Mr. Fitzpatrick noted that building a single family residence (R-1) in an R-3 zone would be going up� not dowxi. Darrel Clark said this request for a variance wae sent by Council to the Board of Appeals to see if they would grant a vaxiance before the request for a lot eplit was made so that it would not be Meceesary to pay the 1ot aplit fee of �15.00 if the vaxiance would not be granted. ' The Chairman said there was no objection on the size of the lote, even though they are below the mini�um atandarda, but under the incox�sistancy of the rezoning, it aeemed to him granting a vsrianae and waiving the rezoning on that lot, would be in line. MOTION by Jeneen, aeconded by Myhra, that the Planning Commiesion recommend to Council denial of the Lot Split requeet (L.S. #68-16) Robert Wilson, Lot 1 , Block 4, Wilaon Addition. Before the vote was taken, there waa further discussion. Mr. Mtiyra said the Commission felt it was probably lack of under- etanding of procedure, to some extent, to voice approval of a lot aplit before the Subcommittee and Planning Commieeion had etudied the requeat. The Planning Commission thought they did the right thing when they rezoned for a triplex, and orderly procedurea are set up to make any neceeeary ahangee. In this inatance they felt that orderly procedurea ehould have been followed and Council could have over-ruled it. They were concurri.ng with the Planning Commiseioii recommendation of rezoniz�g to R-3. They underetand the Wilsone have to try to work with what they have and tha,t eingle family residences would be better. The time factor involved, if it were a young person who had the time to wait, they W4uld . consider it differently. Although he eeconded the motion, he etill had the feelixtg to approve the split contingent upon the fact that it should be rezoned back to the origina,l zoning of R-1 . Mr. Fitzpatrick said he knew the house and area. He knew that they do not want a houae that hae been burned out re-conditioned and didn't eee that was very feasible. The suggeetion was that Mr. Wileon could ta.ke out one building permit right away and the.n petition for the land to be rezoned back to R-1 . � Referring to the above motion, a voice vote wae ta.ken, all voting nay. Knickerbocker said that it would be a 4' x 9 ' buildirig, so it would be only 36 square feet. Councilman Samuelson asked what the sethack was from the front property line. Mr. Knickerbocker said it was 92 ' . Councilman Harris said that he had no objection to granting th is �ermit, hawever, he felt that Moon Plaza should be made to clean ug tk�eir violations, as they have promised. Councilman Sheridan agreed with granting the building permit subject to Moon Plaza c�eaning up their property, to meet City standards. The Council assured Mr, Knickerbocker that their objections were not directed tcyward him, or his company but towar� Moon Plaza Shoppiny Center. Councilman Harris said that he tho�.,,ht that the Building Inspection Department has a list of violations. The City Manager said that he thought that there was a new awner nvw, a Mr. Gearman, and that some progress has been made in cleanir:g up the problems. Councilman Harzis suggested inviti.uiy the awner from Moon Corp. to come to a Council Meeting to get this straightened out and to insist on compl�ance with our ordinances. MOTION by Councilman Liebl to grant the building permit request by Fotomat Corporation subject to correction of the violations of the lrloon Plaza Shopping Center. Seconded by Councilman Samuelson. Councilman Samuelson asked if the parking lot was blacktopped. T'he City Engineer said yes, and that it is adequate now.
