The drainage and utility east is 12 feet and Mr. Wojack is asking for a vacation of 6 feet. It was noted he had letters from the Northern States Power Co. and the Northwestern Bell Telephone Co. stating they did not object to the oneroachment on the easement. The Subcomittee informed Mr. Heine that they cannot split as lot without access or aY plan for access and a dedication consistaut with a plan. It was noted that Lots 2 and 3 have been split which was dime at Anoka County, but had not game threugh the regular charnels of Fridley. Darrel Clark explained that the Wojacks have also started a request to have three feet of the public utility and drainage easement vacated so that the proposed garage would not encroach on an easement. Clark pointed out that the Streets and Utilities Committee have already made a recommendation to the Planning Commission to vacate the south 3 feet. Mr. Nawrocki pointed out that the Wojacks have received letters from Northern States Power and Northwestern Bell Telephone wherein they say they do not object to the partial vacation of this easement. PROPOSED STREET ALIGNMENT: 8 RD AVENUE NORTHEAST AND ITS INTERSECTION WITH EAST RIVER ROAD, AND THE FAYRE GAS CLINE STATION C8255 EAST RIVER ROAD): Mr. Bergman, Chairman of the Streets and Utilities Subcommittee, stated that he felt there was no reason to consider 83rd Avenue Northeast taking any other route than as shown on the City's zoning map, and that it would be wise to take the necessary steps to acquire the right-of-way for this proposal. The Planning Commission discussed the possibility of acquiring a fifty foot right-of-way along the north property line of Mr. Favre in the City of Coon Rapids, and it was decided that the City Manager, with the assistance of the City Attorney, would investigate the possibility and the method by which a fifty-foot right-of-way might be acquired from th© property immediately north in Cron Rapids. WOJACK - NORTH SIX-FOOT DRAINAGE AND UTIY BASEIENT ALONG LOT 18, Bl= 2, PARKVIEW HEIGHTS ADDITION: The Planning Commission had recommended that the south 3 feet of the existing 12 foot easement on the north boundary line of Lot 8, Block 2, Parkview Heights Addition be approved for vacation. There was a discussion of whether a Public Hearing was necessary to vacate this. The City Attorney asked if all the land owners within 300 feet had signed the petition approving it. The City Manager stated he thought they had. MOTION by Barris to concur with the Planning Commission in this matter. The motion was seconded and upon a voice vote, there being no nays, the motion carried unanimously. LOT SPLIT (65-051, LOT 222 BLOCK 2, SPRING LAKE PARK LAXESIDE, FRANK HLAVINKA (1500 OSBORNE RQAD) The Planning Commission had recommended approval of the lot split. MOTION by Wright to concur with the recommendation of the Planning Commission and gaunt the lot split subject to the 25 foot easement being obtained for street purposes. The motion was seconded by Samuelson and upon a voice vote, there being no nays, the motion carried unanimously. PROPOSED STREET ALIGNMENT: 83RD AVER NORTHEAST AND ITS IMRSECTION WITH EAST RIVER ROAD, AND THE FAVRE GASOLINE STATION (8255 EAST RIVER ROAM The Planning Commission had recommended that 83rd Avenue Northeast be considered as part of the logical street pattern and that the City of Fridley take the necessary steps to carry out that pattern as the need arises, and the right-of-way which is needed be acquired before any additions to the Favre Gasoline Station are made. The City Manager explained that the request for a Building Permit has been before the Council, but it was tabled until it was decided what to do with 83rd Avenue. Councilman Harris stated that when he was on the Streets and Utilities Sub-Committee, it was decided by the Committee that there was some need for 83rd- Avenue. Councilman Wright asked Mr. Kravik, Chairman of the Planning Commission, if the Planning Commission would have any objections to curving 83rd Avenue slightly to the north, so that 83rd Avenue could go through without moving the station. Mr. Kravik stated he thought there would be no objections. MOTION by Harris to concur with the recommendation of the Planning Commission and instruct the administration to proceed with the necessary steps to obtain an easement for 83rd Avenue which lies in the City of Cogan Rapids. Seconded by Samuelson. Upon a voice vote, there being no nays, the motion carried unanimously.
