LOT SPLIT APPLICATION PROCEDURE
1 . Obtain application form at City Hall. (6431 University Ave. .N.E. , Fridley)
2. Return completed application form with the required sketch of the property
involved and the lot split fee of g 20.00for each original lot being split.
3. The application will be submitted to the Plats & Subdivisions and Streets
& Utilities Subcommittee for recommendations. This Committee meets once a
month, when required. The City will supply the applicant with minutes of i
the Subcommittee.
4. Following the Plats & Subs Committee recommendation of approval, the owner
must then obtain a Certificate of Survey on the original parcel or parcels
along with the new parcels created with all existing structures tied in. {�
5. The Certificate of Survey should then contain a simple description of a part f
of a platted lot or registered lot and be filed with the Engineering Department
for Planning Commission recommendations. The Planning Commission meets on the
second and fourth Thursday of the month. The City .will supply the applicant
with minutes of the Planning Commission.
6. The recommendations of the Planning Commission are submitted to the City
Council for final action. The Council meets on the first and third Monday
of the month. }
. 7. The City Council dpproval may be subject to certain stipulations which_ must .
be complied with by the applicant.
8. A letter will be sent to the applicant to notify him of the Council action
and to advise him to comply with the conditions imposed by the City. The
letter will also contain any necessary deeds for easements and other pertinent
papers for his signature.
9. When all the conditions of the lot split have been complied with, the applicant
should file the lot split in Anoka County.
10. In all cases where Council action has been sought and denied, no petition for
identical action can be presented until a period of six months has elapsed.
NOTE: THE RESULTING REAL ESTATE TAXES AND SPECIAL ASSESSMENTS FOR
THE NEW PARCELS IN TOTAL AFTER THE LOT SPLIT, MAY EXCEED THE
AMOUNT ASSESSED TO THE ORIGINAL PARCEL. TFC FINANCE DEPARTMENT
OF FRIDLEY MAY BE ABLE TO PROVIDE THE ESTIMATED AMOUNT OF
ADDITIONAL TAXES OR ASSESSMENTS.

Chairman Harris called the meeting to order at 7 :30 P.M.

MOTION by French, seconded by Christensen, that the Plats &
Subdivisions-Streets & Utilities minutes of the May 1 , 1974 meeting
be approved as written . Upon a voice vote , all voting aye , the motion
carried unanimously.
1. REQUEST FOR A LOT SPLIT, L.S . #74-04 MRS . MILDRED MUSTONEN:
Split off the Westerly 75 fee he Easterly 149 . 89 feet
of Lot 11, Block 2 , Spring Lake Park Lakeside, to make another
building site, 1579 75th Avenue N.E.
Mrs. Mustonen was not present.
Mr. Clark said this lot is about 150 feet in the East-West
dimension and 120 feet in the North-South dimension. The lot split
Mrs. Mustonen would like to see approved is the Westerly 75 feet of ' -
of this lot so she can sell it for a building site. The resulting
corner lot does not meet the 80 foot requirement but as there is
already a house on the lot, , there is no worry about someone not being
able to build a house on this lot at a later date. The rear yard of
the existing house is about 4 feet short of the 25 foot rear yard
requirement but as the petitioner knows what she is doing, and this
is an existing house it will '.not require a variance.
Mr. Clark said as far as the staff is concerned, we see no reason
to deny this requE!st because the resulting parcel meets the 9 , 000 square
foot requirement with a 75 foot frontage.
Mr. Clark said that before Mrs. Mustonen is granted final approval
of this lot split she should have the lot surveyed because the drawing
presented is just a rough drawing. The lot will have to be surveyed
before a building permit could be issued anyway.
Mrs . Mustonor_' s house is at 7500 Lakeside Road and the resulting
parcel will face 75th Avenue.
Mr. Christensen said he was in favor of recommending approval of
L this request because the new parcel meets all the codes and fulfills

