APPROVE PLANNING COMMISSION MINUT�S: OCTOBER 5� 1977
MOTION by Ms. Schnabel, seconded by Mr. Lan�enfeld, to
approve the October 5, 1977, Planning Commission minutes.
Upon a voice vote, all voting aye, the motion carried
unanimously.
RECEIVE APPE�LS COT��IISSION MINUTES: OCTO�ER 11 , 1977 '
PJIGTION by Ms. Schnabel, seconded by Ms.' Shea, to receive
the Appeals Commission minutes of Octo�er 11 , 19?7.

� Ms, Schnabel pointed out to the Ccmmi�ssion that much time
had been spent at the Appeals Commis�ion meeting in regards
to the variance request to increase ;the maximum height of
a free standing sign. She said th�� members of the Appeals
Commission vrere concerned because ,of the proposed new sign
ordinance and ti�rere concerned with,%such a high sign in a
residential area.

MOTION by Mr. Bergman, seconded by Ms, Schnabel, to open
the Public Hearing. Upon a voice vote, all voting aye, the
motion carried unanimously. The Public Hearing was opened
at 7:1�$ P�M.
Mr. Boardman explained that the request was to build a
garage on an existing lot �vhere there vras an existing
structure. He said that the entire area was in the
flood plain and according to the restrictions for a
flood plain area there vrould be no building or structure that
could be built in the flood plain . unless a Special Use
Permit was secured. He said that there was eight regulations
. on building in the flood plain. He went on to read the
regulations and gave Staff' s response to many of the
regulations as to ho�v they effected the requested garage.

Mr. Boardman said that basically Staff didn't feel there would `
be a lot of problems vrith the particular situation. He
said that the public hearing process was being follovred�
notices had been sent to the Commissioner of Natural
Resources ten days prior to the Public Hearing and Staff
would notify them of action taken ten days after the
action rras taken. He said that all the proper procedures
were being follo�.ved. He pointed out that Staff had not
heard from the Commissioner and it vras being assumed that
there tivere no objections or input on the request.
Mr. Joseph Shun of 2500 Murray Avenue N.E. , representing
Inter City Builders was present at the meeting. He
indicated that they had agreed with the Building
Inspectors to use the material he required and to follo�v
all building codes.
Ms. Schnabel asked the purpose of Staff requesting that
Inter City Builders obtain the neighbors� signatures.
Mr. Shun said that the survey they had tivas a proposed
survey. He said that tirithout a verified survey the
City required 1� times the code requirement for setback
and also the neighbors' signatures tivould be required.
He presented Mr. Boardman rfith the required signatures.
Mr. Langenfeld asked if there vrould be any landfill used�
Mr. Shun said that they would need apprnyimately ten yards
of fill to bring the garage up to the street grade.
Mr. Langenfeld asked erhat the fifty year average in terms
of 100 feet� etc, regarding the flood plain effecting the
property in question.
Mr. Boardman explained that on a map that each member
had� a dotted line had been inserted. He said that line
represented the approximate 100 year flood level that ti��as
required of the City to maintain by the State of Niinnesota.
He said that City vaas in the process of monumenting that
elevation out in the Field . He said that there lras some
building going on in that area however, in most cases
no special use permits are being requested.
Chairperson Harris asked if the area was in the "dike area��.
Mr. Boardman said that it was. �
Chairperson Harris asked if part of the requirements of
the building code was to tie the structure to the slab.

Mr. Shun said that they vrere putting approximately $300 �
above what the same garage would have cost in a
different area. He said the gara�e would have water- �
proof plates, studs, sheetings, and special anchors �
all over the structure. He said that the driveway to b
the garage vrould be off of Broad avenue. �
Chairperson Harris asked if it tivas in the plans to �
hard-surface the drivevray. �

Mr. Shun said that it probably wouldn�t be done yet #
this fall, but that the approach would be blacktopped. ;

Mr. Langenfeld asked if there tivas an urgency for the #
building at this time. He asked the question due to �
the fact of the oncoming winter and spring floods. ;
Mr. Shun said that they vrould like the garage built
now because of the �vinter �x�eather that is approaching. ,
MOTION by Ms. Shea� seconded by Mr. Langenfeld, to close
the Public Hearing. Upon a voice vote, all voting aye,
the motion carried unanimously. The Public Hearing was
closed at 8:02 P.M.
Mr. Langenfeld felt that in the particular case at hand,
that even though the request is for a garage in a CRP-2
zoning� it cJas on the upper portion of the Flood Plain
area. He said that the petitioner• vras taking all the
necessary precautions as far as impending flooding� and "
they were meeting all the requirements set forth by the
DNR and the stipulations set forth by the City of Fridley.
He said that the petitioner �vas fully aware of the area '
in tivhich the structure was being erected and kne��r the `
possible hazards that could exist. He could find no '
• problems with granting the request.
MOTION by Mr. Langenfeld, seconded by Mr. Bergman, '
that the Planning Commission recommend the approval of
the request for a Special Use Permit, SP #77-13, Inter City
Builders: Per Fridley City Code, Section 205. 157, 5, D to
a11oVr the constzuction of a detached z4 ft by 22 ft garage .
in CRP-2 ( flood plain) , on Lots 1-1�, Block t'J, Riverview

