The petitioner, Thomas Kallroos, is requesting a special use permit be
granted to allow the construction of a third accessozy building at 1466
Ornndaga Street N.E. This building would be used for storage of a boat,
bikes, sna��ncabile, lawn furniture and mawers. Mr. Kallroos will also
relocate his wood hd� shop frcan the house's basement to this accessory
building due to his family's allergies.
Planning Considerations
The Appeals C�a�nission appraved two variances which are related to this
request. These were:
1. Zb allav the total floor area of all accessozy buildirigs to �ceed 1,400
square feet (1,868 square feet).
2. Zb incz�se the equare footage o� an accessoYy building f rom 1,000 square
feet to 1,196 square feet.
This prtr�osal does �nt violate ar� other zoning regulations in R-1, Single
Family Dwellir�g district.
Reccnmenda tion
Staff recommer�ds approval of the special use permit with the following
stipulations:
1. This accessoxy building is �t to be used for autariobile storage.
2. There is to be rn access fmn the accessoxy buildir�g to Onor�daga Street

In reviewing the Special Use pesmit for a third accessory building at 146b
Omridaga Stxeet, I have rnticed that the re3r ya� abuts the future extension
of 73-1/2 Averlue.
A few ya�rs ago, the City authorized the splittir,g of ttie rear yan�s on those
properties between Onor�daga Street and 73rd Avenue. These splits were
predicated upon the future extension arrl construction of 73-1/2 Avenue. The
future extension of 73-1/2 Avenue extends 2U feet into the subj ect property
and is 27 feet wide.
. As the prok�bility for exter�dirig 73-1/2 Avenue is quite good, the City should
obtain a street arx� utility �sanent of 27 feet by 20 feet frun the southeast
corner of Lot 22, Auditors Subdivision 129.

Ms. Castle stated this pn�perty was located in an 1�1, single family, zonir�g

Ms. Castle stated the petitioner was requesting to construct a third
accessozy building on the lot. He currently has a two-car garage attached
to the house and a storage shed, approx. 7,200 sq. ft. The proposed
building would be 42 ft. b� 26 ft. or 1,196 sq. ft.

Ms. C�stle stated the petitioner has also applied for two variar�ces. Those
went to arx3 were approved b,� the Appeals Catmission on August 2. Those were
to ir�crease the total floor area of all accessory buildings fran 1,400 sq.
ft. to 1,868 sq. ft. arrl to ir�crease the square footage of an accessory
building from 1,000 sq. ft. to 1,196 sq. ft.
Ms. C�stle stated staft was recatmending approval of the special use pennit
with the follaving stipulations:
1. This accessory building is not to be used for autanabile storage.
2. There is to be rn access fnZn the accessory building to Omndaga
Street.
3. The design of the building is to be ar�hitecturally camp�tible with
the house.
Mr. Barra questioned why the first stipulation was for autcmobile storage
when the petitioner has said �rt of the use of this building would be to
store an autamabil e, baa t, etc.
Ms. C�st1e stated it was her ur�derstar�ding that the structure would nr�t be
for autanabile storage on a pernlanent basis. Her main aoncern was that the
building not turn into a autanabile re�ir busir�ess.
Mr. Thanas Kallroos shaved pictures of the property as it exists now. He
stated he certainly had no intention of using the structure for an
autcmabile r�i r busi n�ess. It was to be used f or hi s woodworki ng shop
which had to be mwed out of the house because of his wite's allergies and
asttina. It would also be used for storage of yarrl e�uignent, ba3t, etc.
Mr. Kallroos stated he had two letters he would like to give to the
Clrntnission fran his neighbors stating they had no objection to a third
accessozy building.

