It was zoned single family as were most of the properties in the immediate area. The request was for a second accessory structure which was over 240 sq. ft. MOTION BY MS. GABEL, SEC DED BY MR. WELLAN, TO OPEN THE PUBLIC HEARING ON P.S. #85-04. UPON A VOICE VOTE, ALL VOTIN AYE, CHAIRWOMAN SCHNABEL DECLARED THE PUBLIC HEARING OPEN AT 7:47 P.M. Mr. Robinson stated the proposed lat was just west of East River Road and north of existing 75th Way. It involve 8 lots and the land area was approximately 3 acres, approximately 2.3 acres o that being platted into new lots. The zoning was single family as were all he properties in the immediate neighborhood. Mr. Robinson stated the proposal was to plit the parcels into 8 lots , 7 lots will be used for new homes and Lot 4 wit an existing house on it will remain. .All the lots exceed the required lot area f 9,000 sq. ft. The smallest lot was 9,525 sq. ft, and the lots ranged from at up to over 16,000 sq. ft. All the lots were 75 ft. or more at the setback ich was regUfred by code. The road right-of-way was 50 ft. wide and this wou d provide a 36 ft. wide street, e COUNCIL MEETING OF SEPTEMBER 23, 1985 new street (Ashton) . Fe stated the proposed use would be for mini-storage facility. Mr. Flora stated the Planning Commission has recaended approval with a stipulation that the park fee be paid before the plat is recorded. Mr. Flora stated there is an existing billboard sign locat d adjacent to the property by the railroad an 694, and it is suggested thi be removed as an added stipulation to the plat. MDT10N by Councilman Fitzpatrick to approve final plat P.S. #85-03, Great Northern Industrial Center East, with the stipulations that the park fee be paid before the plat is recorded an the existing bigboard sign be removed. Seconded by Councilman Schneider. Mr. Jon Monson, representing the developer ofa mini-storage facility, stated he was here on the developer ' s beh if and not representing Burlington-Northern, but wished to share wha, he felt were Burlington Northern's feelings regarding the billboard. Aie stated, initially, it was their hope to obtain the property on which ;Ehe billboard is located, but were unable to do so and understands the r,eason was because the railroad wants that corner for the billboard. Mr. Monson stated this isn't part of th plat and hoped it would not slaw dawn their development. No persons representing Burlington orthern were present. UPON A VOICE VOTE TAKEN CN TH ABOVE MDTION, Councilman Fitzpatrick , Councilman Schneider, Council Barnette, and Councilman Goodspeed voted in favor of the motion. Mayor N abstained from voting. Mayor Nee declared the motion carried by a 4 to vote. Mr. Flora stated, in conj ion with the above plat, there is a request for a special use permit, #85-08 , to allow outside storage at this mini-storage facility. Mr. Flora stated the ilding area would be 127,930 square feet covering 37% of the lot, with ni parking stalls. He stated two locations would be used for outside storage and the entire facility would be fenced and screened with vines and sl s. Mr. Flora stat d the Planning Commission recommended approval with a stipul ati on th t the landscape plan be approved by the City. MJTION by cilman Fitzpatrick to approve special use permit, SP #85-08, withthe ipulation that the landscape plan be approved by the City. Seconded Councilman Schneider. Mr. shi, City Manager, asked if gates would be across the tracks. Mr. Monso stated there has been no final determination, except Burlington Nor ern understands their request is for gates across the tracks due to the i requent use of that line. Qureshi stated he wanted to make sure there was no problem with access -5- e COUNCIL MEETING OF SEPTEMBER 23. 1985 and the only access to block 1 would be fram the southwest area of lock 2 of this development. Mr. Monson stated that is what they expect. He stated th gates could go across the outlot property line, which would requir opering, or else perpendicular to the"track itself. He stated, one wa or the other, they will be granted an easement frau Burlington Norther o cross. He stated he is well aware cf the limitations, but Burlington rthern made assurances to then that their business would'nt be disrupted the tracks. Mr. Monson asked if it was the City's goal at there wouldn't be a request for access by way of Plymouth Minnesota Mr. Qureshi asked if that was what ey are thinking. Mr. Monson stated that block 1 is served over tha lot. Mr. Qureshi stated if ther s any change, he would want them to come back to the City. He stated of the requirments of the plat is access to a public road. Mr. Monson state , in terms of pure access, the only acces to the block 1 is over the frac and outlot by way of an easement and access beyond that isn't cont ated now or any other time. CONSIDERATION OF SPECIAL USE PERMI SP #8 TD ALLOW CONSTRUCTION OF SECOND ACCESSORY BUILD 1461 RICE CREEK ROAD N.E. , BY HERBERT LENNOX II: Mr. Flora, Public Works Director, stated this special use permit is for property located just north of Rice Creek Road and east of Old Central. He stated the request is for a second accessory building which was over 240 square feet and would be located in the rear yard. Mr. Flora stated the petitioner plans to use this structure as a garage for cars, a boat, snowmobile and trailer, etc. , and would put a hard surfaced drive to the structure. W. Flora stated the Planning Commission recommended approval with the stipulation that a hard surface driveway be installed to the new structure. Councilman Barnette questioned if the lot had been split. Mr. Lennox stated, at some future date it would be split, and that was the reason for his position of the structure. CO IDERATION OF AN ITEM FROMI ION MEETING F AUGUST 27 1985: VARIANCE TO NCREASE MAXIMUM ALIDNABLE FOOTAGE OF A SIGN TO ALdQW AN EXISTING SIGN TO BE CHANGED AND TO REMAIN ON ITS SENT LOCATION 25 VIRON ROAD N.E. MQBILE HOMES USAd Mr. Flora, Public Works Dire or, stated in July, the Council denied a request for a variance for a 00 square foot pylon sign. This is now a riew variance request to reduce a size of the sign to 160 square feet. Mr. Flora stated the code req ' res a sign not in excess of 80 square feet. Mr. Flora stated the itioner states the hardship is "the existing sign with trim, in place since 1970, exceeds 300 square feet. It is their proposal to remove a trim, two panels and repaint the copy. Since the property is undev oped and presently leased for use as a retail sales lot, any other method s not econimically feasible. In addition, the proposed sign would be nsistent with those signs in the surrounding area." Mr. Flora st ted the original sign was installed sometime prior to 1972. He stated Ca e Mobile Hames petitioned for a variance to keep the sign and it was aPpr ed with the stipulation, one being that the variance was only approved for Castle Mobile Hanes. He stated, since they are no longer in busine , it has been requested the sign be brought into compliance. Mr. Flora . ated Hart Custcan Hames and All Seasons Hames have signs which are 96 and 92 square feet respectively. Mr. Flora stated the Appeals Commission felt the sign was twice the size as -7- COUNCIL MEETING OF SEPTEMBER 23. 1985 other mobile hone sales lot signs in the area, and was not consiste with the code, and recommended denial of the variance request. CONSIDERATION OF APPROVING $10,000 PARTICI ATION IN IMPROVEMENTS TO LOCKE PARK WITH ANOKA COUNTY: Mr. Qureshi, City Manager, stated the unty is proposing improvements for the entrance and parking facilities i Locke Park. He stated the project calls for establishment ofanew en ance on 71st Avenue just east of the City garage, as well as installat' on of concrete curb and gutter at the entrance parking lot and suggest that this item be referred to the Parks and Recreation for information. Mayor Nee asked if the Parks d Recreation Commission was involved in the agreement between the City d County for the maintenance of Locke Park. Mr. Flora, Public Works irector, stated they were not involved, but believed it was discusse with the Commission by Dr. Boudreau, Director of Parks and Recreation.
