1976. This will require a Public Hearing before the Planning Com-
mission. To meet the code requirements, a notice of this Public
Hearing must be published twice at least l4 �ay� be-Fore the Hearing.
The earliest this can be published would be the week of May 20th

Chairperson Harris stated he thought there was a lq�t to be discussed, but
without representation from the Parks and Recreat�on Commission it would be
difficult.
Mrs. Gabel sai.d that on page 11 of their minutes it said that the Community
Schools had offered the Youth Center to come under their auspices, and it
had been previously stated that the school board was not interested in it.
She asked for clarification on that matter. Mr. Boardman explained that the -
Community Schools are different from the School Board, and they are the ones
that made the offer. Mrs. Gabel asked what the Community SchooZs do, and
Mr. Boardman answered that they have the Fine Arts Committee, theatricals,
city band, etc. He added that there were people from District 1!� who were
involved in Community Schools, but it is not necessarily tied to the School
Board.
Chai rperson Harris noted that the Parks and Recreation Commission had formed
a Recreation Study Project Committee� and said that whenever a project committee
is formed it should be requested that the Chairperson of that Commission
submit the names of the people on the project committee so it couZd go to
the City Council. Mr. Boardman said they would then keep a running aconnt
of project committees and ��hat they are active in, and the Commissions would
be able to keep an up-to-date account of those committees and who w�.s involved.
Mr. Bergman stated that the Community Development Cornmission had two project
committees now; a sign committee and another for bike and walk�rays. He said
that bike and walkways was a controversial topic and there would be some
� discussion on it. He commented that the one on Mississippi Street looked
like a two-lane street instead of a bike lane. Mr. Boardman stated that the
bike system was not officially opened yet, and that striping and signing
were not completed yet. Mr, Boardman explained that the County had agreed
to a bike system and they had received some Federal monies that they had to
spend or lose, and that is what they did. He further explained that the
monies set aside by the Federal Government were for edge striping. Mr.
Bergman stated that a good]:y share of those stripes that were put down were
in the wrong place, and many were worn off already. t�irr. Boaxdman said that
was because they went through a winter and winters were very tough on striping.

should have tabled the item since she did not have all the necessary signatures

Chairperson Harris read the followin� statement out laud: "I, Nancy Melbie,
am making application for a Special Use I'ermit to the City of Fridley, for having
ten full-time children at my Day Care. My yard will be fenced and they will be
kept on my own property. I need to advise you of this, and I request your
signature for permission or refusal of permission. If you refuse, please state
reason for refusal." Mr. Harris noted that all ten neighbors had given their
approval.
MOTION by Shea, second.ed by Bergman, to rece.ive the petiti.on o£ approval. Upon
a voice vote, all voting a,ye, the motion carried unanimously.
Mr. Boardman stated that since the neighbors have been contacted and there are
no written objections, City Staff has no objections to the proposal. He asked
if Nrs. t�elbie was licensed with the s�ate, and A4s. Nagel replied she was licensed
by the State of rlinnesota to care for five, and had been operating since November�
1975. She stated that Mrs. Melbie would like to expand to include a greater
number oY children; and although the state didn't necessaril,y require a new
pex-mit she must meet city codes to carry an her business.
Mr. Boardman said that Fridley City Code, Secti.on 205.051, 3, F� would allow
a child day �are center for ten chi7_dren in a R-1 Zone. Mr. Langenfeld asked
if this would fall under the category of nursing homes, and Mr. Boardman said -
the code did not really say day care center, but they interpreted a day care
center as that type of operation in which there is caring for more than five
persons.
Ms. Nagel said she u.nderstood the reason they needed a Special Use Permit was
because rirs. Melbie planned to hire someone to help her since she would be
taking children w�rjer three yea.rs old. rir. Boardman stated that as far as the
Special Use Permit was concerned, they felt this j�Tould be regulated under the
hospitals, nursing homes, etc., since Mrs. Melbie would be hiring outside of
her home.
Chairperson Harris asked about the traffic involved in loading and unloading �
children, and Mr. Boardman replied that ten children wouldn't provide heavy
traffic. Mr. Harris asked what the hours of operat;ion ��ould be, and rirs. Melbie
� . said basically from 6:00 - 5:30, but they varied depending on the hours of the
E parent. Mr. Harris questioned if there would be parking for long periods, and
� Mrs. Melbie replied it would only be a matter of seconds. Mr. Harris then asked
' if c�ff-street parking would be provided for the assistant, and Mrs. Melbie said

