Notice is hereby given that there will be a Public Hearing of the
Planning Commission of the City of Fridley in the City Hall at 6431
University Avenue Northeast on Wednesday, July 13, 1977 in the Council
Ciiamber at 7:30 P.M. to consider the following matter:
A request for a Special Use Permit, SP #77-09,
by Sherwood Jordahl , per Fridley City Code, Section
205.051 , 3, D, to allow the construction of a
double bungalow in R-1 zoning (single family
dwelling units) , on Lot 6, Block 2, Spring
Valley Addition, all lying in the South Half

coverage because of his home operation -
M r• Stene said that he had never been ancelled by an insurance
company because of his home business He said that his business
was not even large enough to requir a fire extinguisher . He
said that he indeed had fire extin uishers, but he did so mainly
for his own safety and peace of nd .

MOTION by f1r• Peterson, seconded by Ms . Gabel , to open the
Public Hearing • Upon a voice vote, all voting aye, the motion .
carried unanimously• The Public Hearing was opened at 9: 33 P .M -
Mr• Boardman indicated that the petitioner was requesting a
Special Use Perrnit to enable him to build a double bungalow on
an oversized R-1 zoned lot • He said that the petitioner met
all the code requirements as far as lot size, etc . but that he
needed the Special Use Permit to allow a double bungalow on a
R-1 lot •
Mr• Jordahl showed the Planning Commission a plan of the double _
bungalow indicating a few changes that had been decided since
the drawing up of the plan -
Mr• Peterson asked if Mr• Jordahl would be living in part of the
double bungalow.
Mr• Jordahl indicated that he would be living in part of the
proposed double bungalow.
M�• Herbert Hart of 1450-64th Avenue NE voiced definite objection
to the constructing of a double bungalow on that lot . He said
he had brought his house five years prior after spending previous
years in a double bungalow. He didn' t like the idea of the
constant turnover that went with rental property• He said that
too many times people rent the property that are basically
undesirable . He felt that rental property completely surrounded
by single family dwellings was a bad idea. '

Mr• Langenfeld asked if Mr• Hart was still in objection if the =.
double bungalow was owner occupied• ;
Mr. Hart said that owner occupied would be better but that he �
still opposed• '
Sn answer to an inquiry from the audience, Mr • Jordahl said that `
the double bungalow would be in the $90 ,000 range • He said that
there would be approximately 1 ,0�0 square feet on each floor• `
� Ms . Karla Larson of ?528-?5 Ave NE pointed out that a $90,OD❑ home
would have to indicate that a reasonably stable family would have
to live in the other part of the double bungalow since the rent
would have to be in an awfully high bracket .
Chairperson Harris wanted to know if all the p�operty in the
area had been developed or built on .
M r• Boardman explained what existed near the lot in question .
He went on to discuss where all the homes near the lot in
question were located . .
Mr• Bergman asked if Mr • Jordahl owned the property• �
M r• Jordahl said that he did own the property•
Mr• Langenfeld asked if Mr• Jordahl planned to make the double
bungalow his permanent residence.
Mr• Jordahl said that he hoped to make the house his permanent
residence - He said that he and his family liked the area and
that they would like to be able to build a home that would help
pay for itself• �
Chairperson Harris asked if it would be feasible for Mr• Jordahl
to build a single-family dwelling •
Mr�• Jordahl said that he wanted to build a double bungalow and
did not want to have to consider building a single-family
dwelling •
M�• Langenfeld wanted to know if it would cause Mr• Jordahl an
economical hardship if the request was denied.
Mr• Jordahl indicated that it probably wouldn't cause an
economical hardship but he felt it would be easier and better
if the request was granted.

M r• Bergman wanted to know why the proposed house would have a i
' 60 foot setback from the property line . �

Mr• Jordahl said that it had been recommended to him by the City `
so that his house would be in line with the other houses in the
area• '
At that point there was a discussion amongst the Planning j
Commission and f1r• Boardman regarding required setbacks.
Ms. Gabel aslced Mr• Jordahl if he realized that there was some
incompatibility created by his building a double bungalow in an
area of single-family dwellings. "
Mr• Jordahl said that he felt the main concern of the
neighborhoods regarding rental property would be the undesirability
of tenants - He felt that there would be no problems involved
since the rent would be in the upper bracket numbers .
A person from the audience stated that he felt the double bungalow
would actually be a nice addition to the area - He didn't feel
it would depreciate the value of the other homes in the area ?

