Mr� Reine�tson said he hnd �al.kc�d to various people from
Ci_-�y Hall tl-ying ta get� icleas for tliis property and from these
talks his c�mpany had come up with this cancept. He said there
are problem�s in- +�hia area ir, i.hat Ea:�i. Riv�r Road is heavily
traveled and, esperiall_y i.h^ �:orr.er_ _lot, was n�t conducive to
R-1 developrr�ent. He said �a:i_th i:his cc:zcept the Z story would
be below grade so the to�anhouse typc units would blend into the
neighborhood and wot�J_d make a nice entrance in�to the area. The
entrances and exits to �his development would be on 71st Way.
Mr. . R�inertsori said tl�e drawing� being presented were just
guic�el.ines on h�,a t.his townhouse type complex could be developed
anc; he w�.is open to sugges tions .f-rorn the neighLors or the Planninr
C.ommisri_on, and wouic? �•��lcome i-.hese suggestions . He sai.d there _ '
wou]_c� l:�e a buffer on the West side of tr�e development of about
46 fect from �he ad;ace�it home.

here as a represc,iztative of the Fridley School: Board, to state that
the Schaol Board would be opposed to any rezoning that would increas�
dens�_�y in this ar_ea with.in -Lhe p,-axi_mity of the enr�rance to thc

Reinertson mar�e the stat.�ment �hat �his development would enliance
the community and ben�fit the City . He said we feel like �ee are
a community in this �r�a and our contention is that this woula be
� cnanging our neighl�orhoo� to a tr_ansient soci�ty. This is not� in
line wiL-h whai� we feel for this area. I�Ze are a neighborhood and
we apprec�_ate th� area as it is . Ther� ar.e more things to consider
than �ahat can be don� with thispari�i�ular_ corner. This rnay involve
' less profit for the land oumer, but we feel that I'r_ idley abounds wi1=,11
apartmc:nts and we d.on' �L want any in our area.

zoned �:-1 and the petitioner �aas reauesting a sPecial use
permit to allow douk�lc bungalows or duplexes to be constructed
on these lots.
Mr. Gerald Rossow, C881 Washington Stree� N.E . , said
that he had just iecently purchased Lot 13 , and his new
home was in the process of being bu.ilt. He said that at the
time he pur_chased this la� from the Henr.ing Nelson Company,
no mention was made that tr:�y were qoing to request a Special i
Use Per_mit to build a double bungaloua right next to his new �
home, so he didn ' t feel i�hat they had operated in good faith.
He said that if sorleone from the City staff hadn' t called him
at 4 : 00 today (I�Iarch 17tY1) � he wouldr1' t have known anything
about this proposal. He said t.hat he felt that the petitioner
hadn' t made any effo-rt to build single famiJ_y homes on these
lots . He said l�i� had negotiated with Henning Nelson a long �
time before rie woul_d aqr.ee -L-o scll him the lot. He said that �
he had hcard tl-ia�: other people were interested in these lots , �
and they hadn ' t been able to purchasu them either. He told the
Planning Commission that t�hese loi�s shou7_d be retained for R-1
developm�nt.
Mrs . Kermit Bender, 1.4G 71st Way N.E . , asked if this request
was sti11 valid when one of the lots had been sold. Mr. Harris '
said a r�quest can always bc reduced, but nothing could be added ;
to it. Mrs . Bender said tlzat no one froiti the Henning Nelson !
Construction Company had appeared at this meeting, and this company
• has done this before to this neighborhood at the time of the
rezoning. Srie said they have all sat at this meeting for six hours
and she thought the petitioner should have been here and presented
a plan. Mr. Fiarris said it was not spelled out in the ordinance
that he had to have a plan. He probably wouldn't want to draw �

Mr. Rossow said he had met a lot of nice new neighbors at
this meeting, but he did want �o mention that his contractor
had been at this meeting until 1 : 00 and then he had to leave.
He said his contractor had just picked up the building permit
for Mr. Rossow' s home last Frida� (March 12th) and no one had
told the contractor about this request to construct double
bungalows next to his building site , so the coni�ractor felt
that he had been put in an unfair position also.
Mr. Enqelhardt said that he didn' t thiizk thai� Henning
Nelson shoulci be able. to keep making requests on this property
that was against ho�a the majority felt in this neighborhood.
Mr. Harris said that if this request �aas denied, the petitioner
would have to wait six months before he could make any other
request for this property.
Mrs . Gabel said she was disappoir�ted that the petitioner
� did not appear at this meeting, because there were a couple
of questions she would have liked to have asked. She said that
she noticee:i in reviewing the minutes on the rezoning request,
that he had left the neighL-ors in the lurch like this befa_re.
She said she could see thei_r point when they come and sit at a
meeting for six hours, and then the petitioner didn' t show up.
She felt this was rather inconsiderate.
Mr. Harris said that on paqe 84 and 85 oi their agenda,
there were minutes of the rezoning r_eques� on this same property
from May 22 , 1974 , and it lis�ed the reasons why the rnzoning
request was denied.
Mr. Scott said the problem he had with this request was
because the petitioner v.�as not here to develop his plan, but
he did see multiple dwellings as a means of ir.tergr_ating l�s�
fortunate men�bers of our. society, and felt that you could build
a double bungalow in a neighborhood without destroying the
values of a neighborhood, as long as th�se vaere not co.ncentr�ted
areas . He said he fel.t that a person had the right to do what
the law allows him to da with his own property, and he felt this
was a valid request. Iie said that we were going '�o have to
understand that there were people in this country who couldn' t
afford thc living staridards that most of us enjoy. Somewher� along
the line , these people have got to be 'integrated into our society
and he thought multiple dwellings was a means �f doinq thiti, as
long as this was done on a limited basis. fIe said that because
there was no plan presented at this meeting, he couldn ' t vote
f�r this request, but he thouc�.ht this was a valid request.
Mr. Sangster said he appreciated �Zr. Scott` s comments , but
if he been at the rezoning hearings, h� would have heard Mr.
Reinertson state that they had so much money -invested in these
loi�s that they could not afford to develop them as R-1 proper.ty,
and so the reasons for bu�_ldiny multiple dweliinc�s orr these •lots
were not for helping to 'intcrgrateless fortunate people into

the Planning Cominission. The Planning Commission recommended denial. That first �
of all the property was not compatible with the neighborhood, the petitioner was
absent from the hearing on his petition, and further, the petitioner stated to , g

- The Public Works Director stated that the petitioner was called to inform him �

certainstipulations, performance bond, and landscaping, the property can be
brought into conforraance with the existing use„iiot necessarily appropriate for �
the area. They have not received approval as yLt, and they will be willing �
, to ayree with any reasonable stipulations that;the Council may desire to place �
on them. A concern was the temporary nature qf the site, and that over a period
of time there should be some permanent improv�ements in the area. ' � �
! The Public Works Director further stated that a stipulation could be that a Special }
Use Permit might be approved for a period i three years and after that time the ;
� Holiday Store should make a decision as t�whether they wanted to continue the �
garden center, and if so, they should prr�pare plans of a peririanent nature. Another

April lst to September lst; after• that time the area be cleaned out and cleaned up
and put into a neat and orderly fashi n, and that there be a review to see that �

stipulations. The Manayer stated he would agree and that the garden center would
be closed after the 4th of July. �

potential shallow water problem in this area. We do have the easements, and this t � �
