RESOLUTION REPEALING AND REPLACING RESOLUTION NO. 2018-14
CONSIDERING A COMPREHENSIVE PLAN AMENDMENT, CP #18-01, TO
UPDATE THE ECONOMIC AND REDEVELOPMENT CHAPTER OF THE
FRIDLEY 2030 COMPREHENSIVE PLAN
WHEREAS, the Fridley Planning Commission held a public hearing on Comprehensive Plan
Amendment, CP #18-01, on February 21, 2018 and recommended approval; and
WHEREAS, the City Council also conducted a public hearing on Comprehensive Plan Amendment,
CP#18-01, to consider the Amendment language and contents at their March 12, 2018 City Council
meeting; and
WHEREAS, On April 9th the City Council adopted Resolution No. 2018-14 authorizing staff to amend
the boundaries TOD District in accordance with the law, and
WHEREAS, the Metropolitan Land Planning Act (MN Statutes 473.851 — 473.872) specifies procedures
for local government units to follow when preparing and submitting amendments to their land use plans
to the Metropolitan Council; and
WHEREAS, the City of Fridley has notified all surrounding jurisdictions and special taxing districts of
the proposed amendment as required by MN Statutes 473.858, and following 60 -days' notice no
jurisdiction has responded with concern for the proposed amendment; and
WHEREAS, the City Council has reviewed the Comprehensive Plan changes to Chapter 4, Economic
and Redevelopment, shown in the attached Exhibit A; and
WHEREAS, the City Council of the City of Fridley hereby authorized City staff to submit the proposed
amendment, Comprehensive Plan Amendment, CP #18-01 to the Metropolitan Council for consideration;
and.
WHEREAS, the Metropolitan Council, upon receipt of the Minor Comprehensive Plan Amendment,
reviewed and approved the amendment as submitted and notified the City of said approval on May 7,
2018, as shown in the attached Exhibit B;
NOW THEREFORE, BE IT RESOLVED, that subsequent to the approval of this amendment by the
City Council of the City of Fridley and the Metropolitan Council, a legal description was requested to be
included by legal counsel for the property owner, John Allen. Said legal description is as follows:
Tract 1:
All that part of Section Twenty-two (22), Township Thirty (30), Range Twenty-four (24), Anoka County,
Minnesota, described as follows:
Commencing at a point, marked by Judicial Landmark on the South line of said Section and
distant 365 feet Westerly of, measured at a right angle to the center line of the main track of Great
Northern Railway Company, running in a Northerly and Southerly direction through said Section;
thence Northerly parallel with and distant 365 feet Westerly of measured at a right angle to said
center line of said main track, 4,574.75 feet to a point marked by Judicial Landmark; thence
Northeasterly 714 feet to a point, marked by Judicial Landmark, on the North line of said Section
Twenty-two (22), and distant 265 feet Westerly of, measured along said North section line, the

said center line of main track, thence West on said North section line 328.35 feet to the pint of
intersection, marked by Judicial Landmark, with the Easterly line of right of way of Anoka
County Highway No. 1, as laid out and established in a Northerly and Southerly direction through

of intersection, marked by a Judicial Landmark, with the South section line of said Section
Twenty-two (22), thence East along said section line 1,792.9 feet to the ping of beginning.
Excepting that part lying Northerly of the following described line:
Commencing at a ping in the North line of Lot 13, Auditor's Subdivision No. 78, being also the
North line of the Southeast Quarter of the Northeast Quarter (SE '/4 of NE '/4) of said Section
Twenty-two (22), distant 365 feet Northwesterly, measured at right angles, from the center line of
main track at the railway of the Great Northern Railway Company, as now located and
constructed; thence Southerly parallel with said center line of main track for 570 feet; thence
Westerly on a line, hereinafter called "Line X" parallel with said North line of Lot 13, 400 feet to
a point hereinafter, called "Point A;" thence Easterly retracing last described course for 400 feet;
thence Southwesterly parallel with said center line of main track distant 365 feet Northwesterly,
measures at right angles, there from to a point, being the point of beginning of the line to be
described, in a line parallel with and distant 878 feet South, measured at right angles, from said
North line of said Lot 13; thence Westerly parallel with said North line of Lot 13 for 385 feet;
thence North in a Straight line to Point A; thence Northerly at right angles to Line x for 17 feet;
thence Northwesterly at an angle to the left of 60 degrees 30 minutes to a point in the Easterly
boundary line of East River Road, and there terminating.
Excepting that part lying Southerly of the following described line:
Commencing at the Southeast corner of said Section 22; thence Northerly along the East line of
said Section 22, a distance of 1,528.6 feet to the ping of beginning of the line to be described;
thence deflecting to the left an angle of 86 degrees 28 minutes a distance of 3,500 feet and there
terminating.

