to su4nit a Certificate of SurvEy aontaining a simgle description of a part
of a gl atted 1 ot or r egi st er ed 1 ot, al ong w ith the new pa roel.s cr eated w ith
all existing structures tied in.
4. The application will then be su�mitted to the Planning C.ommission for their
reoomm�►endation. The Planning Canmission meets on the Wec�esday follaaing
the City Co�cil meeting, which is ge�erally the f irst and third Wednesdays
of the month.
5. The reoommer►dations of the Planning Co�¢nission are sutmitted to the City
Council for final action. If a Certificate of Surve� wasn't required before,
it will be required for this meeting. �he City Council meets on the first
and th i rd Mo nday s of th e month.
6. The City Council appraval may be subject to vertain stipulations which must
be c�nmlied with b� the apglicarit.
7. If appraved, the applicant shall then have the larx7 involved in the lot split
surveyed. Upon reoeipt af the required Surv�yor's Certificate, the Council
shall pass a resolution apprwi.ng the lot split.
8. After fir�l appraval, a oertified oop� of the resolution apprwing the
lot spl it and a "Certif icate of Status" f orm shall be attached to the notioe
of apprwal and f orwarded to the appl icant. Yi�e lot spl it, together with a
certif ied oop� of the resolution and "Certif ication of Status" form, shall
thereafter be reoorded among the reoords of the County within one hundred
eic�ty (180) days after the date of the resolution, �uiless a longer period of
time is granted and prwided for reo�rding at the time of approval.
9. In all cases where City Co�cil action has been sou�t arld denied, no petition
for iderttical action can be presented until a period of six months has elapsed.

Mr. Micklc-y wants to begin oonstruction prior to ground f reeze. Due to the
Veterans D�ay holiday the sd�eduling of ti�e spl it was delayed. In order to

and would like Council to apprwe a resolution at their November 23, 1987

To split off the northeasterl; 5.89 ieet of Lot 5, Block 1 , Rice Creek
Plaza South Addition. Said 6.89 feet to remain wii.h Lot 5, Block I ,
Rice Creek Plaza South Addition. The remainder of said Lot 6 to be
combined to create one buildable lot, ihe sa�e being 24] Rice Creen Terr. NE.
Mr. Robinson stated the lot split inwlved a portion of vacant property
located north of Rice Creek Terrace, south of Rice Creek, and west of
Highway 47. The proposal was to split what was the platted Lot 6 of the
Rice Creek Plaza South Addition which, subsequent to the plat, was split
dvwn the middle and approxiriately each half was combined with the adjacent
lots. The lots were quite large, and th�re was a house on Lot 5 and a
house on Lot 7.
Mr. Rpbinson stated the petitioner who lives an Lot 7 has sold his house
and wishes tA build on Lot 6, so he was asking to recombine that lot.
Inasmuch as the house on Lot S had been built within 5 ft. of the lot line,
it was necessaxy to split off 5 ft. of Lot 6 which was the northeasterly
6.89 ft. of Lot 6 in order to have a 10 ft. setback to meet code. A certi-
ficate of survey had been submitted.
Mr. Robinson stated the new lot would be more than a�le in size, 12,000
sq. ft. in area. Staff did not see any probl�n with the split. The house
to the west was set back 4.9 ft. and was 1/10 of a foot short of rieeting
code, and the City Council could recognize that with the lot split.
Mr. Rd�inson stated Staff was recatrarending the follaaing stipulations:
l. A park fee of $750 to be paid prior to building permit for new lot.
2. Petitioner to provide as-built storm sewer legal descriptions and
agrees to provide subsequent easement for same.
Mr. Gerald Sadawski, 250 F�ice Creek Blvd. , stated he lived directly across
the Creek froan Mr. Mickley's property. 4�en he bought his property last
year, it had appeared there was adequate room for this type of develo�rnent.
'The lack of a structure at that locatio� has a major aesthetic i.�act
on the piece of property which he purchased. Before he bought the property,
he looked at Mr. Mickley's property, obsezved the drainage, looked at the
plat map, and was satisfied he had picked a site that would seem difficult
to put in anything that would have an impact on his property. He did feel
this new construction would have a major aesthetic in�act on his property-
He 3hought the drainage barrier presented a severe barrier to any developer
of the property. .

