Purpose. �he purpose of this Sectio� is to provide the City of Fridley with a reasonable degree of discretion in determining the suitability of certain aesic,�ated uses upon the general welfare, public health and safety. In making this determination the City may oonsider the nature of the land upon which the use is to be located, the nature of the adjoining land or build'ings, the- effect upon traffic into and from the premises or on any adjoining roads, and all such other factors as the City shall reasonably dePsn a reguisite of oonsideration in cietermining the effect of such use. For the purpose of recording, the terms Sgecial Use Aermit and Conditional Use Permit shall be said to mean one and the same pursuant to M.S.A. Section 462.3595, Slibdivision 4. B. Application. k'henever this Chapter requires a Special Use Permit, an appl ication in writing mu�st be f iled with the City together with such filing fee as may be estahlished by the City Council and shall be acoompanied by a site plan or other documentation as reo,uired by the City. C. Referral Zb The Planning Caunissian. The application and related file shall be referred to the Flanning Commission for study concerning the effect of the pro�osed use on the Coc�prehensive Plan and on the character and c3evelopnent of the neighborhood. The Planning Caiunission shall hold an official public hearing within sixty (60) days of the c13te of f il ing such petition. D. Aearing. A notioe of public hearing shall be publ ished in the of f icial newspaper at least ten (10) days but not more than thirty (30) days prior to the date of the hearing. E. Actian By Zl,e Planning Carmission. (1) Notices shall be mailed to all awners of property Mithin 200 feet of the parael included in the rea,uest not less than ten (10) days nor more than thirty (30) days prior to the hearing. Failure of a property owner to receive notice shall not invalidate any such proceedings as set forth within this Q�apter. Would this shed be rgnwed? Mr. Linc�her stated, yes, he intended to renove the metal storage shed. Mr. Betzold asked if there was anyone in the audienae who wished to make any oaranents regarding this special use permit request. Mr. Qenn Tonneslan, 6538 Qover Plaoe, stated he lived next door to Mr. Lincher. He stated he objected to the building. This was a residential r�eic�borhood, and a structure of this size would be a detriment to the appearanoe af the neic�borhood. He stated it would also obstruct his view of the neicj�borhood. Iie stated it did not make much sense to have a boat if the boat was only going to be taken in and out of the building onoe a m�th. He stated their bedroom windows are on the side of the house where the bulding would be located, and he just felt it would take a4aay fran the value of the surro�mding properties. Mr. Linc�er stated he had cbne a market analysis of his existing property and the neic�b�rs' properties. He had two realtors out and both realtors said that the �nstruction of a storage building in this location would not devalue the properties, either plus or minus. Mr. Lee Wendk, 6545 Nbnroe Street, stated his prcyperty was located directly behind Mr. LincY�er. He stated his garage was located in the rear yard and was alm�ost back to back to the proposed building. Mrs. Wendt stated they did not object to the storage building as p�roposed by Mr. Linc�er. It did affect Mr. Tonnaslan more than it did then. -2- r 7 w . •� � ` ' Mr. Robinson stated that in 1 ooking at the aerial photo, it looked 1 ike Mr. Lindner's building, if apprwed, w�uld be the third rear yard garage in the ursnediate grouping of hanes. Mr. Betzold stated he did not recall many ather acoessory buildings simil ar to this that have been denied. Mr. Robinson stated that as far as the garage to the west, that did not seem to be an issue. He suggested the possibility c�f a landscape buffer between Mr. LincY�er's property and Mr. Tonnaslan's. A buffer would require a little bit more setback - 8 ft. AS far as Mr. Lincher using the grassy area to mc�ve his boat in and out, the special �se permit wuld be reviewed again at the end of the s�nmer to see if there had been any damage to the turf. Mr. Betzold asked Mr. Tonaslan haw he felt about a buffer, landscaping and shrubbery, between the two properties. Mr. Tonnaslan stated there were already shrtahs between the two properties. He stated his main concern was what would happen in the future if Mr. Li.ncY�er moved away �d new aar�rs used that building for a machine shop or for the storage o�' a�omobiles. He stated he had a b�at for five years and had it stored in the driveway. He agreed having a boat stored in the driveway was an eyesore, and he had f inally mwed his boat to the St. Croix. He stated he oould oertainly appreciate the problen of having a boat and needing a place to store it. He stated Mr. Lindner was a very nice neic�bor, and he had nothing against Mr. Lindner personally. He was j ust o�naerned about that large a storage building in the rear yard. Mr. Betzold asked Mr. Lincher if he would have a probleqn if the Planning Comnission reoo�mended the City Co�ncil review the sp�ecial use permit in a f ew month s. Mr. Linciler staed he would have no prohlen with the City Council reviewing the special ase permit wher�ever they saw fit. Mr. Betzold asked if Mr. LincYier r�eeded a storage building quite this large. Mr. Linc�her stated the reason he was proposing a 20 ft. by 28 ft. building was beca�e the boat he would be purchasing was 25-26 ft. long with the tongue. A narraw structure, 9 ft. by 27 ft. , would not look very nice. Another