The City of Fridley Planning Commission will be holding an informal hearing
on a request for a Vacation, SAV #87-06, ty Roger Leffler, to vacate the 12
foot alley located between 57th Avenue and 58th Avenue and between Jefferson
Street and Washington Street.
Anyone who wishes to be heard shall be given the opportunity at the Planning
Commission meeting on Wednesday, July 8, 1987 in the Council Chamber of City
Hall at 6431 University Avenue N.E. at 7:30 p.m.

responded positively to the proposal. We will continue to try to contact
the remaining property owners to determine their intent. We will provide an

proposals by Roger Leffler that were to be heard by the Planning Commission
on July 8, 1987. Me first proposal, which has since been approved, was to
Split Lots 1-5, Block 4, Adams Street Addition into three new building sites,
which would involve removing the existing house and garage. This garage is
the only one which utilizes the alley at this time.
The second proposal involved vacating the 12 foot alley located between 57th
Avenue and 58th Avenue and between Jefferson Street and Washington Street.
If you and your neighbors are in agreement with the vacation the alley would
revert to private ownership with each adjacent property owner obtaining one
half of the alley, or six feet of property all along each rear lot line. The
vacation would be completed at no cost to you.
If you do not oppose this vacation proposal, we would greatly appreciate your
signing the statement below and returning it to the Fridley Planning
Coordinator, Jim Robinson, so that City Council may take action. Please
return this letter by August 18, 1987.

Dear Mr. and Mrs. Wallerius:
On August 24, 1987, the Fridley City Council considered the first reading of
an ordinance approving the vacation of the alley located between 57th and
58th Avenues and between Jefferson and Washington Streets. At this time
City Council was notified that all neighbors involved had agreed to the
vacation by siding and returning a letter with the exception of the owners
.,f 5703 Washington Street, Stephen and Nancy Wallerius, and that Stephen
Wallerius had approved the vacation over the telephone during the week of
July 27. (See attachment.) Staff and City Council considered this verbal
confirmation as sufficient approval, and therefore, City Council approved the
first reading.
On August 25, Lisa Neumann, Comnun i ty Development Secr eta ry, spoke to Nancy
Wallerius who informed Lisa that neither she nor her husband were going to
return a signed copy of the letter stating their agreement to the vacation.
Will you please notify the City Council in writing whether you approve or
oppose Mr. Leffler 's vacation proposal, so that the Council may take final
action?

Mr . Robinson stated staff is recommending the following stipulations:
(1) petitioner or subsequent owners agree to construct ho es of
equal or better quality than those petitioner has used a illustrative
of intended development; (2) lot width variances for w' th and area
to 66.66 feet and 8,599 square feet respectively are anted with
the final approval of this lot split; (3) three par fees of $750 each
to be paid prior to issuance of each permit; and ) lot split to be
recorded at the County prior to October 15, 1987
Mr. Leffler stated the lots would be about 6 feet wide and the homes
45 to 46 feet wide. He stated the square f tage of the homes would
range from 1,070 to 1,100 and the fronts o the homes would be
different. He stated these homes would two bedrooms with the
possibility of expansion in the lower 1 vel and double car garages
no smaller than 22 x 22 feet. Mr. Le ler stated he built the home
to the north of this property which 's on a 66 foot lot.
Mr. Betzold asked the price range or these homes. Mr. Leffler stated
they would range from the upper 0's to the low 90's.
Mr . Kondrick asked if the hom s would have the same setbacks as the
others fronting on Jefferso Street. Mr. Robinson stated the minimum
setback is 35 feet so this ould not be a problem.
Mr. Leffler presented ph tos of a similar home in Andover which he
constructed.

Mr. Robinson stated this vacation is requested to allow for develop-
ment in this area. He stated if the alley is vacated, the property
owners to the east and west would each receive six feet.

to the affected property owners and several letters were received
indicating the. owners had no objection. He stated staff
will contact those persons who have not as yet responded as,
normally, 100% agreement is required for a vacation.
Mr . Robinson stated staff is recommending the following stipulation:
(1) alley Vacation. subject to concurrence of all abutting property
owners; and (2) a drainage and utility easement to be maintained
across the entire alley.
Mr. Mike. Phelps, 5755 Washington Street, requested an explanation of
stipulation No. 2. Mr. Robinson stated the City would be vacating
the alley in terms of ownership, but an easement should be maintained
for drainage and utility purposes. He stated if the need arose, this
would allow the City or utility companies access.
Mr. Phelps asked if he could construct a fence. Mr. Robinson stated
a fence may be constructed, however, if work had to be done on any
of the utility lines, the companies would have the right to remove it
if it interferred with their repair work.
Mr. Phelps questioned how this extra six feet would affect his property
taxes. Mr. Billings stated in recent discussions with the City Assessor
regarding a similar situation, he felt the increase in taxes would
probably be negligible.
Mr. Phelps asked the limitations on the fence as far as height.
Mr . Billings advised him to contact the City's Building Inspector,
Mr. Darrel Clark.
Mr. Jay Workman, 5704 Jefferson Street, stated he lives adjacent to
this property proposed for development. He stated he did have some
concern about damages to his home when the foundations were dug for
the new homes.
Mr . Leffler, the petitioner, assured Mr. Workman this wouldn't be a
problem.
Mr. Workman questioned how he could determine where his property line
was located.
Mr. Leffler stated a surveyor will survey the property and locate the
pins so these could be used as a point of measurement.
Mr. Betzold stated it may be to the surrounding property owners ad-
vantage to contact Mr. Leffler if they wish to have their own
property surveyed. He felt as long as the surveyor will be in the
area, the costs may be lower for others to participate in the survey.

as yet. She stated she is representing her mother, the owner of the
property, and asked who pays for the lot split.
Ms. Sherek stated this item should be covered in the purchase agree-
ment between the buyer and seller .
Mr. Betzold stated who pays these costs is strictly between the buyer
and seller and is something that would not involve the City.
5. CONSIDERATION OF LOT SPLIT L.S. #87-07 , BY MARGARET BRICK
Mr. Robinson stated this is a request to split off t northerly 180
feet of Lot 3, Auditor's Subdivision No. 88, at 1 Mississippi Street.
He stated this parcel was rezoned from single ily to C-1 to allow
a single family home to be used as a gift s
Mr. Robinson stated if the lot is spli , it will be over 25,000 square
feet and the code requires 20,000 s are feet. He stated there is a
concern that the remaining proper would be landlocked, however, the
petitioner has indicated they e the owners of the adjacent property
and this will be added to t property.
Mr. Robinson stated sta is recommending the following stipulations:
(1) the southerly por on of the split parcel is to be added to
Sandee's Restauran rcel concurrently with recording of subdivision;
and (2) park fee f $1,905 to be paid prior to recording lot split.
Mr. Robinson ated a third stipulation was going to be added to pro-
vide joint iveway easements between the gift shop and Sandee's
Restaura , but this has already been accomplished and recorded.

MOTION by Councilman Goodspeed to waive the reading of the public hearing
notice and open the public hearing. Seconded by Councilman Schneider. Upon
a voice vote, all voting aye, Mayor Nee declared the motion carried
unanimously and the public hearing opened at 7:41 p.m.
Mr. Robertson, Community Development Director, stated in conjunction with
this vacation, the Council granted a lot split and variances at their July
20 meeting. He stated if the vacation is approved, additional square
footage would be added to the lots (created by the lot split) and bring them
into compliance with the code.
Mr. Robertson stated staff contacted the affected property owners and no
objections have been received. He stated three owners have not replied and
staff would recontact these persons.
Mr. Robertson stated two stipulations are recommended in connection with
this vacation, as follows: (1) the alley vacation is subject to concurrence
of all abutting property owners; and (2) a drainage and utility easement is
to be maintained across the entire alley.
Mayor Nee asked if anyone now uses the alley for access purposes.
Mr. Robertson stated as far as he can determine, the only person using the
alley is the one requesting the vacation.
No persons in the audience spoke regarding this proposed vacation.

Vx. Robertson, Community Development Director, stated he ordinance should
contain the two stipulations approved by the Council on July 20 at the first
reading of the ordinance.
Mr. Herrick, City Attorney, stated there ma be a question about the
ownership of this property. He asked if th petitioner was present and
since there was no response, he stated he ouldn' t object to the second
reading of the ordinance, but thinks th Council should allow staff to
review this question further and withhold publication of the ordinance until
the ownership is resolved.
Mayor Nee felt under these circumstances, the item should be tabled.

approved the f nal plat at their July 20 meeting, there were several
outstanding s ipulations. He felt if the Council wished to adopt the

upon comple on of outstanding stipulations on the final plat.

opening distances,/and parking and hard surface setbacks. He stated the
property is zoned/14-1 and requires a special use permit for this type of
activity. Mr. R, bertson stated Rapid Oil Change is proposing a 1 ,700 square
foot facility With nine parking stalls, one handicapped, and four service

Mr. Robertson, Community Development Director, stated this i a request for
a variance to reduce the distance from any property line driveway from
the required 10 feet to 6 feet to allow the erection of a reestanding sign
and that the dumpster is to be screened as noted in the tial use permit.
He stated the hardship is existing landscaping and ility poles in two
corners of the property make it impractical to p ce a sign at these
locations. He stated staff has no objection and the Appeals Commission has
recommended approval of this variance.
Mr. Robertson stated it should be noted that be re the variance is issued,
a previous stipulation for the dumpster to be creened, which was approved
in conjunction with the special use permit, ould be complied with.

alteration t the original stipulations, as the definite ownership has not
been establ shed at this time, and there is a question whether the original
stipulatio s can be implemented.

which a is, essentially, recommending the Council adopt the original
stipul tions, but recognizing that if by some small chance, that land is

Street.
All lying in the north half of Section 23 , T-30, R-24, City of
Fridley, County of Anoka, Minnesota.
Be and is hereby vacated subject to stipulations adopted at City
