Floral Public Works Director DATE: July 21, 1986 SUB=: SP 86-09, McPhillips With the Special Use Permit for a second accessory building for the McPhillips property at 291 Sylvan Lane, the stipulation disallowing a paved driveway should be recorded at the County. We have experienced revised uses of storage buildings and an increased number of nonpaved driveways as a result in land use and ownership changes. Therefore, it would be appropriate that a document be recorded at the County for all future property owners to be aware that a change in use of this storage structure would require a paved driveway to be constructed. Rind the City Council incorporate the stipulation for recording of a requirement to pave the driveway if the use of the building is ever modified for vehicle use. The siding on the new building be matched with the existing home. 2. No driveway is required as long as it is being used for storage. 3. The special use permit be reviewed by staff in one year to determine that no vehicles are being driven in and out of this structure. On July 21, 1987, I inspected the site and found that the above-mentioned stipulations were being met. Mr. Robinson stated the petitioner is requesting the requirement for a hard surface driveway be waived as the building would only be used fer storage. Mr. Robinson stated staff would recommend approval with the stipulations that the siding on this new structure match the existing home, iio oaved driveway would be required if the building is used for storage only, and a review of the special use permit in one year. Ms. Sherek stated she doesn't have a problem with not having a paved driveway as long as vehicles or motorcycles weren't driven in and out of the building. Mr. McPhillips stated his son hasa motorcycle and when it is stored in the garage all winter, his wife can't get her car in and out. He stated the motorcycle will be parked in this new garage all winter. Mr. Mervin Herrmann, 278 Mercury Drive, stated he lives north of this property and has no objection to Mr. McPhillips` request. REVIBI OF MOTIONS FROM PLANNING COM'ISSION AND PARKS AND RECREATION MZIISSION REGARDING MEADOgANDS PARK IMPRCVEMEITT Mr. Flora, Public Works Director, stated there was a proposal submitted last year fran the Parks and Recreation Commission to the Planning Commission regarding development of Meadlowlands Park and included pions for development of adjacent property. He stated a Task Force studied the issue and supported the fact they would like the park retained as a passive irk, but water conditions in the area needed to be addred. ,586 Mr. Flora stated the Planning Commission mad a recommendation because of high the hicost to improve the drainage,,�nsideration be given to assess benefiting adjacent properties. He stated if this was done, approximately 23 properties would be involved at a cost ranging frau $2,500 to $4,000 per lot depending on haw it was assessed. Mir. CONSIDERATION OF A SPECIAL USE PERMIT, SP #86-09, GENER- ALLY LOCATED AT 291 SYLVAN LANE N.E. , BY MICHAEL MCPHILLIPS: Mr. Robertson, Community Development Director, stated the petitioner has requested the requirement for a hard surface driveway be waived as this new accessory building will only be used for storage. Mr. Robertson stated the Planning Commission recommended approval of this special use permit with three stipulatons which he outlined. M?TION by Councilman Goodspeed to approve special use permit, SP #86-09 with the following stipulations: (1) that the siding of this new building be matched with the existing hone; (2) no paved driveway is requied as long as it is being used only for storage; and (3) that this special use permit be reviewed by staff in one year to determine that no vehicles are being driven in and out of this structure. Seconded by Councilman Barnette. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously. D. PFVIB< OF MOTIONS FROM PLANNING CMIISSION AND PARKS AND RECREATION COhZIISSION REGARDING MEA)aL LANDS PARK I t'IPRgVEI UZTT Mr. Flora, Public Works Director, stated there was a propo submitted last year from the Parks and Recreation Commission to the P�nning Commission regarding development of Meadlowlands Park and iptluded options for development of adjacent property. He stated a Task Force studied the issue and supported the fact they would like the park retained as a passive park, but water conditions in the area needed to >addressed. Mr. Flora stated the Planning Commiss' made a recommendation because of the high cost to improve the drai "e, consideration be given to assess benefiting adjacent properties. e stated if this was done, approximately 23 properties would be invo4v,63 at a cost ranging frau $2,500 to $4,000 per lot depending on how it assessed.
