Mr. Ruud stated, as he understands, in negotiations for the acquisition of this praperty, canrents were made that the variance required b� the City to maintain this as a buildable lot was scanething the County offered. He stated that the affer made was based on oonversations with Jim Rabinson of the City's Plaruiing and Zaning Department. He stated it was on the basis that the variance would be considered favorably by the City that they proceeded with the negotiations. He stated if there is so�ne reason he variance is not appraved, the riegotiations would have to be reopened. Mr. Ruud stated a slight re-arrangement of that plat may have solve this prabl en. Cbuncilman Fitzpatrick stated he was disturbed that sane member the City staff assured scnieone that the variance w�uld be granted. He stated it is the Council who grants the variances and he is bothered by at statement, since it isn't based on past practices. He stated a year o, right-of-way had been taken requiring an even greater variance than s p3rticular one. Councilman Fitzpatrick stated aside fran the communica ion problem, there are residents in the imr�diate r�eighborhood whp c�bjec to this variance. Mayor Nee stated since the County is pregared to r n this case, it is not the question of the owner suffering. He st ed the question is if constructing a house on this lot is a good idea Councilwaman Jorgenson stated the County wil be doing additional work on East River Road and she wanted to make it c ear that the Council takes a clim view of variances, especially of this ma tude. N�. Ruud stated the County has recei ed information that sidewalks and bikeways should be included and at th time of the public hearing f or this project, this did not ocn� to light. Ms. Boedigheimer stated at the last Council meeting she heard the person who wants to build this hane state he would pr�ably live there a year and then sell. �fel t the other residents in the area have a ca�r[nitment to the neighbor and their hanes. He stated the City should obtain a street and utility easement, 27 by 20 feet fram the southeast corner of this lot, for the probable extension of 73-1/2 Avenue.
