Purpose. �rie purpose of this Sectian is to provide the City of Fridley with a reasonable degree of discretion in determining the suitabil ity of oertain oesignated uses upon the general welfare, public health and safety. In making this determination the City may oonsioer the nature of the land upon which the use is to be locateo, the nature of the adjoining land or buildings, the effect upon traffic into and from the premises or on any adjoining roads, and all such other factors as the City shall reasonably deen a requisite of oonsic3eration in determining the effect of such use. For the purpose of recording, the terms S�eciGl Use Pernut and Conditional Use Permit shall be said to mean one and the same pursuant to M.S.A. Section 462.3595, S�i�division 4. B. Application. w'henever this Chapter requires a Special Use Permit, an application in writing must be filed with the City together with such filing fee as may be established by the City Council and shall be accompanied by a site plan or other documentation as req uired by the City. C. Referral Zb The Planning Coamissian. The application and related file shall be referred to the Flanning Corur�ission for study concerning the effect of the pro�osed use on the Cor�prehensive Plan and on the character and development of the neighborhood. The Planning Commission shall hol d an official public hearing within sixty (60) days of the c13te of f il ing such petition. D. Aearing. A notioe of public hearing shall be published in the off icial newspaper at least ten (10) days but not more than thirty (30) days prior to the date of the hearing. E. Action By ZY�e Planning Carmission. (1) Notices shall be mailed to all owners of property kithin 200 feet of the paroel included in the rea,uest not less than ten (10) days nor more than thirty (30) days prior to the hearing. Proposal �,t� The petitioner, F`ath�- , is requesting a special use permit be granted to allaa a chu�h, �rsonage, bell tower and religious book store at I 5973 - 3rd Street N.E. Background This property is located in an S-1, Hyde Park neighborhood, zoning district whose r�gulations are similar to those of the R-1, single family dwelling, zaning district. In an �1 district, churches, bell tawer, parsonage and bookstore are allaved as a special use. The buildirr� and site requirements for this use is the same as those outlined in the CR-1, general office, zoning district. A special use peiznit was previously granted for this site in 1985 and 1987 = which allaaed a different crnmercial use in an S-1 zoning district. The 1987 permit was gassed with four stipulations regarding site and building impmvanents. Due to extenuating circiunstances, the petitioner never used the special use pezmit, therefore, the stipulations were never ccac�leted. The chu�h will be approxin�ately 530 square feet. Of this 530 square feet, 63 square feet will be used for a bookstore and 32 square feet for the parsoriage. The sanctuary will provide space for approximately 24 �rishoners, iricluding the clwir. On the �.st side of the building an apse will be constructed which will be used as the alter. The exterior p�rtian of the building wi11 consist of stucco arr3 ooncrete block. Ms. Castle st.�ted the petitioner was proposing to expand the building by adding an entryway on the west side of the building arrl an apse on the east side of the buildirr�. Tl:e proposed parking lot does encroach about 5 feet onto city pzr�rty, Lot 29. This has been covered by a variance. One of the stipulations staff was rec�n�ndir�g was that the petitioner lease this portion of the property fram the city. Ms. Castle reviewed the floor plan. Mr. Vladimir C7�avhavsk:a�, the ar�chitect for the proj ect, stated there was � ap�roximately 2,000 sq. ft. of building area. One-half of that would be for sar�ctuary, and one-half would be for adjoinir�g uses--book store, parsonage, arri Ix�throan facilities. Ms. C�stle stated the building would be concrete block and stucco. She stated the petitioner has applied for several variances. Those consist of building variances and hard surface setback variances. The Appeals Carenission approved all the variar�ces except the variance allaair�g the bell tvwer in the front yard. The City Code does not allaa accessozy uses in the front yard, only in the rear and side yard. The Appeals Cam¢nission did discuss the use of the University Avernue slip-off. Right mw, it is on Lot 29 and 20 which is aa�d b� the City. Mr. Barna stated two neighbors in attendan�ce at� the Appeals Caranission meeting on July 19 agreed that the sl ip-of f should be closed. At the time of the widening of University Avenue, that was a compranise to retain access to those businesses on 3rd Street. Subsequently, there has been a change in city policy to retain Hyde Park as a residential district. Mar� of those businesses have been replaced by residences so the rLeed for the sli�roff has been reduced. Also, it should be pointed out that the City plans the imjor renovation arrl upgrading of University Avenue in this section. This is the urban denonstration corridor that will tak,e place next spring, so if the City were to abandon the sl ip-of f, the timing would be appropriate to make a reoomnerr7ation to the Cit,y Council naw so that could be accanplished r�ext spring. F`ather Jahn stated that regardir�g stipulation #4, he was askirig the City to consider a 10 year lease for garking. The previous petitioner was given 3 ymrs. - Mr. Betzold stated the Canmission could certainly reca�unerr3 that amount of time to the City Council, ar�d then that could be negotiated with the City Courycil. Father John stated that he questioned Nov. 1, 1989, in stipulation #8 for the d�dlir�e for the sealccx�tir�g and striping for the parking lot. City ordirarice irrlicates that the snallest allvwable square footage for a residence in a multiple c�aelling district (the least restrictive) was 425 sq. ft. He personally felt that portion of the buildirx,� that was going to be-util iz ed f or a residence should be seg3rated from the rest of the use of the building and shauld meet the minimtun stan�3ards (425 sq. ft. , or ariy other siz e the Planning Ca�rmission or City Council deemed apprapriate) . When a facility is pravided in a large building for a watchperson, for example, he did not know how that deternliration was m�de. Mr. Barra stated Mr. Qark did mt sean to have a problem with this, and he did mt either, fn�m the starrlpoint that the entire 2,000 sq. ft. was the residence arrl more than meets the 1�-1 oode. � Mr. Dahlberg stated he did not think the issue was that this was a resider�ce. This is rnt a resider�ce. They are approvir�g a change in use for this building to a church. They are mt saying this is a residence that can be used as a church. If they are going have multiple uses within a given structure, then there should be a defini.te segaration between those uses.
