This permit was passed by the City Council on October 6, 1986 with four stipulations. Of the four stipulations, one remains to be completed. This is: 1. Provide a hardsurface driveway with the construction of garage. This stipulation is also a requirement of the City Code, Chapter 205.07.06.a.2 which states that "all driveways and parking stalls shall be surfaced with blacktop, concrete or other hardsurface material approved by the City". Although no canpletion date was assigned to the driveway installation, City policy requires the applicant to install improvenents within one year of the final inspection date. On December 2, 1986 Mr. Darrel Clark conducted a firal inspection of the garage, therefore, the hardsurface driveway shold have been installed by December 2, 1986. Mr. Throndson was notif ied of this violation twice and given 15 days to canply with the special use permit. Mr. Throndson has not installed the hardsurface drivaway, therefore, he has been summoned to appear on September 16, 1988 before the Anoka County Court. How do you plead? 7 THE DEFENDANT: Guilty. 8 THE COURT: What 's your address? 9 THE DEFENDANT : 6620 Lucia Lane. 10 THE COURT: That ' s in Fridley? 11 THE DEFENDANT: Um-hum. 12 THE COURT: Did you have a special use permit? 13 THE DEFENDANT: I pulled a special use permit a 14 year ago to build a garage, and onto that the City of 15 Fridley attached that the driveway be made a hard surface. 16 THE COURT: And that 's the violation? 17 THE DEFENDANT: Right . 18 THE COURT: It wasn' t? 19 THE DEFENDANT: Right . There's no limit on that 20 permit as far as time . There 's no set -- you know, it 21 doesn' t have dates on that permit . And since then I 've 22 also pulled permits for electrical , plumbing and heating. 23 Okay. And I 've told Kathleen down there at the City 24 Office that it will be done in the spring. It ' s almost 25 harassing. She wanted it done by October 1st . I said 4 1 there was no way that the budget could have that driveway 2 in by the 1st . 3 THE COURT: When did you build the garage? 4 THE DEFENDANT: It was a year ago. 5 THE COURT: A year ago? 6 THE DEFENDANT: Yeah. And since -- what I did 7 is, sir, I re-sided the house, built an attached garage. 8 THE COURT: I live in the City of Fridley. I 9 pulled permits before. I know they' re only good for a 10 year. 11 THE DEFENDANT: It doesn' t say anything on the 12 permit . It doesn' t state anything on the permit . 13 THE COURT: Oh, it does on the form. If you 14 don' t begin construction within a year you've got to get 15 another permit . If there 's conditions attached to it 16 you've got to fulfill them. You had a year to get the 17 hard driveway surface in. How would you like to live next 18 to somebody who half built a garage? 19 THE DEFENDANT: I do live next to two people 20 with their driveways. And the only reason why I 've got to 21 pave mine is because I took out a permit to build a 22 garage. And I 'm not saying that I won' t do it . 23 THE COURT: Yes, I know. 24 THE DEFENDANT: But the budget for my second 25 mortgage, when I took out the loan for the construction, 5 1 did not include a $3500 driveway. They attached that to 2 the permit when I went before the City Council to get the 3 permit . That was attached to the original permit . 4 THE COURT: Where is Lucia Lane? 5 THE DEFENDANT: It 's right one block north of 6 Mississippi , one block off of Central . The Knights of 7 Columbus is at the end of the street . s THE COURT: Oh. Okay. 9 THE DEFENDANT: Since I 've owned this house, 10 okay, I 've put almost $30,000 worth of construction into 11 it . I 'm not trying to shed any responsibilities on the 12 driveway at all , but I have a list of priorities that have 13 to be, you know, done. 14 THE COURT: What is the driveway like now? 15 THE DEFENDANT: It ' s got Class 5 gravel on it . 16 And I bought the house with Class 5 gravel on it . Two of 17 my neighbors have Class 5 gravel in their driveway. I 18 have no qualms about putting in the driveway, Your Honor. 19 It 's just that, like I told Kathleen, when I got the 20 second mortgage to do the construction and to do some of 21 the stuff there wasn' t that -- there wasn' t enough equity 22 in the house and I couldn' t get enough money to do it all . 