Robinson stated staff is recommending the following stipulations: (1) petitioner or subsequent owners agree to construct ho es of equal or better quality than those petitioner has used a illustrative of intended development; (2) lot width variances for w' th and area to 66.66 feet and 8,599 square feet respectively are anted with the final approval of this lot split; (3) three par fees of $750 each to be paid prior to issuance of each permit; and ) lot split to be recorded at the County prior to October 15, 1987 Mr. Leffler stated the lots would be about 6 feet wide and the homes 45 to 46 feet wide. He stated this parcel was rezoned from single ily to C-1 to allow a single family home to be used as a gift s Mr. Robinson stated if the lot is spli , it will be over 25,000 square feet and the code requires 20,000 s are feet. He stated there is a concern that the remaining proper would be landlocked, however, the petitioner has indicated they e the owners of the adjacent property and this will be added to t property. He felt if the Council wished to adopt the ordinance, t stipulation should be added that the deed should be executed upon comple on of outstanding stipulations on the final plat. He stated the special use permit is for an auto;(otive service facility on the site of the now vacant gas station north of/73rd Avenue and south of 73-1/2 Avenue on Highway 65 . He stated the variaces pertain to the lot area, side yard setback, curb opening distances,/and parking and hard surface setbacks. He stated the property is zoned/14-1 and requires a special use permit for this type of activity. Mr. R, bertson stated Rapid Oil Change is proposing a 1 ,700 square foot facility With nine parking stalls, one handicapped, and four service bays. r Mr. Robertso i stated if the street vacation was approved, the lot size would increase frtim .54 to .66 acres and there would be a driveway opening onto the/orner road which would conform with the code requirements. He stated it tant to point out that the service road, Viron Road, does not exth and is presently blocked by the trailer court south of Fireside Ave . CONSIDERATION OF FIRST READING OF AN ORDINANCE APPROVING A VACATION, SAV #87-06, TO VACATE THE 12 FOOT ALLEY LOCATED BETWEEN 57TH AVENUE AND 58TH AVENUE AND BETWEEN JEFFERSON STREET AND WASHINGTON STREET N.E ., BY ROGER LEFFLER: Mr. Robertson, Community Development Director, stated all persons affected by this vacation are in agreement. He stated letters have been received from everyone except Mr. Stephen Wallerius, 5703 Washington Avenue, and he has agreed by phone and a letter should be forthcoming. MOTION by Councilman Goodspeed to waive the reading and approve the ordinance upon first reading. Seconded by Councilman Fitzpatrick. He stated the hardship is existing landscaping and ility poles in two corners of the property make it impractical to p ce a sign at these locations. He stated staff has no objection and the Appeals Commission has recommended approval of this variance. Mr. Robertson stated it should be noted that be re the variance is issued, a previous stipulation for the dumpster to be creened, which was approved in conjunction with the special use permit, ould be complied with. BY J. BENSON AND G. BRADBURY: Mr. Robertson, C mmunity Development Director, stated there were some questions of ow rship raised at the last meeting in regard to lot split, L.S. X87-04. H stated portions of land covered under this lot split were to be combined with Mr. Schroer' s property with the intent that no land would be land ocked. Mr. Robertson stated staff has submitted a proposed alteration t the original stipulations, as the definite ownership has not been establ shed at this time, and there is a question whether the original stipulatio s can be implemented. For the vacation of easements for public utilities described as follows: Vacate the 12 foot alley located between 57th Avenue and 58th Avenue and between Jefferson Street and Washington Street. All lying in the north half of Section 23 , T-30, R-24, City of Fridley, County of Anoka, Minnesota. Be and is hereby vacated subject to stipulations adopted at City Council meeting of August 24, 1987. SECTION 2 The said vacation has been made in conformance with Minnesota Statutes and pursuant to Section 12.07 of the City Charter and Appendix C of the City Code shall be so amended.