All that part of the Northeast Quarter of the Southeast Quarter (NE '/4 of SE 1/4) of Section Twenty-two
(22), Township Thirty North (30), Range Twenty-four (24) West of the Fourth Principal Meridian,
described as follows:
Beginning at a point in the North line of said Northeast Quarter of the Southeast Quarter (NE '/4
of SE '/4) of Section Twenty- two (22), perpendicularly distant Three Hundred Sixty-five (365)
feet West of the center line of main track of the Railway of the Great Northern Railway Company
as now located and constructed; thence Southerly parallel with said center line of main track to a
point in the Northerly boundary line of State Trunk Highway No. 100, said Northerly highway
boundary line lying parallel with and perpendicular distant One Hundred Fifty (150) feet
Northerly from the survey centerline of said State Trunk Highway No. 100 as now laid out and
established; thence Easterly parallel with center line of said highway, Three Hundred (300) feet;
thence Northwesterly in a straight line to a point in said North line of the Northeast Quarter of the
Southeast Quarter (NE '/4 of SE '/4), distant One Hundred Seventy (170) feet East of the place of
beginning thence West along said North line of the Northwest Quarter of the Southeast Quarter

commencement, according to the United States Government Survey thereof. The Easterly line of
said land is marked by Judicial Landmarks set pursuant to Torrens Case No. T-1311.
BE IT FURTHER RESOLVED, that the City Council of the City of Fridley by the adoption of this
resolution hereby does the following:
1. Repeals Resolution No. 2018-14 in its entirety; and
2. Replaces Resolution No. 2018-14 with this resolution which now defines the legal description of
the property located at 5601 East River Road.

Dear Ms. Jones:
The Metropolitan Council received the City's Update to Economic & Redevelopment Chapter Comprehensive Plan
Amendment (amendment) on April 12, 2018. The City submitted supplemental information for this amendment on
April 27, 2018.
The amendment changes the Northstar TOD section of Chapter 4 of the 2030 Comprehensive Plan to remove the
parcel at 5601 East River Road from the master planned Northstar TOD overlay district. The removal of this parcel
re -guides the land to from Industrial (13 acres), Commercial (9 acres), and Multi -family Residential (5 acres) to
Industrial (27 acres total) land use to allow for construction of two industrial buildings.
Council staff finds the amendment meets the Comprehensive Plan Amendment Administrative Review Guidelines
revised by the Council on July 28, 2010. The proposed amendment does not affect official forecasts. The
amendment does reduce opportunities to accommodate the City's share of the region's affordable and lifecycle
housing need. However, the City still guides enough land at appropriate densities to meet its affordable housing
need allocation. Therefore, the Council will waive further review and action; and the City may place this
amendment into effect.
In addition, staff offers the following advisory comments for your consideration:
Forecasts (Todd Graham, 651-602-1322)
Council staff advise that the City should adjust TAZ forecast allocations from TAZs 268 and 269 to reflect the
change in expected development. The City can update the TAZ forecast through correspondence to
Metropolitan Council, with submission of the 2040 Pian Update or in advance of the Plan Update.
Land Use (Eric Wojchik, 651-602-1330)
The City received $100,000 in L,CDA funds in 2012 to assist with its Northstar TOD Master Plan. The City
formally adopted the Northstar TOD Master Plan into the City's 2030 Comprehensive Plan in 2015 (Review
File No. 20387-3). Since 2015, the City has stated that it has been difficult to market this site at 5601 East River
Road for TOD development given its location and distance from the Fridley Northstar Station (over '/2 mile).
While the Council appreciates the challenges in marketing and development of TOD sites, Council staff advise
that TOD development takes time and resources to implement. Given that only three years have passed since
Master Plan adoption within the 2030 Plan, the Council would have preferred that the City retained and
promoted this site within the TOD district to allow for development which is more transit supportive, walkable,

and connected. With removal of this site from the TOD district, Council staff strongly encourages the City to
require connectivity (for motorists, bicyclists, and pedestrians), sufficient landscaping, and high quality design
to enhance and retain some of the features and TOD aspirations for this area.
Transit (Kyle Burrows, 612-349-7749)
The site is served by Route 852 with hourly all -day service and peak service around every 30 minutes. Council
staff support the re -plating of the site to allow for a future 57'x' Ave extension. The City should encourage good
pedestrian access into this site from the Route 852 stops on East River Rd.
Housing (Tara Beard, 651-602-1051)
The City should be aware that its share of the region's 2021-2030 need for affordable housing is 268 units. In
preparing the 2040 comprehensive plan update, the City should note that the minima n density of land guided
to address this need is 8 units per acre. The City is encouraged to contact their Sector Representative or Council
housing staff with any questions regarding the Council's housing policy for the 2040 comprehensive plan
update.
Wastewater (Roger Janzig, 651-602-1119)
Metropolitan Council Interceptor (4 -NS -521), is located cast of East River Road Northeast and north of
Interstate 694, and runs through this proposed project location. The interceptor was built in 1965 and is a
combination 48in RCAP/CIPP Liner Foreemain & 96in RCP Gravity, at approximate depths of 7 to 16 feet. To
assess the potential impacts to our interceptor system, prior to initiating this project, contact Scott Dentz,
Interceptor Engineering Manager (651-602-4503) at the Metropolitan Council Environmental Services.
