(6431 University Ave. N.E. , Fridley) 2. Return completed application form with the required sketch of the property involved and the lot split fee of $15.00 for each original lot being split. 3. The application will be submitted to the Plats & Subdivisions and Streets & Utilities Subcommittee for recommendations. This Committee meets once a month, when required. The City will supply the applicant with minutes of the Subcommittee. 4. Following the Plats & Subs Committee recommendation of approval, the owner must then obtain a Certificate of Survey on the original parcel. or parcels along with the new pare-:e .reaf - i w.*h al: -xisting structures tied in. 5. The Certificate of Survey should then contain a simple description of a part of a platted lot or registered lot and be filed with the Engineering Department for Planning Commission recommendations. The Planning Commission meets on the second and fourth Thursday of the month. The City will supply the applicant with minutes of the Planning Commission. 6. The recommendations of the Planning Commission are submitted to the City Council for final action. The Council meets on the first and third Monday of the month, 7. The City Council approval may be subject to certain stipulations which must be complied with by the applicant. 8. A letter will be sent to the applicant to notify him of the Council action and to advise him to comply with the conditions imposed by the City. The letter will also contain any necessary deeds for easements and other pertinent papers for his signature. 9. When all the conditions of the lot split have been complied with, the applicant should file the lot split in Anoka County. 10. In all cases where Council action has been sought and denied, no petition for identical action can be presented until a period of six months has elapsed, NOTE: THE RESULTING REAL ESTATE TAXES AND SPECIAL ASSESSMENTS FOR TEE NEW PARCELS IN TOTAL AFTER THE LOT SPLIT, MAY EXCEED THE AMOUNT ASSESSED TO THE ORIGINAL PARCEL. ROLL CALL: MEMBERS PRESENT: Crowder, Batterson, Jensen, Myhra, Zeglen OTHERS PRESENT : Engineering Assistant Clark 1 . LOT SPLIT REQUEST: L.S. #69-12, NORBERT J. LIESEN: Lots 27, 28 and 29, Block 4, Oak Grove Addition. Mr. Liesen was present. It was explained that the lots in the original plat were all 40 feet. Lot 30, which is vacant and lies north of Mr. Liesen's property, is a corner lot. Mr. Liesen said he tried to buy this lot but was unable to agree on a price with the owner. There is a home on Lot 29, but Mr. Liesen wished to split the three lots so that he would have two 60 foot lots. If in the future, he could purchase Lot 30, he would not object to a 100 foot corner lot. A new street has just been put in with sewer and water. This would probably amount to about $3,000 in assessments and Mr. Liesen felt he would have a better chance to sell a 60 foot lot rather than a 40 foot one. MOTION by Myhra, seconded by Batterson, that the Plats & Subdivisions- Streets & Utilities Subcommittee recommend to the Planning Commission approval of the Lot Split #60-12, Norbert J. Liesen, of Lots 27, 28 and 29, Block 4, Oak Grove Addition. Upon a voice vote, all voting aye, except Crowder voting nay, the motion carried. Mr. Crowder said the only reason he voted against the request was to call attention to the fact that a problem does exist with regard to the 40 foot corner lot and serious consideration should be given to what would Happen on that corner lot. 2. CONTINUED REZONING REQUEST: ZOA #69-02, GEORGE M. NELSON: Road Pattern Study. Referred by Council to Planning Commission. Mr. George Nelson and Mr. Howard Moore were present. The Engineering Assistant explained that Mr. Nelson has a request pending before the Council for rezoning the North half of Lots 30 and 31 , Auditor's Subdivision #129. The Planning Commission denied this request because of probable increase of traffic and street pattern. Mr. Nelson has reduced the size of his request so that there would be a strip of R-1 lots along Onondaga, and the balance would be a future plan for multiples. The Planning Commission thought the whole block should be looked at before they would make a recommendation. From this Body, what they want to know is,if this plan is adopted, what would be the recommendation as far as streets are concerned. In 1962 a street plan was made, but at that time, the whole block was R-1 . If the whole block was rezoned, the guess is that it would develop from 73rd Avenue to the north line of the zoning group. Mr, Jensen explained that the Plats & Subdivisions-Streets 4 Utilities Subcommittee had a split vote for approval of this request in order to call 4ttention to the corner lot which is a 40 foot lot, At one time there was a small house on the lot and was condemned and forcibly removed by the City and is separate ownership. It was noted that the lot* to the South. in this block have been split into 60 foot sites. Mr. Liesen explained he had made an offer to acquire the corner lot, but could nat purchase it at a price he thought reasonable. The question was asked that, as a matter of legality, if the owner asked for a building permit, would he be refused? The answer wa* that the owner could be refused, but h could to court, h t s wa u d, e l o t, T e la size g such that he could not meet the City requirements. Upon a voice vote, all voting aye, Mayor Kirkham declared the motion carried unanimously. 2. LOT SPLIT REQUEST: L.S. #69-12, NORBERT J. LIESEN: Lots 27 through 29, Block 4, Oak Grove Addition. The City Engineer explained that this request is so that he can make two buildable sites of 60' each. He pointed out that there is a 40' corner lot owned by Mr. Dumphy which he understood Mr. Liesen tried to purchase, but he felt that Mr. Dumphy was asking an unreasonable price. By granting this lot split, there will be a 40' lot that nothing can be done with. Councilman Sheridan asked if the corner lot had a building on it., Mr. Liesen said there was one, but it has been removed. Councilman Harris asked if the corner lot is maintained at all. Mr. Liesen said no. He said that his.%house is on Lot 29. Councilman Harris asked what the depth was. The City Engineer said 128' . Councilman Samuelson asked if these lots would meet the minimum standards. The City Engineer did some figuring and said that they do not, however, the other lots in the area are the same. If he could get the corner lot, he Mould meet the land requirements. Councilman Harris pointed out that the 40' lot will n6t do Mr. Dumphy any good, he cannot build on it. WALQUIST: West 150 feet of Lot 18, Block 1, Spring Valley Addition Councilman Harris asked if this was a rear-front split. The City Engineer said yes, and added that the City will need some easements from him. Council- man Sheridan asked if this was not the same type of split he requested behind the mortuary. The City Engineer said no, because there is access in the back of this lot. There is a 16' dedicated alley along the back of the lot so the City will need some additional right of way for a future road. He explained that the split is between the two zoning categories. The back portion is zoned residential. These lots are 300 feet deep so they will not be double frontage lots, they are plenty big enough to split. MOTION by Councilman Sheridan to grant the Lot Split L.S. #69-13 requested by George L. Walquist on the west 150' of Lot 18, Block 1, Spring Valley Addition, subject to his dedicating the easterly 34' for the purpose of a road in the future. Seconded by Councilman Harris. ORDINANCE #420 - AN EMERGENCY ORDINANCE AUTHORIZING THE PURCHASE OF A POLICE SQUAD CAR: The City Manager explained that the Police Department advertised for bids, but received none. He said that it seems the manufacturers have stopped making the special cars sooner than anticipated. He explained that they would be going to several dealers to get quotations, on cars that would meet the specifications as closely as possible. MOTION by Councilman Harris to adopt Emergency Ordinance #420 on first reading, waive the reading and order publication. Seconded by Councilman Sheridan. Upon a roll call vote, Sheridan, Kirkham, Liebl, and Harris voting aye, Mayor Kirkham declared the motion carried. RECEIVING THE ANNUAL POLICE AUCTION REPORT: MOTION by Councilman Liebl. to receive the annual .Police auction report, the auction being held May 10, 1969. Seconded by Councilman Harris.