Mr. Mickley stated he lived on Lot 7 directly behind Mr. Sadawski. He
stated that Lot 7 and the proposed Lot 6 have steep drop-offs in the back
part of the lot. Neither of the lots lend th�elves to any landscaping
theme, and so he has left that property pretty much wild. He really had
no intention of doing anything different, although Mr. Sadawski really had
no protection against that. .

Mr. Robinson stated bec-�use it was necessary for Mr, t�Iickley to move
quickly in order to start construction this fall, this would go to the
City Council on Nov. 23 before the minutes were approved at the next

5. CONSIDERATION OF A LOT SPLIT, L.S. #87-10, BY VERNON �OLLESEN:
To split off that part of Lot 6, Block 3, Rice Creek Plaza th
Addition, lying southwesterly of a line drawn parallel w' and 5 feet
northeasterly of, as measured at right angles to, st southwesterly
line of said Lot 6, the same being 250 Rice Creek errace N.E.
Mr. Rabinson stated the reason for the lot it application was because
the swinming pool overlaps the lot line, the neighbor on Lot 6 has
agreed to sell 5 ft. to the petitianer n order to clean up this situation.
The survey presented by Suburban En 'neering indicated exactly that.
Originally, they were both 95 ft ots. With the subdivision, Lot 6
will be reduced to 90 ft.; hvw er, it would still be 10,800 sq. ft.
after the split, far in ex s of what the code requires. Staff has no
prablem with the lot spli and recarrn�nded approval.

Couneilmar� Schneider stated he didn't understand y there is a difference
whether a business serves the immediate area or lar�er area and why the 20
percent and 30 pereer�t categories.
Mr. Robertson stated, for instance, if th�20 percent occupancy has been
filled in an industrial complex ar.d ther�'another commercial establishment
requested they be allowed to locat�.�in this complex, the 30 percent
occupancy provision would allow the oUncil to consider this request.
Councilman Fitzpatrick stated i seems the people most affected by this
proposed ordinance were in fav r of it from comments made at the public
hearing.
Ceuneilman Schneider sta d he wasn' t opposed to commerical uses in an
industrial 2rea. He s ted his problem is considering the special use
permit and if a busine �:ould or would not serve as a supplemental to the
industrial district.
Mr. Billin�s, Cha an of the Planning Commission, stated if a developer
applies for a s cial use permit to set aside 20 percent of his industrial
sgace for comm ical use, staff makes a determination if the business would
be appropria as a supplemental use to the industrial district. He stated
if someone shed to locate a commerical use that wasn't supplemental to the
industri district, this request would be submitted to the Council.

appropriate to grandfather a very small variar,ce for one-tenth of a foot.
Mr. Billings, Chairman of the Pl annin� Commission, stated the Pl anning
Commission unanimously recommended approval of this request for a lot split.
He stated there was an original plat of Lot 6 and the awners of Lots 5 and 7
each purchased one-h21f of this lot. He stated one of the owners is now
going to sell his half of Lot 6 to the other in order to make it�a buildable
1 ot.
N,r. Qureshi, City Manager, asked if Lot 6 wag assessed for water and sewer
and if this assessnent was paid.
Mr. Robertson stated he didn't believe it was assessed because the system
was privately installed.
Ma.yor Nee stated there was mention of a difference in one-tenth of a foot
and asked if a varianee was requested en Lot 7.
r�r. Robertson stated there was an error in the survey of one-tenth of a foot
a.nd felt it would be in order, as a separate motion, for Council to grant
this variance.
t�'r. Flora, Public Works Director, stated if the lot split is approved, a new
Lot 6 will be established and a lot line which will be � .9 feet from the
ad�oining property.
Mr. Robertson stated there was a survey completed in December, 1962 at the
time Lot 6 was originally sglit. He stated the west half was added to Lot 7
and the east h�1f wa� added to Lot 5.
r`ayor Nee stated he didn't have a problem with the lot split, but war.ted to
make sure there wouldn' t be any title problems.
Mr. Qureshi stated the newly created lot is actually smaller than the
original Let 6 as a certain portion will be going to Lot 5•
Mr. Mickley stated when he first approached the City with this lot split
request, the concern was the house on Lot 5 �ias too close and a resurvey was
requested in order to provide enough property to Lot 6 to make sure it meets
setback requirements,
P�. Newman, City Attorney, stated Lot 6 was platted ar_d in checking the plat
map for 1970, the lot does exist . He stated as far as the legal
description, Lot 7 has the west half of Lot 6 and Lot 5 has the east half of
Lot 6. He stated the petitioner is seeking to move this property line by
means of the lot split. He stated if the lot split is approved, the owner
of Lot 5 would sell his portion of Lot 6 to the awner of Lot 7 so it is all
in common ownership. He stated the Council may wish to clarify that these
two Lots 6 ar:d 7, ha�e their individual pieces combined into one tax parcel

Mr. Rol�ertson, Community Development Director, stated the Coun 1 approved a
special use permit for TYie Lift which was to be reviewed at is time. He
stated three of the stipulations of the special use perm have not been
completed, which are as follows: (1) provide a screened , pster with fenee
on all four sides; (2) mulch planting bed on the east s� e of the property ;
and (3) provide a timetable pertaining to the provisi��`ns of the finalized
site plan including parking lot setbacks, concret�" curbing and complete
landscaping. Mr. Robertson stated the temporary t�iler license granted on
June 4, 1984 was for a three year period and ha�expired. He stated the
owner, Mr. Holmer, was requested to apply for ar�"extension by November 17,
1987, but as of this date, no request has be�n received. Mr. Robertson
stated if Council wishes to extend this tempc�e"ary trailer permit, staff is
recommending the remaining stipulations,fof the special use permit be

Mr. Flora, Public Works Director, stated the City received a quest from
the Metropolitan Transit Commission to use 3rd Street. e stated the
Council has a letter in the agenda packet which was draf , �d by staff in
response to this request. Mr. Flora stated this letter su orts the concept
proposed by rSTC to use 3rd Street between 61st and 57th;"�Avenues as a bus
route for the mcrnin� scuthbound rush period betwee �6 a.m. and 8 a.m.
weekdays with two qual ifications: (1 ) a review of e street condition
during the sprin� thaw to deternir�e if the reroute 'can continue or what
n�ber of bus trips can be safely approved; and (2);% any structural damage

supplemental tc the district, would require individual review throug a
special use permit. He stated this type of business would poter,tially raw
from a wider �arket and produce greater parking and traffic burde . He
stated this type of use would be permitted up to 5, 000 square fe for a
business and up to 30 percent accumulative total commercial occup cy.
Couneilman Schneider stated he didn' t understand why there i a�difference
whether a business serves the immediate are2 or a larger a and why the 20
percer_t and 30 percer,t categories.
Mr.- Robertson stated, for instance, if the 20 perc t oecupancy has been
filled in an industrial complex and then another mmercial establishment
requested they be allowed to locate in this omplex, the 30 percent
occupancy provision would allow the Council t consider this request.
Councilman Fitzpatriek stated it seems e people most affected by this
proposed ordinance were in favor of i fros comments made at the public
hearing.
Councilman Schneider stated he asn' t opposed to commerical uses in an
industrial area. He stated s problem is considering the special use
permit and if a business wo or Would not serve as a supplemental to the
industrial district.
Mr. Billin�s, Qlairma of the Planning Commission, stated if a developer
applies for a speci use perait to set aside 20 percent of his industrial
sp�ce for com�,eri use, staff nakes a determination if the business Would
be appropriate a supplemental use to the industrial district. He stated
if someone wi ed to locate a commerical use that Wasn't supplemental to the
industrial strict, this request would be submitted to the Council.

ordi nce upon first reading. Seconded by Councilmar. Goodspeed. IIpon a

Mr. Billings, Chairman of the Pl annin� Commission, stated the Pl ar.ning
Commission unanimously recommended approval of this request for a lot split.
He stated there Was an origir,al pl at of Lot 6 and the o�wners of Lots 5 and 7
each purchased one-h21f of this lot. Y.e stated one of the owners is now
going to sell his half of Lot 6 to the other in order to make it a buildable
lot. �
A'r. Qureshi, City Manager, asked if Lot 6 was assessed for water and sewer
and if this assessnent w2s paid.
Mr. Robertson stated he didn' t believe it was assessed because the �ystem
was privately installed.

N'r. Flora, Public Works Director, stated if the lot split is approved, a new
Lot 6 will be established and a lot line which will be 4 .9 feet from the
ad�oining property.
N.r. Robertson stated there was a survey completed in December, 1962 at the
time Lot 6 uas originally split. He stated the west half was added to Lot 7
and the east h�lf wa� added to Lot 5.
r;ayor Nee stated he didn' t have a problem with the lot split, but �.•�r.ted to
make sure there wouldn't be any title problems.
!�,"r. Qureshi stated the newly ereated lot is actually smaller than the
original Let 6 as a certain portion will be going to Lot 5-
M.r. rackley stated when he fir•st approached the City With this lot split
request, the cor,cern was the house on Lot 5 �*as too close and a resurvey was
requested in oraer to provide enough pruperty to Lot 6 to make sure it meets
setback requirements.
1x. New�nan, City Attorney, st2ted Lot 6 was platted ar_d in checking the glat
map for 1970, the lot does exist. He stated as far as the legal
description, Lot 7 has the West half of Lot 6 and Lot 5 has the east half of
Lot 6. Fie stated the petitioner is seeking to move this property line by
means of the lot split. He stated if the lot split is approved, the oNner
of Lot 5 Hould sell his portion of Lot 6 to the awner of Lot 7 so it is all
in common ownership. He stated the Council may wish to clarify that these
two Lots 6 ar,d 7, h2ve their individual pieces combined into one tax parcel
for each lot. t;OTION by Councilman Fitzpatrick to coneur with the
recommendation of the Planning Commission and grant lot split, L.S. �k87-09,

Mr. Robertson, Community Development Director, stated the Council appr ved a
special use pernit for T2ie Lift which was to be reviewed at this ti e. He
stated three of the stipulations of the special use permit have ot been
completed, tahich are as follows: (1) provide a sereened dumpster �rith f�r.e�
on all four sides; (2) mulch plantir.g bed on the east side of e praperty ;
and (3) provide a timetable pertaining to the provisions of e finalized
site p1Zn including parking lot setbacks, concrete curbi and complete
landscaping. Mr. Robertson stated the temporary trailer 1 cense granted on
June �I, 198�1 �as for a three year period and has expir d. He stated the
rn�r.er, Mr. Holmer, Was requested to apply for an exten on by November 17,
1987, but as of this date, no request has been rec ived. Mr. Robertson
stated if Council wishes to exter.d this temporary t ler permit, staff is
recommending the remaining stipulations of th special use permit be
completed and a bond of �10,000 be provided to i sure these improvements.
Mr. Robertson stated N'.r. Holner contacted sta f and stated he would not be
able to attend the neetins this evening.
Councilman Schneider stated he f t comfortable with staff ' s
recommendations, but felt Mr. Holner uld attend the Council �eeting to
explain his non-complianee with reque ts that have been made by staff.
MOTION by Councilman Schneider o table this item to the next Council
meeting and instruct staff to trongly eneour2ge Mr. Holmer to attend.
Seconded by Councilwoman Jorg son. Upon a voice vote, all voting aye,

Main Street. He tated Rosewood has delayed development plans and requested
the City not stall this storm sewer line until they are prepared to
proceed with onstruction.
