University Avenue Northeast on Wednesday, April 5, 1978 in the Council

Hearing was opened at 7 ;40 P. M.
P1r. Boardman stated the property on which the buildir.g will be located is zoned
R-3, however, this request• is to use two ad jacent single family lots f.or par�:inn.
}Ie indicated the staff did not see any problems with t}iis request for a ,pecial
use permit, however, une of the stipulations for the parking lot wauld be solid
screening along the East and Narth sides of thc: property.
Mr. Boardman stared all other recluirements have been met, wi,th ttie except.i.on of
a variance on the front yard setback. He stated the Appeals C�mmission has
recommended approval of the variance.
Mr. Doyle stated, at tlie. re•�uest of C�_ty �t�ff, they have revised the plans ta
include tt�e apa�tment b�iilding on t'r��f� R-3 property, mov� ttie bui.lding back
from �czst River Road and inc�rporatc Lots 78 and 79 for parking.

Mr. Doyle explained the apartment building itself will be in the semi-deluxe
category with each unit having their individual �.�nderground parking stall.
He stated Lots 78 and 79 wi11 be used for auxiliary parking.
Mr. Harris asked lio�o many units would be included in the apartment building.
Mr. Doyle stated there would be a total of 10 units for this parcel, each
havin g a tuck-under garage.
N1r. Harris asked Mr. Doyle if he had any objections to the screening fence
recommended by staff.
Mr. Doyle questioned what type of fence the staff had in mind. Mr. Boardmatt
staied it has to be a solid separation of either vegetation or solid board
fence. He stated, fro:n past experiences, a solid wood fence would probably
be the best.
Mr. Doyle indicated there would be no problems with the fencing.
Mr. Peterson questioned why it was suggested the residential lots be used for
parkin g. •
Mr. Boardman stated the parking lot could have been �-located� on' the unimproved
lot area, however, if East River Road is ever widened, they might lose some
of the parking area.
i�Ir. Doyle stated if the 'parking were on the ur.improved area, you would almost
h�ve to have access onto East River Roa1 which is less desirable.
No persons in the audience spoke for or against this request for a special
use permit. .
MOTION by Mr. Bergman, seconded by Ms. Gabel, to close the Public Hearing.
Upon a voice vote, all votin g aye, the motion carried unanimously. The Public
Hearin g was closed at 7:50 P. M.
MOTI(AV by Mr. Peterson, seconded by Mr. Lan genfeld, that the Plannin; Commission
recommend approval of the Request for Special Use Permit, SP ��78-04 by John R.
Doyle: Per Fridley City Code, Section 205,051, 3, E, to permit R-1 zoned pro-
perty (single fami.ly dwellings) to be used for an off-street parking lot for a
proposed apaxtment buildin g on adjacent land, to be located on Lots 78 and 79,
Block A, Riverview Heights, the same being part of 441 Hugo 5treet N. E.
Mr. Harris questioned Mr. Peterson if he wished to include the recommendation
far solid screen fencing in his motion. �
Mr. Peterson felt this was covered in the code and, therefore, wouldn't be
necessary to include it in the mation.

i Mr. Sobiech, Public Wo �rector, stated this request for special use
• � permit is to permit R-1 property to be used as a parking lot for an adjacent �
i 10-unit multiple dwelling unit at East River Road and Nugo Street. i

i Mr. Sobiech stated the Planning Commission held a public hearing and has �
� recommended approval of the special use permit. j
' Mr. Sobiech pointed out the 10-unit building will consist of 1, 3 bedroom
; unit; l, efficiency, 3, 2 bedroom units and 5, 1 bedroom units. He
� stated there would be a garage for each unit in the building. I
i Mr. Sobiech stated, with this layout of the building and parking, it would �
not be necessary to access off of East River Road. He felt, if East River ;
; Road is imoroved, at some future date, this pian would not interfere with i
the parking at the apartment complex.
Mr. Sobiech stated it has been the procedure, along the entire length of �
, East River Road, to acquire additional easements in order to provide for �
; any future roadway improvements in the area. He stated the easeruerit required
' is 17%2 feet and would recoinmend this be part of the Council 's consideration '
� when acting on the special use permit. Mr. Sobiech felt stipulations should �
. � also be added that the drainage be worked out with the Engineering �
Department to made sure there are no detrimental effects to adjacent �
� i property, and that a solid wood screen fence be installed on the property. � .
, , In conjunction with this special use permit, there is also a variance {
request to reduce the front yard setback from 35 feet to 32 feet. Mr. ;
; Sobiech stated this variance request appears later on the Council 's agenda. ;
; MOTION by Co�mcilman fitzpatrick to concur with the recommendation of the �
, Planning Commission and grant Special Use Permit �78-04 with the stipulation
the City be granted a 17%2 foot easement on property adjacent to East River ',

He stated the variance requests are or "0" lot line for the rear yard ;
and reduction in the number of par ng stalls. M11r. Sobiech stated, presently,
some of the existing boulevard ri t-of-way is being used for parking.
` � . Mr. Sobiech stated the Appeals ommission recommended approval of the sid2 ,! ! �
yard variance from the required 5 feet to "0" lot line and denied the - �
variance to reduce the number of parking stalls. It was not, however, in !
the jurisdiction of the Appeals Commission to discuss parking in the �

Councilman Fitzpatrick felt Little I_eague has been around;a long time and �
didn't foresee this language as a big prablem. Fle though't'perhaps future ',
improvements that would be permanent and eventually accrue to the City
, could be reviewed.
. I Mr. Herrick indicated language could be added to make`the clause more
specific and to indicate that any future improvemenx5 are to be submitted , '
to the Council before they are installed.
Councilman Hamernik felt possibly language to the�effect that this par- '
ticular clause would stand, if the City terminatzd the lease. He stated,
in that way, Little League would then oe proteated if there was an act �
� not to renew the lease.

Mr. Qureshi, City Manager, pointed out that on the first page of the
I lease, paragraph 3, it provides for renewal of the lease for an additional ,
five years; however, on the second page, second paragraph from the bottom
! of the page, it also prevides for termination of the lease upon a 30 day ,'
written notice.
Councilman Hamernik indicated he would �e in favor of the City Attorney �
i looking at this lease ard clarifying l;anguaqe regarding termination and
extension and also clarifying the lan,guage on Page 2, paraqraph 2, regarding
compensation.

i Mr. Klockers stated, according to th�e lease, the Little League Association �
� hds th2 option for rene��ral for an 9dditional five years. He felt it
� ; was important to point out that t�ie Association do`s serve the young people
; in the community and intend� to �ulfill their obligation. He stated, if �
', the City intends some other use of this property, then the City would
� purchase the investment the Association has in the property. '
� Mayor Nee stated the provision for the five years, under the same terms
! and cenditions, �vouid apply f�r the renewal, unless the Ccuncii decided
' i there were some serious problems.
! Mr. Qureshi, City Manager, ii�dicated the Lii:tle Leayue Association is a
, ; , civic greup and they have indicated a willinaness to work w�th the City on
i some of the concerns regard;�g parking and improvements, therefore, hz would
, recorrmend the lease be renewed for another five years.
i MOTION by Councilman Fitzpatrick to renew the Lease Aareement with the Little �
• ' League Association for an additonal five year period. Seconded by Councilman ;
, Hamernik. ;
� 14r. Klockers stated he understands the Council 's concerns and has no qualms
regarding the services provided by Little League in the past and future. He '
; stated maybe, if this wasn't the best a�reemer,t for both parties, the Cit ,

i Attorney would like to draft another lease and the Association would be
' willing to take a'look at it. He thought perhaps they could agree on a
better designed �greement on some of the concerns the Association has and
' some the Council' has.

j Councilman Harr�rnik stated, under the terms r�f the present lease, if the
� Association hds an option to renew, he has no probiem with the lease, but
indicated he was a little surprised at the lang�age contained in the lease.