all the requirement except for the survey.
MOTION by Christensen , seconded by French, that the Plats & Sub-
divisions-Streets & Utilities Subcommittee recommend approval to the
Planning Commission of the request for a lot split , L.S . #74-04, by
Mrs. Mildred Mustonen , to split off the Westerly 75 feet of the
Easterly 149 . 89 feet of Lot 11 , Block 2 , Spring Lake Park Lakeside,
to make another building site, 1579 75th Avenue N.E. with the stipulation
that there is a survey made of the lot. Upon a voice vote, all voting
aye, the motion carried unanimously .
2. REQUEST FOR A LOT SPLIT, L.S . #74-05 , SPRINGFIELD HOMES: Split
off the Northerly 4 feet of Lot 4 , and add it to Lot 3 , Block 1 ,
Innsbruck North, the same being 5643 North Danube Road N.E.
No one present to represent the petitioner.
Mr. Clark said the petitioner had put in the foundation of this
home and when there was a verification survey , they-,found that they
had used the wrong front iron so the house could not meet the side
yard requirement. Lot 4 is a 90 foot lot and they were able to purchase
4 feet from this lot to gain the 10 foot side yard for this existing
foundation to meet the code requirement: This will make Lot 4 86 feet
which is not out of context with other lots in this area. If this
lot split isn' t granted they will either have to ask for a variance
or move the foundation.
Mr. Clark said if they would look at the map in their agenda
they could see where the radius point was used to locate this foundation
instead of the lot iron.
MOTION by French , seconded by Christensen , that the Plats &
Subdivisions-Streets & Utilities Subcommittee recommend approval to
the Planning Commission of the request for a lot split, L.S . #74-05 ,
Springfield Homes , to split off the Northerly 4 feet of Lot 4 , and
add it to Lot 3, Block 1 , Innsbruck North the same being 5643 North
Danube Road N.E. Upon a voice vote, all voting aye , the motion carried-
unanimously.
3. RZQUEST FOR A LOT SPLIT, L.S . #74-06 , DARREL A. FARR DEVELOPMENT
CORPORATION: Split off that part of •Lot 1, Block 28 lying South
and East of a line described as follows: Beginning at the North-
west corner of Lot 5, Block 4; thence North 0 degrees 09 minutes
12 seconds East a distance of 1. 50 (bearing assumed from plat of
record) ; thence South 89 degrees 50 minutes 48 seconds East to the
West line of Lot 4 , Block 4, and there terminating, and add it
to Lot 5, Block 4 , Innsbruck North Townhouse 3rd Addition, the
same being 5537 East Bavarian Pass' N.E.

a lot split. One parcel of land has complicated legal description
because it is taken from the common area.
Mr. Lindblad asked if the petitioner had any objection to
replatting.
Mr. Kruger said they had no objection, except to the time involved
in replating.
Chairman Fitzpatrick said this would be a pretty routine plat
so the Public Hearing notices could go out for the Planning Commission
and for the Council ahead of time and this would hurry it up a little.
Mr. Kruger said they have sold the townhouse with the garage that
has the complicated legal description (5537 East Bavarian Pass N.E. ) .
MOTION by Harris seconded by Lindblad, that the Planning Commission
approved the concept of the land division on Lots 5, 6, 7 and 8, Block 4,
Innsbruck North Townhouse 3rd Addition, but recommend that this be
handled as a replat, rather than by lot splits . Upon a voice vote, all
voting aye, the motion carried 1
11. REQUEST FOR A LOT SPLIT L.S. #74-04 , RS. MILDRED MUSTONEN: Split

which will be addressed as 1579 75th Avenue N.E.
The petitioner had notified the administration that she was ill
and was unable to attend the meeting.
Mr. Boardman said that when the petitioner called the office,
she was told that the Plats & Subdivisions-Streets and Utilities Sub-
committee had recommended approval of this lot split, but that she
would have to get a survey of this lot. The petitioner agreed to do
this.
Mr. Boardman said as far as the City administration is concerned,
the lot that is being split off meets all the code requirements so
we have no objection to this lot split being granted. The existing
house on the part of the lot that will be left does fit on the 75 foot
lot even if this does not meet the 80 foot corner lot requirement.
Mr. Harris said the reason for the lot split is so the petitioner
can sell this portion of her property. She is a widow and the assess-
ments for the street, plus the fact that this is a large lot and too
hard for her to maintain are the reasons she want's to sell this
part of her property.
Mr. Drigans said he thought someone from administration should
contact Mrs. Mustonen and explain 'to her about the tax structure on
this property becoming two lots in' case she didn' t sell the lot as
soon as she planned on.
MOTION by Harris , seconded by Drigans, that the Planning Commission
recommend to Council approval of the request for a lot split, L.S. #74-
04 , by Mrs . Mildred Mustonen, to split off the Westerly 75 feet of the

off the Northerly 4 feet of . Lot 4 , and add it to Lot 3 , Block 1,
Innsbruck North, the same being 5643 North Danube Road N.E.
No one was present to represent the petitioner.
Mr. Harris said the foundation is already in for this house
and they used the radius iron instead of the lot iron to locate the
house on the lot. They got the house 4 feet too close to the property
line to meet the sideyard requirement. This is the reason for the
lot split request.
Mr. Boardman said that Springfield Homes owns both lots and Lot
4 will still have a front footage of 78 . 36 feet which is comparable
to other lot sizes in this area.
-Mr. Drigans said he thought this should have been handled as a
variance rather than a lot split. There will be a lot of legal work
involved in a lot split and a variance could be handled locally.
Mr. Harris said it would be easier to obtain mortgage money on
a house that meets all the setback requirements than one that has
a variance . Mr. Drigans said does that mean that every variance
that is granted on a house may make it difficult to sell? Mr. Harris
said that usually no additional land is available and a variance is
granted on a hardship that is requested by the property owner. On
this request, there is property available so that a variance is not
necessary.
Mr. Boardman said that by requesting this lot split, both lots
3 and 4 will still meet the code, and the petitioner felt this was
better than asking for a variance and having a house that did not meet
the code on the side yard requirement.
MOTION by Lindblad, seconded by Harris , that the Planning Commission
recommend to Council approval of the request for a lot split, L.S. #74-
05 , by Springfield Homes , to split off the Northerly 4 feet of Lot 4 , and
add it to Lot 3 , Block 1 , Innsbruck North, the same being 5643 North
Danube Road N.E. Upon a voice vote, Harris , Lindblad, Fitzpatrick voting
aye, Drigans abstaining, the motion carried.
Mr. Drigans said he abstained because he felt this should have
been handled as a variance rather than a lot split.
13 . RECEIVE PARKS & RECREATION COMPREHENSIVE PARK PLAN
Mr. Boardman said the Council had this on their agenda on May 20 ,
1974 and they delayed any action on this plan until surveys are done
and there is a more detailed study on the bikeways and pathways and on
park usage. This delay will be between six and seven months.

The City Manager said the recommendation of the Planning Commission would be
to approve the request, but have the matter handled as a replat rather than lot
splits. He said if the Council would concur, this would be brought back again
in the form of a replat.
MOTION by Councilman Starwalt to concur with the recommendation of the Planning
Commission and direct the applicant, Darrel A. Farr Development Corporation that
the concept is acceptable, but this should be handled as a replat rather than a
lot split application, and be brought back in this form for Council consideration.

The City Manager explained the Planning Commission is looking at the over all
development plans of the Hyde Park area and they thought the Council may want to
have a hearing on the matter. }

Councilman Nee said he was very encouraged by what is being done. He said it may 3
be good at this time to get the neighborhood reaction before the plan is completly
laid out. He explained the area people would not feel any ownership of the plan
if they were not involved in the discussions. He stressed, they should have some
input before the plan is finished. He thought the plans would have a better chance i
