2. Return vomgleted application form with the required sketch of the property
involved and the lot sglit fee of $100.00 for each original lot being split.
3. The application will be checked aver by Staff and the aaner may be required
to sutrnit a Certif icate of Surv� �oritaining a simgle description of a part
of a gl atted 1 ot or r egi st er ed 1 ot, al ong w ith the new pa rcel s cr eated w ith
al l exi sti ng str uct ur es ti ed i n.
4. Zlle application wi11 then be sutmitted to the Planning Conunission for their
reo�manendation. �e Planning Canmission meets on the Wec�esday following
the City Council meeting, which is ge�,erally the first and third Wednesdays
of the morrth.
5. The reoommendations of the Planning Catunission are sutmitted to the City
Co�cil for f inal acti on. If a Cer ti f ica te of S�rv ey wasn't r eq ui red bef or e,
it will be required for this meeting. 'Il�e City Council meets on the first
and th i rd Monday s of the mornh.
6. Zt�e City Council appraval may be subject to certain stiptz].ations which must
be canmlied with b� the apglicant.
7. If apprwed, the applicant shall then have the land involved in the lot split
surv�ed. Upon reoeipt of the requi red Surve�or's Certif icate, the Council
shall pass a resolution apprwing the lot split.
8. After firr�l appraval, a vertified �p� of the resolution apprwing the
lot sglit and a "Certificate of Status" form shall be attached to the notice
of appraval and forwarded to the applicarrt. �e lot sglit, together with a
oertif ied o�p� of the resolution and "Certif ication of Status" form, shall
thereafter be reoorded among the reoorcis of the County within one hur,dred
eic�ty (180) days after the date of the resolution, �.m].ess a longer period of
time is granted and prwided for reoording at the time of apprwal.
9. In all cases where City Council action has been souc�t ar�d denied, no petition
for identical action can be presented until a period of six moriths has elapsed.

Mr. Mickley stated he lived on Lot 7 directly Uehind r1r. Sadaaski. He
stated that Lot 7 and the proposed Lot 6 have steep drop-offs in the back
part of the lot. Neither of the lots lend therr�selves to any landscaping
theme, and so he has left that property pretty much wild. He really had
no intention of doing anything different, although Mr. Sadawski really had
no protection against that. �

To split off that part of Lot 6, Block 3, Rice Creek Plaza South _
Addition, lying southwesterly of a line drawn parallel with and 5 feet
northeasterly of, as measured at right angles to, the rrost southwesterly
line of said Lot 6, the same being 250 Rice Creek Terrace N.E.
Mr. Robinson stated the reason for the lot split application was because
the swimning pool overlaps the lot line,so the neighbor on Lot 6 has
agreed to sell 5 ft. to the petitianer in order t�o clean up this situation.
The survey presented by Suburban F�gineering indicated exactly that.
Originally, they were both 95 ft. lots. With the subdivision, Lot 6
will be reduced to 90 ft.; however, it would still be 10,800 sq. ft.
after the split, far in excess of what the code requires. Staff has no
prablem with the lot split and rec�nded apgroval.

To split off the northeasterl; b.89 feet of Lot 5, Block ] , Rice Creek
Plaza South Addition. Said 6.89 feet to remain with Lo 5, Block 1 ,
Rice Creek Plaza South Addition. The remainder of sa' Lot 6 to be
combined to create one buildable lot, the sa�e being 4l Rice Creek Terr. NE.
Mr. Rd�inson stated the lot split involved a porti of vacant property
located north of Rice Creek Terrace, south of Ric Creek, and west of
Highway 47. The proposal was to split what was e platted Lot 6 of the
Rice Creek Plaza South Addition which, subsequ t to the plat, was split
down the middle and approximately each half w s combined with the adjacent
lots. The lots were quite large, and there as a house on Lot 5 and a
house on Lot 7.
Mr. Rabinson stated the petitioner who 1' es on Lot 7 has sold his house
and wishes to build on Lot 6, so he was asking to recor,i�ine that lot.
Inasmuch as the house on Lot 5 had built within 5 ft. of the lot line,
it was necessary to split off 5 ft. Lot 6 which was the northeasterly
6.89 ft. of Lot 6 in order to have 10 ft. setback to meet code. A certi-
ficate of survey had been submitt
Mr. Rr�binson stated the new lot ould be more than a�le in size, 12,000
sq. ft. in area. Staff did no see any problem with the split. The house
to the west was set back 4.9 . and was 1/10 of a foot short of rieeting
code, and the City Council ld recognize that with the lot split.
Mr. Rabinson stated Staff as reca�mending the follaaing stipulations:

Mr, Gerald Sadaw i, 250 Fice Creek Blvd. , stated he lived directly across
the Creek from 4r. Mickley's property. 4d�en he bought his property last
year, it had peared there was adequate room for this type of develo�xrent.
The lack of structure at that locatian has a major aesthetic i.�act
on the pie of property whi.ch he purchased. Before he bought the property,
he look at Nir. Mickley's property, observed the drainage, looked at the
plat ma , and was satisfied he had picked a site that would seem difficult
to pu in anything that would have an impact on his property. He did feel
this ew construction would have a major aesthetic impact on his property.
He ought the drainage barrier presented a severe barrier to any develaper
of the property.

THE SAME BEING 165 8 RD AVENUE N.E. BY LISA GI COLA:
Mr. Robertson, Community Development Director, st d this request is for a
special use permit to allow a day care facil y within the Springbrook
apartment complex. He stated the facility wo d have 3,3�7 square feet of
space to allow for the care of 62 ehildren, e stated 22 parking stalls are
required and the apartment complex has a s plus of 12 stalls which will be
reserved for use by the day care facilit . He stated there is now green
space in the plan which could be conver d to parking, if there is a need.
He stated this Would be referred to a deferred parking and is permitted
under the eode.
Mr. Robertson stated the Planni Commission recommended approval of this
special use permit with six s pulations which he reviewed. He stated
Stipulation 6 required a signa e plan be submitted to staff for review. He
stated this has been done nd one minor revision has been made . Mr .
Robertson stated the baekgr und color of the sign should match the apartment
sign's color scheme. He ated the petitioner agrees to the final approval
of the signage by the Ci y staff.
MOTION by Couneilman itzpatrick to grant special use permit, SP #8?-20,
with the followin stipulations: ( 1 ) provide parking lot signage
designating the s stall bank of parking, immediately ad�acent to day care
facility, as re rved for day care users on Monday through Friday 6 :00 a.m.
to 6:00 p.m. ; 2) provide parking lot signage designating nine stalls,
directly wes and across the driveway from the day care facil ity, as
reserved for day care employees only Monday through Friday 6:00 a.m. to 6:00
p.m. ; (3) rovide playground area and equipment details prior to building
permit f staff approval; (�1) building facade materials for day eare to be

�'� I�. Holmer stated With the road improvement in 1979, a lot of their parking
Was eliminated. He stated he really cannot speak as o future plans for the
business. He stated there is still hope to tear do n the old gas station
and add on to the existing building. However, the inancial situation over
the last several years has not allowed this to take place . Mr. Holmer
stated the dumpster is screened and the only pla it is exposed is to the
side whieh is opposite the City's liquor store pster. He stated as far
as mulching the planting beds, they have moWed he area and are attempting
to get grass growing around all the shrubbery
Mr. Holmer stated their parent company dces ave office space in Lake Elmo
and the office facility may move to that 1 cation. He stated he would 1 ike
to renew the trailer permit for their fae lity for a short period of time.
Couneilman Sehneider asked Mr. Holmer if they could resolve the parking
issue. Mr. Holmer stated the drawing ubmitted did layout the parking with
an 8-foot setback.
Mr. Robertson stated the original tent was to demolish the old gas station
structure and create sufficien room to meet the parking and setback
I� requirements. Mr. Holmer stat , at this time, it isn' t financially
feasible to sign a long term 1 ase to proceed With a neW facility. He
stated the property has been u raded by seeding and sealcoating.
Couneilman Schneider stated h s biggest concern is the trailer. He stated
he wouldn't ob�ect to the si month extension, but at the end of this time,
he would 1 ike to see concre e pl ans for the future.
Mr. Holmer stated in six onths he should lrnow the timetable for merging the
offices together and the trailer will no longer be needed on the property.
He stated as far as exp sion, it depends on how business goes and if the
partnership wants to u grade the property.
Councilman Schneider sked Mr. Holmer if he Was willing to provide the gate
on the other side o the dumpster. He stated he couldn't afford to hire a
carpenter, but co probably get out his tools to install the screen�.ng.
MOTION by Counei an Schneider to extend the trailer permit for TYie Lift for
six months, Wit the condition that the dumpster be fully sereened on all
four sides, an a timetable pertaining to the improvements, landscaping of
the site, and emoval of the trailer be worked out with staff. Further,

requested because a swimming pool overlaps the lot line . He stated the
owner of Lot 6 has agreed to sell a five foot portion of his lot to the
oWner of Lot 5 . He stated both lots are 95 feet wide and, With this lot
split, Lot 6 will be reduced to 90 feet, but still is over 10, 000 square
feet in area which exceeds the code requirements.
Mr. Robertson stated the Planning Commission unanimously recommended
approval of this lot split.

Mr. Robertson, Community Development Direetor, stat�d this is a request for
a variance to inerease the maxim� allowable sigrr from 80 square feet to 96
square feet. He reviewed a letter submitted by the petitioner, Mr .
Freyinger, whieh outlines What he feels are hardships associated with this
property. Mr. Robertson stated these hard�hips deal with access, loeation,
past history of the building, visibility,�'and the number of tenants in the
building. He stated the petitioner fel� if they couldn't get a larger sign
for the tenants, they may not survive,/as three tenants will be located in

MOTION by Couneilman Fitzpatrick to concur with the unanimous recomme dation
of the Appeals commission and grant variance , VAR #87-36 , th the
stipulation that if the building is occupied by one or two tenan s, rather
than three, the sign would be reduced to 80 square feet as req red by the
code. Seconded by Councilwoman Jorgenson. '
Mr. Qureshi, City Manager, asked the status of the lot to t e north oF this
building which is a small parcel.
Mr. Freyinger stated he is the owner of that pareel an it would be used for
overflow parking.

6. CONSIDERATION OF AN AGREEMENT WITH THE ANOKA OUNTY CONII�lUNICATIOI�S WORKSHOP
(ACCW) :
Mr. Hunt, Assistant to the City Manager, stated this is an annual request by
the ACCW for a portion of the funding ich comes from the cable operator's
franehise fee. He stated the agreeme t before the Council stipulates the
City would grant 40 pereent of the f anehise fee to the ACCW. He stated the
request was eonsidered by the Cabl Commission at their last meeting and
they made the recommendation that 50 percent of the franchise fee be given
to the ACCW.
Mr. Hunt stated last year the e was discussion on this matter and it was
resolved that 40 pereent f the franehise fee would be given plus the
interest ineome from the le Fund. He stated this actually turned out to
be more than 50 percent. He stated a decision must be made by the Council
on the percentage of th franehise fee which would be given to the ACCW, and
if they wish to coneur with the Cable Television Commission's recommendation
� for 50 percent.
I�h�. Qureshi, City nager, stated the City feels the franchise fee is being
used for three di inet funetions; the ACGW allocation, City Commission
operational co ts, and City staff monitoring. He stated staff' s
reeommendation ould be to give u0 pereent of the franehise fee to the ACGid
and the intere from the Cable Fund acerued in 1987.
Couneilman S neider stated he talked to Mark Scott, of the ACG1r], and he
would be pl ased either way the Council decides to proceed. He stated he
Would tend to agree with the City Manager because if, in the future, they
have to c t back on distribution of these funds, it may be less difficult.
