REQUESTS
Rezoning application approval for a 28 unit townhome development on 2.69 acres located in the
northeast quadrant of TH 47 (University Avenue NE) and 57`h Avenue NE.
PROJECT DESCRIPTION
The proposed Gateway East Addition townhome site development provides a development
proposal that matches the envisioned land-use for the 2.69 acre site.
Twenty-eight townhomes are proposed to be constructed on this site, consisting of two 5 unit
clusters and six three units clusters. The units are orientated so that access is provided by interior
roadways and not onto the city streets.

SITE DESCRIPTION
The site is located in the northeast quadrant of TH 47 (University Avenue NE) and 57"' Avenue
NE. The site at one time had a variety of uses including gasoline station, Full access to the site is
I from 57`�' Street NE, 4`�' Street NE, 57t�' Place NE, 57 '/2 Avenue NE and University Avenue
service road. No easements are present on the site. The site has been cleared of all buildings and
� vegetation.
Adjacent Land Use
Adjoining the site to the north and south is developed as commercial, to the west is Mn/DOT
right-of-way and to the east developed as residential.
DEVELOPMENT STANDARDS
The proposed development is designed to meet the S-2 zoning requirements. The required
building size, parking ratio, and landscaping all fall within the regulations outlined in the S-2
section of the ordinance. Variances is being requested for a reduction of the building setback for
two units.
Site Design
Many factors were considered in creating the layout for the 28 townhomes. Access was to be
provided from interior roads and not from the city streets. Also, 57 '/z Avenue NE was to be
disconnected from a direct access to University Service Road and 4`'' Street NE was to be
extended north to make a connection with 57'''Avenue NE. Sidewalks are provided around the

site connectin all townhome units to the cit s sidewalk s stem.

Also landscaping was provided to meet city standards. Foundation plantings are provided to
enhance each townhome and create a pleasing visual impact. Plantings will be installed to
provide screening of adjacent commercial site and also the apartments on the north end of the
site. Over story trees are provided throughout the site.

TIMING
It is anticipated that approvals will be received from the city so to start construction in April
2001. Architectural construction documents have been started.
UTILITIES/GRADING
Watermain
Existing 6" watermains are located in 57 '/2 Avenue NE and in 57`h Place NE and a 10"
watermain is located in 57`�' Avenue NE. The watermains are not currently looped together.
The development will be served by 6" DIP watermains with each unit served by 1" copper water
service. The six northern units will be served by a 6" DIP watermain that will connected to the
existing watermain in 57 '/2 Avenue NE. A 6" DIP watermain will be constructed between 57 '/2
Avenue NE and 57'�' Avenue NE and will serve the 13 units facing 4"' Street NE. This watermain
will be connected to the existing watermains in 57 '/2 Avenue NE, 57'�' Place NE and also 57"'
Avenue NE. The connection to the watermain in 57"'Avenue NE will be completed by the city
project in which 57`�' Avenue NE is to be reconstructed. The remaining 9 units will be served by a
6" DIP watermain that will be connected to the existing watermain in 57`�' Place NE.
Approximately 220 linear feet of existing watermain in 57"' Place NE will be abandoned and
replaced with new 6" DIP watermain servicing the development. Once completed the
construction of the watermains will provide a looped system for this area.
Three fire hydrants will be placed in the development.. The hydrants are located and spaced so to
provide a maximum 300 foot coverage to the proposed buildings.
Sanitary Sewer
An existing 10" sanitary sewer line is located in 57'�' Place NE. The sanitary sewer is located in
the portion of the street that will be vacated for this development and therefore will have to be
relocated. The 10" sewer line will be located approximately 20 feet south of the existing line.
Four sanitary sewer structures will be constructed for this realignment. 8" PVC sanitary sewer
lines will be constructed to serve the townhomes. The sanitary sewers will be connected to the
relocated 10" sanitary sewer line.
Storm Sewer
The stormwater for this site will be collected by a storm sewer system and carried to the existing
city's storm sewer system.

Grading
Stormwater runoff on the existing site generally flows overland to several storm sewer structures
as follows:
The most southern portion(approximately 0.60 acres) flows south to the storm sewer structures
located in 4`'' Avenue NE located just north of 57`�' Avenue NE. A small portion drains directly to
57"' Avenue NE.
The center portion (approximately 1.00 acres) flows north to a storm sewer structure located
along the south curb line of 57 '/z Avenue NE
The westerly portion (approximately 0.76 acres) flows west and south to a storm sewer structure
located in the north curb line of University Avenue service road.
The northern portion (approximately 0.45 acres) flows south to a storm sewer structure located in
the north curb line of 57 '/2 Avenue NE. A small portion of the northern portion flows directly to
the University Avenue service road.
Suitable material grading material exists on site and will be used for the backfill for the buildings
and paved areas. Erosion control measures will be placed prior to the start of grading operations
and will remain in place until all slope stabilization is completed.
The grading of the site will not greatly change the existing drainage patterns.
Suitable fill material will be brought onto the site to bring the site to the proposed finished
grades.
It is estimated that 3,500 cubic yards of material will be excavated for this construction project.
VEHICULAR/PEDESTRIAN CIRCULATION
Vehicular traffic currently is carried through the site by 4`�' Street NE which intersects with 57 '/z
Place NE; 57`�' Place NE and 57 '/2 Avenue NE which intersect with University Service Road; and
University Service Road. It is proposed to vacate 57"' Avenue NE and the portion of University
Service Road south of 57 '/z Avenue NE. 4th Street NE will be constructed from 57`'' Place NE to
57 '/z Avenue NE. 57 '/2 Avenue NE will be reconstructed so to only have a direct connection to
4"' Street NE and not to University Service Road. This reconstruction will limit the amount of
traffic from traveling through the adjacent neighborhoods. The realignment of the streets were
reviewed with the residents at public meetings prior to this project starting.

The site development scheme creates a logical vehicular circulation pattern by clearly defining
the site entry, the parking areas for the project, and by providing a system that allows traffic to
enter and exit the site efficiently. Drive aisles and parking stalls have been designed to meet the
City of Fridley's' standards for residential development.
Pedestrian circulation is accommodated with an ample sidewalk system that interconnects each
building to the City's sidewalk system..

The Request
Gateway East Redevelopment, LLC is seeking to vacate portions of the University Service
Road and 57t" Place; rezone property to S-2, Redevelopment District; and to replat the

The property referred to as "Gateway East" is comprised of properties formerly used as a
pawn shop, an automotive repair shop, a duplex, &two vacant lots. The "Gateway East"

neighborhood input that went into this project.

Aug. 1987 Holiday Station Stores closes operations at 5807 University Avenue, but
retains ownership of building and site. Building remains vacant.
Nov. 1988 City receives development proposal from Winfield Development for
commercial redevelopment of NE quadrant of 57th and University Avenue.
Project does not proceed, in part because of costs related to purchase of
Valvoline Instant Oil Change facility.
1993 Holiday leases building at 5807 University Avenue to Cash 'n' Pawn.
Jun. 1998 Owner of JR's Automotive at 5755 University Avenue, indicates desire to
close business and approaches HRA with offer to sell. HRA acquires
building and evaluates redevelopment options for area, including possible
acquisition of adjoining properties.
Jul. 1998 HRA hires Hoisington Koegler Group to develop concept plans for
redevelopment of NE quadrant of 57th and University Avenue, exclusive of
the Valvoline Instant Oil Change site. That site is considered too expensive
to purchase based on previous discussions. Residential development(e.g.
town homes) becomes vision for area.
Apr. 1999 HRA signs purchase agreement with Holiday Co. to acquire 5807 University
Ave.
Aug. 1999 HRA initiates offers to purchase duplex at 349-353 57th Place, a vacant lot
next to JR's Automotive and a vacant lot at the corner of 4t" St. and 57th
Avenue. Negotiations are successful on duplex, HRA initiates condemnation
proceedings on remaining parcels.
Nov. 1999 HRA closes on purchase of Holiday site.

HRA's Vision for Gateway East
The Housing & Redevelopment Authority's (HRA) goal for Gateway East is to convert this
former commercial area into a viable residential development. This owner occupied
townhome development is situated to take advantage of it's close proximity to I-694, bus
routes, shopping opportunities and nearby schools.
Street Aliqnment & Site Plan Confiquration
Prior to sending out a Request for Proposals to developers, the City staff&the HRA
examined ways to reconfigure the roadways through this site to maximize development
opportunities. Three site plans containing different roadway configurations were
developed. The City then reviewed the proposed layouts with the neighborhood adjoining
"Gateway East". The neighbors chose the road layout now being proposed by the
petitioner. This option does require the City vacate portions of existing street and utility
right-of-way and that the petitioner dedicate the needed right-of-way through the plat
process. The proposed street configuration is on sheet C4 of the attached plans. It should
be noted that this layout will eliminate Valvoline's access to the existing University Service
Drive, but that staff has met with Valvoline to discuss options for modifying their site.

A zoning designation of S-2 gives the City greater flexibility in determining setbacks for a
given project. This flexibility is needed in this case due to street alignments, right-of-way
needs, utility locations, and proximity to adjacent land uses. With this sight plan, where
front yard setbacks range from 19.5' to 35', the developer is trying to establish "residential
character" by providing some amount of separation between the streets and adjacent land
uses. The 35' front yard setbacks, typical in the surrounding residential area, is used on
the 6 buildings fronting on public streets. The reduced front yard setbacks are found on the
2 buildings which front on private streets.
Staff Recommendations
Granting of these variances will enable the City's HRA to realize their vision of turning this
site from two run down commercial buildings into new owner occupied housing.
City Staff recommends approval of the street and utility vacation request.

Stipulations
City Staff recommend that the following stipulations be placed upon approval of the plat
request.
1. Petitioner shall obtain all necessary permits prior to construction.
2. Grading and drainage plan to be approved by City's engineering staff prior to the
issuance of any building permits, in order to minimize impacts to the surrounding
properties.
3. During construction, silt fencing shall be used where applicable.
4. Petitioner to pay$750 per unit park fees prior to issuance of building permits.
5. Petitioner to pay all water and sewer connection fees.
6. The petitioner shall agree to preserve mature trees to the extent possible. All trees
required to be removed for the new homes shall be marked and approved by City
staff prior to issuance of building permits.

MOTION CARRIED AND THE PUBLIC HEARING WAS OPENED AT 7:41 P.M.
Mr. Bolin stated that these three requests were for the Gateway East Project. The petitioners
are Gateway East Redevelopment and the Limited Liability Corporation. This is a joint venture
between Rea! Estate Equities and the Bisanz Brothers. The project is located at the corner of
57th and University Avenues. The entire site is about 2.5 acres in size. Former uses on these
properties included a pawn shop, automotive repair facility, a duplex, and two vacant sites. The
developer's an� HRA's goal is to change the current agirg commercial struct�res into a livable
residential area. Gateway East Redevelopment is proposing 28 owner-occupied townhome
units to be priced between $126,000 and $142,000. Each townhome will be a three-story
design with two bedrooms and two car attached garages.
Mr. Bolin stated the developer is seeking to vacate portions of the University Service Road, a
portion of 57th Place, and a portion of 4`h Street. They would also like to rezone the property
from a mix of C-2 commercial and R-2 residential into an S-2 redevelopment district. They
would like to replat the properties into one parcei suitabie for townhome development. In 1988,
the City was approached by a developer who looked at developing this site and the Valvoline
site as commercial. Due to the fact that the property was so expensive, it was determined that
the development was not feasible.
Mr. Bolin stated that in 1998, JR's Automotive contacted the HRA about purchasing their
property. The HRA acquired the property and looked at redeveloping that quadrant. In July
1998, the HRA hired the Hoisington Koegler Group to develop specific concept plans for the
redevelopment of this quadrant at 57th, exclusive of the Valvoline site. In April 1999, the HRA
signed a purchase agreement to purchase the Holiday property occupied by Cash-N-Pawn. In
August 1999, the HRA initiated offers to purchase the duplex at 349 57th Place and the two
vacant lots.
Mr. Bolin stated that in March 2000, City staff conducted a neighborhood meeting to present
three options for realigning streets in the project area. The residents favored the plan which
closed off access to the neighborhood. The residents in the northeast portion did not want to
see 4th Street extended through. In June 2000, the HRA sent out proposals to a number of