property on that lot from the st ndpoint that the
lot was located on Rice Creek R ad. He said that he had
had a lot of interest shown for the construction of a
double bungalovr.

Mr, Brickner said that the c�ist tvould be in the $100,000
bracket. Ae said that the dbuble bungalovJ ti��ould be owner
occupied. He said that the 'e were many requests for
double bungalows being made�available in that area.
Mr. Bergman asked if he was��building the double bungalotiv
on speculation. �

Mr. Brickner said that it tv�as speculative. He felt that
the City of Fridley needed more double bungalotiv type
dwellings. He said �rhen t�ere ZFras a nice looking building
! in that price range scatte�ed throughout the City on the
more busy streets� it woul� be making the best use possible
for those particular lots. He also said that that type
of construction r�ould actujall� increase the value of some
of the homes in the area. ;

The Planning Commissiqn recoinnended approval of the request with the understanding

Mr. Sobiech stated correspondence has been received from the Department of Natural

regulations were followed.

owner originally owned bo�h lots and at the pres nt time, the existing driveway
indolves both properties. The intent of i:he lo split is to attach a certain arnount
of property and existing driveway to Lot 7 to eisure that. the driveway goes with
the proper residence.

Ms. Carla Ekdahl of the State Crime Cont ol Planning Qoard presented a slide presentation
regarding community crime urevention whi h ���as the subject of a study made in Minneapolis.
She stated their Board worked with the ity of h�inreapolis to analyze the crime problem
and make recom�rendations on what the Ci y might do to lower the crime rate. She indicated
they would be in a position to offer t aining and technical assistance in working with
the City staff in iinplementing a crime pre��ention program in Fridley, if the Council has �
an interest.
Ms. [kdahl stated that Ms. Carla Ott, Police Technician in Fridley has recommended a
committee to study crime in Fridley nd she would be hap;�y to work with the City in
pursuing such a proyram.
Mr. James Hill , Public Safety Direc or, stated the Crime Control Board was requested to
make this presentation to the Counc 1 so i:hat the City would have the advantage of seeing
what they had developed. He stated, in law enforcement, they are continually trying
to reduce crime and felt the citiz s should get involved. P•1r. Hill stated, through
the research of Carla Ott, he is p oposing to the Council an "umbrella concept" involving
a crime prevention committee compo ed of citizens, individuals representing the Police
� Department, members o` tl�e Plannin Department, ar�d members of the civic and business
� conimunity, to actually view the va ious crime problems in the City.

P1r. Qureshi suggested the staff ���ork with the ovrner of the oroperty regardin� a
traffic pattern at this locati��n that may requi,�e only one entrance off of 73rd and
provide some type of 4•rider e,ccess off of T.H. ;;47. He felt they should have a irhole
picture on tJhat the total use of the property t�rould be and to work with the owner on
a mcre acceptable traffic oattern.
Couricilman Hamernik indicateu he has a problem �,�ith allowing the curb cuts in that
area. May�r Nee indicated he shared Councilnian liamer�nik's concer�ns antl hoped a�iother
altcrnative could be werked out.

' Mr. Dick Walsh, representing Real Estate 10, indicated there was a n�istake on tt�e
location of the sign, and there is only one location on the property suitable for
the sign which would be west of the building.
Mr. Walsh stated the variance is recuested from the 6 foot height in order to get the
sign above ground. He indicat.ed the purpose is to have an illuminated sign to identify
, the building and indicated they do not wish to put up anything that wouid detract from
this structure.
Councilman Schneider indicated h�s primary concei�n is surrounding residential properties.
Mr. Walsh irdicated they would like to get the sign out of the ground to a heiyht
acceptable to the Council.
' Mayor Nee asked Mr. l+lalsh if he would be willing to work with Councilman Schneider
regarding the positioning of the sign. Mr. Walsh indicated this would be satisfactory
with him and he could meet with Councilman Schneider at any time.