o�tion was a carp�rt cEf the garage, and he did not think tha� would look very nice. Another option was a semi-structure, a pole barn �type structure, and that would look worse yet. He stated the size of the buildinq would help him in the storage of a lot of lawn equipment in addition to the boat. He did have two cars and those were kept in the atta�ed cbuhle car garage. Mr. S�anda asked if Mr. Lirx�er had considered maving the building closer to the ho�se. Mr. Lincher stated he would not object to having the building closer to the house, but he thought that would look worse than lirung the building up with -3- . � • �x . They are aertainly not going to make Mr. Linch�er remove a building that was al ready built. CONSIDERATION OF ANOKA COiJN'1'Y JOINT POWERS AGREEMENT FOR RECYCLING, O�MPOSPING AND WASPE REDUCTION: Mr. Rd�ertson, Ccnmunity Development Director, stated this joint �wers agreement with Anoka County cavers recycling, composting, an-' waste reduction activities between July 1, 1988 and June 1, 1989. He s ted it is important to note there has been a change in the County' s olid 4vaste Abatement Plan. He stated the City's recycling reimbursanen ill be based on tons r�cycled. He stated under this funding, the City ould receive as much as $20,475 or as little as $1,076. Mr. Robertson tated the General Fl�nd contribution to the recycling program, if the ge ga�l of 572 tons plus 10� is met, wou..ld be $7,170. He stated, how er, this figure will vary with the amount af tons recycled. Co�cilrr�an Schneider asked what the cost d be if this agreement was in force today. Mr. Rcabertson stated abo $7,000 as the City has met the goal so far. Cbuncilman Schneider stated �1 s scmething drastic happens, the figures probably wou.ldn't change. . Robertson stated Fridley has been the leader in the County for partici ion. He stated in the worst scenario, the City would get as little $1,000 and the City' s subsidy would have to be in�creased. N.�. Flora, Public Works Director, stated at the public hearing on May 2, inforn�ation was received and there was discussion oaz the cost distribution for the intersection and signal portioz�s of the 51st Way Street I�ravement. He stated as a result of the questions raised by Burlington Northern and the Fast River R:aad develapers, the costs for the intersection and signals have been redistributed to the County and City. He stated the remaining costs for entrance and street impravements will be distributed to all of the . garties. N�. Flora stated the C`ity has abtairbed an eas�ient and an agreenent frcm the Navy and FMC for the waterlir�e construction along 51st Way, however, it naw appears the Navy chooses to redefine their funding mechani sn for the roadway improvanent. He stated while all of the parties essentially support the imprava:lent of 51st Way and East River Road with permanent signals and traffic controls, it appears that the Navy may take a considerable amc�unt of time, through their review process, before a final decision is made on the cost �rtici�tian. He stated this same design is simi r to the parking lot at Southdale Shapping Center as there is parking g the main entrance to the shopping ma11. Mr. Qureshi, City Manager, stated a possibl solution to deter persons f rom crossing wer the entire garking lot woul be to install a small sidewalk between the plantings on the west and co inue it to the ru�rth. Councilwanan Jorgenson stated she ca ot understand why a parking stall would be installed where yau have to ck into the driveway. 5he stated she would like this �rking lot to be fe for pedestrians and vehicles. Mr. Applebaimn stated e vacatian of the service drive was being done at the City staff' s reques and he didn' t want to spend additional funds for curbing in arder to a public street in this lot. Councilwanan Jor enson stated in order to imprave the site, a concrete barrier has to installed which would prohibit the service road f rcm being used. She sta ed the i.ntersection will be impraved partly to accommodate N�. Appleba s center. Mayor Nee ked if the vacatian of the service drive increased the amc�unt of land avai le for garking. Mr. Apr ebatun stated as part of this vacation, he agreed to give up the south ge af the property along Rice Creek Road where it is being widened. Qureshi stated if the Cbuncil desires, a variance coul oonsidered on the parking stall width frcm 10 to 9 feet and on the w�est side, ten parking sp�aces could be eliminated for installation af a sic7ew . Mr. Applebaum stated he wauld prefer the plan pres ed by staff. He stated it is extrenely costly to ranove the street and, th the ponding which will be required, it wou7.d be $100,000 to $150,000. N�. Qureshi stated the sidewalk would only about 200 feet. Mr. Applebatan stated he would prefer rx�t to c10 it at all. N�. Qureshi stated he would request thi itan be tabled to the next meeting in order to give staff the opportun' y to work out a solution with the petitioner. Nfr. Schlichting, 7426 West Circle, st ed the State statute prwides that a shelter ar evacuation plan must be praved by the City by March 1, 1989. He stated the existing shelter 1 adequate lighting, ventilation, and has I a problen with flooding. He s ted this subject has been brought to the attention of the aaners of FYidley Mobile Hane Park in the past and no adequate reply has been eived. Mr. Schlichting stated at the most, the existing shelter can acccnnx�date 150 persons. He stated the pa.rk has 326 mcabile hctnes and ut 2-1/2 persons per trailer or probably about 750 to 800 people in th mobile Yxx�ie p�'k.