developers. Two proposals were received by Gateway East Redevelopment for 28 townhome
units and Hokanson Development for 40 townhome units. It was determined that the less dense
28-unit townhome proposal would be most appropriate for this site.
Mr. Bolin stated that in July 2000, the HRA demolished the duplex, JR's Automotive, and Cash-
N-Pawn. In December 2000, the HRA approved the contract for private redevelopment with
Gateway East Redevelopment and approved the Gateway East TIF District. In January 2001,
the developer prepared the final plans with the land use applications, called a neighborhood
meeting, and started conducting additional environmental testing on the site.
Mr. Bolin stated staff recommends approval of the three requests. The proposed alignment for
the streets is supported by the neighborhood and the Public Works Department. Rezoning of
the property is necessary to get the density needed on this site to accommodate the 28 units
proposed and gives more flexibility to establish a more residential character. It allows for some
closer setbacks found on the private streets close to the development. The plat request is
necessary to combine the five properties in the project area into one property to be platted for
the units. This would also dedicate the right-of-way necessary for the proposed street layout.
Mr. Chris Winter, representing Real Estate Equities, stated they are requesting to realign and
vacate the University Avenue Service Road. Valvoline Oil will have their entrance relocated.
They are proposing eight buildings with five and three-unit clusters. Green grass will be
between buildings and the driveways and garages will be in back with a private entrance. There
will be a nice streetscape with front porches and landscaping. There will be a common area in
the center of the community and nice landscaping on various properties. They are proposing a
three story tuck-under garage style that would allow front porches and decks. Landscaping will
add different elements of interest. Shaker maintenance free siding will be throughout. Private
entrances are on the front and the back. They took a lot of time to work on the elevation. They
want to make the development as residential as possible and bring down the elevation.
Mr. Saba asked for more information about the landscaping.
Mr. Winter stated they are looking at a two inch tree in the front yard with various types. The
first level is a garage level with room for a home office/bedroom space. Two different main level
floor plans are being proposed right now. Both have two bedrooms and one and a half
bathrooms. Both offer a little computer nook area on the main level and great room and dining
room area. The third floor will have two bedrooms with a master suite walk-in closet, oversized
bathroom, and a bedroom/storage room.
Mr. Saba asked how much green space is in back.
Mr. Winter stated there is about 35 feet of setback in the front yard for green grass and trees.
There will be about four or five feet of green space between each driveway in the back. There
is green grass and trees in the side yard.
Ms. Johns asked if the environmental testing has been done.
Mr. Winter stated they did soil borings in a number of locations, and the results should be in
next week.
Mr. Saba asked if the computer nook will have cable access.
Mr. Winter stated that they will have cable and phone access.

