LOT SPLIT APPLICATION PROCEDURE
1 . Obtain application form at City Hall. (6431 University Ave. N.E. , Fridley)
2. Return completed application form with the required sketch of the property
involved and the lot split fee of $15.00 for each original lot being split.
3. The application will be submitted to the Plats & Subdivisions and Streets
& Utilities Subcommittee for recommendations. This Oommittee meets once a
month, when required. The City will supply the applicant with minutes of
the Subcommittee.
4. Following the Plats & Subs Committee recommendation of approval, the owner
must then obtain a Certificate of Survey on the original parcel or parcels
along with the new pare- 8 treat- ; w. *!! al Pxist irk strictures tied in.
5. The Certificate of Survey should then contain a simple description of a part
of a platted lot or registered lot and be filed with the Engineering Department
for Planning Commission recommendations. The Planning Commission meets on the
second and fourth Thursday of the month. The City will supply the applicant
with minutes of the Planning Commission.
6. The recommendations of the Planning Commission are submitted to the City
Council for final action. The Council meets on the first and third Monday
of the month.
7. The City Council approval may be subject to certain stipulations which must
be complied with by the applicant.
8. A letter will be sent to the applicant to notify him of the Council action
and to advise him to comply with the conditions imposed by the City. The
letter will also contain any necessary deeds for easements and other pertinent
papers for his signature.
9. When all the conditions of the lot split have been complied with, the applioant
should file the lot split in Anoka County.
10. In all cases where Council action has been sought and denied, no petition for
identical action can be presented until a period of six months has elapsed.
NOTE: THE RESULTING REAL ESTATE TAXES AND SPECIAL ASSESSMENTS FOR
THE NEW PARCELS IN TOTAL AFTER THE LOT SPLIT, MAY EXCEED THE
AMOUNT ASSESSED TO THE ORIGINAL PARCEL. THE FINANCE DEPARTMENT
OF FRIDLEY MAY BE ABLE TO PROVIDE THE ESTIMATED AMOUNT OF
ADDITIONAL TAXES OR ASSESSMENTS.

1 . PROPOSED PRELIMINARY PLAT P.S. #69-o6, LONDA G UND: That part of Lot 15,
Revised Auditor's Subdivision #23 lying Westerly _of_WomUrly right of way' lins
of Riverview Terrace as described in Book 70210f Deeds, page 197.
The history of the previous plat, which had been approved but never
recorded, was reviewed. Lot 15 was a large lot from the river to East River
Road. This proposed plat is from the West right of way line of Riverview
Terrace to the Mississippi River. The original plat included a short cul de sac,
Mrs. Englund said the reason for platting at this time was for resgle of
one of the lots immediately in order to get some money back toward taxes.
Mr. Myhra brought up the fact that the Ordinance says that a lot ca of be
built on, unless it is on a public access. There is a short street into the
plat, and Darrel Clark called attention to two other similar situations,
Harland Berry Registered Land Survey and Chesney Acres. This short road would
not be maintained by the City, and according to Section 4505.2 of the City Code,
it could be dedicated by easement. In relation to the neighboring lots, it
was felt there was no problem as tlAe house on the lot to the South (Lot 16), is
centrally located and is a relatively new house, and Lot 14 would not be
adversely affected. The utilities would go up the driveway, and have a minimum
grade as part of the higher area would be graded lower when homes were to be
built.
MOTION by Myhra, seconded by Batterson, that the Plats & Subdivisionsr
Streets & Utilities Subcommittee recommend to the Planning Commission approval
of the Preliminary Plat, P.S. #69-06 by Londa Englund of that part of Lot 15,
Revised Auditor's Subdivision #23 lying Westerly of Westerly right of way line
of Riverview Terrace as described in Book 702 of Deeds, page 197, calling
attention to the fact that in order to meet the requirements of the City Code,
the driveway casement would have to be a permanent and non-obstructed easement
and also for utilities. Upon 4 voice vote, all voting aye, the motion carried
unanimously.
2. LOT SPLIT REQUEST: L.S. #69-11 , ELMER j3. FLOWERS: Lots 6 and 7, Block 2,
Gunderson Terrace. F
Mr. Flowers explained that he wiphed this split in order to have a
buildable lot on Lot 7, which he intends for his new home. There is a garage on
Lot 6, where he is presently living, which faces Lot 7 and does not give enough
room to drive out. The bank would not give him permission to tear down the
garage. The house is also too close to the lot line. Mr. Flowers said the

