Per Fridley City Code, Section 205.051 , 3, F, to a are center on

River Road N.E.
No action needed. Withdraw by petitioner by telephone call October 7, 1975.
� Mr. Boardman said the petitioner stated she was withdrawing this request bec4use
° the house on this property would not meet ti;e State requirements for licensing.
Mr. Scott asked if the petitioner stated why this wou1d not meet the State
requirements. Mr. Boardman said no.
2. PUBLIC HEARING: REZONING REQUEST, ZOA �75- 5, BY ROBERT OLMSTFAD: To rezone from
C-1S local shopping areas to R-2 two fam, ly dvr1ling areas Lot 14, Auditor's
Subdivision No. 129, except the East 225 f �t, being that par� of Lot 14 not
zoned R-1 (single family dwelling areas), enerally located at Fireside Drive
N.E. and Central Avenue N.E.
Mr. Rober� Olmstead was present. �
MOTION by Drigans, seconded b� Langenfe d, that the PZanning Commission open
the Public Hearing on rezoning request, ZOA 75-05, by Robert Ulmstead. Upon a voice
vote, a11 voting aye, Chairman Harris decla ed the Public Hearing open at 9:00 P.M�
Mr. Boardman said there was a petiti n �o receive on this request.
Mr. Harris said this was petition . 19-1975 dated October 8, 1975 which ;
read "We the undersigned property owners of single family dwellings and residents of
the area around and adjacent to Lot 14, Auditor's Subdivision No. 129, all lying in tne
North Half of Section 12, T-30, R-24, C ty of Fridley, County of Anoka, Minnesota,
generally located a� Fireside Drive N. . and Central Avenue N.E. , hereby petition the '
Planning Cam�nission of the City of Fri ley to deny the request, ZOA #75-05, to rezor.e
the C-1S District to any zone other t an R-1 . That the undersigned represent the �
majority of single family dwlling pro erty owners around and adjacent to the above
mentioned property and hereby volunt rily signify our objection to such rezoning
� requests and respectfully request t Planning Commission to deny such requests. "
Mr. Narri� said there were signatur s from 15 residences in the area. (Only six in
the 350' radius of the property).
MOTION by Scott, seconded b Langenfeld, that the Planning Conm�ission receive
Petition No. 1975, in opposition o any rezoning except to R-1. Upon a voice vote,
- a11 voting aye, the motion carri d unanimously. '
Mr. Boardman said the fit, t request to split this lot was back in 1965, which
subsequently was dropped. In 1 76 there was a petition to split one lot from the
commercial property and to all this split off lo� to be developed as R-2. At the
time of this request you coul ccnstruct a double bungalow on commercial property.
The request was to split off 75' but when this was recorded at the County, it was
. recor�ed as 80 feet. The pre en� lot split request was going to match up with what
the County had, so there will be two 80' lots and one 90' lot. Under the present zoning
ordinance, you cannot buil�;�g R-2 in a commercial area, so this was the reason for
the rezoning re�uest. You also cannot building a double bungalow on a 75' lot.
� Mr. Robert Olmstead said that with the lot split request they were trying to
clarifiy" the legal description once and for a'Il because this had become ay_mish-mosh between