Ms. Savage asked if any calls were received.
Mr. Bolin stated that he has had three calls. Two were in favor of this and the third was just
curious about the project.
Ms. Savage asked if he had any problems with stipulations.
Mr. Winter stated they have no problems with the stipulations.
Mr. Oquist asked if there were any problems with the way the roads were constructed.
Mr. Bolin stated that in December he, the building inspectors, the Fire Marshail, and the City
Engineering staff met to discuss the road construction. They ended up moving some utilities
and one fire hydrant. There were no other issues.
Ms. Johns asked if Valvoline has a problem with anything.
Mr. Bolin stated Valvoline is working with the HRA on the best way to redesign the site.

Mr. Oquist stated that this is a nice package and would clean that area up.
Ms. Savage stated they certainly could use more residential in Fridley.

3. During construction, silt fencing shall be used where applicable.
4. The petitioner shall pay $750 per unit park fees prior to issuance of building permits.
5. The petitioner shall pay all water and sewer connection fees.
6. The petitioner shall agree to preserve mature trees to the extent possible. All trees required
to be removed for the new homes shall be marked and approved by City staff prior to
issuance of building permits.

INTRODUCTION
Gateway East Redevelopment, LLC is seeking to rezone property, generally
located at 57th Avenue & University Avenue, to S-2, Redevelopment District in order
to accommodate the development of 28 two bedroom townhome units.
The property referred to as "Gateway East" is comprised of properties formerly
used as a pawn shop, an automotive repair shop, a duplex, & two vacant lots.
PLANNING COMMISSION RECOMMENDATION
At the February 7, 2001 Planning Commission meeting, a public hearing was held
on the rezoning of the Gateway East property. After review of the proposed project,
a motion was made to recommend approval of the rezoning. The motion carried
unanimously.
PLANNING STAFF RECOMMENDATION
City staff recommends that the City Council hold a public hearing for the rezoning of
the Gateway East property, from a mix of R-2 & C-2, to S-2 Redevelopment District.

Mr. Burns, City Manager, stated that Gateway East Development, LLC, is seeking to
rezone property generally located at 57`h and University Avenues to S-2, Redevelopment
District, in order to accommodate the development of 28 two-bedroom townhome units.
The City Council held a public hearing regarding this matter on February 26, 2001. The
Council tabled action on the rezoning and directed staff to amend the text as necessary to
allow action on the item on March 5, 2001. Staff modified the text of ZOA #01-01 to
reflect the modifications identified by Council. Item "F" was added to include all vacated
right-of-ways. Staff recommends approval of the first reading of the ordinance as
amended.

regarding acquisition of the vacated right of-way, agreed to a purchase price, and agreed
to terms of acquisition. Staff has also mo ified the description of the right-of-way to be

approval of the resolution as amended.

Mr. Burns, City Ntanager, stated that this ordinance would allow property owners of
certain types of p'roperties to exclude individuals who have committed a crime on that
property or hav� violated its rules of conduct from entering that property. Tenants may
also issue trespass notices. This also applies to areas of the property with restricted
access. The �roperty owner or tenant issues written trespass notices within 30 days of
violations. tX violator is not allowed to enter the property for up to one year. If they do,
the police�nay be called for assistance, and the violator may be charged with a
misdemea�Ior. This ordinance will prevent someone who has been evicted from a
property�rom returning to that property. This situation often occurs with drug houses.
Staff recpmmends approval of the second reading.

structures on these lots co rming as long as they were built on lots that contained a
minimum of 5,000 square et and were at least 50 feet wide. The new law also includes
5,000 square foot lots t t are at least 50 feet wide that were created prior to January 1,
2001. The purpose f the legislation is to protect the property values of existing
homeowners and c ate incentives for investment in these previously non-conforming
properties. First r ding of this legislation was approved at the March 5 Council meeting.

The City Council held a public heazing regarding this matter on February 26, 2001. The
Council tabled action on the rezoning and directed staff to amend the text as necessary to
allow action on the item on March 5, 2001. Staff modified the text of ZOA #Ol-01 to
_ _ reflect the modifications identified by Council. Item "F" was added to include all vacated
right-of-ways. Staff recommends approval of the first reading of the ordinance as

Mr. Burns, City Manager, state that Gateway East Redevelopment is seeking to vacate
portions of the University Servi Road and 57`� Place in order to accommodate the
development of 28 two-bedroom ownhome units. The City Council held a public
hearing regarding this matter on Fe ruary 26, 2001. The Council tabled action on the
vacation request pending modificati n to the description of the right-of-way to be
vacated. Council directed Staff to ame d the description as necessary to allow action on _ _
the item on March 5, 2001. Since Coun '1's last meeting, Staff has approached the owner
regarding acquisition of the vacated right ef-way, agreed to a purchase price, and agreed
to terms of acquisition. Staff has also mo ified the description of the right-of-way to be
vacated by SAV #O 1-O 1 to reflect the chan es identified by Council. Staff recommends
approval of the resolution as amended.

Councilmember Barnette.

MOTION CARRIED AND THE PUBLIC HEARING WAS OPENED AT 8:07 P.M.
Mr. Bolin, Planner, stated that he would go through the ordinance, preliminary plat request,
street vacation, and then give separate recommendations on all three items.
Mr. Bolin stated that the project is located at the corner of 57`h Avenue and University Avenue.
It is 2.5 acres in size. The former uses of the site were a pawn shop, automobile repair facility,
duplex, and two maintenance sites. The goal is to change an aging dilapidated commercial area
into new residential. The Gateway East Redevelopment Corporatioi�, which is a spinoff from
Real Estate Equities of St. Paul, is proposing to build 28 owner-occupied townhome units priced
between $126,000 to $142,000. The units will be two bedrooms with a three story design and
two car attached garages.
Mr. Bolin stated that Gateway East Redevelopment is seeking to vacate portions of the
University Avenue Service Road and 57`h Place, to rezone this property from C-2 to R-2 and
replat the property to accommodate the 28 townhome units. The vacation of University Avenue
Service Road, bounded on the west by the easterly Mn/DOT right-of-way line for State Highway
47 (University Avenue); on the north by the southerly right-of-way line of 57-1/2 Avenue; on the
east by the easterly right-of-way line of said University Avenue Service Road; and on the south
by the extension of the southerly righi-of-way line of 57`�' Place, to said easterly Mn/DOT right-
of-way line for State Highway 47, University Avenue. The Planning Commission unanimously
approved this at their February 7 meeting after the public hearings held on all three items.
Mr. Bolin said on the street utility vacation request staff recommended approval to maximize
development opportunities. He said this is a street layout chosen by the neighborhood. The
Public Works Department also approved the street layout. Staff recommended approval to
rezone the property to provide the desired density on this site and give the developer flexibility to
develop this site in a manner they would establish for residential character. Staff recommended
approval on the preliminary plat to combine the five properties into one property and will give
the right-of-way necessary for the street layout. Stipulations on the plat are as follows: 1)
Petitioner shall obtain all necessary permits prior to construction; 2) Grading and drainage plan
would be approved by City Engineering staff prior to issuance of any building permits to

minimize impact to other properties; 3) During construction, silt fencing should be used where
applicable; 4) Petitioner shall pay $750 payment of pazk fees prior to issuance of the building
permits; 5) Petitioner shall pay all water and sewer connection fees; 6) Petitioner shall agree to
preserve mature trees to the extent possible; and 7) All trees required to be removed shall be
marked and approved by City staff prior to issuance of building permits.
Mr. Chris Winter, Real Estate Equities, stated that they are proposing to have eight buildings.
Two buildings will have five units and five will have three units. This will allow more green
space in between buildings. This will also allow a courtyard area and move the buildings back
for a more residential chazacter. The building is designed to keep the residential look to fit into
the neighborhood. There is off-street parking and parking inside the driveway for two cars. The
landscape includes boulevard trees, trees on the corner and in the courtyard. Everything else will
be sodded. There is a significant border of pine trees. There are front yards with back porches
and decks to add privacy. There is a tan scherne with maintenance free siding. The brick
banding is on the bottom and bay windows at the side of the building. Privacy decks aze off the
back. There are rear entrances. The landscape plan did vary to give more residential character
with three different schemes.
Mr. Winter stated that the units will have a 2.5 car garage with ample storage. On the same level
will be an area for a third bedroom or computer area. Upstairs there will be the front porches
with the entryway halfway up with an oversized closet. The main living area has full kitchens
with oversized windows and patio doors. There will be full baths with one full one on the main
level and a reading and computer nook. There are two bedrooms upstairs and a laundry room.
� The master bedroom has a large walk-in closet.
Councilmember Barnette asked what was the difference between the two streets of 57-1/2
Avenue and Fourth Street.
Mr. Winter stated that it is scaled at about five feet.
Councilmember Barnette asked what they were going to do there other than a tree or curbs to
prevent an accident.
Mr. Winter stated that he could rnention at the neighborhood meeting any ideas for what to have
there. His concern is safety and reducing the available space is to be considered.
Mayor Lund asked if hedging would work there.
Councilmember Billing stated that salt and sand will be plowed there in the winter.
Mr. Hickok, Community Development Director, stated that staff is looking at Minneapolis or
Edina where there are situations like this. A reflectorized post would be visible at the curb.
From a landscape perspective, it is extremely difficult because the root system would not have an
opportunity to survive.
Mayor Lund asked about the feasibility of a retaining wall.

Councilmember Bolkcom stated that they would have to be careful to make sure they are not
increasing their liability by doing that.
Mr. Hickok stated that one concern of the wall is that it can cause damage to the plow
equipment, which could become a problem.
Mayor Lund asked about lighted bulbs there.
Mr. Hickok stated that would be a nice solution.
Councilmember Billings asked how the zoning is determined on the vacation of part of 57`" Place
and part of the University Avenue Service Drive.
Mr. Hickok stated that they need to take the zoning action first and then the land would be
considered the same zoning. The vacation comes after that. The land use would be recognized
that the zoning is intended for the land underneath. Staff would like to make sure that the legal
description for the zoning matches.
MOTION by Councilmember Billings to close the public hearing. Seconded by Councilmember
Bolkcom.

Councilmember Billings state that the roadway is vacated and reverts to the abutting property.
A portion of 57ih Place is adj cent to the current Valvoline Oil operation. There is also a
condemnation procedi.ue. He a ked if this includes the portion of the future vacated right-of-
way.
Mr. Fernelius, HRA Housing Coor inator, stated that the condemnation was totally unrelated to
that portion and it is not included.
Councilmember Billings asked if the outhern half of 57`h Place adjacent to the Valvoline Oil
reverts to Valvoline Oil rather than the ity.
Mr. Fernelius stated that it would revert o Valvoline Oil. The issue is what the City should do
since half that vacated right-of-way is aff cted. Valvoline has been approached with an offer for
that part of it and it has not been resolved t.
Councilmember Billings stated that at this p int neither the City nor the developer has control of
the southern 33 feet of that piece of propert adjacent to Valvoline Oil. He asked how Council
could approve a plat for something someone e e has control over.
Mr. Hickok, Community Development Director, stated that they are optimistic and confident that
an agreement can be reached a provision be mad to maintain the overall integrity of the project.
Councilmember Billings asked if it would be mor practical to vacate the north 33 feet of' S7`h
Place and then the other 33 feet adjacent to Valvolin Oil would remain as City right-of-way. He
asked what would be the best way to handle this and acate the remaining portion of the street or
hold up the vacation.
Mr. Hickok stated that his solution aligns with staff s. The ideal would be to have both pieces
and make it part of the plat and consider it all part of the�arcel. If it does not work, this project
would have to be revisited. �
