A. Purpose.
�he purpose of this Sectio� is to provide the City of Fridley
with a reasonable degree of discretion in determining the
suitability of certain aesic,�ated uses upon the general welfare,
public health and safety. In making this determination the City
may oonsider the nature of the land upon which the use is to be
located, the nature of the adjoining land or build'ings, the-
effect upon traffic into and from the premises or on any
adjoining roads, and all such other factors as the City shall
reasonably dePsn a reguisite of oonsideration in cietermining the
effect of such use. For the purpose of recording, the terms
Sgecial Use Aermit and Conditional Use Permit shall be said to
mean one and the same pursuant to M.S.A. Section 462.3595,
Slibdivision 4.
B. Application.
k'henever this Chapter requires a Special Use Permit, an
appl ication in writing mu�st be f iled with the City together with
such filing fee as may be estahlished by the City Council and
shall be acoompanied by a site plan or other documentation as
reo,uired by the City.
C. Referral Zb The Planning Caunissian.
The application and related file shall be referred to the
Flanning Commission for study concerning the effect of the
pro�osed use on the Coc�prehensive Plan and on the character and
c3evelopnent of the neighborhood. The Planning Caiunission shall
hold an official public hearing within sixty (60) days of the
c13te of f il ing such petition.
D. Aearing.
A notioe of public hearing shall be publ ished in the of f icial
newspaper at least ten (10) days but not more than thirty (30)
days prior to the date of the hearing.
E. Actian By Zl,e Planning Carmission.
(1) Notices shall be mailed to all awners of property
Mithin 200 feet of the parael included in the rea,uest not
less than ten (10) days nor more than thirty (30) days prior
to the hearing. Failure of a property owner to receive
notice shall not invalidate any such proceedings as set
forth within this Q�apter.
(2) The Carunission shall make its recommendation to the
City Council within sixty (60) days of the date of hearing
of the petition to the Planning Caranission or within sixty
(60) days of any v�ntinuanoe of such matter granted at the
applicant's written request.

The petitioner, Gerald Linc�er, is requesting a Special Use Permit be granted
to allaw a seoond aooessory building at 6536 Clwer plaae.

Currently. Mr_ r.inc�er has a ctarage attadzed to his dwelling whic3z serves as
an aocessory use- I3e warrts to oonstruct a seoondary accessory building in
his rear yard that would serve as a storage shed for boating and lawn
equiFnent. The shed would be 20' in width and 28' in length for a total of
560 square feet. T,ocation of this second accessory use will be five feet
(5') fran the side and rear property line.

Mr. Robinson stated this special use permit request was for a second
aooessory building at 6536 Clover Place. The petitioner would 1 ike to
aonstruct a 20 ft. t� 28 ft. (560 sq. ft. ) storage building in the rear
yard t o be used f or boat st or age and 1 awn equipne.nt st or age. Th e pr ope r ty
was located in an entirely single faanily nei�borhood. There was an
attached garage with a driveway. Since the proposed second accessory
building was intended only for boat storage and lawn equipnent storage,
there was no �Soposal for a driveway fran the building to the street.

Mr. Linc�er stated that, as mer�tioned, the storage building would be used
only for boat and lawn equignerit. He envisioned taking his boat in and out
of the building about once a month. He planned to have the new storage
building oonform to the same siding and shingles as the house.
Mr. Betzold stated that �esently Mr. Lin�er had a metal storage shed in
the back yard. Would this shed be rgnwed?
Mr. Linc�her stated, yes, he intended to renove the metal storage shed.
Mr. Betzold asked if there was anyone in the audienae who wished to make any
oaranents regarding this special use permit request.
Mr. Qenn Tonneslan, 6538 Qover Plaoe, stated he lived next door to Mr.
Lincher. He stated he objected to the building. This was a residential
r�eic�borhood, and a structure of this size would be a detriment to the
appearanoe af the neic�borhood. He stated it would also obstruct his view
of the neicj�borhood. Iie stated it did not make much sense to have a boat if
the boat was only going to be taken in and out of the building onoe a m�th.
He stated their bedroom windows are on the side of the house where the
bulding would be located, and he just felt it would take a4aay fran the value
of the surro�mding properties.
Mr. Linc�er stated he had cbne a market analysis of his existing property
and the neic�b�rs' properties. He had two realtors out and both realtors
said that the �nstruction of a storage building in this location would not
devalue the properties, either plus or minus. The property values would
resnain the same.

Mr. Barna asked if there w�ere any other garages in the neighborhood that
were located in the rear yard in approximately the same location as the
building proposed by Mr. Lin�er.
Mr. Lee Wendk, 6545 Nbnroe Street, stated his prcyperty was located directly
behind Mr. LincY�er. He stated his garage was located in the rear yard and
was alm�ost back to back to the proposed building.
Mrs. Wendt stated they did not object to the storage building as p�roposed by
Mr. Linc�er. It did affect Mr. Tonnaslan more than it did then.

' Mr. Robinson stated that in 1 ooking at the aerial photo, it looked 1 ike Mr.
Lindner's building, if apprwed, w�uld be the third rear yard garage in the
ursnediate grouping of hanes.
Mr. Betzold stated he did not recall many ather acoessory buildings simil ar
to this that have been denied.
Mr. Robinson stated that as far as the garage to the west, that did not seem
to be an issue. He suggested the possibility c�f a landscape buffer between
Mr. LincY�er's property and Mr. Tonnaslan's. A buffer would require a
little bit more setback - 8 ft. AS far as Mr. Lincher using the grassy area
to mc�ve his boat in and out, the special �se permit wuld be reviewed again
at the end of the s�nmer to see if there had been any damage to the turf.
Mr. Betzold asked Mr. Tonaslan haw he felt about a buffer, landscaping and
shrubbery, between the two properties.
Mr. Tonnaslan stated there were already shrtahs between the two properties.
He stated his main concern was what would happen in the future if Mr.
Li.ncY�er moved away �d new aar�rs used that building for a machine shop or
for the storage o�' a�omobiles. He stated he had a b�at for five years and
had it stored in the driveway. He agreed having a boat stored in the
driveway was an eyesore, and he had f inally mwed his boat to the St. Croix.
He stated he oould oertainly appreciate the problen of having a boat and
needing a place to store it. He stated Mr. Lindner was a very nice
neic�bor, and he had nothing against Mr. Lindner personally. He was j ust
o�naerned about that large a storage building in the rear yard.
Mr. Betzold asked Mr. Lincher if he would have a probleqn if the Planning
Comnission reoo�mended the City Co�ncil review the sp�ecial use permit in a
f ew month s.
Mr. Linciler staed he would have no prohlen with the City Council reviewing
the special ase permit wher�ever they saw fit.
Mr. Betzold asked if Mr. LincYier r�eeded a storage building quite this large.
Mr. Linc�her stated the reason he was proposing a 20 ft. by 28 ft. building
was beca�e the boat he would be purchasing was 25-26 ft. long with the
tongue. A narraw structure, 9 ft. by 27 ft. , would not look very nice.
Another o�tion was a carp�rt cEf the garage, and he did not think tha� would
look very nice. Another option was a semi-structure, a pole barn �type
structure, and that would look worse yet. He stated the size of the
buildinq would help him in the storage of a lot of lawn equipment in
addition to the boat. He did have two cars and those were kept in the
atta�ed cbuhle car garage.
Mr. S�anda asked if Mr. Lirx�er had considered maving the building closer to
the ho�se.
Mr. Lincher stated he would not object to having the building closer to the
house, but he thought that would look worse than lirung the building up with

Mr. Robinson stated that regarding Mr. Tonneslan's concern about the
building being used for a machine shop in the future, this special use
permit, if approved, w�uld be filed against the property at the County, and
the stipulation that the 1�uilding was to be used for the storage � boat and
laFm equigner►t ail.y would be attached, so that any future owners would be
aware af the special use pernait and the stipulation.
Mr. Betzold stated it sotmded 1 ike there would be an eyesore either way. If
the special use permt was denied, then there would be the eyesore of hav ing
the boat stored in the driveway. He stated he would be inclined to vote in
favor of the special use permit, subject to a review by the City Co�cil in
six months and that the existing metal shed be renaied, along with the two
stipulations reaom¢nended by staff.
Mr. Kondrick stated he would agree with Mr. Betzold.