23 THE COURT: Okay. 24 THE DEFENDANT: And in the meantime then, too, 25 since the last year we've had a child and, you know, all 6 1 this together . It 's $3500. And it would be in by May 2 31st is what we projected we should be able to have it in 3 by. I told Kathleen that , and she wanted it in by the 1st 4 of October. It 's not feasible. 5 THE COURT: All right. It 's 30 days and $300. 6 I ' ll stay the 30 days and I ' ll stay the $300 on the fol- 7 lowing conditions : You' re on probation for one year . 8 You're to have no further violations of the City Code. As 9 far as the driveway, there's an exception to that . BETZOLD, TO APPROVE THE AUGUST 20, 1986, PLANNING OMMISSION MtNUTES AS WRITTEN. UPO A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON BILLINGS DECLARED THE MOTION C IED UNANIMOUSLY. 1. PUBLIC HEARING: CONSIDERATION OF A SPECIAL USE PERMIT, SP #86-12, BY RICKY THRONDSON: Per Section 205.07 .1, C, 1 of the Fridley City Code, to allow a second accessory building on Lot 6D, Auditor's Subdivision No. 21, .the same being 6620 Lucia Lane N.E. MOTION BY MR. BETZOLD, SECONDED BY MS. SHEREK, TO WAIVE THE READING OF THE PUBLIC HEAPING NOTICE AND OPEN THE PUBLIC HEARING. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON BILLINGS DECLARED THE PUBLIC HEARING OPEN AT 7 :35 p.m. Mr. Robinson stated this is a request for a second accessory garage located on Lucia Lane with double frontage on Highway 65 and Lucia Lane, just north of Mississippi Street. He stated the property is zoned R-1 and in a predominately single family neighborhood. He stated the petitioner is proposing to construct a new garage, approxi- mately 526 square feet, in front of the existing detached garage and attach it to the !house. Mr. Robinson stated staff was recommending approval with the following stipulations : (1) a hard surface driveway be provided with construction of the garage; (2) tires and debris be removed from the side yard; (3) boat be moved to the side/rear yard or stored inside garage; and (4) garage materials, siding and roofing are to match existing house. PLANNING COMMISSION MEETING, SEPTEMBER 24,_1986 PAGE 2 Mr. Throndson stated the new garage was to provide extra storage for vehicles as well as for a boat and trailer. He stated no mechanical work would be done in the garage. Mr. Throndson stated the existing garage was in good shape and when the new garage is constructed, everything would be re-sided. He stated he had no problem with the stipulations recommended by staff. Mr. Betzold asked if there was a reason why the petitioner was leaving about an eight foot gap between the existing garage and house. He questioned why this couldn't be filled in and attached to the house to make one large garage. Mr. Throndson stated this was what he originally proposed , but had some negative feedback. He stated he would have no problem with closing in this gap, if it was allowed by the City Code. He stated the new garage would have footings under it because it would be attached to the house and the existing garage is on a floating slab. He stated the existing garage has been there for 20 years and has not moved and he was told by some construction people it would be feasible to attach it to the new garage. He stated if it is not allowed by Code, it could then be detached. Mr. Robinson stated this matter could be worked out with the Building Inspector. MOTION BY MR. BETZOLD, SECONDED BY MR. SABA, TO CLOSE THE PUBLIC HEARING. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON BILLINGS DECLARED THE MOTION CARRIED UNANIMOUSLY AND THE PUBLIC HEARING CLOSED AT 7 :42 p.m. MOTION BY MR. BETZOLD, SECONDED BY MS. SHEREK, TO RECOMMEND TO THE CITY COUNCIL APPROVAL OF SPECIAL USE PERMIT, SP #86-12, WITH THE FOLLOWING STIPULATIONS: 1. A hard surface driveway be provided with construction of the garage; 2. Tires and debris be removed from the side yard; 3. Boat be moved to the side/rear yard or stored inside garage; and 4. Garage materials, siding and roofing are to match existing house. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON BILLINGS DECLARED THE MOTION CARRIED UNANIMOUSLY. Chairperson Billings stated this item would go to the City Council on October 6, 1986. 