LOT SPLIT APPLICATION PROCEDURE
1 . Obtain application form at City Hall. (6431 University Ave. N.E. , Fridley)
2. Return completed application form with the required sketch of the property
involved and the lot split fee of $15.00 for each original lot being split.
3. The application will be submitted to the Plats & Subdivisions and Streets
& Utilities Subcommittee for recommendations. This Committee meets once a
month, when required. The City will supply the applicant with minutes of
the Subcommittee.
4. Following the Plats & Subs Committee recommendation of approval, the owner
must then obtain a Certificate of Survey on the original parcel or parcels
along with the new parcels created with all existing structures tied in.
5. The Certificate of Survey should then contain a simple description of a part
of a platted lot or registered lot and be filed with the Engineering Department
for Planning Commission recommendations. The Planning Commission meets on the
second and fourth Thursday of the month. The City will supply the applicant
with minutes of the Planning Commission.
6. The recommendations of the Planning Commission are submitted to the City
Council for final action. The Council meets on the first and third Monday
of the month.
7. The City Council approval may be subject to certain stipulations which must
be complied with by the applicant.
8. A letter will be sent to the applicant to notify him of the Council action
and to advise him to comply with the conditions imposed by the City. The
letter will also contain any necessary deeds for easements and other pertinent
papers for his signature.
9. When all the conditions of the lot split have been complied with, the applicant
should file the lot split in Anoka County.
10. In all cases where Council action has been sought and denied, no petition for
identical action can be presented until a period of six months has elapsed.
NOTE: THE RESULTING REAL ESTATE TAXES AND SPECIAL ASSESSMENTS FOR
THE NEW PARCELS IN TOTAL AFTER THE LOT SPLIT, MAY EXCEED THE
AMOUNT ASSESSED TO THE ORIGINAL PARCEL. THE FINANCE DEPARTMENT
OF FRIDLEY MAY BE ABLE TO PROVIDE THE ESTIMATED AMOUNT OF
ADDITIONAL TAXES OR ASSESSMENTS.

The meeting was called to order by Chairman Schmedeke at 7:40 P.M.
ROLL CALL:
Members Present: Engdahl, French, Schmedeke, Forster

1. LOT SPLIT REQUEST: L.S. #72-02, RONALD E. SMITH: Lots 15 and 16, Block 4
and Lots 8, 9, 10, Block 1, Adams Street Addition. To make three 66 2/3
foot lots from five 40 foot lots.
Mr. David Anderson represented the petitioner as Mr. Smith was out of town.
Mr. Anderson said that he was a builder.
Mr. Clark stated that about a year ago, the five lots (Lots 3, 4, 5, 6, and
7) behind these lots were considered. In this area there are lots that are
smaller than 9,000 square feet. The discussion had been whether or not we
should try to get one large lot of 80 feet and two 60 foot lots. The question
was would three 66 2/3 foot lots be better than two 60 foot lots and one 80 foot
lot. The Council finally approved three 66 2/3 foot lots on these five lots.
Mr. Schmedeke asked Mr. Anderson if he was informed by the City about the
lots being 66 2/3 feet. Mr. Anderson said Mr. Smith had been handling this
request and he could not answer that. Mr. Clark said he informed Mr. Smith of
the former lot splits and Mr. Smith said he would make the request this way
and be willing to discuss other possibilities.
Chairman Schmedeke said that in the light of the fact the Subcommittee
had already approved lots of this nature which back up to these lots, in his
opinion, it would be virtually impossible for the Subcommittee to deny this
request.
Mr. Clark added that there was no problem as far as the City is concerned
as there were no easements necessary other than the easement for utilities in
the alley which is not vacated nor open for traffic.
MOTION by Engdahl, seconded by French, that the Plats & Subdivisions-
Streets and Utilities Subcommittee recommend approval to the Planning Commission
of the Lot Split Request, L.S. #72-02, by Ronald E. Smith to make three 66 2/3rds
feet lots from five 40 foot lots using lots 15 and 16, Block 4 and Lots 8, 9, and
10, Block 1, Adams Street Addition. Upon a voice vote, Engdahl, French, Forster
voting aye, Chairman Schmedeke abstaining, the motion carried.
2. VACATION REQUEST: SAV #72-03A BY GENE HETLAND: Vacate Beech Street and
Alley in Block 7, Onaway Park.
Mr. Gene Hetland was present and also Mr. Ray Carlson of the Brooklyn
Tool Company at 7779 Beech Street.