real estate people told him he would have no trouble selling Lot 6. The area
of both of the lots is adequate, The Subcommittee did not think the change
would damage the plat.
Mr. Flowers was asked to get a legal description of the new lots either
from an attorney or surveyor as the lots would appear on the deed if they were
split. $e mold he would not have to have a survey until he appeared before
the Planning Commission.
MOTION by Myhra, seconded by Crowder, that the Plats & Subdivisions-
Streets & Utilities Subcommittee table the lot split request, L.S. #69-11 ,
Elmer H. Flowers of Lots 6 & 7, Block 2, GmWderson Terrace to the meeting of
May 1 , 1969 in order to enable Mr. Flowers to return with a legal description
of the proposed lot split. Upon a voice vote, all voting aye, the motion
carried unanimously.
3. VACATION RPQUEST: SAV #69-03, GREAT NORTHERN RAILWAY CO. : Streets & Alleys
in Block 6, Berlin Addition.
The Subcommittee felt they would like to have the opinions of the
Utilities Companies before taking any action on this request.
MOTION by Myhra, seconded by Crowder, that the Subcommittee table the
item of a vacation request, SAV #69-03 by the Great Northern. Railway Company
until the next meeting and ask Darrel Clark to obtain the necessary clearance
from the utility companies and the Standard Oil Company relative to the
vaoation. Upon a voice vote, all voting aye, the motion carried unanimously.
ADJOURNMENT:
MOTION by Crowder, seconded by Myhra, that the Plate & Subdivisions-
Streets & Utilities Subcommittee meeting of April 17, 1969 adjourn at 8:35 P.M.

streets in the suggested pattern, would not be necessary. The streets which
have already been dedicated, could be vacated.
MOTION by Crowder that the Plats & Subdivisions-Streets & Utilities Sub-
committee recommend to the Planning Commission approval of ZOA #69-02 and that
further recommendation as to road easements as shown on Lots 4, 5.and 6, Auditorve
Subdivision #108, upon adoption of the rezoning of these streets be vacated, and
if this zoning plan is adopted, no interior streets are necessary. In the
discussion which followed, it was decided that it was inappropriate to vote on
the rezoning, as the request was for an opinion of the street pattern. Mr.
Crowder withdrew his motion.
MOTION by Myhra, seconded by Crowder, that the Plats and Subdivisions-
Streets & Utilities Subcommittee bring the information forward to the Planning
Commission that if the rezoning would take place as shown on the map dated
April 25, 1969 for the rezoning study, that it is the conclusion of the
Subcommittee that the interior streets are not needed in that area and that the
streets previously dedicated on Lots 4, 5 and 6, Auditor's Subdivision #108 be
vacated. Upon a voice vote, all voting aye, the motion carried unanimously.
3. CONTINUED LOT SPLIT REQUEST: L.S. #69-11 , ELMER FLOWERS: Lots 6 & 7,
Block 2, Gunderson Terrace.
The petitioner was not present.
MOTION by Myhra, seconded by Zeglen, that the Plats & Subdivisions- Streets
& Utilities Subcommittee continue the item of the Lot Split Request, L.S. #69-11 ,
Elmer Flowers of Lots 6 & 7, Block 2, Gunderson Terrace. Upon a voice vote, all
voting aye, the motion carried unanimously.
4. CONTINUED VACATION REQUEST: SAV #69-03, GREAT NORTHERN RAILWAY CO. : Streets
and alleys in Block 6, Berlin Addition.
Because the Standard Oil Company has a pipe line on the property to be
vacated and had not responded to the City's letter apprising them of the
proposed vacation, the item was continued.
MOTION by Myhra, seconded by Crowder, that item SAV #69-03, Great Northern
Railway Company , vacation of streets and alleys in Block 6, Berlin Addition be
continued. Upon a voice vote, all voting aye, the motion carried unanimously.
5. LOT SPLIT REQUEST: L.S. #69-13 GEORGE L. WA UIST: Lot 18, Block 1 , Spring
Valley Addition - split off West 150 feet. 441 Central Avenue)
The petitioner was not present.
Darrel Clark said that Lot 18 falls into two different zoning categories
and the division line fall on the zoning line. Mr. Walquist wants to build
a Taetee Freeze on the portion zoned commercial which is 150 feet and fronts
Central Avenue. The rear portion could not be built on until such time as
access becomes available. The east portion could be red tagged. The alley,
between Mississippi Street and Rice Creek Road and abuts this lot, is 16 feet
wide. Mr. Walquist had indicated willingness to dedicate land for a road
whenever this lot would be developed.
