divi5ions-Streets & Utilities Subcommittee recommend approval to the
Planning Commission of the request for a Zot split , L. S . �74-04, by
Mrs. Mildred Mustonen , to split off the Westerly 75 feet of the
Easterly 149 . 89 feet of Lot I1 , Block 2, Spring Lake Park Lakeside,
to make another building site, Z579 75th Avenue N.E. with the stipulation
that there is a survey made of the Zot. Upon a vo�ce vote, all voting

2. RFQUEST FOR A LOT SPLIT, L.S . #74-05 ,>SPRINGFIFLD HOMES : Split
off the Northerly 4 feet of Lo nd add it to Lot 3 , B1_ock 1 ,
Innsbruck North, the same being 5643 North Danube Road N.E.
No one present to represent the petitioner.
Mr. Clark said the petitioner had put in the foundation of this
home and wher there was a verification survey, they� �found that they
. had used the wrong front iron so the house could not meet the side .
yard requirement. Lot 4 is a 90 foot lot and they were able to purchase
4 feet from this lot to gain the 10 foot side yard for this existing
foundation to meet the code requiremEnt.: This will make Lot 4 86 feet
which is not out of context with other lots in this area. If this
lot split isn' t granted they will either have to ask for a variance
or move the foundation.
� � Mr. Clark said if they would look at the map in their agenda
they could see where the radius point was used to locate this foundation
instead of the lot iron.

No one was present to represent the petitioner.
Mr. Harris said the foundation is already in for this house
and they used the radius iron instead of the lot iron to locate the
house on the '.ot. They got the house 4 feet too close to the property
line to meet the sideyard� requirement. This is the reason for the
lot split request. -
Mr. Baardman said that Springfield Homes o�ans both Iots and Lot
4 will still have a front footage of 78 . 36 feet whi.ch is comparable
to other lot sizes in this area.
� Mr. Drigans said he thought this should have been handled as a
variance rather than a lot split. Ther_e will be a lot of legal work
involved in a lot split and a variance could be handled locally.
Mr. Harris said it would be easier to obtain mortgag� money on
a house that meets all the setl�ack re�uirements than one that has
a �rariance . Nir. Drigans said does that mean tha.t every variance
that is granted on a house may make it di:�ficult to sell? I�Ir. Harris
said that usually no additional land is ��vailable and a variar�ce is
g.ranted on a hardship that is requested by the progerty o�7ner. On
this request, there is property available so that a variance is not
necessary.
Mr. Boardman said that by requesting this lot split, both lots
� 3 and 4 will still n�e�t the code, and the petitioner felt this was
better than asking fo.r a variance and havi_ng a house that, did not meet
t.he code on the side yard requirement.

13 . RECEIVE PARKS & RECREATION COMPRFHENSIVE PARK PLAN
Mr. Boardman said the Council had this on their agenda on May 20 ,
1974 and they delayed any action on this plan until surveys are done
and there is a more detailed study on the bikeways and pathways and on
parlc usage. This delay will be between six and seven months .

He said that all the recommendatibns that were made by the Planning
Commission �,iere incorporated into the Plan by the Parks & Recreation
Commission, except for the changing of the name.
M.r_ . Drigans said they could discuss this. Nr. Harris said that
he would rather wait until they had the same information that the Council
had requested.

14. HYDE PI3RK STUDY
Mr. Boa.rdman said this study was requesf_ed by the City Council
because they had a request to develop a sinc,rle family residence into
a commercial development, and this location did not meet the requiremen�:.A>
of cor�u-nercial developmen.t. The Council did deny this request and then
they requested that the Planning Department do a study on the coir�mercial
area of Hyde Par3: ta determine the best way to combine lots so this
area could be developed.
Mr. Boardman present.ed a map of �iyde Park showing the location
of_ the R�-?_ , R-3 and comme.r.cial area. He said that what the Planriing
Depart���l�nt did was to go th.rough this area and locatL al1 the str_uctures
presently on these properties to det�rmine what type of land use we
had. Yello�a designat�s residential , orange designates aPartments and
red designates commercial.
Chairman Fitz�atrick sai.d the request that the Council received
was in the commer�ci_al area. Mr. Boar.clman said it was , but what ch.e
petiti.oners wanted to do �aas turn a residential. structure into comrnercia.l
and th.ere was a problem oL variances and that the lot size did not
meet the commercial requirements of 20 , 000 square feet or a lot width
of 160 feet. Th� Plan.ning Department divided the parcels up into
usable sites accordinq to presentl.ot lines to show what would be feasible
for someone to buy and sti.11 leave a usable site, without request ling
a vari�nce. The map presented shows the plan we came up with.
Mr. fIarris said that this study only concerns the portion of Iiyde
. Park that is zoried commeicial then. � Mr. I3oardman said yes .
Mr. Boardmaz� said the dotted lines on the map show ownership of
the lots. �
Mr. Lindblad asked if i:he Council or the City had any long range
program for this area? It is suc.h a blighted area. Mr. Boardman said
that �the only way that we ar_e going to be able to do anything in this
area as far as controlled development is to cigher stick to a concept
plan like this, which we still might have some problems with, or go to a

The City Manager said the recommendation of the Planning Commission would be j

MOTION by Councilman Starwalt to concur with the recommendation of the Planning
Commission and direct the applicant, Darrel A. Farr Developmeni: Corporation that
the concept is acceptable, but this should be handled as a replat rather than a _
lot split application, and be brought back in this form for Council consideration.
Seconded by Councilman Utter. Upon a voice vote, all voting aye, Mayor Liebl '

The City Manager explained the Planning Commission is looking at the over all ;
development plans of the Hyde Park area and they thought the Council may want to : �
have a hearing on the n�atter. }

Councilman Nee said he was very encouraged by what is being done. He said it may �
be good at this time to get the neighb�rhood reaction before the plan is coinpletly �
� laid out. He explained the area people would not feel any ownership of the plan �
� if they were not involved in the discussions. He stressed, they shouid have some �
! input before the plan is finished. He thought the plans would have a better chance