Mr. Dave Anderson was present to answer any questions.
Mr. Schmedeke stated that the Plats & Subdivisions-Streets & Utilities Sub-
committee a week ago approved the lot split in this fashion because there are
five lots, similar in size, abutting this property to the East that were split
into three 66 2/3 feet lots. They were O.K. 'D.
Mr. Clark said the total lot area measured 200 feet. The request Mr.
Schmedeke referred to was Lots 3 through 7, located to the rear of the lots
being considered this evening. There was some discussion and difference of
opinion whether or not we should try to make one standard lot and the other two
60 foot lots. The request was approved by a majority vote and Council approved
the split as requested.
Mr. Dave Anderson said they have built several homes in this area. They
are negotiating for this land now providing they can get the lot split.
MOTION by Minish, seconded by Zeglen, that the Planning Commission recommend
to Council approval of the Lot Split Request, L.S. #72-02, by Ronald E. Smith
to make three 66 2/3 feet lots from five 40 foot lots using Lots 15 and 16,
Block 4, and Lots 8, 9 and 10, Block 1, Adams Street Addition. Upon a voice
vote, Minish, Zeglen, Fitzpatrick voting aye, Schmedeke abstaining, the motion
carried.
Mr. Schmedeke explained his abstention by saying the reason being this
particular type of lot split. He is Chairman of the Plats & Subdivisions-Streets
& Utilities Subcommittee and he felt if this man could come in and ask for a
66 2/3 foot lot, it would be hard for him, as Chairman, to ask another man to
plat 75 foot lots. He did not look unfavorably if it were a hardship case. If
there were three 40 foot lots and divided evenly, no objection. If there were
five 40 foot lots, and two lots could be full sized, he would agree to building
on a 40 foot lot providing the lot was wedged between two homes. The reason
for abstaining was that by abstaining, he was voting with them but not objecting
per se. He did not think the Subcommittee Chairman should condone this thing.
This is the second request.' Ancfher f.-zt was that the previous request was
approved by Council and went through.
4. PRELIMINARY PLAN APPROVAL, PHASE I, (9 FOUR UNIT QUADROMINIUMS) BY VIEWCON,
INC. . Condominium portion of total multiple unit complex ort pati of
Outlot H, Innsbruck North Addition being the 1600 Block.
Kenneth Nordaune, Architect, was present and explained that a latter had
been submitted by Viewcon, Inc. as to how the utilities would be handled and
the landscaping on this site. Originally they submitted a request for five
quadrominiums, but now they have added four to this making a total of nine.
Darrel Clark pointed out several items on the layout used, this evening. A
quadrominium is a group of four dwelling units. Each group of four will have
four garages. Vehicles can park in front of the garages. The Building Standards-

VACATION REQUEST, SAV #72-03, GENE HETLAND: Vacate alleys in Block 7?

MOTION by Councilman Breider to set May 8, 1972 for the public hearing on the
vacation request SAV #72-03 by Gene Hetland. Seconded by Councilman Utter,

The Engineering Assistant said that this request is to take 5 forty foot lots,
or 200 feet, and divide them equally into three lots of 66 2/3 feet for building
sites. About a year ago the Council approved almost exactly this same request
. to the rear of this property. There was some discussion on whether the split
should be like this or to make two 60' lots and one 80' lot.
Mr. Dave Anderson said that he had earnest money on these lots and the agreement
was made that he would purchase the lots providing the lot split went through to
make three lots out of the five. If less than three lots, he feels the property
would be too expensive. Mayor Liebl asked if he intended to build and Mr,
Anderson said yes. Mayor Liebl asked if the homes he would build would be in a
class benefitting the area. Mr. Dave Anderson said yes, they would be in the
$30,000 range. It was pointed out that 75 feet is the basic requirement for
new plats, however, this is an old plat with only 40 foot lots, and due to the
fact that the lots both directly to the north and the south of these lots
are already built upon, and there is no more available land that could be added
to make them standard lots, this would seem to be the best use for these
substandard lots. Mayor Liebl said that in approving the lot split, it would
made these lots of 66 2/3 feet closer to the Code, and although he did not want
a precidez* set, this would seem to be the best solution to use these lots to
their best advantage for the builder and for the City.
MOTION by Councilman Utter to concur with the Planning Commission and approve the
lot split request L.S. #72•-02 by Ronald E. Smith. Seconded by Councilman
Mittelstadt. Upon a vocie vote, all ayes, Mayor Liebl declared the motion carried
unanimously.