2. PUBLIC HEARING: CONSIDERATION_C T ., USE PERMIT SP #86-13 BY RONALD CHRISTENS . .C. AUTOMOTIVE: COUNCIL MEETING OF OCTOBER 6, 1986 Mr. Flora, Public Works Director, stated the Council, in 1984 , approved a variance for property at 420 67th Avenue to reduce the side yard setback from 10 feet to 7 feet to allow an addition to this home. He stated the petitioner didn' t complete this contruction and ' w requesting the Council re-approve this three foot varia n order to construct a three-season porch behind the gara Ir. Flora stated the adjoining property owner has submitted etter that he has no objection to the variance. MOTION by Counci Goodspeed to re-approve the variance to reduce the side yard setback cm 10 feet to 7 feet for the property at 420 67th Avenue to allow truction of a three-season porch. Seconded by Councilman Fitz rick. Upon a voice vote, all voting aye, Mayor Nee declared the ion carried unanimously. 8. RECEIVING THE MINUTES OF THE PLANNING COMMISSION OF SEPTEMBER 24 , 1986 A. CONSIDERATION OF A SPECIAL USE PRMIT SP #86-12, TO ALL W A SECOND ACCESSORY BUILDING, GENERALLY LOCATED ON LOT 6D, AUDITOR' S SUBDIVISION NO 21, THE SAME BEING 6620 LUCIA LANE N.E. , BY RICKY THRONDSON: Mr. Flora, Public Works Director, stated this is a request for a special use permit to allow a second accessory building at 6620 Lucia Lane. He stated the property is zoned R-1 and is in a predominately residential area. He stated the petitioner proposes to construct a new garage approximatey 526 square feet to provide extra storage for vehicles, as well as a boat and trailer. Mr. Flora stated the Planning Commission recommended approval of this special use permit with four stipulations, which he outlined. MOTION by Councilman Schneider to concur with the recommendation of the Planning Commission and grant special use permit, SP #86-12, with the following stipulations: (1) A hard surface driveway be provided with construction of the garage; (2) Tires and debris be removed from the side yard; (3) Boat be moved to the side/rear yard or stored inside garage ; and (4) Garage materials, siding and roofing are to match existing house. CONSIDERATION OF A SPECIAL USE PERMIT, SP #86-14 , TO ALLOW OFFICES NOT ASSOCIATED WITH A PRINCIPAL USE, GENERALLY LOCATED ON WTI,' BLOCK 1, PACO INDUSRIAL PARK, THE SAME BEING 250 COMMERCE- CIRCLE SOUTrH, BY DAVID HARRIS; -� Mr. Flora, Public Works Director, sta is is a request for a special use permit for property located o e corner of Commerce Circle South and Commerce Circle East to offices not associated with a principal use. He stated the prope is zoned M-1 and the building constructed on the site is 21,040 squar -Let with 50 parking spaces provided. Mr. Flora stated the Planning Commission recommended approval of this special use permit with the stipulation that the developer provide the City with tenant information prior to each occupancy of the building so that the parking may be monitored to insure there is a sufficient number of spaces. He stated this is similar to what was done with the Winfield Development whose building was constructed as an office/warehouse facility. Cbuncilman Goodspeed questioned the trading of parking between Mr. Harris' property and spaces at the (bmmunity Park. Mr. Harris, the petitioner, stated he would be willing to enter into an agreanent with the City for joint use of his parking and the City' s parking at the Community Park. Mr. Flora stated the staff' s concern is ere are a lot of daytime activities at the Couununity Park and if th have such an agreement with Mr. Harris, there may be a shortage of spaoes available for the park. Cbuncilman Barnette stated the reality is the park isn't used every day on a constant basis and when special events, are held, they are usually only for a short period of time. Mr. Harris stated he hoped the de sion not to enter into a joint parking venture is not based only on a f day's use of the park. Mr. Flora stated Mr. Harris' ilding is adjacent to the park and if all the space is leased for offic , it would be an increased use, and if no additional parking were pr ided, it would be a problen. Mr. Harris stated he wo It be able to rent space to someone who needed more parking than what e could provide so he felt some of these things are self- correcting. MJTION by Counilma Goodspeed to concur with the recommendation of the Planning Commissi n and grant special use permit, SP #86-14, with the stipulation that e developer provide the City with tenant information prior to each oc panty of the building.
