Nir. Barry Satterlee, The Sussel Company, was present to represent the
petitioner.
MOTIOIJ by Peterson, seconded by Bergman, that the PZanning Commission
open the Pub.Zic Hearing on the request for a SpeciaZ Use Permit, SP # �
76-05, by ArZyne R. Johnson. Upon a voice vote, a11 votinq aye, Chairman �
Harris declared the Public Hearing open at 8:I1 P.M. �

and the other aceess on 57th Avenue �1.E. He said this garage ��rould be �
20' x 22' and would meet all the code requirements . The staff had no ;
objections to this special use permit being granted.
Mr. Qarry Satterlee presented pictures of the site,, a dra�aing of
how the garage wou'Id be located on the lot, and a statement signed by r
the two adjacent property owners. �
Chairman Harris read the statement from the two adjacent property �
owners ���hich stated: "L�le the undersigned have no objection to a double E
garage being constructed at 420 57th Place and the present single garage �
attached to the dwelling remaining open and being used as a garage. " He
said it was signed by Warren Sunderland of 410 57th Place N.E. and Carl
Paulson of 430 57th Place N.E.
MOTTON by Langenfeld, seconded by Peterson, that the Planrzinq Commiss.ion
receive the signed statement from the adjacent property oHmers. Upon a
voice vote, a11 votinq aye, the motion carried unanimously.
T�Ir. Satterlee said that Miss Johnson lived alone and far security
reasons would ]ike to continue to use the single attached garage for her
personal car. She was going to �use the second .garage to s�ore a boat
and a second car.

MOTION by Bergman, s�conded by Peterson, that the Planning Commission
recommend to Council approval of the request for. a Special Use Permit, i
SP #76-05, by Arlyne R. Johnson, per Fridley City Code, Section 205.051, ;

Mr. Harris asked Mr. Satterlee to be sure the petitioner was aware
that it was a code requirement to have a har.d surface driveway.
Upon a voice vote, all voting aye, the motion carried unanimously. �

Chairman Harris said this req st would be handled as an informal �
public hearing.
Mr. Board n sa�d that a p tion of unimproved Johnson Street was f
vacated in 197 At that time, this portion of Johnson Street was �
not vacated bec se the petit oner wanted to maintain that area for an `
access. They ha e changed t eir minds and want it vacated now. There
will have to be a ,easement re�ained for drainage and utilities on
the East 20' of the,vacate street. �

Mrs. Albert Villel�a 5300 Matterhorn Drive N.E. , said that their I
house was on the other �' de of this unimproved Johnson Street, and
she wondered how this v � tion would affect her property. Mr. Harris
said this road easeme fo��, Johnson Street was 33' which was half of
an easement for a str et, so`,it would all go back to Swanstrom's Court
Addition, so this wo, ldn't af�ct Mrs. Villella's property at a11 .

Mrs. Villella �`jaid that if the, petitioner was going to construct
something on this 33' , then it woui�,d affect her property very much.
Mr. Presteman sa'd that they were go:�ng to construct a new attached
garage on their roperty, which would�be built 2 feet from their present
property line, o the vacated street wbuld be used just as part of the
required setb k. They didn't intend tv Use any part of the vacated
street for an s�;ructure.
Mrs. Presteman said this. unimproved street has been used as a dumping
� ground by all the surraunding neighbors. She said there has been concrete
chunks, tree branches, etc. , dumped here, and she was the only one in the
past ten years who has made any effort to clean up this area. Mrs. Villella
said that they had just purchased their home last spring, and they had tried
to clean up the area closest to their property.
