Proposal
,t
The petitioner, F`ath- , is requesting a special use permit be
granted to allaa a chuh, rsonage, bell tower and religious book store at
I 5973 - 3rd Street N.E.
Background
This property is located in an S-1, Hyde Park neighborhood, zoning district
whose rgulations are similar to those of the R-1, single family dwelling,
zaning district. In an 1 district, churches, bell tawer, parsonage and
bookstore are allaved as a special use. The buildirr and site requirements
for this use is the same as those outlined in the CR-1, general office,
zoning district.
A special use peiznit was previously granted for this site in 1985 and 1987
= which allaaed a different crnmercial use in an S-1 zoning district. The 1987
permit was gassed with four stipulations regarding site and building
impmvanents. Due to extenuating circiunstances, the petitioner never used
the special use pezmit, therefore, the stipulations were never ccacleted.
The chuh will be approxinately 530 square feet. Of this 530 square feet,
63 square feet will be used for a bookstore and 32 square feet for the
parsoriage. The sanctuary will provide space for approximately 24
rishoners, iricluding the clwir. On the .st side of the building an apse
will be constructed which will be used as the alter. The exterior prtian of
the building wi11 consist of stucco arr3 ooncrete block.
Staff recccmerr.is approval of this request with the follaaing stipulations:
1. Parking situation to be reviewed in two years to determine adequacy of
existirg lot. .
2. The church bell shall be only rung at the beginning of each mass on
Surr3ay.

3. Reuse of this building b a different churh is required to apply for a
special use pernnit.
4. A portion of Lot 29, approxinately 1,604 square feet is beirg leased fnxn

UIN A VOICE VOTE, AL,L VOT7I AYE, iAIRPER90N BEIZQLD DEQ,ARED THE NDTION
CRRIm UNANIlDUSLY.
Mr. Betzold stated this itan wauld gr to City Cauncil on August 8.
2. PUBLIC HEARING: ONSIDERATION OF A SPECIAL USE PERMIT, SP #88-09, BY
OKl'E3DOX CHURCi OF THE RFSURRECI'IDN OF QtIST:
Per Section 205.05.04 of the Fridley City Code to allaa a church, parsorage,
bell tower and religious book store in an S-1, Hyde Park Neighborhood,
zonirig district on Lots 27 arrl 28, Block 12, Hyde Park, the same being 5973
- 3rd Street N.E.
MYI'IDN b, Mr. Kondrick, secor, ded b Ms. Sherek, to waive the reading of the
fonrel public hearing rrtice and to apen the public hearing.
ULN A VOICE VOTE, ALL VOTIl AYE, Q3AIRPER9N BEIZpLD DEQ,ARID THE NDTIfJN
(RR UNANIlDUSL,Y A1ID THE PIBLIC OPIIV AT 9:57 P.M.
Ms. C`astle stated this properiy was located on 3rd Street, south of 60th
Avernze arrl north of 59th Avernie. It was located in an S-1, Speci.al District
or Hyde Park District. Chuhes in S-1 districts were regulated by CR-1,
general office district regulations. 5he stated the buildirx was currently
existrx, and was the former Ener 5hed.
Ms. Castle st.ted the petitioner was proposing to expand the building by
adding an entryway on the west side of the building arrl an apse on the east
side of the buildirr. Tl:e proposed parking lot does encroach about 5 feet
onto city pzrrty, Lot 29. This has been covered by a variance. One of
the stipulations staff was recnndirg was that the petitioner lease this
portion of the property fram the city.
Ms. Castle reviewed the floor plan.
Mr. Vladimir C7avhavsk:a, the architect for the proj ect, stated there was
aproximately 2,000 sq. ft. of building area. One-half of that would be for
sarctuary, and one-half would be for adjoinirg uses--book store, parsonage,
arri Ixthroan facilities.
Ms. Cstle stated the building would be concrete block and stucco. She
stated the petitioner has applied for several variances. Those consist of
building variances and hard surface setback variances. The Appeals
Carenission approved all the variarces except the variance allaairg the bell
tvwer in the front yard. The City Code does not allaa accessozy uses in the
front yard, only in the rear and side yard. The Appeals Cam¢nission did
discuss the use of the University Avernue slip-off. Right mw, it is on Lot
29 and 20 which is aad b the City.
Mr. Barna stated two neighbors in attendance at the Appeals Caranission
meeting on July 19 agreed that the sl ip-of f should be closed. No one in
atteridarce at the meetirg had anq obj ection to the use of the bui.lding for a
church.

PL,AIINIl QNAiISSIDN MEE.TIl. JULY 27. 1988
Mr. Rdrtson stated apprently the slip-off has a long history that goes
lxck to the time when there were quite a few businesses on 3zd Street. At
the time of the widening of University Avenue, that was a compranise to
retain access to those businesses on 3rd Street. Subsequently, there has
been a change in city policy to retain Hyde Park as a residential district.
Mar of those businesses have been replaced by residences so the rLeed for
the sliroff has been reduced. Also, it should be pointed out that the
City plans the imjor renovation arrl upgrading of University Avenue in this
section. This is the urban denonstration corridor that will tak,e place next
spring, so if the City were to abandon the sl ip-of f, the timing would be
appropriate to make a reoomnerr7ation to the Cit,y Council naw so that could
be accanplished rext spring.
Ms. Castle stated staff was reconending approval with the following
stipulations:
1. Parking situation to be reviaaed in two yrs to detennine adequacy of
existing lot.
2. The church bell shall be only rung at the beginning of each mass on
Surday.
3. Reuse of this building by a different church is required to apply for a
special use pennit.
4. A portion of Lot 29, approximately 1,604 square feet is being leased
 fran the City at $1.00.
5. Landscaping to be installed as per plan b July 1, 1989.
6. A perforniance bond or letter of credit for 3 of the construction value
be given to the City pri.or to issuarce of the building pennit.
7. Install six irrh aoncrete curbing around the entire perimeter of the
parkirig lot ircluding drivaaay vpenirx by Novenber 1, 1988.
8. Parkirx3 lot to be sealooated arrl striped (eit spces) L-y Ncvember 1,
1988.
9. Fbsts are to be ranaved upon installation af landscaping (July 1, 1989) .
10. Petitiorer to intain site ii.ately b cutting grass arri elimirating
weeds.
Father Jahn Magraam stated tYat regaiing stipulation #1, he was wondering
if there was ar connection between the two year review arr3 the amount of
time they would be given to lase Lot 29 for the parkirx3.
Ms. 5hernk stated that was a pertinent question, because if the slip-off is
closed, the City wi11 have to vacate the property and Lots 29 and 30 are
going to became available for purchase. If they are mt purchased by Father
John's church, hen sameone else could purchase thein and build a single

family home there. So, Father John would have to consider that if that
slip-off frnm University Avernie was closed, in order to retain the parking
on Lot 29, his church might have to purchase either Lot 29 or both Lots 29
ard 30 from the City.
Father Jahn stated that in the event they would not be able to reach an
agresnent with the City to either lse or purchase property for parking,
then the, would be against havirg the sli, roff closed.
Father John stated that regarding stipulation #2, he would suggest the
woniirx3 be changed that the church bells be rung only for services and
special occasions. The, clo have more than one service on a Sunday, arxi the
d4 have sezvices sanetimes on a Saturday, perhaps twice a month.
F`ather Jahn stated that regardirg stipulation #4, he was askirig the City to
consider a 10 year lease for garking. The previous petitioner was given 3
ymrs. -
Mr. Betzold stated the Canmission could certainly recaunerr3 that amount of
time to the City Council, ard then that could be negotiated with the City
Courycil.
Father John stated that he questioned Nov. 1, 1989, in stipulation #8 for
the ddlire for the sealccxtirg and striping for the parking lot. They
will be closing on the pn7periy in Septatr, and that might npt give thn
ernugh time. Could that da3dli be extended?
Mr. Betzold stated that if the petitioner had problems meeting that
deadline, he could reuest that the City Cauncil exterd the da3dline.
Mr. Dahlben asked what the ftuction of the garsomge would be.
Father John stated it would be living quarters for either himself or a
sister. They currently have a priest's residence in Frid1Ey, so this would
be additional living quarters.
Mr. Chahovskv, stated that appivvximately one-faurth of the building (apprax.
250 sq. ft.) wauld be the g3rsorage ar.
NDTIDN b, Mr. Saba, secorYied b Ms. Sherek, to close the public hearing.
UPN A VOIC VOTE. ALL VOTII AYE, Q-iAIRpER9pN BEIZQLD DECLARID THE P'CLIC
HEARIl]G QASID AT 10:47 P.M.
Mr. Barra stated he wanted to again point out that the neighbors at the
Apals Caanission meeting seaned quite happ with the proposal ard were mt
aPPosed to the church.
Mr. Saba stated he had rn problens with the proposal. It seaned like a good
pl.n for the use of a currently urned facility. He would be in favor of
recrnmending approval of the special use pennit.
-17-
, ' ! i 3'"
PIArIItIl mNIltISSIDN MEE.'rIlVG. JLJLY 27, 1988
Mr. Dahlben stated he had one naj or concern about the proj ect as proposed
with respect to the building furctionirg also as a place of residence for a
priest or a sister. He thought it was lackirg fnxn the standpoint of what
th mit classify as a miruim.un uirenent for hausing of an individual.
City ordirarice irrlicates that the snallest allvwable square footage for a
residence in a multiple caelling district (the least restrictive) was 425
sq. ft. In an 11 district, that would be 768 sq. ft. He personally felt
that portion of the buildirx, that was going to be-util iz ed f or a residence
should be seg3rated from the rest of the use of the building and shauld meet
the minimtun stan3ards (425 sq. ft. , or ariy other siz e the Planning
Carmission or City Council deemed apprapriate) . Just frrm the stardpoint of
the organization ard the layaut of the proj ect, Y did mt f eel comf ortabl e
that it meets miniimun starr3ards or minimum requirenents.
Mr. Rc.bertson stated he could ask for a detenniration frnm Darrel Qark, the
Chief Building Official. There is a kitchen area and a bathrocan area
adjacent to the sleeping room. When a facility is pravided in a large
building for a watchperson, for example, he did not know how that
deternliration was mde.
Mr. Barra stated Mr. Qark did mt sean to have a problem with this, and he
did mt either, fnm the starrlpoint that the entire 2,000 sq. ft. was the
residence arrl more than meets the 1-1 oode.
Mr. Dahlberg stated he did not think the issue was that this was a
residerce. This is rnt a residerce. They are approvirg a change in use for
this building to a church. They are mt saying this is a residence that can
be used as a church. If they are going have multiple uses within a given
structure, then there should be a defini.te segaration between those uses.
Mr. Fbertson stated that was an interpretation of the Building Code that
would have to be made, ard he would bring this question to Darrel Clark,
Qzief Building Official and staff representative to the Appeals Ca[ranission.
Ms. Sherek stated there reeded to be an opinion before this goes to City
Cotlncil.
Mr. Llahlberg stated there must be a detenniration ard an opirnn rendered by
staff relative to the buildirx3 oode as well as the city oniirsce.
NDTIDN b Mr. Dahlberg. seconded by Ms. Sherek, tA recoanend to City Courci.l