The Engineering Assistant reported that the petitioner withdrew his request, Vere
were a pumber of questions raised by both the Building Standards and the Plazuurg
Commission, so Viewcon decided to withdraw, redraw their plass and start over again.

TRANSFER AND EXTENSION OF SPECIAL USE PERMIT SP #71-07, BY ANDIE HAUGEN •
(MR. SWIMMING POOL, INC. ) TO GREEN GIANT HOME AND GARDEN CENTER FOR
SWIMMING POOL:
The Engineering Assistant said that this request is for the same area as last year
by Bob's Produce Ranch. They were granted a special use permit for one year.
Last year the operation was not under the jurisdiction of Green Giant, but uhig
year they will be responsible for the maintenance, display and sales of the
pools. He showed the plans on the easel and said that the plans include the
$` X IV cabana used last year. The cabana will be used mainly for handout
material and display of pool supplies and the actual sales will take place in
the main Garden Center. `

QQuncilman Utter asked if the pool area would be fenced and the Engineering
Assistant replied yes, it was last year. Councilman Utter asked if it WgUld
he locked so there would be no possibility of a youngster getting into this
area. Mr. Bob Schroer said that it would be locked at night and it would
also be locked if the salesman steps out for a cup of coffee. There will be
an attendant there all the time.
MOTION by Councilman Mittelstadt to concur with the Planning Commission and
grant the special use permit SP #71-07 to Green Giant Home & Garden Centers, ;nq, J.
for the pyrpose of above ground swimming pool display and to allow the cabana 3
structure to be used again for a one year period as of the date of approval,
*econded by Councilman Utter. Upon a voice vote, all voting aye, Maygr
Liebl declared the motion carried unanimously.
PLANTING BOULEVARD: 40 FEET, MOORE LAKE HIGHLANDS 4TH ADDITION: •
The Engineering Assistant said -there is a program sponsored by the Senior
High for planting trees and the thought was that the school might participate.
Q9unci1man Utter talked to the school and found that there is more lana for
planting now than trees available. Councilman Utter added that the school
has A number of things scheduled for this year already and there is neither
trees nor time available.
Mayor Liebl said he would like to encourage the young people to participate
in the beautification of their City, and that it would be a worthwhile project
for them to plant trees, nurture them and see them grow. He said, as he
recalled, about 5 years ago Former Councilman Samuelson mentioned this, Mayor
Liebl said he felt that the schools should be more involved in plantings within
the City of Fridley. He asked that the Planning Commission pursue this and
perhaps something could be worked out for next year. The Engineering Assistant
suggested that this strip of land could lend itself to a walking trail to Locke
Park and that the Parks and Recreation Commission could consider it.
FORTY FOOT LOTS IN FRIDLEY:
Mayor Liebl said that Fridley still has some 40 foot lots left undeveloped, and
if anyone should show an interest in purchasing them, he would like to hay$ a
policy already formulated that would be fair and impartial to all. The
Engineering Assistant pointed out that last December the Planning Ccumnission •
made a recommendation on the use of some of the 40' lots in Plymouth Addition.
There cannot be a blanket policy for use on all 40' lots, because some of �herq
are in the interior of a block and some are on a corner where if they were built
upon{ they wpuld create a traffic hazard. Mayor Liebl said that over the past
five years, he has received calls from people having 4p' .lots and they wondered
what they should do with them. He said he would like to see every lot utilize�
