2. Return vompleted application form with the required sketch of the property
involved and the lot sglit fee af $100.00 for each original lot being split.
3. �e appl ica ti on w il l be ch ecked av er by Staf f and th e aa ner may be r eq ui r ed
to sutmit a Certificate of Surve� o�ntaining a simple description of a part
of a gl atted 1 ot or r egi st er ed 1 ot, al ong w ith th e new pa roel s cr eated w ith
all existing structures tied in.
4. The application wi11 then be sukmitted to the Planning Ganmission for their
reo�mmendation. Tt�e Planning CaYunission meets on the Wec�esday follaaing
the City Cotuicil meeting, which is ge►,erally the first and third Wednesdays
of th e month.
5. The reo�mmendations of the Planning Catunission are sutmitted to the City
Co�cil for final action. If a Certificate of Surve,� wasn't required before,
it will be required for this meeting. Zhe City Council meets on the first
and th i rd Mondays of the month.
6. �e City Council approval m�y be subject to oertain stipulations which must
be c,anmlied with b,� the apglicant.
7. If appraved, the applicant shall then have the land involved in the lot split
surveyed. Upon receipt of the required Surveyor's Certificate, the Council
shall pass a resolution appraving the lot sglit.
8. After fin31 appraval, a oertified wp� of the resolution appraving the
lot sgl it and a "Certif icate of Status" f orm shall be attached to the notice
of appraval and forwarded to the applicant. �ie lot split, together with a
oertified �p� of the resolution and "Certification of Status" form, shall
thereafter be reoorcled among the reaorc� of the County within one hundred
eic�ty (180) days after the date of the resolution, �mless a longer period of
time is granted and pravided for reoording at the time of approval.
9. In all cases where City Council action has been sou�t and denied, no petition
for icientical action can be preserited until a period of six months has elapsed.

Dear Mr. Johnson:
Pursuant to our conversation last Thursday, I am writing to clarify the
potential for single family developnent on your three lots located on the
rbrtheast ac>rner of Mississippi Street and Hic�way 65. As you are aware, on
M�y 7, 1984 the City Co�mcil ap�roved a lat split r�uest to split the west
half of Lot 4 and all af Lats 5, 6 and 7, in order to create four building
sites. At this time, Lot 4 is no longer available for subdivision.
�erefore, only Lots 5, 6 and 7 would be involved. Should you decide to
build on Lats 5, 6 and 7 as they stand today, you would merely need to obtain
a building permit for each of the three building sites. Zhe particular fees
associated with single family building permits can be addressed by Darrel
Qark, the City's Building Inspector.
If, haaever, you dioose to subdivide the property in order to create four
lots, ifie City Council stipulations fram 1984 would be reactivated and would
be proposed with a new petition which would have to go to the Planning
Ca►mission and back to City Council for approval. This procedure takes
approximately two to three mazths. I am enclosing a �p� of the May 7 , 1984
Co�cil minutes. Ple�se rote in the motion that there were two stipulations.
I woul.d have to assune that a new petition basically for the same lot spl it
would carry the same two stipulations.

Mr. Robinson stated this property was located just north of Mississippi St.
and east of Highway 65. The petition was identical to one which the
Planninq Commisson reviewed in April 1984 and which the City Council
appraved in hSay 1984. 7he zoning was R-1, single fanily, and was surrouided
by single fanily. Zhe proposal was to take two lots, Lat 5 and Lot 6, which
are now separate tax parcels and buildable lots, and subdivide them by
splitting off approximately 15 feet of the easterly gortion of Lot 6 and
adding that to Lot 5, and then subdividing Lot 5 in such a way as to create
Tract A and Tract B with access onto Lucia Lane. Lot 7 would stay the same,
and there was aarrently a purc�ase agreement on that lot.
Nfr. Robinson stated one of the previous lot split requests also included the
back half of the northerly Lot 4. Since that time, they have been
successful in recpmbining that portion of property with the original parent
property so that pieoe of landlocked property was no longer a problem. So,
the petitioner wus to take two lots and create three lots, which was the
same petition appraved in 1984. 7.fie lots do meet oode in terms of lot area
and lat width. In fact, they exceed the lot area substantially.
Mr. Robinson stated staff was reoonanending the follaaing stipulations:
1. Owner to supply a 15 foot bikeway/walkway easement on Mississippi
Street frc� Lucia Lane to Hi}�way 65.
2. A park fee c�f 5750.00 each for Tract A and B lae �id prior to
issuance of building permits.
3. Driveway on Tract B to aooess Lucia Lane only.

Mr. Betzold stated that when the lot split is recorded at the County, was
there any way af filing these stipulations along with it--to put the buyers

about the median. He stated Charles Campbell, the property owner's agent,
has indicated he o�uld put related language into the purc�ase agre�nents for
any prospective buyers relating to the oenter median on Mississippi Street.
Mr. Robinson stated the Commission might want to consider a stipulation
reoonmending that there be a driveway turnaround installed so vehicles do
not have to back out onto Mississippi Street frcm Lots 6 and 7.

Mr. Charles Campbell stated he was with Merrill Lynch and was representing
Mr. Gerald Johnson on the sale of the property. He stated a niunber of
ather real estate oom��nies and developers have attempted to util ize this
property. He stated they have advised Mr. Johnson that the best use and the
easiest way to market this property w�ould be to go ahead with its intended
use which was single fam�ly hanes. He had advised Mr. Johnson to go ahead
with the lot split based on the market value and his investment in the
property. Mr. Johnson has agreed with this and is motivated to sell the
lots and have hcmes wnstructed.
Mr. Campbell stated they have made an arrangement with Brandon Construction
to bui.ld to suit. They are advising a walkout r�nhler type of home in the
$100,000 price range. It is what they call a ghost listing so there could
be an adjustment in the lot or type of house that is built there, but they
are trying to alert tuyers that this is the type of construction they see
for these lots. 7hey cb have a purchase agreenent on Lot 7, the lot closest
to Hic�way 65. Zhe buyers for that lat have been in touch with rir. Robinson
and he believed they know about the stipulations and the proposed median.
Mr. (�mpbell stated he had mentioned to Mr. Robinson before the meeting that
the driveway c�uld be further to the east az Lot 6. The median issue was
relatively new to him, but he had no problem with it and will put a
statement to that effect in the advertising and can have a stipulation in
the purchase agre�nent if that is helpful.
Mr. Betzold asked what Mr. (�mpbell thouc�t about a driveway turnarotmd.
r�r. C�mpbell stated the buyer was satisfied with the c�eal he is getting on
the lot, and he will know the location and the traffic situation. Any
further stipulations might make it a little harder to market the property,
but he clid not see a big probleqn if the Commission wanted to make that
st ipul ation.
Mr. Sak� stated he liked the stipulation for a turnaround because of the
safety protal�ns which oould be created by cars backing out onto Mississippi
Street.
Ms. Jody Bystran, 6533 Lucia Lane N. E. , stated there is a lot of on-street
p�rking on Lucia Lane whic.3� oontinues to be a problen. EVen with only two
rew driveways exiting onto Lucia Lane, th�re was the potential for a lot
more cars parking on the street. Had any thought been given to this
probl en?
Mr. Barna stated that the standard oode requires an adequate �aved driveway

and cbuble car garage and a 35 ft. setback f rom the street, which gives the
potential for five cars to park on the lot. He stated the neighborhood
could always petition to have "no parking" signs put up; but, of course,
that would then apply to everybody including the r�eic�►borhood.
It seemed to be the general v�noensus of those in the audience that single
fanily housing was what they have always wanted for this propert� and were
in agrec�nent with the lot spl it.

Mr. Robinson stated that on page 5 of the E�virorunental Qual ity Commission
minutes, the Con�unission had mac7e a motion reoomanending that the City Cotmcil
support the proposed Comprehensive Waste Reduction & Recycling Act; that the
City Council pass a resolution in support of the Comprehensive Waste
Reduction & Recycling Act; and forward the resolution to the t•iPCA, Waste
Management Board, Metropolitan Cotncil, Anoka Cot�ty, and State legislators
representing the City of Fridley. The Environmental Quality Conanission
would like the Planning Commission to ooncur with that recti�endation.
Mr. RDbinson stated there have been public hearings on the bill and most of
the curk�sic�e haulers are opposed to it. Super C�c1e was vehenently opposed
to it. 7Y�ey feel th�y are doing a g�od job and are follawing the initiative
put out b� Metropol itan Coincil and f eel the bill is detrimental to what
they are trying to achieve through cvrbside recycling.
Mr. R�binson stated they have been looking at bins for curbside recycling.
It has been praven that bins increase �rticipation dramatically. Fridley
has c�ne to bi-r�nthly pickups, L-ut it still has not increased participation
very much. The biggest problem seemed to be the lack of a distinction
between recycling and garkx�c�e placed at the curb. The bins are a strong
visual cue to people to recycle and mic�t help increase �artici�ation.
Ms. Sherek stated she aqreed that gart�ge pickup had to g� hand in hand with
recycling. People just cb not get into a oonsistent ��attern of putting out
recycl abl es.
Mr. �kx� stated he thou�t bins were an interesting idea. Maybe the �QC
oould look ir�to this and oome up with something similar to what r'linneapol is
is doing in their campaiyn promotion, maybe even get together with
M.ir,nea�nli� and other aonunia�►ities and make it a metro-wide effort. Maybe
the aosts for bins would be much cheaper when purchased in larc�e volLanes.
Ms. Sherek asked if businesses in the oonun�ity recycle. Does Super Cycle
pick up recyclables fran businesses in Fridley?
, Mr. Rc�bertson stated the Chamk�er of Commerce Board has talked about
organizing recycling. �here is a lat aF interest on the part of building
owr�ers in organizing it because there is a real oost savinc}s in reu'ucir,g the
�ano�t o� �per that has to be hauled away.

calls for left turn lanes fro�n Mississippi onto Highway 65 and the
constructian af a median almost to Lucia Lane.
Cotmcilman Billings asked about the west half of Lot 4 as he noticed past
pr�osals included this west half. I�s. C�mpbell stated he tmderstands that
i s r� lo¢iger p3rt of r�. Jcahnso�'s pmperty and isn't owned by him.
MyI'ION by Councilm3n Schneider to grant lot split, L.S. #88-01, with the
follaaing stipulations: (1) awner to supply a 15 foot bikeway/walkway
easanent oa7 Mississippi Street frar. Lucia Lane to Higl�aaay 65; (2) a park fee
of $750 each for Tract A and B be paid prior to issuance to building
permits; (3) driveway cm 7�ract B to access Lucia Lane ccily; (4) driveway on
balance of Lot 6 to be as far east as possi.ble; and (5) owner is responsi.ble
to notify prospective buyer of possible mEc3ion cai Mississippi Street which
could preclude easterly movenent frcm Lot 6 and 7. Seconded by Councilwa�nan

and Recyclino Act 1988 vras an attattpt to a ess the lag in development of
waste reduction and recycling pro �►ms behi;.d the deve�oFm2r.t of
wast�t�-eneregy incineratars. He s ed as originally proposed, the Act
included several provisions and ohibitions which its authors believed
would increase waste rec?uctio� ci recycling in Minnesota. Mr. Robertson
stated subsequent to the rormental Quality Cartrsssion recrnmending that
the C.ouncil support thi egislatian, all the key provisioazs were deleted in
Ca�uttee hearir_gs.
Mr. Robertso� ted the Cbuncil may si�pport the legislation as ori5inally
pr�aposed, rt the current draft oF the bill with th�e deletians, support
tt�e legi aticm with deletic�n af itens that are of concern to the City, or
suppo the legislatic� with an amendment to delete the recy�cling cieposit cm
f illable beverage co�tainers as it w�uld reduce the ftmds received f ram
e Cotmty by the City and create instability in the curbside program.
