Also, they would li ity Council to note that the garage that a permit was issue n 1983 has not yet been completed. 5. C014SIDERATION OF A VACATION REQUEST, SAV #87-03, BY DONNA OLSON: To vacate a 6 foot drainage and utility easement created by Veit's Second Addition, generally located at 6431 East River Road N.E. Mr. Robinson stated there was presently a 6 ft. utility easement that ran across the middle of the existing lot . This would have to be vacated in order to build a new house. There were no utilities in that easement. The only recommendation they had was from NSP and Nortel Cable that the easement be replaced with a 10 ft. easement along the west and along the north side of the property. The prior stipulations with the plat included the provision for that easement and also that there be underground electrical service. There were no further stipulations. MOTION by Ms. Sherek, seconded by 11r. Kondrick, to recommend to City Council approval of Vacation Request, SAV #.87-03, by Donna Olson, to vacate a 6 ft. drainage and utility easement created by Veit's Second Addition, generally located at 6431 East River Road N.E. Upon a voice vote, all voting aye, Chairperson Billings declared the motion carried unanimously. Mr. Robinson stated this vacation request and the preliminary plat would go to City Council on June 1 . 6. CONSIDERATION OF A LOT SPLIT, L.S. #87-03, BY BERNADETTE BENSO11 OF PIIDWEST SUPER STOP: To split off all that part of Lot 13, Revised Auditor's Sub- division No. 103, Anoka County, Minnesota, according to the t on file and of record in the office of the Anoka County Recorde lying easterly of the easterly line of Lot 2, Block 1 , Waynes First tion and westerly of a line drawn from a point on the easterly line said Lot 2, Block 1 , distant 1 .5 feet southerly of the northeas orner of said Lot 2 to a point on the easterly extension of the south y line of said Lot 2, Block 1 , distant 45.0 feet east of the south st corner thereof, generally located at 8100 East River Road N.E. Mr. Robinson stated the p perty was located on the southwest corner of Fairmont and East Rive - ad. In 1984 a special use permit was issued for the construction ofA gasoline facility. He stated the petitioner, Bernadette Benso , had done a very nice job of rehabbing that corner. After moving into t building, they discovered their property line was not identical to the fent ine west of the building but ran at a drastic angle to what would bee side and back yard of the adjacent family house. In order to clean this problem, they have agreed to split the property west of the fen and will be selling the property to the neighbor who will combine that h his lot which will then bring his lot up to code. After the split, the lot area for the gas station will be 21 ,800 sq. ft. which was more than adequate by code. Code requirement was 20,000 sq. ft. PLANNING COMMISSION MEETING, MAY 6, 1987 PAGE 11 Ms. Olson stated these lots have already been sold, subject to the lot split, and plans have been approved by the City for houses that will fit on hose lots. The houses would be a comparable value to her home. Mr. Kondrick stated that even though that was the case, he would ave to vote in favor of the stipulations for the revised lot widths as reco mended by Staff. Mr. Billings stated he agreed with Mr. Betzold and Mr. Kon ick. He thought it would be more appropriate to end up with two lots, ea being approximately 130 ft. in width which would be consistent with the 100 t. wide lots across the street. The petitioner had indicated that this wo d not be economically feasible. The Planning Commission was not obligated o do things which were motivated by financial criteria; however, at the sa time, some concessions were made by the City Council in 1982, and he thou t the compromise made by Staff on the lot widths was a fair compromise. was not what they would like to see, but it was something they could pr ably live with. He could go along with the stipulations as recommended by taff. Mr. Billings stated he would like to see th Planning Commission recommend to the City Council that the park fees be 750/lot for two lots , rather than $1 ,500, because of the additional expens the petitioner has gone to for the replat and the petitioner's willingness o work out a compromise. MOTION by Mr. Kondrick, seconded by . Sherek, to recommend to City Council approval of Preliminary Plat, P.S. 7-03, Oliver Olson Addition, by Donna Olson, being a replat of Lot 1 , Block 1 , Veit's 2nd Addition , and Lot 26, Revised Auditor's Subdiv' ion No. 23, according to the plats thereof on file and of record in the of ice of the County Recorder in and for Anoka County, Minnesota, the same b ng 6430 East River Road, with the following stipulations: 1 . Provide for the fo owing lot widths : (1 ) corner 75 ft. ; (2) middle 70 ft. ; (3) west ly approximately 121 ft. 2. Provide a 25 ft street easement along west of property with 25 ft. triangle at in ersection with 642 Way. Petitioner not to be assessed for street i rovements provided petitioner does not access new road. 3. PUBLIC HEARING ON A VACATION REQUEST, SAV #87-03, TO VACATE A 6 FOOT DRAINAGE AND UTILITY EASEMENT CREATED BY VEIT'S SECOND ADDITION, GENERALLY LOCATED AT 6430 EAST RIVER ROAD N.E., BY DONNA OLSON: MOTION by Councilman Fitzpatrick to waive the reading of the public hearing notice and open the public hearing. Seconded by Councilman Schneider. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously and the public hearing opened at 9:20 p.m. Mr. Robertson, Community Development Director, stated this is a request to vacate an existing easement in order to provide for develoment of plat, P.S. 087-03. He stated a new easement would be provided on the west and north of the plat, if this one is vacated. No persons in the audience spoke regarding this proposed vacation. MOTION by Councilman Fitzpatrick to close the public hearing. Seconded by Councilman Goodspeed. Upon a voice vote, all voting aye, Mayor flee declared the motion carried unanimously and the public hearing closed at 9:20 p.m. Mayor Nee thought perhaps the utility company should be billed for the work provided by the City in conjunction with the easement. A gentleman in the audience questioned the work involved by the City on such a utility easement. Mr. Flora, Public Works Director, stated staff reviews developments in an area and determines the most prudent location for the utilities to make the parcel more developable and connect with existing utilities in the area. He stated each staff person reviews the area of his expertise. Councilman Schneider stated he felt the utility company is really receiving a lot of benefit for the $13,000 return the City receives. He stated it was unfortunate the public address system did not work this evening, as staff had a presentation regarding the amount of staff time involved to provide these services. Mayor Nee stated the City provides all kinds of special services and persons are charged accordingly. He stated the City is attempting to identify the special costs which are above and beyond what is provided to everyone, and -8- COUNCIL MEETING OF JUNE 1, 1987 Schneider voted in favor of the motion, and Mayor Nee declared the motion carried unanimously. Persons in the audience were angry and stated if Minnegasco had not sent them a notice on the proposed franchise fee, they wouldn't have known about it. He stated, in 1982, a to ' split approved by the Council was rejected by the petitioner and the itioner is now requesting a different subdivision. He stated the propos was for a corner lot to be 73 .39 feet wide, the middle lot to be 65 fee wide and the resident's lot would be 128 feet wide. Mr. Robertson state in conjunction with the plat, there is a request to vacate a six foot d ainage and utility easement which runs east to west across the property. Mr. Robertson stated, pre ntly, four residences exist to the south of this property which share tw unimproved driveways off East River Road. He stated the City and Co ty objectives would be to eliminate these curb cuts by providing a minim of 25 feet of street easement on the west of the plat and a 25 foot trian a at the intersection with 64 1/2 Way . He stated the balance of the ri t-of-way, if needed, could come from the adjacent park. He stated the plat shows a 10 foot easement on the north and a 25 foot easement on the west. He stated stipulation No. 3 had to be redrafted because the street easement is not a part of the plat, but a semi-ate document. MOTION by Councilman Fitzpatrick to adopt Resolution No. 47-1987 with the following stipulations attached as Exhibit A: (1) provide for the following lot widths: a) corne.---75 feet; b) middle 70 feet; c) westerly approximately 121 feet (incorpoydted on revised plat received June 10, 1987) ; (2) provide a 25 foot stre t easement along west of property with 25 foot triangle at intersectio with 64 1/2 Way. CONSIDERATION OF A SPECIAL USE PERMIT, SP #87-09, TO ALLOW OFFICES NOT ASSOCIATED WITH THE PRINCIPAL USE, GENERALLY LOCATED SOUTH OF 77TH AVENUE, WEST OF MAIN STREET AND NORTH OF OSBORNE ROAD BY KEN BUREAU OF ROSEWOOD PROPERTIES INC.: Mr. Robertson, Community Development Director, stat/ed this is a request for a special use permit to allow offices not associated with the principal use in an industrial zone . He stated plans are to construct two buildings totaling 113,000 square feet with 29% lot cov age. He stated the parking ratio associated with a building of this typ was one stall for every 500 square feet of floor area and would requi 226 stalls. He stated the plan presently shows 212 stalls and thi deficit is addressed in the stipulations. He stated the berming a d drainage has been reviewed and approved by staff. Mr. Robertson also reviewed the type of construction materials which would be used for the buildings. Councilman Goodspeed stated at the 'Planning Commission meeting there was discussion regarding the Zoning Code and if it should be changed to accommodate these types of buildings and there was concern about the additional traffic. Mr. Robertson felt this was a valid concern and a review should probably be done to see what type of uses the Council wishes in a manufacturing z one. Mr. Herrick, City Attorney, stated the discussion at the Planning Commission was pertinent and felt it may be a good idea to review the Zoning Code . He stated industrial uses are changing somewhat to a more high tech use . He stated, originally, e City did allow commercial in an industrial zone, however, this was hanged several years ago. He stated he hasn' t been terribly concern with these developments because he felt they are good quality. He st ed persons having heavy industrial plants would be harmed by this type f commercial use in a manufacturing zone . He felt the distinction s becoming less clear and probably should be reviewed and expand the definition or revert back to the type of zoning that was previously in effect. Mr. Bur au, the petitioner, stated development in the Twin Cities is towards light ulti-use high tech and away from heavy industrial . He stated he felt thi would be a nice development for the community. He stated the buildings would be brick with burnished block with the doorways opening under a canopy. He stated they are seeking tenants who are light industrial users, but would not say they wouldn't have tenants who are retail oriented. -4- COUNCIL MEETING OF JULY 6, 1987 Mayor Nee reviewed Section 14.08, Sub-section 1 , a through f, covering the reasons why licenses may be denied such as fraud, conviction of offense involving moral turpitude, habitual drunkenness or intempera in the use of drugs, or engaging in any conduct which would const to grounds for refusal . Councilman Schneider stated he requested restriction on hours of solicitation after an organization did a youngsters soliciting after dark. He stated he received several one calls regarding this matter and has had solicitors at his home in lsite evening hours. He stated he felt it would be reasonable to establi*'Isome hours for solicitations. MOTION by Councilman Sefineider to waive the reading and approve the ordinance upon firstreading.
