vacate the south five (5) feet of a ten (10) foot utility easement

2 . A landscape plan should be submitted for staff approval
prior to issuance of a building permit.
Mr. David Larson stated he has no problem with he two
stipulations. There already is a retention pond on s' e, and it
will be engineered. The landscaping will be done icely. He
stated he did not know the vacation process was ch a lengthy
process. He would like to construct the additio yet this fall.
If he cannot build this year, he does not know f he will do it.
He asked if there was any way this process co d be speeded up.
Ms. Dacy stated staff has discussed this wi Mr. Larson. She told
him that on Monday, September 18, staff ' s asking the Council to
go ahead of schedule and establish the ublic hearing for October
2, and also schedule the first reading of the ordinance on October
2 . The second and final reading 11 be on October 23, 1989.
Typically, the Council holds a pu ic hearing and does not read
the first reading until two weeks fter the public hearing. In the
past, the City has allowed a lan alteration permit and grading to
occur prior to the second an final reading at the applicant's
risk.
MOTION by Mr. Kondrick, se onded by Mr. Barna, to recommend to City
Council approval of va tion, SAV #89-04, by David Larson, to
vacate the west 27 fee of a 57.5 foot existing east/west easement
on Lots 7 and 8, Bloc 4, Onaway Addition, generally located a 7890
Hickory Street N.E. with the following two stipulations:
1. A grad'ng and drainage plan shall be submitted for
Engin ering staff's approval prior to issuance of a
buil ing permit.
2. A andscape plan should be submitted for staff approval
rior to issuance of a building permit.
The P1 ning Commission also recommends that staff expedite this
vacat 'on request as quickly as possible.

AUTHORITY MINUTES:
OM TION by Mr. Kondrick, seconded by Mr. Saba, to receive t e August
10, 1989, Housing and Redevelopment Authority minutes.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON BETZOL DECLARED THE
MOTION CARRIED UNANIMOUSLY.
Mr. Dahlberg referred to Item 10-a of the August 0, 1989, Housing
and Redevelopment Authority minutes on SBF Devel ment Corporation,
in which Mr. Robertson stated: "SBF Develop ent Corporation is
proposing the redevelopment of the old Cub Fo ds Store site on the
southwest corner of University Avenue/Osbo e Road. Contrary to
their expectations and their reassurance the City Council that
they would be able to secure total financ'ng for the project, they
are asking the City to underwrite about 0� of what is represented
as a $5 million project. "
Mr. Dahlberg stated the City has bee very cooperative in granting
them a rezoning, a plat, a vacati , and variances to allow them
to go ahead with this developme . If the City is going to be
participating in another manner inancially, then the City should
be able to re-review and recon ider some of the variances, etc. ,
the developer requested. Per nally, he still did not think this
was a very efficient or a ropriate site development. Every
indication he had received e rlier was that because SBF Development
was not asking the City for any financial assistance, the City was
will ing to let them have t e variances because it was a proj ect the
City wanted to have happ n.
Mr. Dahlberg stated C ncilmember Billings was at the meeting to
hear this discussion, and he would like the HRA to be made aware
of this also.
The Commission me ers concurred with Mr. Dahlberg's comments.
MOTION by Mr. D lberg, seconded by Ms. Sherek, to direct staff to
express to the the Planning Commission's feelings regarding the
financial a istance being requested by SBF Development
Corporation.
