We are going to want it 12,000 square feet in area and we have to have a large water supply because of the sprinklers, and we would want the pipe large enough the first time. We will be short of water if we don't act now. Chairman Jensen said that if that easement went straight across University Avenue over to 78th Avenue, the other easement would have to move down about 33 feet south. It would make Lot 5 worthless and Lot 4 even more so. Then that line could go across square with 78th Avenue. It was mentioned that Spring Lake Park has an outfall that opens in the highway ditch. He added it looked like it wouldn't line up perfectly square from 78th Avenue to Onaway -- chances are tremendous it would not line up. It is not an industrial adjustment. It makes sense to make it square through Fridley and make the adjustment in the highway right of way. Darrel Clark asked Mr. Schroer if he had any reason for not dedicating a street right of way making it 33 feet instead of 31) feet. It would give more for boulevards if 79th Avenue would become a State Aid street. Richard Harris commented that if the City would want two feet from Bob Schroer, they would want two feet from him, and then he would have to go to the Board of Appeals for a variance because of the size of his lots. Mr. Schroer said he would. not mind it on 79th Way. MOTION by Crowder, seconded by Myhra, that the Plats & Subdivisions- Streets & Utilities Subcommittee recommend to the Planning Commission approval of the proposed preliminary plat, P.S. #69-05, East Ranch Estates 2nd Addition, Robert Schroer, of the SW4 of the SW4 of Section 2 subject to portion taken for T.H. #47 and subject to easement for sanitary sewer purposes over the South 33 feet thereof, subject to the following stipulations that the present 30 foot easement shown for 79th Avenue be changed to read 33 feet; the east-west storm easement as shown on the plot be changed to run more directly with 78th Avenue on the west such that this storm sewer easement runs predominately east-west through the property. Darrel Clark stated Mr. Minar's house is on the corner lot and is crowded at the rear of the lot. Lot 2 is presently owned by Rodney Billman. He talked to him and Mr. John Johnson, president of Acres, Inc. Also, a letter was received from their attorney that it was agreeable with all parties that Lot 2 be divided. The remaining dimensions of Lot 2 are 85' x 130' . Chairman Jensen said the description does not look controversial. Planning Commission Meeting - March 27, 1969 Page 5 Mr. Smith asked if it were permissible to build a nursing home in R-1. The answer was only with a special use permit. There has been a hearing on the plans and the Building Board did reject the plan presented, but it will go on to the Council. Wolf Painter, 7563 Lyric Lane: What kind of parking apace? Answer, lk stalls per unit. How many cars will be parked off the street and where would the exits be? Mr. Donaldson said they expect to have enough parking, and the exits would be on 0abo—ms Road. When asked about the number of units and size, the people were told thirty to forty units and 1, 2 and 3 bedrooms. Mr. Smith said that woul(�' mean there could be families with five children. MOTION by Myhra, seconded by Mittelstadt, that the Planning Commission con- firm the i,-mzblic hearing date of April 10, 1969 for the Preliminary Plat, P.S. #69-04. Upon a, vcice vote, all voting aye, the motion carried unanimously. REGULAR COUNCIL MEETING OF APRIL 7, 1969 PAGE 8 any of the Ordinances and Codes. Mr. Eotvos said that this would be a light auto body shop. There is 3200 square feet and he stated that there would be no outside storage of cars or trucks for more than 24 hours. Mr. Guzy, representing Mr. Eotvos explained that there is trouble in finding tenants as the building does not face University Avenue. At the time the building was being built, the City Council requested that it face South instead of facing University Avenue. He said that Mr. Eotvos will have a five year lease with him and does not intend to do any major overhauling. He felt that as a landlord, this business could be operational within the Code. As a landlord, he would not want outside storage either, and Mr. Eotvos has been made fully aware of this both by the Board of Appeals and by himself. Mr. Guzy pointed out that he would question whether a special use permit is even needed, as, if there is not outside storage, he would be operating within the Code. He said that if Mr. Eotvos violates the City Code, he would also be in violation of his lease. The City Attorney said that this is a point well taken, that technically speaking a special use permit would not be necessary. He suggested he occupy the building under a Certificate of Occupancy with the understanding that if he violates the City Code, the Certificate of Occupancy would be withdrawn. MOTION by Councilman Samuelson to grant the special use permit based on the provision that he comply with all the City Ordinances and the City Code, and that the Certificate of Occupancy be issued upon the understanding that if he violates the Code, it will be withdrawn. Seconded by Councilman Liebl. Upon a voice vote, all voting aye, Mayor Kirkham declared the motion carried. MOTION by Councilman Liebl to receive the Minutes of the Board of Appeals Meeting of April 2, 1969, and concur with the recommendations of the Board of Appeals on the requested variances. LOT SPLA -.BEQUEST: L.S. #69710, CUSHMAN K.D. MINAR, JR. : Westerly 20 feet of Lot 2, Block 2, Innsbruck 5th Addition, purchased to add onto Lot 1, Block 2, Innsbruck 5th Addition. MOTION by Councilman Liebl to approve the Lot Split #69-10 requested by Cushman K.D. Minar, Jr. Seconded by Councilman Samuelson. Upon a voice vote, all voting aye, Mayor Kirkham declared the motion carried. 2. VACATION REQUEST: SAV #69-02, WILLIAM J. KEEFER: Lots 1 through 4, Block 1, Spring Brook Park The City Engineer explained that when this area was platted in about 1930, 50 feet was inadvertently dedicated instead of the necessary 20 feet for the right of way and they are now-asking that the 30 feet be vacated. MOTION by. Councilman Liebl to set the Public Hearing on the vacation request SAV #69-02, by William J. Keefer for May 12, 1969. Seconded by Councilman Samuelson. The City Engineer called the Council's attention to Item #8 of the Planning Commis- sion Minutes regarding the Meeting night which indicated that they will be REGULAR COUNCIL MEETING OF APRIL 7, 1969 PAGE 7 off and areenerall in poor condition. He said that the one on East River g Y Road is very dirty. He said that he has asked verbally many times that this situation be corrected. Mr. Housenga replied that he was not aware of any of this as no correspondence has been received. He said that the first thing to do would be to submit a letter, then Standard Oil will be glad to see to this. Councilman Samuelson said that the Council and the City Manager work hard to try to keep old Junk cars out of the City. Mr. Housenga said that these are private businesses, and the Company is not in a position to approach the stations, unless there is a formal complaint. Councilman Samuelson said that he would be glad to write a letter, if that is what is needed to correct the situation. Mr. Housenga then gave Councilman Samuelson his card. Mr. Housenga then showed the Council pictures of the proposal, and said that they will comply with any provisions the Council may wish to make. Councilman Samuelson wondered if the permit was granted, what assurance would the Council have that the maintenance would be improved. Mayor Kirkham felt that the maintenance problem would require a separate action. The City Engineer asked if the Council would not wish to require a dedication for sidewalks if they should prove necessary in the future. He suggested a small amount of landscaping also. He said that they have a limited amount of land, but it is hoped to carry the sidewalks all the way to the corner sometime in the future, so the City would need a dedication of land. There followed a discussion while looking at the plans. MOTION by Councilman Samuelson to concur with the Board of Appeals with the stipulation that prior to the issuance of the building permit, a plan for some landscaping is to be received, and an easement for sidewalks along Osborne Road for future development. Councilman Liebl said that he would also like to see something done about the trucks that park on the new sod at the Standard Station on Mississippi Street and University Avenue. RECEIVING THE MINUTES OF THE BOARD OF APPEALS MEETING OF APRIL 2, 1969: A REQUEST FOR A SPECIAL USE PERMIT TO OPEN AND OPERATE AN AUTO BODY REPAIR AND PAINT SHOP ON LOTS 7 AND 8, BLOCK 2, COMMERCE PARK, THE SAME BEING 7500 UNIVERSITY AVENUE N.E. , FRIDLEY, MINNESOTA. (REQUEST BY ALEXANDER EOTVOS, 9900 NORWAY N.W. , COON RAPIDS, MINNESOTA) : The City Engineer eXplained that the building is already built, but there are no tenants. Mr. Eotvos would be occupying the third stall furthest from the service road. This is CR-2 zoning and the restrictions are very stringent on outside storage. He said that the Board of Appeals granted the special use permit subject to the following stipulations: 1. There be no outside storage of cars or trucks. 2. He meets the requirements of Section 45.102 Paragraph 9. 3.
