The City of Fridley Planning Commission will be holding an informal
hearing on a request for a lot split, L.S. #89-01, by Mark and
Pamela Nyberg, to split off the north 151 feet of Lot 4 , Auditor' s
Subdivision No. 22 to create a separate parcel for a single family
house, the same being 1501 Rice Creelc Road N.E.
Anyone who wishes to be heard shall be given an opportunity at the
Planning Commission meeting on Wednesday, March 22 , 1989 at the
COMMUNITY EDUCATION CENTER, 6085 - 7TH STREET N.E. at 7 : 30 p.m.

SUBJECT: Consideration of a Resolution Approving a Lot
Split, L.S. #89-01, by Mark and Pamela Nyberg
At the April 5, 1989 meeting, the Planning Commission approved the
lot split request for 1501 Rice Creek Road N.E. , subject to four
stipulations:
1. The certificate of survey shall indicate a suitable building
elevation for connection to the City sewer. The elevation
shall be reviewed and approved by the Public Works Department
prior to issuance of a building permit.
2 . A grading and drainage plan shall be submitted with the
building permit application for approval by the Public Works
Department prior to issuance of a building permit.
3 . The driveway location must be approved by the Public Works
Department prior to issuance of a building permit.
4. The petitioner shall execute appropriate utility easements as
requested by the City or by the cable TV company.
At the request of the petitioner, action on this request by the
City Council was postponed, pending the petitioners' divorce. The
petitioner has submitted a certificate of survey, and now requests
that the City Council take action on this lot split.
The stipulations recommended by the Planning Commission address any
environmental concerns that may be raised by the neighbors. Staff
recommends that the City Council approve the resolution authorizing
the lot split request, L.S. #89-01.

Ms. Dacy stated this property is located on the north side of Rice
Creek Road. The property is zoned R-1, single family. An existing
home is located on the southern portion of the parcel at this time,
and the applicant is proposing to split the lot with an east/west
lot line to create another building pad to the north.
Ms. Dacy stated staff has no concerns about this lot split;
however, she would point out that the elevation of the property is
lower than the street. There will be the necessity for some
filling in order to get a building elevation pad so there can be
a connection to city sewer. Also, staff has recommended that in
conjunction with the building permit application, the driveway
location be reviewed by the Public Works Department. There is a
curve in the northwest corner of the property and there is a stand
of very tall evergreen trees to the east, and they want to make
sure there is adequate sight distance and a good intersection with
the street.
Ms. Dacy stated Nortel Cable Company had notified staff that they
might need an easement, but they have not been able to define an
exact location at this time. So, staff is recommending that the
petitioner execute a utility easement as necessary by the cable
company.
Ms. Dacy stated this property has been assessed on the basis of two
lots. That should not influence the Commission's decision one way
or the other, because the land use and the zoning issues are to be
considered separately from the assessment issue.
Ms. Dacy stated staff is recommending the Planning Commission
recommend to the City Council approval of this lot split subject
to the following stipulations:
1. The certificate of survey shall indicate a suitable
building elevation for connection to the city sewer.
The elevation shall be reviewed and approved by the
Public Works Department prior to issuance of a building
permit.
2. A grading and drainage plan shall be submitted with the
building permit application for approval by the Public
Works Department prior to issuance of a building permit.
3 . The driveway location must be approved by the Public
Works Department prior to issuance of a building permit.
4 . The petitioner shall execute appropriate utility
easements as requested by the City or by the cable TV
company.
Mr. Kondrick asked if the new lot had the required square footage.

Ms. Dacy stated it had. In fact, the lot is almost twice the size
as the lots to the northeast of the property.
Mr. Betzold asked Mr. Nyberg if he had any problems with the
stipulations as presented by staff.
Mr. Nyberg stated he did not have any problems with the
stipulations. He stated he realizes he will need some fill in
order to hook up with city sewer.
Mr. Betzold asked if Mr. Nyberg would be able to save some of the
trees on the lot.
Mr. Nyberg stated he plans to put the driveway where the tall stand
of trees is on the east side. There are about 30 trees along
there. He does not need a double width driveway so he might take
down two trees. He wants to save as many trees as possible.
Ms. Sherek stated she thought the City's concern is traffic safety
and so more trees might have to be removed for proper visibility.
MOTION by Mr. Saba, seconded by Ms. Sherek, to recommend to City

REQUEST
The petitioners, Mark and Pamela Nyberg, are proposing to split off
the north 151 feet of Lot 4, Auditor's Subdivision No. 22, the same
being 1501 Rice Creek Road, to create a separate parcel for a
single family dwelling. This property is located in an R-1 (single
family residential) zoning district. The petitioners intend to
sell the south lot (which contains the existing house) and build
their new residence on the resulting north parcel.
SITE
The lot in question is 36, 696 s . ft. and has double frontage with

Rice Creek Road on the south and Camelot Lane on the north. Arthur

residential lots (37, 500 sq. ft. each) are west of the site in the
Spring Valley Addition. Smaller single family lots are located
east of the petitioners' land in Harris Lake Estates. The present
house is on the south portion of the existing lot with a setback
of 44 feet from Rice Creek Road. An in-ground swimming pool is
located on the north part of the lot.
ANALYSIS
The proposal would divide this property into separate parcels
totalling 19,932 sq. ft. (north lot) and 16,764 sq. ft. (south
lot) . Both of these exceed the 9, 000 sq. ft. minimum lot size
required for a single family dwelling unit. In addition, each
parcel would be considerably larger than the lots located directly
to the east, which are all under 11, 000 sq. ft. in size.
There are some issues which must be addressed before construction
of a single family dwelling in the resulting north parcel. City
water is available on the north and west sides of the lot, and
sewer is available on the north side. However, because the
property is at a lower elevation than the street, additional fill
may be needed to accomplish a sewer hook-up at an appropriate
elevation. The certificate of survey accompanying the building
permit should indicate an appropriate building elevation for
connection to city sewer. In addition, the site, because of its
low elevation, has received the run-off from adjacent properties.
A grading and drainage plan should be submitted with the building
permit application to properly address the new drainage patterns.
Finally, driveway access should be carefully considered since
numerous mature trees currently provide excellent screening along
Camelot Lane and access from the northwest corner is restricted by
the curve where Arthur Street intersects Camelot Lane. Al1 of
these points should be resolved prior to issuance of the building
permit for new home construction on this site.

Nortel Cable TV has indicated a need for an easement. At the time
of the writing of this report, they had not defined the location
or width of the easement. A stipulation to grant an easement for
this purpose is recommended.
RECOMMENDATION
Staff recommends that the Planning Commission recommend approval
of L.S. #89-01 allowing the requested lot split for 1501 Rice Creek
Road N.E. with the following stipulations:
1. The certificate of survey shall indicate a suitable
building elevation for connection to the city sewer. The
elevation shall be reviewed and approved by the Public
Works Department prior to issuance of a building permit.
2 . A grading and drainage plan shall be submitted with the
building permit application for approval by the Public
Works Department prior to issuance of a building permit.

Descriptions for Lot Split for Mark Nyberg
Background
On February 12, 1990, the City Council approved the lot split, L.S.
#89-01, for Mark Nyberg, to create two lots in the general vicinity
at 1501 Rice Creek Road N.E. The resolution was approved using the
legal descriptions contained in the Certificate of Survey dated
January 24, 1990. However, the petitioner has determined that the
legal descriptions must be revised in order to record properly at
the Anoka County Recorder' s Office.
Analysis
We have received a corrected copy of the Certificate of Survey with
the revised legal descriptions. The City Clerk has advised us that
a new resolution must be passed containing the new legal
descriptions.
Recommendation
We recommend the City Council approve the attached resolution as
presented.

Ms. Dacy, Planning Coordinator, stated this property abuts Rice
Creek Road on the south and Camelot Lane on the north. She stated
the petitioner is proposing to subdivide this lot in approximately
equal halves with an east/west lot line.
Ms. Dacy stated the Planning Commission recommended approval
subject to four stipulations which she outlined.
Councilman Schneider stated he noted the property is for sale and
asked if potential buyers are informed of the lot split.
Mr. Nyberg, the petitioner, stated there are stakes there in the
ground.
Councilman Schneider asked if the drainage would be a problem if
the property is filled.
Mr. Flora, Public Works Director, stated one of the stipulations
is that a grading and drainage plan be submitted for approval prior
to issuance of the building permit. He felt that the drainage
would not be a problem as Harris Pond has a pipe that drains into
an open ditch to Highway 65 and eventually to Rice Creek.
Councilman Schneider stated at some point in time, someone will
probably have to pay for a storm sewer system on that back lot.

with the following stipulations attached as Exhibit A: (1) The

Councilman Billings stated the depth of the lots to the east are
130 feet and asked why this lot was only 122 feet.
Mr. Nyberg stated this lot is much wider than the ones to the east,
even if it is not as deep. He stated he did not want it any deeper
because of trees that are located in the back and wanted to make
sure they were on his lot.
Councilman Billings stated one of the stipulations was for the
petitioner to obtain an easement for cable television and wondered
why this had not been done since there has been sufficient time
since this item was before the Planning Commission.
Ms. Dacy stated staff felt this was the petitioner's responsibility
to contact the cable television company.
Councilman Schneider asked if other easements, other than cable
television, would be required. Ms. Dacy stated they would not.
UPON A VOICE VOTE TAKEN ON THE ABOVE MOTION, all voted aye, and

13 . RESOLUTION NO. 13-1990 ESTABLISHING A WATER CONSERVATION
PROGRAM FOR THE SUMMER OF 1990:
Mr. Flora, Public Works Director, stated with the recent wo year
drought and the apparent extension into this year, as ell as the
placement of two of the City's major producing lls into an
emergency standby position, it appears that t summer water
demands may not be satisfied. He stated lawn s nkling is a major
summer demand that severely impacts the Cit s water production,
therefore, it appears necessary to implem a lawn sprinkling ban
for this summer and notify residents as oon as possible.
Mr. Flora stated this resolut' n would establish a lawn
sprinkling/watering ban daily ring the period of 12 : 00 p.m.
(noon) to 8:00 p.m. He state his conservation program could be
amended or terminated depe ing on the summer conditions. He
stated this ban would not ply to gardens or car washing at this
time.

Mr. Hunt, Assistant to the City Manaqer, stated that although he
agenda states approval of the 1991 budget of the North , etro
Convention and Tourism Bureau, the action by the Counc' this
evening is merely to receive the budqet.
Mr. Charles Cook, Executive Director of the North Metr Convention
and Tourism Bureau, briefly reviewed the budget appro riations for
a total budget of $377,949. He stated that one of he items that
was a tremendous success in 1990 was a tabloid t at was inserted
in newspapers in the Dakotas, Wisconsin, Winnipe , and Thunder Bay.
He stated that this would be expanded in 1991.
Mr. Cook stated that, normally, they woul anticipate about an
eight percent increase in revenue in 1 1. He stated that,
unfortunately, the economy is very slugg'sh so they are cautious
and are going to take a "wait and see" a titude. He felt that the
hospitality industry will be one of the first to feel the effects,
if there is a short supply of gasolin .

MOTION by Councilman Schneider to �'eceive the 1991 budget of the
North Metro Convention and T rism Bureau. Seconded by
Councilwoman Jorgenson.
Councilman Billings stated tha it seems a number of organizations
were trying to "raid" the orth Metro Convention and Tourism
Bureau's funding and asked i these organizations were successful.
Mr. Cook stated that a 1983 law states the monies are for
advertising and promotio . He stated that in the agreement with
the National Sports Ce er, the Bureau does not pay them a set
amount, but they pay a if the Bureau is bidding for business.
Councilman Billings ated that he understands some of the Chambers
of Commerce and th North Metro Mayors Association were looking
for funding.
Mr. Cook stated hat the North Metro Mayors Association has backed
off. He stated that they want to support the Chambers and now have
an agreement at they will solicit business for them so it is a
legal contra .
Mayor Nee ated that he believes the Bureau has been doing a very
good job nd is impressed with their efforts.

SUBDIVISION NO 22 TO CREATE A SEPARATE PARCEL FOR A SINGLE
�'AMILY HOUSE GENERALLY LOCATED AT 1501 RICE CREEK ROAD N.E. :
Ms. Dacy, Planning Coordinator, stated this property abuts Rice
Creek Road on the south and Camelot Lane on the north. She stated
tne petitioner is proposing to subdi�•i�e th�s lot in appraximately
equal halves with an east/west lot line.
Ms. Dacy stated the Planning Commission recommended approval
subject to four stipulations which she outlined.
Councilman Schneider stated he noted the property is for sale and
asked if potential buyers are informed of the lot split.
Mr. Nyberg, the petitioner, stated there are stakes there in the
ground.
� Councilman Schneider asked if the drainage would be a problem if
the property is filled.
Mr. Flora, Public Works Director, stated one of the stipulations
is that a grading and drainage plan be submitted for approval prior
to issuance of the building permit. He felt that the drainage
would not be a problem as Harris Pond has a pipe that drains into
an open ditch to Highway 65 and eventually to Rice Creek.
Councilman Schneider stated at some point in time, someone will
probably have to pay for a storm sewer system on that back lot.
MOTION by Councilman Schneider to adopt Resolution No. 12-1990,
with the following stipulations attached as Exhibit A: (1) The
certificate of survey shall indicate a suitable building elevation
for connection to the City sewer. The elevation shall be reviewed
and approved by the Public Works Department prior to issuance of
a building permit; (2� A grading and drainage plan shall be
submitted with the building permit application for approval by the
Public Works Department prior to issuance of a building permit;
(3) The driveway location must be approved by the Public Works
Department prior to issuance of a building permit; and (4) The
petitioner shall execute appropriate utility easements as requested
by the City or by the Cable Television company. Seconded by
Councilwoman Jorgenson.

Councilman Billings stated the depth of the lots to the east are
130 feet and asked why this lot was only 122 feet.
Mr. Nyberq stated this lot is much wider than the ones to the east,
even if it is not as deep. He stated he did not want it any deeper
because of trees that are located in the back and wanted to make
sure they were on his lot.
Councilman Billings stated one of the stipulations was for the
petitioner to obtain an easement for cable television and wondered �
why this had not been done since there has been sufficient time
since this item was before the Planning Commission.
Ms. Dacy stated staff felt this was the petitioner's responsibility
to contact the cable television company.
Councilman Schneider asked if other easements, other than cable
television, would be required. Ms. Dacy stated they would not.
UPON A VOICE VOTE TAKEN ON THE ABOVE MOTION, all voted aye, and
Mayor Nee declared the motion carried unanimously.

13 . ESOLUTION NO. 13-1990 STABL SHING A WATER NSERVATION
PROGRAM FOR THE SiJMMER OF 1990: �
Mr. Flora, Public Works Director, stated with t recent two year
drought and the apparent extension into this ar, as well as the
placement of two of the City's major pro cing wells into an
emergency standby position, it appears at the summer water
demands may not be satisfied. He stated wn sprinkling is a major
summer demand that severely impacts t City's water production,
therefore, it appears necessary to im ement a lawn sprinkling ban
for this summer and notify resident as soon as possible.
Mr. Flora stated this reso tion would establish a lawn
sprinkling/watering ban dail during the period of 12:00 p.m.
(noon) to 8:00 p.m. He stat this conservation program could be
amended or terminated dep ding on the swnmer conditions. He
stats� �his ban woLld no agply to gardens o� car washing at t�is
time.
MOTION by Councilma Schneider to adopt Resolution No. 13-1990.
Seconded by Counci oman Jorgenson. Upon a voice vote, all voting
aye, Mayor Nee d lared the motion carried unanimously.

Mr. Flor , Public Works Director, stated funds have been
appropri ted for these two diesel tractors and it is recommended
Council adopt this resolution to advertise for bids. i
