SUGCZSTBD BY BUILDING INSPECTION DEPARTMT: 1 The City Manager read the motion of the Planning Commission concerning the proposed easement vacation. The City Manager asked the City Attorney whether the vacation requires a Public Hearing. The City Attorney answered, «YeB.�P Councilman Sheridan asked why the City should reduce the size of the utility easement when the City on other occasions paid money to obtain a larger utility easement. Councilman Sheridan stated that in the future the City might need the utility easement. The City Manager replied that apparently the property owner needs the land on the easement to build upon the property. Councilman Wright stated that he would suggest the City allow the property owner to build upon the easement at his own risk and simply state the City has no objections to the proposal of the property owner to build upon the easement. Mayor Nee asked wiry the request was made by the Building Inspector. The City Manager stated that the property owner may have asked the Building Inspector whether vacation of part of the easement could be obtained. The City Manager stated that the request was considered by the Plate and Sub-Divisione Sub-Committee and the Street and Utilities Sub-Committee. He stated that these committees recommended that the Utility Easement Vacation be granted. Councilman Wright stated that he would litre to have the consulting engineer examine the request and make recommendations to the Council concerning the same. Motion by Thompson to table to the Regular Council Meeting of September 20, 1965 consideration of Vacation of the Utility Easement in Blocks 1 and 2, Lyndale Builders 7th Addition. Seconded by Sheridan. Upon a voice vote, there being no nays, the motion carried unanimously. Councilman Wright left the meeting at 12:27 A.M* WRM #309 REGULe1TING TEE USES PBRMiTTED IN M-1 DIS C-1 AND C-18 D187UCTS: The City Manager read the :notion of the Planning Commission recommending adoption of the Ordinance. The City Manager read the Ordinance. Motion by Sheridan to adopt the Ordinance upon second reading and publish one. Seconded by Thompson. Upon a roll call vote, there being no nays, the motion carried unanimously. Councilman Wright returned to the Council Meeting at 12:30 A.Y . REZONING UEST° CARLSON AND LEVINE INC: ZQA #55-07 PORTION OF SYLVAN HILLS PLAT #8E Mr. Levine and Mr. Hawrysh were present at the Council Meeting. Mr. Levine showed the plan of the City Center building renewal project to the Council and the location of the rezoning drawn on the plan to the Council. Mayor Nee asked Mr. Comstock whether there were any sewer problems on 64th Avenue Northeast which the Council should consider in connection with the request of Mr. Levine to rezone this property. Mr. Comstock stated that under the SPECIAL COUNCIL MEETING, IDLY 8, 1967 PAGE 39 Mayor Kirkham asked that this be brought back on the agenda at the meeting of May 15, 1967. Mayor Kirkham read the following paragraph suggested by the City Manager as a thought to replace the last paragraph: "The Council will be happy to meet with you and discuss alternatives, but the Council must advise you that it is not inclined at this time to accept less than its interpretation of the supplemental agreement. RESOLUTION #89-1967 REVOKING MUNICIPAL STATE AID STREET: 7Co ncilman Harris asked why this street is being revoked. Councilman Sh ridan pointed out that this was a County road, and when it is taken out they will have 5 or 6 blocks more of MSAS street available. MOTION by Councilman Liebl to adopt Resolution #89-1967. Seconded by Councilman Sheridan. Upon a voice vote, therelAng no nays, Mayor Kirkham declared the motion carried. The City Engineer said that the County is proposing to improve this street this year. GARAGE BUILDING PERMIT --5896 WASHINGTON STREET NORTHEAST, ROBERT PETERSEN: The City Manager said that there is at least one other garage on this 30 foot easement, and indications are that a 12 foot easement is the maximum the City needs. He said the Council would not necessarily need to vacate this easement, but they could let the owner build iap to the 12 foot easement, and if the City should need the 30 foot easement, he would have to remove his garage, but there is no indication at this time that the City would ever need this. ' Councilman Sheridan said that he had talked to these people the other evening, and he had suggested that they wait until the Council has had a chance to look at it. He said that it appeared at the time of platting, this was left for a possible storm sewer installation. Councilman Samuelson said that it appears all right with him if they would sign an agreement, using an agreement similar to the one that was used in Hartman Circle as a guideline. Councilman Harris asked if this garage would be blocking people from getting into other garages if others also chose to use this easement for garages. Councilman Sheridan said that all garages would be serviced off the street, as there is no alley. The City Manager said that if the Council wished, they could grant this permit with a written agreement, and he can bring back more information on possibly vacating this easement. MOTION by Councilman Harris to authorize the building permit subject to a written agreement. Seconded by Councilman Samuelson. Upon a voice vote, there being no nays, Mayor Kirkham declared the motion carried.