Mr. Barna stated that if this was a situation where the petitioner was
oonverting the existing garage to living space, he would be allowed to
o�nstruct the garage back there. In Minnesota it was good to be able to
store things in a garage, especially during the wintertime.
Mr. Svanda asked what the six month review was going to accompl ish. They
are aertainly not going to make Mr. Linch�er remove a building that was
al ready built.
Mr. Robinson stated that if, in six months, the lawn has deteriorated
because o� the b�at being taken in and out o� the building, a hard s�rface
driveway wnuld have to be installed.

approval of this special use permit with four stipulations which he

Councilman Billings stated he was concerned about access to this storage
building, He stated there are about four pine trees on the east side and
appears to be sa�ne hedging along the property line. He stated N�. Tonneslan
is one neighbor who objected and these trees are on this side of the
property.
Cour�ilman Billings felt the itan should be tabled until the petitioner is
present to answer any questions.

5. CONSIDERATION OF ANOKA COiJN'1'Y JOINT POWERS AGREEMENT FOR RECYCLING,
O�MPOSPING AND WASPE REDUCTION:
Mr. Rd�ertson, Ccnmunity Development Director, stated this joint �wers
agreement with Anoka County cavers recycling, composting, an-' waste
reduction activities between July 1, 1988 and June 1, 1989. He s ted it is
important to note there has been a change in the County' s olid 4vaste
Abatement Plan. He stated the City's recycling reimbursanen ill be based
on tons r�cycled. He stated under this funding, the City ould receive as
much as $20,475 or as little as $1,076. Mr. Robertson tated the General
Fl�nd contribution to the recycling program, if the ge ga�l of 572 tons
plus 10� is met, wou..ld be $7,170. He stated, how er, this figure will vary
with the amount af tons recycled.
Co�cilrr�an Schneider asked what the cost d be if this agreement was in
force today. Mr. Rcabertson stated abo $7,000 as the City has met the goal
so far.
Cbuncilman Schneider stated �1 s scmething drastic happens, the figures
probably wou.ldn't change. . Robertson stated Fridley has been the leader
in the County for partici ion. He stated in the worst scenario, the City
would get as little $1,000 and the City' s subsidy would have to be
in�creased.
Councilman S eider asked if the agreement could be terminated. Mr.
R,obertson s ted it could, but it is in the best interests of the City to
gartici e in order to obtain this subsidy.

Mayor Nee reopened the public hearing on part af this impravement project,
which was continued fran the May 2 meeting, the Slst Way Street Impravanent.
N.�. Flora, Public Works Director, stated at the public hearing on May 2,
inforn�ation was received and there was discussion oaz the cost distribution
for the intersection and signal portioz�s of the 51st Way Street I�ravement.
He stated as a result of the questions raised by Burlington Northern and the
Fast River R:aad develapers, the costs for the intersection and signals have
been redistributed to the County and City. He stated the remaining costs
for entrance and street impravements will be distributed to all of the .
garties.
N�. Flora stated the C`ity has abtairbed an eas�ient and an agreenent frcm the
Navy and FMC for the waterlir�e construction along 51st Way, however, it naw
appears the Navy chooses to redefine their funding mechani sn for the roadway
improvanent. He stated while all of the parties essentially support the
imprava:lent of 51st Way and East River Road with permanent signals and
traffic controls, it appears that the Navy may take a considerable amc�unt of
time, through their review process, before a final decision is made on the
cost �rtici�tian.
I�. Flora stated he would reccnmend the Council close this public hearing
for the 51st Way Improvanent Proj,�ct. He stated this portion of th�e project
will be bid separately so if thg' f�mding cannot be worked aut with the Navy,
the bid can still be awarded ,�or the other projects covered under this

Councilm-�n Schneider stated he had a concern about persons isscrossing
across the parking lot and the parking along the entran e drive. He
questioned the a�no�t o� traf f ic in the area.
Mr. Flora, Publ ic Works Director, stated there were rw ent traf f ic cot.mts
for this area, but felt less than 1,000 cars per day this service road.
N�. Robertson, Caiammity Developnent Director, stat planting beds will be
at the entrance and a striped line will delinea the route through the
parking lot. He stated this same design is simi r to the parking lot at
Southdale Shapping Center as there is parking g the main entrance to the
shopping ma11.
Mr. Qureshi, City Manager, stated a possibl solution to deter persons f rom
crossing wer the entire garking lot woul be to install a small sidewalk
between the plantings on the west and co inue it to the ru�rth.
Councilwanan Jorgenson stated she ca ot understand why a parking stall
would be installed where yau have to ck into the driveway. 5he stated she
would like this �rking lot to be fe for pedestrians and vehicles.

that more than ten cars per ever use the service raad.

�errace Mabile Hame Park and a spokesperson f or them ha requested an
appearance before the Council. He stated Tim Turnbu , Public Saf ety
Projects Coordinatar, has submitted a letter to the gers of this mobile
hane park, Gordy and Lois Anderson, regarding the State law requiring a
shelter ar evacuation plan to be appraved by the
Ms. C�ty Rayce, Anoka People's Alliance f or ange, introduced Mr. Steve
Schlichting, a resident in the Fridley Te ce Mobile Hane Paxk.
Nfr. Schlichting, 7426 West Circle, st ed the State statute prwides that a
shelter ar evacuation plan must be praved by the City by March 1, 1989.
He stated the existing shelter 1 adequate lighting, ventilation, and has
I a problen with flooding. He s ted this subject has been brought to the
attention of the aaners of FYidley Mobile Hane Park in the past and no
adequate reply has been eived. Mr. Schlichting stated at the most, the
existing shelter can acccnnx�date 150 persons. He stated the pa.rk has
326 mcabile hctnes and ut 2-1/2 persons per trailer or probably about 750
to 800 people in th mobile Yxx�ie p�'k.
Mr. Schlichtin tated at a meeting with Mr. Turnbull and the managers of
the nu�bile g�rk, they discussed closing the shelter because of the
liability ' ssue. He also stated there were problems with using Unity
Hospital s a shelter as the Safety/Security Manager af the hospital stated
they ot really handle the number of people that would need to be
eva ted.

residents of the mr�bile hane park. 5he stated she heard a�'out the problem
today and was not aware o� the condition of the storm she�er at the F7idley
'I�errace Mabil e Hrnie Park. She stated when re s i dent s sp� e about be i ng i n
last year's stoxm, there was up to three feet of water n the shelter.
Representative Jd�u�.san stated she was pleased to be of the Legislature
that mandated that any mobile hame park with t or more hames has to
pravide a shelter or place for their residents. e stated it only seems
htanane to provide that type o� shelter for resi ts. She stated she knaws
there is same question as to the interpretatian,of the law. She stated she
spoke with Senatar D�hl's office, wl'�o sponsor this legislation, and asked
what they felt was the intent of the law and t was that every mobile hame
gark would have an appraved shelter by ch 1, 1989. She stated they
agreed it could go to the courts for an interpretation. Represenative
Johnson stated the summaiy of the bil , as published, states that the
shelter must be approved by the imuzici ity by March l, 1989. She stated
she shares the con�erns of the reside ts as this is tornado weather and
these peaple presently don't have a elter ar� an evacuation plan.
Gordy and Lois Anderson, NHnagers the Fridley Terrace Mobile Home Park,
stated they have been the manager ' for abrnit six weeks and they do have a
plan. Ms. Anderson stated the aundry roam facilities and the existing
shelter can be used. 5he stat she spoke to Mark Tabara at Unity Hospital
regarding the use of their fa lity for those who feel unsafe with the stozm
shelter at the mobile lxme k. 5he stated she was thinking in the area of
about 200 peaple, however, ey were only thinking about 50. She stated
after their meeting, pl would be to have the stornn shelter open for
residents and sane may to Unity Hospital.
Cbuncilman Schneider stioned the flooding in the shelter. Ms. Anderson
stated 1�. Bob Barke, representing the aaner, will be coming to Fridley to
work with the vari agencies concerning the shelter.
Cbuncilman Schnei r stated several years ago this issue about shelters for
mabile hane �r was discussed and h,e thought there was a shelter and plan.

inadequate is arwther issue.