Mr. Ruud stated, as he understands, in negotiations for the acquisition of
this praperty, canrents were made that the variance required b� the City to
maintain this as a buildable lot was scanething the County offered. He
stated that the affer made was based on oonversations with Jim Rabinson of
the City's Plaruiing and Zaning Department. He stated it was on the basis
that the variance would be considered favorably by the City that they
proceeded with the negotiations. He stated if there is so�ne reason he
variance is not appraved, the riegotiations would have to be reopened. Mr.
Ruud stated a slight re-arrangement of that plat may have solve this
prabl en.
Cbuncilman Fitzpatrick stated he was disturbed that sane member the City
staff assured scnieone that the variance w�uld be granted. He stated it is
the Council who grants the variances and he is bothered by at statement,
since it isn't based on past practices. He stated a year o, right-of-way
had been taken requiring an even greater variance than s p3rticular one.
Councilman Fitzpatrick stated aside fran the communica ion problem, there
are residents in the imr�diate r�eighborhood whp c�bjec to this variance.
Mayor Nee stated since the County is pregared to r n this case, it is not
the question of the owner suffering. He st ed the question is if
constructing a house on this lot is a good idea
Councilwaman Jorgenson stated the County wil be doing additional work on
East River Road and she wanted to make it c ear that the Council takes a clim
view of variances, especially of this ma tude.
N�. Ruud stated the County has recei ed information that sidewalks and
bikeways should be included and at th time of the public hearing f or this
project, this did not ocn� to light.
Councilwanan Jorgenson asked if s'dewalks and bikeways were in the pl an at
this time. N�. Ruud stated t were not.
Mr. Robertson stated, for the record, he recalls a conversation with Mr.
Robinson and 1�. �'lora, whe the East River Road impravanent was discussed,
if variances s,hould be gr ted as a group at the time the right-of-way was
being condemned. He s ted the City staff concurred they would not
recananend this approach and that each variance would be submitted to the
Co�cil on a case-by- se basis, if the property awner petitioned for it.
He stated he f inds i dif f icul t to bel ieve Mr. Robinson woul d i nf orm the
County that these v iances would be granted.
Cb�cilman Fitz rick stated he would be surprised if Mr. Rrabinson had made
this statement each variance has to be judged on its aan merits.

effart to w k v�rith �he Cc�un.t�r wher�ever a plat abuts any �ounty road so
input can �-ovici�e� fran the County before a plat is appraved.

Ms. N�ry Boedigheimer, 117 76th Way, stated if the variance is granted, this
hame would be located very close to Fast River R�aad. 5he stated it would be
different from the other hanes in the neighborhood. Ms. Boedigheimer stated
at the last Council meeting she heard the person who wants to build this
hane state he would pr�ably live there a year and then sell. �fel t the
other residents in the area have a ca�r[nitment to the neighbor and their
hanes. She also stated it would not be easy to sell t s hoqne and she
c�bj ected to the variance.
Mayor Nee asked Ms. Boedi�eimer what she erivision for this lot, if a Yxame
is not constructed. Ms. Boedigheimer stated the ot c�oes not look that bad
right now and it is a very wooded area. She tated the neighbors to the
north and sauth have stated they would mai ain the property. Mayor Nee
stated if the lot is left vacant, mainte e wuuld be his main ooncern.
Mrs. Jan CYeamer, 55 75th Way, stat er back yard is adjacent to this lot
and if no hane is constructed, th would maintain it.
Mr. Wojcik, 109 76th Way, stat he lives on the ru�rth side of this property
and he would be willing to 1 el the lot and maintain it.

Co�cilman Billing stated he did not object to den.ial of the variance, but
is o�ncerned the maintenance of the lot. He stated the neighbors who
indicated they uld be willing to maintain it may sell their hames and the
r�ew c�wriers ma not wish to maintain the lot. He suggested possibly the
County coul acquire the lot and split it in order to assure that it is
mai.ntaine .

, Mr. Flora, Public Works Director, stated several years ago, the Council
authorized the splitting of the rear yards on those properties between
Onondaga Street and 73rd Avenue. He stated these lot splits were predicated
on the future extension and construction of 73-1/2 Avenue. He stated the
City should obtain a street and utility easement, 27 by 20 feet fram the
southeast corner of this lot, for the probable extension of 73-1/2 Avenue.
The Council explained to the praperty owner they would like an easement f or
the possible future extension of 73-1/2 Avenue.
NDTION by Co�cilman Schneider to concur with the reco�mmendation of the
Planning C�unission and grant special use permit, SP #88-10, with the
follawing stigulations: (1) this accessory building is not to be used for
an autcmabile reFair business; (2) there is to be no driveway access fram
the accessory building to OnondacSa Street; (3) the design of the building is
to be architecturally cc��atible with the house; and (4) petitioner to work
with staff to acquire an appropriate easement for a potential future

wide space. Mr. R�obertson stated i 150 parking stalls were lost due to

Ms. N�ry Boedigheimer, 117 76th way, stated if the variance is granted, this
hcme wauld be located very close to East River R�ad. 5he stated it wauld be
different frcm the other ha�es in the neighk�orYrood. Ms. Boedigheimer,stated
at the last Council meeting she heard the person who wants to b 'ld this
hame state h,e wauld probably live there a year and then sell, e felt the
other residents in the area have a occmtiitment to the neic�Y�bor and their
h�anes. She also stated it would not be easy to sell t s hane and she
abjected to the variance.
Mayor Nee asked Ms. Boedi�-ieimer what she envision for this lot, if a hane
is not eonstructed. Ms. Boedigheimer stated the t does not look that bad
right r�ow and it is a very wooded area. She ated the neighbors to the
north and south have stated they would main in the property. Mayor Nee
stated if the lot is left vacant, mainte e w�ould be his main concern.
Mrs. Jan CYeamer, 55 75th Way, stated er back yard is adjacent to this lot
and if r�o har�e is aonstructed, they uld maintain it.
Mr. Wojcik, 109 76th Way, stat he lives on the north side of this property
and he would be willing to 1 el the lot and maintain it.
NDTION by Councilm�n Fi trick to deny variance, VAR #88-17. Seconded by
Councilwcxnan Jorgenso .
Co�cilman Bil lin stated he did ru�t c�bj ect to denial of the variance, but
is concerned t the maintenance of the lot. He stated the neighbors who
indicated th would be willing to maintain it may sell their hr.�r��es and the
i�ew aaners y r,c�t wish to maintain the lot. He suggested possibly the
County c d acquire the lot and split it in order to assure that it is
mai nt d.

Mr. Robertson, C�resminity Develagment Director, stated this request is for a
special use pernlit to allaw a third accessozy building at 1466 Onondaga
Street. He stated the proposed building would be 1,196 square feet. Mr.
Rd�ertson stated that in conjunction with this special use pennit, the
petitioner has applied far two variances to increase the floor area of all
accessory buildings frc�n 1,400 square feet to 1,868 square feet and to
increase the square footage of an accessory building fram 1,000 square feet
to 1,196 square feet. He stated the Appeals Cammission approved these
variances at their August 2 meeting.

Mr. Flora, Public Works Director, stated several years ago, the Council
authorized the splitting of the rear yards on those properties between
Onondaga Street and 73rr1 Avenue. He stated these lot splits were predicated
on the future extension and construction of 73-1/2 Avenue. He stated the
City should obtain a street and utility easement, 27 by 20 feet fram the
sautheast corner of this lot, for the prob�-�ble extension of 73-1/2 Avenu,e.
The Council explained to the praperty aaner they would like an easement for
the possible future extension of 73-1/2 Avenwe.
NDTION by Co�cilman Schneider to concur with the recomnmendation of the
Planning Cc�anmission and grant special use permit, SP #88-10, with the
follaving stipulations: (1) this accessory building is not to be used for
an autcmobile re�ir business; (2) there is to be no driveway access fram
the accessory building to Onondaga Street; (3) the design of the building is
to be architecturally campati.ble with the hr�use; and (4) petitioner to work
with staff to acquire an appropriate easement for a potential future
extension af 73-1/2 Avenue. Seconded by Councilwoman Jorgenson. Upon a
voice vote, all voting aye, Mayor Nee declared the motion carried
w�animously. __

a variance to reduce the size of a p�rking stall fran by 20 feet to 9 by
18 feet to allvw the existing �rking lot stripin to remain at the Onan
Corporation. He stated the hardships cited ar that 150 parking stalls
wauld be lost, if the restriping was required; e lot was just restriped in
1986-87; the nature af the busirvess is such t traffic in the lot mainly
occurs at the shift change; and cars are ler and do not need a 10 f oot
wide space. Mr. Rabertson stated if 15 parking stalls were lost due to
restriping, there would be a shortage garking for Onan anplayees and may
cause overflav �rking in the adj a nt residential districts. He stated
staf f, as wel l as the Appeal s 'ssion, is recommendi ng appraval of the
, variance.
Councilman Schneider st ed the stalls were striped before this code
requirenent of 10 by 20 oot p3.rking stalls. He stated he would not object
to delaying the rest 'ping of the visitor �rking stalls to 10 by 18 feet
until the riext t' Onan restripes their lot.
NDTION by Co ilman Schneici�er to concur with the tmanimous recvmmendation
of the Ap ls Coarnnission and grant variance, VAR #88-20, with the
stipulat' that the visitor parking stalls be restriped to ten (10) feet by
