Othenaise they will only be able to build one home. Chairman Erickson asked if Mr. Henriksen awned all of the lots im�olved and was told that he did. Mr. Mittelstadt asked how close the house next door was? Mr. Mattson explained that there would be 30' separating the two homes. Chairman Erickson asked if Lot 1 was a comer lot? Mr. Clark explained that neither lot was a corner lot. There are no corner lots involved. Chairman Erickson asked if there would be garagea on the proposed buildings? Mr. Mattson explained that both hames would have tuck-under garages. He continued that as he understood it, these were the last two lots on the block that it was possible to get building permits for because the land then slopes to the flood area. Chaixtnan Erickson caminented that the 50' hane would only be 6 1/2' frotn the lot line and a 10' clearance is needed where thera is livable space. There is livable space above a tuck-under garage. He continued that they would need a variance from the Board of Appeals in oxder to �et a biiilding permit. Mr. Mattson a�ked if he didn't still need the lot �plit first and was told that he did. Chairman Erickson inquired if the seoond ham�e was 72' back from the lot line. Mr. Clark said that it was 52' back from the lot line. Chairman Erickson caa�ented that because the se�back could only vary 6' from the average of the setbacks of the� ham�s on either aide, Mr. Henriksen would also need a variance for the second proposed building. He was proposing a setback of 35' and the average is 44' . Chairman Erickaon continued that Mr. Henricksen should check with the Building Inspection Department about the var- iances to see if he would be able to get a permit to build. Mr. Mattson asked if the building had to be 10' from the lot line if there ie a garage within 3'' of the lot line? Mr. Mittelstadt explained that the living epace must be 10 feet from the lot line and a tuck-under garage has livable space above it. Mr. Jensen noted that there had been no new legal description supplied. Mr. Clark stated that the petitioners were told that they would have to supply a new legal description, but it did not have to be for this meeting. Mr. Clark answered that the description for the first lot would probably be; Lots 1 � 2, except the Easterly 5 feet. The second lot would probably be; the Easterly 5 feet of Lot 2 and all of Lots 3 & 4. Mr. Mittelstadt asked if the lot numbers would be the same? Mr. Clark explained that they would be. RIEDEL, Continued from Planning Caaanission Meeting of February 4, 1970. Mr. Mittelstadt asked if the Public Hearing for the rezoning request had beea closed? Chaisman Erickeon explained that the Public Hearing had been elosed at the February 4, 1970 Planning Coamission meeting but because of a meeting that had been held between the Wall Company and the r�sidents of the area the pre�vious night, he thought the Public He�,rin� shrnald be reopened. 1�DTION by Fitzpatrick, seconded by Jensen, t�at the Public Hearing for the rezoning request: ZOA �70-01, Nornoan E. Riedel, be reopened. Upon a voice vote, all voting aye, the motion carried unanianously. Mr. Lee Hoffu�an, a representative of the Wall Campany, stated to the Plaaning Carmissian that the Wall Company had sent letters to the residanta of the area, using the City's mailing list for the area, asking them to attend the meeting for a more detailed presentation of the company's plans for the development. Far ty-two people had attended the meeting. The presentation had consisted of: 1. An Introduction of the Wall Co. explaining whnt the Wall Co. was and a few of its projecta. 2. A Discussion of the Apartment Survey (Land in Use Tax Survey Report for School District #14) REGULAR COUNCIL MEETING OF MARCH 2, 1970 � PAGE 5 Mr. Wayne Sether said that the boring under East River Road was investiqated thoroughly by the contractor and they felt that it was not a practical idea and a concrete estimate could not be made. They estimated it at $1500, but with an open end contract in case of unforseen trouble. He agreed that the most practical idea would be a water line, but his neighbors do not want the line as they are having no trauble with their own wells� He said that he would be going from a 9' well to a 100' well. He said that the cost would be $3.50 per foot, or $350 for the well, and he could use his present pump. Councilman Sheridan said that the water line would be the best solution, but this would not provide relief xight now. The neighbors we11s may last for � another 10 years or so. He said that he was in favor of granting the rec�xest. Councilman Liebl pointed out that he would have to have his watex checked. He said that he has always advocated hooking onto the munic�pal supply, but in this case he agreed with Councilman Sheridan.