Ms. 6abe1 asked if Mr• Hart felt any differently about the « '
proposed double oungalow after hearing the different discussions•
Mr- Hart said that it was still a shock . He said that perhaps �
it would really be fine and everything would work out, but he '
still felt it would be nicer if a single-family dwelling was !
constructed on that lot • �
MOTION by Mr • Langenfeld, seconded by Ms . Gabel , to close the
Public Hearing • Upon a voice vote, all voting aye, the motion
carried unanimously• The Public Hearing was closed at 9:55 P .M .
MOTION by Mr• Langenfeld, seconded by Mr • Peterson, that the
Planning Commission recommend to City �ouncil the approval of
the request for a Special Use Permit, SP �77-09, Sherwood Jordahl : �
Per Section 205 .�51 , 3D � of the Fridley City Code, to allow the
construction of a double bungalow in R-1 zoning {single family
dwelling units} , on Lot 6, Block 2 , Spring Valley Addition, the
same being 1441-1443 Rice Creek Road N .E .

j Mr. Sobiech explained the map in the agenda book was i correct and the
property is act�laily on Pandora Drive and not Rice C ek Terrace.
i Mr. Sobiech stated the request is for a special us permit to retain the use
, of both ex,isting attached garages and to permit a existing drive to the original .
, � garage to remain as is. He stated a building p it was issued in May of 1972,
and at that time it was stipulated that the dri eway to the original garage be
' removed and this earage be used just for stor e. He explained that stipulation
; was not met; and due to concerns of resident in the area, the petitioner was
advised he would have to come before the Co cil to obtain a special use
� permit to allow the original driveway and o use the original garage for storage.
j Councilman Hamernik indicated he has tal ed to the property owner and residents
in the area and has no objection to thi special use permit. '
' MOTION by Councilman Hamernik to conc with the recomnendation of the Planning
i Commission and grant SP #77-08. Seco ded by Councilman Fitzpatrick.
Mr. Stene stated he has a petition rom residents in the area and only one
resident objected to this request. He believed the complaint may have arisen
because he had made a canplaint o a neighbor's bee hives.
' Councilwoman Kukowski stated tha was not the property owner that had contacted
. her, but others that signed the petition had called and were concerned about
� Mr. Stene running a business f m his home. She stated she believes the problem
has been resolved.

, Mr. Sobiech exp ' this is a a ow cons ruction of a double bungalow
in an R-1 zoning dis ric a -1443 Rice Creek Road N.E. He stated, at
the he�ring before the Planning Commission, there was some objection from the
residents in the area. He submitted a proposed plan for the double bungalow.
. � Councilman Schneider asked why this was handled as a special use permit, as opposed I •
to a rezoning.
Mr. Sobiech explained there is a section in the Zoning Code which allows a two
; family home in an R-1 district, with a special use permit. �

j Councilman Schneider stated he talked with most of the residents in the immediate
iarea and although there is a general feeling in opposition, it certainly isn't a
strong feeling; with the exception of two people. i
jMr. Sobiech stated, from a pianning standpoint, it is a permitted use as far '
� as the Zoning Code. He indicated the dwelling would nat look like a multiple i
� unit and would maintain the single family effect. �

' Councilman Schneider stated concerns were that this could be rental property ,
, and that there are other lots in the area where there may be petitions to construct
j double bungalows, if this special use permit is granted. i
Ms. Karla Larson, 7528 75th Avenue N.E., indicated she was a disinterested party, �
but was at the Planning Commission meeting when this item was considered. She
� brought out the cost of the double bungalow was to be in the $90,000 bracket
' and felt the rental would be such that you would not obtain any undesirable
tenants. ;

� Mayor Nee explained this was brought out in the Planning Comnission minutes. i
� ' Mr. Herrick felt the Council should not grant this request, unless there is !
' something unusual about the situation. He felt, if the special use permit �
i '
is granted, it should be justified on the basis of son,ething unique about the ;
lot and so it would be sensible to allow a double bungalow. j
I Mr. Sobiech stated the lot is over 30,000 square feet, but it could be a problem I
to allow for two single family lots in a north/south direction. '

Mr. Sobiech mentioned another stipulation which might be added is that the �

only. He stated the interpretation the staff now uses is that this � ecial use

I permit is for a particular use and if anyone else wanted to use the !�acility for
( something other than this use, it would be necessary to come back b�fore the
I Council. However, if the property were used for the same type of cyisplay that
l is now proposed, it would not come back to the Council. �
. Mr. Herrick, City Attorney, agreed with the interpretation by th�staff in ;
this regard. �
Councilman Fitspatrick questioned if these stipulations k�ere a cepted by the �
property owner. Mr. Wormsbecker, 13401 Southridge Road, stat d he is involved '
• in the lease and the property owner is aware of the stipulati ns, and he does
�` not think there will be any problems. �

Mayor Nee questioned the amount of square footage to be u�d by the Apache '�
Camping Center. Mr. Sobiech indicated they would be usi� about 4,000 square �
feet in the rear of the building. ;
Councitman Fitzpatrick indicated the request is for a p rticular use of a portion '
of the building and eventually there would probably be a request for use of the
r�naining part of the building.

Mr. Sobiech explained the zoning of the property is -2S. ;
Mayor Nee stated he personally does not like the i�ea as he has a bad feeling
about display when they`�are trying to keep it as� residential area. He questioned
� . if the neighborhoad agre� to this special use p mit. ,

• � Ms. Mary Martin, 133 Stonybr�ok Way N.E., felt ,the neighborhood realizes something
will be going in the building�'�nd this seemed �o be the best alternative.
She stated it is zoned commerci�d�, and resideNtiai would be the onTy better use.
She indicated, as far as she is c�i�cerned, th'is business is probably not going
to bring in a lot of people and the`�{�etition�r has agreed to only two vehicles
in front of the building. She stated'•�he residents are probably in agreement �
that this is the best possible use at tNe. moment. She requested an added ' .
stipulation that when the camping center is. no longer in business, the special
use permit would expire. i

MOTION by Councilman Fitzpatrick to concur with 'the Planning Commission and �
grant SP #77-04 with the nine stipulations as outlined in these minutes and
with the added stipulation that this permit is issued to Apache Camping Center .
and the special use permit shall cease,' if the use changes. Seconded by '
Councilman Hamernik. Upon a voice vote, all voting aye, Mayor Nee declared '

of a 27' x 24' attached garage to be used as an accessory building at 6040
Benjamin Street. He stated the Planning Corrrnission held a public �earing
and recormiended approval of this request. i
I Mr. Sobiech presented a preliminary plan for construction of this acc� ssory �
� building. He explained the new building and driveway will be off Fern�le
Avenue.

� on the lot, size of the lot, and Kerry Lane exists directly opposite to this lot.
MOTION by Councilman Schneider to concur with the recorrmendation of the Planning
Comnission and approve SP ,#77-09 because of (1) the size of the lot in question;
(2) the drainage ditch at the rear of the lot and the drainage easement on the
� east side of the lot; and (3) the unique hardship of lights from traffic on
I Kerry Lane shining on the lot. A further stipulation of the special use permit ;
� is subject to the City administrative staff approving the plans which shall be ;
substantially similar to the one presented this evening. Seconded by Councilwoman �

this request and recommended appresval. He stated it was suggested to the petitioner �
that possibly additional property could be acquired to the north to eliminate
any need for a variance. He stated the petitioner had contacted these persons,
but apparently there was no intkrest shown in selling the property. i
Mr. Haggertyappeared before the Council regarding this lot split. He stated !
I the property, the way it exists now, does present a hardship. He stated, if �
� , Lakeside had gone through, they would have had a fairly decent lot; however, �

, ' Mr. Herrick, City Attorney, explained when the inclustrial revenue bonds were
� approved for Safetran Systems Cor�poration, there were complications because the '
j property had a Torrens title and the landowner did not have a sufficient survey
� to split off the property that the building for Safetran was to be constructed on. '
� Therefore, the mortgage was giv�'n on the entire tract and it was agreed the owner ', •
had the right, at some future time, to have the lease and the mortgage amended to
have it apply simply to the newiconstruction and the lar.d for this construction.
� He stated they have elected to exercise that option so this is the reason these '
Iamendments to the indenture and lease is before the Council. '

j Mr, Herrick stated it was unde,hstood between the parties, in order not to delay ,
the start of construction unti'1 the property could be split, that the mortgage
' woulcl be on the entire parcel !and then would be split off. He stated the City still
