LOT SPLIT APPLICATION PROCIDIIRE
1 . Obtain application form at City Hall. (6431 University Ave. N.E. , Fridley�
2. Return completed application form with the required sketch of the property
involved and the lot split fee of $15.00 for each ori�inal lot being split. .
j. The application will be submitted to the Plats & Subdivisione and Streete
8o IItilitiee Subcommittee for recommendations. Thie Committee m�eta once a
manth, when required. The City wiil aupply the applica,nt with minutes of
the Subcommittee.
4, Following the Plats & Subs Committee recommendatiox� of approval, the owner
mu�t then obtain a Certificate of 5urvey on the original parcel or parcele
alqng with the new parcr:�: ;re8'_� '. w: ", ai: Pzietir,K strt�c'.area tied in.
�. The Certificate of Survey sriould then contain a simple description of a part
of a platted lot or registered lot and be filed with the Engineering Department
for Planning Commission recommendations. The Planning Commiesion meet� on the
�econd and fourth Thursday of the mo.nth. The City will aupply the applicant
with minutes of the Planni.ng Commissio.n.
�. The recommendatio.ns of the Pla.nni.ng Commission are submitted to th� C�.ty
Council for final action. The Council meets on the first and third Monday
of the month.
7. The City Council approval may be subject to certain a�ipulatione which muet
be complied with by the applicant.
8. A letter will be sent to the applicant to notify him of the Council actioz�
and to advise him to comply with the conditione impoaed by the City. The
letter will also contain any neceseary deede for easements and other pQ�rtinent
papere for hie sigxiature.
9• W�en all the conditions of the lot aplit have been complied with, the appliw�nt
ehould file the lot split in Anoka County.
� 10. �n all casea where Council action has been sought and denied, no petition for
identical action can be presented until a period of six montha ha� elap�ed.

Darrel Clark explained that Council asked if it would ba feaaible to
trade property. Because of the building of the Onan plant and future indua-
trial expaneion, 73rd Avenue was designated to be a State Aid road and it
Was necessary for access to Highway �65. If 73� ie vacated, half of ths
right of way would go to the awnera on the north side of the atrset aad the
other half to the awners on the south.
Chairnoan Erickaon etated thie was s fairly aizable problem aad could be
sent down to the Subcomonittee for further study and call the public back.
Aa attempt should be made to get more of the people to the meetiag.
Mr. Jensen, chairn►an of the Plats � Subdivisione-Street• 6 Utilitiea
Subcoumittee, said the public meeting would probsbly be in the middle of
November.

Chainnan Erickson said it $ppeared the Board of Appeals and Couacil
has concurred With the request. The Plaaning Co�isrion, about a year ago,
had reco�ended rezoning this lot to R-3 with no waiver of the land area.

only large enough for a triplex. She added there is a ti�ot factor b�causs

The Commission felt the size o#' the lot after the split wae not
particularly out of line for thia area. Mr. Fitzpatrick noted that
building a single family residence (R-1) in an R-3 zone would be going
up� not dowxi.
Darrel Clark said this request for a variance wae sent by Council to
the Board of Appeals to see if they would grant a vaxiance before the
request for a lot eplit was made so that it would not be Meceesary to pay
the 1ot aplit fee of �15.00 if the vaxiance would not be granted.
' The Chairman said there was no objection on the size of the lote,
even though they are below the mini�um atandarda, but under the
incox�sistancy of the rezoning, it aeemed to him granting a vsrianae and
waiving the rezoning on that lot, would be in line.
MOTION by Jeneen, aeconded by Myhra, that the Planning Commiesion
recommend to Council denial of the Lot Split requeet (L.S. #68-16)
Robert Wilson, Lot 1 , Block 4, Wilaon Addition. Before the vote was
taken, there waa further discussion.
Mr. Mtiyra said the Commission felt it was probably lack of under-
etanding of procedure, to some extent, to voice approval of a lot aplit
before the Subcommittee and Planning Commieeion had etudied the requeat.
The Planning Commission thought they did the right thing when they
rezoned for a triplex, and orderly procedurea are set up to make any
neceeeary ahangee. In this inatance they felt that orderly procedurea
ehould have been followed and Council could have over-ruled it. They
were concurri.ng with the Planning Commiseioii recommendation of rezoniz�g
to R-3. They underetand the Wilsone have to try to work with what they
have and tha,t eingle family residences would be better. The time factor
involved, if it were a young person who had the time to wait, they W4uld
. consider it differently. Although he eeconded the motion, he etill had
the feelixtg to approve the split contingent upon the fact that it should
be rezoned back to the origina,l zoning of R-1 .
Mr. Fitzpatrick said he knew the house and area. He knew that they do
not want a houae that hae been burned out re-conditioned and didn't
eee that was very feasible.
The suggeetion was that Mr. Wileon could ta.ke out one building permit
right away and the.n petition for the land to be rezoned back to R-1 .
� Referring to the above motion, a voice vote wae ta.ken, all voting nay.
The motion failed.

The �ity Engineer shawed the plan to the Council . He said that
bloon P�aza Shopping Center needs a lot of maintenance and the park-
ir�q lot is in bad shape.
1�C. Knickerbocker said that it would be a 4' x 9 ' buildirig, so it
would be only 36 square feet. Councilman Samuelson asked what the
sethack was from the front property line. Mr. Knickerbocker said
it was 92 ' .
Councilman Harris said that he had no objection to granting th is
�ermit, hawever, he felt that Moon Plaza should be made to clean
ug tk�eir violations, as they have promised. Councilman Sheridan
agreed with granting the building permit subject to Moon Plaza
c�eaning up their property, to meet City standards. The Council
assured Mr, Knickerbocker that their objections were not directed
tcyward him, or his company but towar� Moon Plaza Shoppiny Center.
Councilman Harris said that he tho�.,,ht that the Building Inspection
Department has a list of violations. The City Manager said that
he thought that there was a new awner nvw, a Mr. Gearman, and that
some progress has been made in cleanir:g up the problems.
Councilman Harzis suggested inviti.uiy the awner from Moon Corp. to
come to a Council Meeting to get this straightened out and to
insist on compl�ance with our ordinances.
MOTION by Councilman Liebl to grant the building permit request
by Fotomat Corporation subject to correction of the violations of
the lrloon Plaza Shopping Center. Seconded by Councilman Samuelson.
Upon a voice vote, all voting aye, Mayor Kirkham declared the
naotion carried unanimously.
Councilman Harris asked that this list oi violations be brought
back on the next Regular Meet.ing Agenda. .

The City Engineer explained the recommendations of the Building
Sta�ndards - Design Control ar�d said that they are applying for a
�et2,�a,ck waiv�r in the front yard from ?00 ' to 60 ' to conform with
Qther buildings in the area. This is being considered by the
Board of Appeals.
�Qtuze�.lman Harris asked if there was to be any outside storage.
The City Engineer said no. He said that the front is to be brick
and the sides are to be block and ' � will face onto Osborne Road.
He said that it was 60 ' x 200 ' for �� total square footage of
12,000.
Councilman Samuelson asked if the parking lot was blacktopped. T'he
City Engineer said yes, and that it is adequate now. He pointed
out that one side is only 1 ' from the property line, and asked if
it could not be made into a co�non wall when there is future '
development. Vi Nagel said that this could be done.
Councilman Samuelson said that there should be an additional
requirement Eor 5 ' sidewalks across the front of the building.
Counci].man Sheridan asked if the parking in front of the building
was necessary. A v3sitor to the Meeting said that this was the
sugs��stion of the Building Standards - Design Control Subcommittee,
and was not on their original plans, but was added on their re-
commendation. He said that if the front yard parking was eliminated,
there would still be plenty of room for parking.

Councilman Harris said that this has been a problem for some time
and it will not get solved by allawing the land to stand vacant.
Mrs, �icClish said that thexe should be adequate parking space
behind the tri-plex. Councilman Samuelson commented that the
building corporation is naw defunct.
Mrs. McClish said that she is planning to build a house 24' x 40 '
and placing it the long way on the lot.
MOTxON by Councilman Samuelson that to resolve a problem of long
standing, this building permit be granted for a single family
dwelling and waive the ordinance.
Carl Paulson raised a question about setback requirements. The
City Attorney said that there was ample room and no problem. Mayor
Kirkham said that the Council attempted to get the tri-plex next
door to get adequate parking back in 1960, but we cannot force
him. Carl Paulson asked if this was an error of long ago that the
Council is attempting to correct and Mayor Kirkham told him that
was right.
THE MOTION made by Councilman Samuelson was seconded by Council-
m�an Liebl. Upon a voice vote, all voting aye, Mayor Kirkham