� that her assistant lived right next door.
, Chairperson Harris asked if they didn't require the Fire Marshall to look at
this, and rir. Boardman replied that the Welfare Department checked that. Mr.
Harris asked how large the fenced-in area was, and Mr. Boardman replied that
Y the lot size was 75 X 120 so there was probably a 50 X 75 back yard. Mr. Langen-
� feld asked if hixs. Melbie had the proper liability coverage from an insurance
standpoint, and she said she did.

of Ironton Street just East of a present two-family dwelling unit that was being
built. r1r. Boardman said that; at this time the City Staff would have no objections
to a two-fa�r►ily dwelling as f,ar as zoning purposes go; and they felt that if the
design of the structure was �roper they could envision a two-family dwelling with
no trouble.
Mr. Bergman asked if the t�o-dwelling struct.iire that was bein� built next door
would be classified as a double bungalow and f'all under those requirements. Mr.
Boardman said it fell unde� the requirements of a two-tamily structure as f ar as

, Councilrnan Starwalt stated that he recognized that the Plannirtg Commission did
recommend that it not be rezoned and the rezoning for that is very yood, but he has
a different interpretation of the matter. He said his interpretation is that the
persons probably most affected, if at all, in any future action vrould be the persons
immediately to the north and the families to the north on the corner of Mississippi
and State Highway 65. He had talked to the residents in the ,area, and his belief is
that this sort of usaye would be best for the City in the lot�g run over possible
future apartments that could be put in there. The people oq` Dellwood, east of the
affected ��r�operty, didn't express any objection; in fact, they indicated they would
rather see coinmercial there than to see it vacant.
Councilman Starwalt went on to say that if we are to deryy it, let's deny it for the
proper reasons. Spot rezoning is to be avoided except w}lere circumstances warrant
approval. He is trying to look at the effect that the y:ommercial pattern would have
in consolidating or enhancing the particular area over ti�rhat it is now. The owners
directly to the north, although this is residential , do not have City gas and have
not been able to get it except at a considerable expe�diture. They are inclined to
think if it were rezoned that out of the process theyf city gas and this would certainly
be to their advantage. �� �

Some of the audience briefly remarked that they ob'ected to the rezoning. Some of them
felt that rezoniny would improve winter parking co ditions in that the office building
would not have snowbirds and would not create oth�r winter parking problems to th�
residents in the area. !�
MOTION by Councilman Starwalt to waive the readj�ng and adopt the ordinance upon first
reading. Seconded by Ceuncilwoman Kukowski. A oll call vote was taken. Council-
woman Kukowski voted nay, Councilman Fitzpatri k voted nay> Mayor Nee voted nay,
Councilman Hamernik voted nay, Councilman Sta alt voted aye. Mayor Nee declared the
motion failed to pass by a four to one vote.
CONSIDERATION OF FIRST READIWG OF AN ORDINAN�E TO A��1EfJD CHAPTER 11 OF THE CITY CODE
OF THE CITY OF FRIDLEY SERVICE STATIONS�f-
Mr. Brunsell , Finance Director, stated tha the administration has taken a look at
the expenses involved. A survey was made of the time spent and from that it is the
recommendation that the fees be increased� from $30 a year to $60 a year for service
stations.
Mayor Nee remarked that he was very imp essed with the work that was done in this matter.

frequest scrutiny than has been done. �
