This is to confirm a conversation I had with N1rs. Bel};.holm on April 29, 197G
following your unfortunate fire.
As stated to Mrs. Belkholm, I want to point out that there have been some
changes in the City Code since your garage was built. First, since your
garage was damaged by more than 50 percent; you must comply with all
existing Codes; four of which do affect your situation rather seriously. �
1. You Will need a Special Use Permit for a second garage. This process
• takes about six weeks and cost�_, C9.

2. . You will need a new survey th��sT�ows ,�our existing structure; your
� mortgage company may have one.
3. If your garage door is closer than 25 feet to the property line, or
approximately 35 feet from the cuxb, you will need a variance which
, takes about 1 month at a cost of 15 00. (This can be processed at the
, same time as• your Special Use Permit application.)

4o If you choose to provide heat in the garage, the structure must meet
the new State Energy Code. . �
The variance and Special IIse Permit are not automatically granted; there
� is a public hearing process for each request and the C�ty may approve,
deny, or place stipulations with their approval. on them.

Mr. Boardman said that it had. been nip and tuck for ahile on the ha.ndicapped
codes, but they had finally gotten some clarification from the state on that.
He explained that as long as the en�rance to the unit was to the outside,
the three-unit buildirigs were not required to have handicapped facilities,
but a rmiltiple unit would be required to have them.
Njr. Lynn D. Hansen, 210 67th Ave. .,N.�., stated tha� he owned the �-plex that
was on the property ad,joinin� rir. Aspenson's, and asked if he could see the
plans for the proposed building. Mr. Aspenson showed him the plans, and �4r.
Hansen agreed it was a nice-looking and attracti�e building. Mr. Donald F.
Cable, 6530 Second St. N.E., stated he was the earetaker for Mr. Hansen's
building, and he also thought �Lhe proposed structure would be beneficial.
Mr•. Bergman said he wo�zl.d agairi Iike a show of hands of those people in the
audience who were concerned with this item, �nd two people (I�Sr. Hansen and
Mr. Cable) raised their hands. rir. Bergman 'asked if rir. Boardman could fill .
him in on the zoning surrounding the lots in question. Air; Boardman directed
the Commissioners to turn to the map on pa�e 36 of the agenda, and explained
the property directly North was R-3 (l�-pl��), the property across the street
was R-3 (apnrtment buildings), North of tihe !�-plex was City park property,
and 6525 A�ain St. and the property just ,South of thai; were zoned R-1. P-ir.
Bergman noted that there seemed to be sytime land left af'�er the service drive
went through, South of lot 11 and the c�ne to the West of it, and asked if
there were any plans for that property;: rir. Boardman said tha� was cour�ty
right-of-way. �

and to the �ervice drive. ?�;r. Boardman replied there would be. He explained
the buildin� would sit right on the corner, and access to tne gara�es would be

entrance to the units FTould be on the West side.
Chairperson Harris asked what t�he size of that parcel was, and Mr. Aspenson

City Staff had no objections to this request.

Mr. Boa.rdman explained that 2�Ir. Rotter was going to came in for a replat on
an area South of Springbroolc Creek, axid they want tio discuss at this time tYie
possibility of the Planning Comrlission inil;iating a rezoning of the PJ district
which is presently in there to R-1. He said that most of the property laas
zoned R-1, and they would request that N1r. Potter initiate thE rezoning South
of the creek, and the Planning Co,-nmission ini�iate the rezoning North of there.
Chairperson Harris asked who ow:led the property North of the creek at the
present time, and l��r. Boardman replied it was owned by varzous individuals
and single far►ilies. ,�Ir. Harris asked ho�r tnis ti��ound up as PD, and P•�r. Boardman
.said tha� took place quite a while ago. ; He explained tnat at t.hat time there
was a `"�roposal for a commercial development North of the creek and an apartmer�t
development South of the creek. He st�,ted he i�rasn'i really sure of tha background
on that zoning, but it was rezoned to PJ so developers could develop both.

talking about then was reverting it to the original zoning. Mr. Boardman said
that indications were that the property otaners North of the creek would not
have any objections to the rezoning.
Mr. Rotter said his company was owner of the South section of this property
and builder of the North sectio�. He stated that in 1973. he came before the
Planning Commission to ask for perm�ts to build single-family dwellings in
the PD area, and he was grantec� them. Mr. Rotter said he as}:ed them to leave
the South section alone until they decided what to do with it. He referred to
the map on page �5 of ttie a�;erida, and said that South of the line kThich said
359 there was about a five acre piece of 1and. He stated lie would like to
rezone part of this or be al�owed to bui]_d single-tamily d:,rellings, leaving
lots 11, 12 and 13 in either; PD zoning or R-3 zoning rather �han changing it
all back to residential. i-ir. Rotter explained that c�ne piece of property
abutted East River Road, anrl there �ti*as no access off Liberty or Ruth, and no
access off the extension of Ely. He said that ratner than leaving it as
residential property and b�^ing up three driveways to East River Road, he was
going. to leave that as eit�her PD or. R-3 zoning and put something in there that
would be condusive to the ;area. He stated he did not �aant; to rezone the whole
entire piece because that would leave a dead piece .of property.
Chairperson Harris said it seemed to him the practical thing to do would be to
leave it PD and have the developer bri.ng in a total plan on the whole area.
Mr. Rotter said that was what he wanted to happen. He said they had already

CONSIDERATION OF VACATION REQUEST, STREET AND ALLEY VACATION S #76-04, BY KAREN '

Mr. Tom Colbert, Assistant Engineer, stated that this was a' request to vacate an alley
' bounded by Liberty Street, Fly Street, Ruth Street, and Ashton Avem�e. At the Plar,ning
Commission's meetinn of July 14, 1976 a motion to deny tMe vacation request failed to '
pass by a tie vote; and therefore, was brought to the Council 's attention with no
recommendation from the Plannin� Commission. �1r. Tom Geddy, City Attorney's office,
stated that in his opinion if it is just a question of an access to a vacant back yard,
it would probably be very marqinal as to whether or not one could collect damages
from the City. However, if the alley is being used;to get to the garages and the garages
cannot be reached from the street in front of the houses, the City could be liable for I
damages to the particular property owners involved. founcilman Fitzpatrick then
conunented that in reading over the minutes befcre the Plannirn Conimission and the hearina
that was had before the Council and the letters that were received, he was convinced
that a number of people use the access in question and it was in existence as such
when they arranged their habits as far as access to their property.

Fine Arts fundin� came fror� the Human Resources Cor�rission ar�d was aonroved by the
; Planninn Commission. The Human Resources Commission discussed �riarities for
community needs by using the �10,000 fiaure to break into percentaaes. They also did �
