Mr. Robinson stated the driveway would have to be installed before the garage could be used and this is required under the City Code.- t Mr. Claesgeng stated construction on the garage probably wouldn't begin until October as he will be going on vacation for the next several weeks. He stated he wanted to use the garage this winter, however, didn't know if it would be too late in the season to install the hard surface driveway. Mr. Billings asked Mr. Claesgens if it was his intent to install a hard surfaced drive. Mr. Claesgens stated it is in his plans, Mr. Billings stated it is almost impossible to see the garage from the street due to the trees and foliage. He felt if Mr. Claesgens was unable to install the driveway this construction season, a stipu- lation could be made that it be completed by a specific date next spring. Mr. Robinson stated he could not see any reason why the driveway couldn't be completed this construction season. He stated if it wouldn't be completed until next spring, Mr. Claesgens may have to post a performance bond to guarantee this would be installed. Mr. Claesgens stated he didn't expect the garage to be completed until October 15. He also stated in the special use permit he requested a garage/carport, however, has decided this structure will be a double garage. Mr. Robinson stated this would not be a problem as it is within the requirements of the Code. Ms. Sherek thought perhaps a stipulation of the special use permit was that the hard surface driveway had to be installed by November 15 or else the petitioner would have to post a performance bond. Mr. Betzold asked who was the contractor for construction of the garage. Mr. Claesgens stated it was Inter-City Builders. He stated the garage would conform to the hip roof construction of his home and the siding would be 12 inch masonite lap and painted to match the house. MOTION BY .MR. KONDRICK, SECONDED BY MS. SVANDA, TO RECOMMEND TO CITY COUNCIL APPROVAL OF SPECIAL USE PERMIT, SP #86-11, BY ROGER CLAESGENS, WITH THE FOLLOWING STIPULATIONS: PLANNING COMMISSION MEETING, AUGUST 20, 1986_ PAGE 3 1. DISCUSSION OF ADDITIONAL 1986 COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS: Mr. Robinson stated the City is being allocated another $18,5 in 1986 CDBG funds. He stated a recommendation for the proposed us of these funds must be submitted to the County by September 12. Mr. Robinson stated the previously authorized 1986 CD funds have been allocated as follows: Human Service Grants 31,588 Crime Prevention - Security Hardware 15,500 Plaza Center/University Corridor Study 10,000 Riverview Heights Park Development 24,400 Locke House Restoration 8,000 He stated several areas were considered use these additionals funds such as restoring the $8,000 to the Pla a Center improvement as this amount was taken for the Locke House storation. He stated the other area was in conjunction with t e Mississippi/University Avenue improvement to cover the costs of oviding underground power lines. Mr. Robinson stated a meeting w held with the Director of Springbrook Nature Center and because of a costs involved to restore the Center, it is recommended the entire 18,544 be allocated for this purpose. Mr . Robinson stated thous nds of trees were destroyed in the July 18 tornado and options are ow being considered for the clean-up. He stated another priorit was to restore the handicapped trail. Ms. Sherek stated s e reviewed the damage at the Center and felt the restoration of th handicapped trail should be one of the priorities. Mr. Robinson s ted the restoration of the handicapped trail would be the easiest t justify for using these CDBG funds, however, he felt there shoul be some flexibility in the use of these funds. Mr. Svan stated he agrees the funds 'should be used at the Nature Center d for restoration of the handicapped trail. MOTIO BY MR. KONDRICK, SECONDED BY MR. BETZOLD, TO RECOMMEND TO THE CI COUNCIL THAT THE ADDITIONAL $18,544 IN COMMUNITY DEVELOPMENT BL K GRANT FUNDS BE ALLOCATED FOR EXPENDITURE AT THE SPRINGBROOK URE CENTER. PLANNING COMMISSION MEETING AUGUST 20 1986 PAGE Mr. Billings stated to allocate the funds to the Nature Center is certainly a worthwhile cause, but wondered if it wouldn't fie bett to submit a list of possible uses for these funds, rather than make a specific recommendation. He felt it would give the Cou cil some discretion, if they felt there were other uses for thes funds, without being on record as voting against the Nature Cerate Mr. Robinson stated the City Council is always faced wi these decisions as far as following the recommendations of a Commissions. UPON A VOICE VOTE TAKEN ON THE ABOVE MOTION, ALL V _ED AYE, AND CHAIRPERSON BILLING DECLARED THE MOTION CARRIED NIMOUSLY. 3. REVIEW OF SP #85-16,- BY MINNESOTA DEPARTMENT 0 JOBS AND TRAINING: Mr. Robinson stated the Commission requeste this special use permit be reviewed in August. Mr. Robinson stated the stipulations h e, basically, been met except for an improved wall sign. He stated taff is working with the petitioner on this stipulation. Mr. Robinson stated the petitione has an agreement with the U. S. Swim and Fitness Club for overfl parking. This information was submitte as an update to the Commission and no official action was needed. 4. REVIEW OF SP #85-13 BY NO FREEWAY INVESTORS: Mr. Robinson stated the ommission requested this special use permit be reviewed in August. Mr . RECOMMENDATION OF CONTRACTORS FOR THE S.0 R T SITE AND THE CURBSIDE RECYCLING PROj9RAM FROM THE ENVIRONMENTAL QUALITY COMMISSION: Mr. Robinso stated two proposals were received for operation of the S.O.R.T. s te, one from Blumenthal and Sons and the other from Earl Frank. H stated Mr. Svanda may wish to make this presentation to the Comm ssion. Mr. Sv nda stated the Environmental Quality Commission's recommendation was t accept the proposal of Blumenthal and Sons to operate and main- tain he S.O.R.T. site for the next five years as they felt it best ser s the needs of the City. • 0 COUNCIL. err: OF SEVIEMBER 8. 1986 Mr. Robertson, Community Development Director, stated the Planning Commission reviewed allocations for the additional $18,544 which the City will receive under the Community Development Block Grant program. He stated several areas were considered where these funds could be used and the Commission unanimously endorsed this allocation for renovation at the Springbrook Nature Center. He stated the Commission felt a high priority was restoring the handicapped trail. Councilman Barnette asked if a decision had been made regarding removal of the wood at the Nature Center. He stated he is receiving requests frau residents who wish to cut the wood. Mr. Flora, Public Works Director, stated if residents a atallowed to cut the wood there may be a policing problem as someone hast wch that good stock is not removed. He stated another consideratio was the question of 1 iabil ity and damage to new growth. Mr. Neaman, City Attorney, stated even if a w ' er is signed, there still is the question of liability. Mr. Qureshi, City Manager, stated the City is reviewing several options and questions f ran residents should be diO cted to Jim Hill, Civil Defense Director. He stated there probably wi l be some definite answers by the next Council meeting. G - RDCYCLIM PROGRAM: AND RECOMMENDATION ACMR FOR THE SORT CENTER: Mr. Flora, Public Works Di ector, stated the City rebid their contract for curbside recycling and current contractor, Beerman Services, did not submit a bid. He stat a formal bid was received from Super Cycle for $2,700 per month or $ ,400 a year. He stated in further negotiations, the price per morph for beide was lowered to $1,500. He also stated if Super Cycle was to exree 50 tom a month, for two consecutive months, the City and Super Cycle w d renegotiate the contract, Mr. Flora stated this bid is within budge limitations and staff would recommend Council authorize the City to ente into a contract with Super Cycle for curbside recycling services unt' June 30, 1987. He requested Council consider the resolution to contin the curbside recycling with a new contractor. NDTION Vy Councilman Fitzpatrick to adopt Resolution No. 87-1986 to continue the cu6mide recycling programs for Fridley with a new contractor. Seconded by Councilman Schneider. He stated the Planning Con mission reviewed this request and has recotrrnended approval with two stipulations, which he outlined. M)TION by ODuncilman Fitzpatrick to concur with the unanimous reooscm�endation of the Planning Commisson and grant special use permit, SP X86-11, with the following stipulations: • (1) a hard surface driveway be installed by November 15, 1986 or the petitioner to past a performance bond for this work to be completed, and (2) the architectural treatment of the garage be compatible with the existing house. Seconded by Oouncilman Goodspeed. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously. B.
