr. Robertson, Community Development Director, stated the Co cil approved
this lat split on July 6 and the Certificate of Survey h been completed
and the lot split is ready for recording.
N'�r. Qureshi, City Manager, stated the survey es not reflect what the
Council approved on July b as the resolution ould indicate only two tax
garcels rather than three.
N's. Robertson in reviewing the survey tated Mr. Qureshi was correct and the
resolution should be amended a a corrected Certificate of Survey
submitted.
MOTION by Councilman Goo ed to adopt Resolution No. 58-1987 and amend
paragraphs two and fo to change the parcels from three to two. Further,
that a corrected Ce ificate of Survey be submitted. Seconded by Councilman
Fitzpatrick. II a voice vote, all voting aye, Mayor Nee declared the
motion carrie unanimously.
